Baghdad-Erbil conflicts disrupt oil and gas investment: Who will prevail?

The ongoing conflicts between the federal government and the Kurdistan Regional Government and their failure to agree on a unified version of the oil and gas law resulted in delays in investing this wealth properly and distributing it fairly for more than a decade and a half, to coincide with the failure of all regional and international mediations to solve this problem, so that the project remains in the hope that it will see the light in the current parliamentary session after there are news of its approval during the coming period.

Government insistence

On August 2, Prime Minister Mohammed Shia al-Sudani held a meeting with leaders of political blocs, ministers of foreign affairs, oil and industry, officials from the Kurdistan region, as well as Iraqi oil experts to confirm that the law "is part of the commitment to the ministerial curriculum, voted on by the Council of Representatives, to ensure the fair distribution of oil wealth."

He said that the draft law "represents a factor of strength and unity for Iraq, and it has been stuck for years, at a time when the country today is in dire need of its legislation and benefit from this natural wealth." He stressed that "the absence of law has deprived Iraqi provinces of investing their natural resources until today, which has disrupted the development path in the country."

Acknowledgment Rebounds

For his part, Mahmoud Khoshnaw, a prominent member of the Patriotic Union of Kurdistan, ruled out in an interview with "Baghdad Today" the approval of the oil and gas law in the current electoral cycle of the Iraqi Council of Representatives. He attributed the reason to "the lack of agreement on the terms of the law so far between Baghdad and Erbil."

"The legislation of this law will cast a shadow on the legislation of the upcoming financial budgets in Iraq without problems or disputes between Baghdad and Erbil," he said.

The technical debate on the law was supposed to end in June, but it is clear that it will be delayed longer, and some lawmakers say it could extend to the end of this year.

Democratic Expectations

In turn, the spokeswoman for the Kurdistan Democratic Party bloc in the House of Representatives, Vian Dakhil, revealed in press statements that "a delegation from the Kurdistan Regional Government is expected to visit Baghdad to contribute to the maturation of the oil and gas law with the aim of legislating it."

"The differences are currently technical, and will be resolved between the joint committees and delegations, and the oil and gas law will be approved in the Council of Ministers after the completion of resolving the points of contention between the center and the region," Dakhil said.

According to the leaks, the law includes more than 40 articles, about half of which have been debated, and the rest will be difficult for political blocs due to political and technical intersection.

What do the Kurds want?

Economist Nabil Al-Marsoumi pointed out in a blog post on Saturday (August 26, 2023) that "the main point of intersection between Kurdistan and Baghdad in the third version of the draft oil and gas law for the year 2023 revolves around the region's endeavor to establish an article in the new law that: The federal government should manage the oil and gas extracted from the current fields (before the constitution was enacted in 2005) with the regional government or the producing governorates that are not organized in the region. The regional government or the producing provinces that are not organized in a region shall be the competent authority to manage oil and gas in current and future fields after the enactment of the constitution."

He added, "This means that all of Kurdistan's fields are managed exclusively by the regional government and Baghdad has nothing to do with them!

The new law is likely to give state company SOMO full control over oil imports, and initially, the political blocs have shown no objection to this, but have differed in details.

The dispute emerged between the oil-producing cities and those without fields, as the former negotiated exceptions at the expense of the center, but the other cities insist that Baghdad be the only party in managing the oil file.

Effects of Disruption of the Law

Economic researcher Ali Awad believes that "the oil and gas law can contribute to raising the production capacity of oil and the investment of national gas and practically regulate the production and export capacity estimated at more than 4.6 million barrels per day.

Awad said in a statement to the newspaper "Al-Araby Al-Jadeed", that "Iraq has 530 geological structures that include large oil reserves, in addition to the presence of 115 sites that have been drilled so far, and its reserves are estimated at about 311 billion barrels."

He added that "the huge quantities of oil reserves in Iraq contribute greatly to improving production processes because the country contains more than 80 fields, while production is limited to part of them, which means that the application of the oil and gas law will achieve large oil revenues for Iraq by opening the fields of oil production and extraction, taking into account the decisions of OPEC, and achieving international agreements with consuming countries."