the easy thievery of oil revenue from those in power gets the skids applied when and if a oil n gas law makes it to the gazette or sees the light of day ... iraq can prove my theory wrong any time now sooner than later .

Parliamentarian expects to pass oil and gas law before local elections

Zainab al-Moussawi, a member of the parliamentary oil and gas committee, expected on Tuesday to vote on the draft oil and gas law before the provincial council elections scheduled for December 18.
Al-Musawi said that "discussions and discussions are continuing on the oil and gas law, which will join the work of natural resources in Iraq, but we want to reach a law that serves the country and not serves one party at the expense of another."
She added, "There are objections by the Kurdish blocs about some articles in the law, such as the delivery of oil production in the region to Baghdad and its export through SOMO, in addition to the allocations of oil-producing provinces and other matters that will be resolved soon."
Al-Musawi said in an interview with Al-Furat News and followed by Al-Eqtesad News, that "it is expected to vote on the law before the next local elections."

Turki Jadaan, a leader in the coordination framework, confirmed on Wednesday that half of the controversial paragraphs on the oil and gas law have been exceeded.

Jadaan said in an interview with Al-Maalouma that "the number of sticking points in the oil law reaches 14 points, half of which have been exceeded through meetings and discussions between specialized technical committees," pointing out that "there is political support by all parties in order to overcome all differences and obstacles to reach a space of acceptance that supports the option by approving it during 2023."

He added, "The adoption of the law will address the challenges of smuggling and the influence of foreign companies and contribute to restoring the compass of the administration towards the federalism, considering oil and gas as wealth for all Iraqi components."

He pointed out that "discussions are currently taking place and there are expectations that a preliminary report will be submitted on the size of what has been achieved next September to the government in order to discuss the possibility of resolving what remains in coordination with the political forces."

Oil and gas are among the important laws that have been postponed for 4 parliamentary sessions due to disagreements, and the government still has the purpose of coming up with objective clauses that contribute to consensus leading to its approval. End 25 F

Today, Thursday, the Kurdistan Democratic Party confirmed its rejection of the oil and gas law if it was drafted according to personal and political tendencies, while indicating that the Prime Minister formed a committee to unify the visions of the political blocs on the project. 

 

Party member Sharif Suleiman said, in an interview with Al-Ghad Press, that "three drafts were submitted regarding the draft oil and gas law, but the political blocs did not reach an agreement on any of the three drafts. "

 

He added, "The dispute between the political blocs prompted Prime Minister Muhammad Shia' al-Sudani to form a committee to unify the visions of the political blocs regarding the draft law and achieve the highest level of consensus among those blocs ."

 

Suleiman stressed the importance of "approving the law according to the constitutional provisions, away from personal interpretations and political tendencies, in order to be fair among all groups of society and the Iraqi provinces, including the oil-producing ones ."

It is noteworthy that in February 2022, the Federal Supreme Court ruled that the oil law in the Kurdistan region, which has been in place and in effect since 2007, is "unconstitutional" and obligated the region to hand over oil production to the federal government in Baghdad .

Al-Marsoumi stated in a post followed by Al-Sumaria News, "The main point of intersection between Kurdistan and Baghdad in the third version of the draft oil and gas law for the year 2023 revolves around the region's endeavor to install an article in the new law that states: that the federal government manages the oil and gas extracted from the current fields (before legislation is passed). Despite the economic importance of the Iraqi Oil and Gas Law, which has been awaiting legislation in Parliament since 2005, which stipulates that the responsibility for managing the country’s oil fields should be entrusted to a national oil company, which is supervised by Baghdad, the dispute over the issue of managing the fields of the Kurdistan region of Iraq remains. Oil has prevented it from being voted on for many years, as the law was passed many times during previous parliamentary sessions and was not included in parliamentary laws and legislation.

The stalled oil and gas law in the Iraqi parliament since its first session, in 2005, is one of the most prominent points on which a preliminary agreement was reached between the governments of Baghdad and the Kurdistan region.

On February 15 of last year 2022, the Federal Supreme Court issued a ruling that the oil and gas law of the regional government of 2007, which regulates the oil industry and its extraction in the region, was unconstitutional. This ruling came after the regional government concluded contracts with foreign oil companies. The Kurdistan Regional Government rejected the Federal Court's decision, relinquishing its control over oil exports.

Shafaq News/ The spokeswoman for the Kurdistan Democratic Party bloc in Parliament, Vian Dakhil, revealed today, Saturday, that a delegation from the Kurdistan Regional Government is expected to visit Baghdad to contribute to the maturation of the oil and gas law with the aim of enacting it.

 

Dakhil told Shafaq News agency, "There are exchanged delegations between the region and Baghdad, and there is a delegation from the Kurdistan Regional Government that will visit Baghdad to complete the discussion of issues about the oil and gas law in order to ripen it, approve it in the Council of Ministers, and then send it to Parliament with the aim of legislating it."

 

She added, "The most prominent disputes over the law are related to export and oil fields, and we are proceeding under the roof of the Iraqi constitution."

 

A spokeswoman for the Kurdistan Democratic Bloc stated, "The differences are currently technical, and will be resolved between the joint committees and delegations, and the oil and gas law will be approved in the Council of Ministers after the completion of resolving the points of contention between the center and the region."

 

On August 17, 2023, the Ministry of Oil organized a meeting for the working group tasked with preparing a draft oil and gas law, headed by the Ministry’s advisor for administrative, legal and oversight affairs, Hamdan Awijel, and included a number of officials in the oil companies and the ministry’s center departments, while the ministry indicated that the meeting aims to discuss the preparation of a draft. Oil and Gas Law, and work to crystallize a professional national vision that achieves the objectives of optimal investment of oil wealth to serve the public interest.

 

In early August, Prime Minister Muhammad Shia’ al-Sudani directed the formation of a ministerial committee to supervise technical dialogues between the Federal Ministry of Oil and the Ministry of Natural Resources in the region, in addition to inviting the governors of the oil-producing provinces of Basra, Maysan, Kirkuk and Dhi Qar, and the directors The two years of government oil companies for the ongoing technical dialogues regarding the draft oil and gas law, provided that these dialogues are followed by the completion of the political dialogue to agree to present the draft law.

 

The oil and gas law is one of the most important differences between the federal government and the Kurdistan Region, and the parties did not reach a settlement on it throughout the past four parliamentary sessions.

 

During the current parliamentary session, the political blocs are counting on reaching solutions to the existing differences and pushing for understandings that satisfy all parties to pass the law.

The government's statements and declarations confirm its move towards resolving all outstanding problems between Baghdad and Erbil in order to prepare the appropriate ground for approving the oil and gas law without leaving any obstacles that lead to the rejection of the law when it is submitted to the House of Representatives with a view to passing it.

 

At a time when political parties ruled out the agreement of the center and the region to approve this law, which was confirmed by parties affiliated with the Erbil government, expecting that the law would be postponed to another parliamentary session.

On the other hand, former MP Jassim Al-Bayati said in a press interview seen by Taqaddam that “negotiations on the oil and gas law will not reach any good stages, as the opportunity that the Kurds had in 2008 when sending this law to Parliament for the purpose of its legislation will not come back again.”

 

He added, "The Kurds rejected the law in the aforementioned year, despite having voted on it in the Council of Ministers, and preparing it for its passage in Parliament."

 

Al-Bayati pointed out that “it is impossible for the law to come back again to be in the interest of the Kurds, at a time when they are demanding that the law meet their interests far from consensus or passing by a numerical majority in the House of Representatives.”

 

On the other hand, a member of the Kurdistan Democratic Party parliamentary bloc, MP Mahma Khalil, said in a press interview seen by “Takadum”, that “approving the oil and gas law is one of the most important economic laws that regulate the relationship between the center and the region, and there is an intention among the political forces to approve it.”

 

Khalil added, "This matter is difficult to achieve during the current parliamentary session, as the adoption of the law needs careful scrutiny in line with technical and political goals."

 

A member of the Kurdistan Democratic Party expected, "political differences will emerge when discussing its details."

Im thinking after 20 years baghdad and erbil need a non biased outside negotiation team to mediate to get it done but of course this is how both sides want it to continue meanwhile the oil profit sharing to the provinces - citizens are forgotten imo .
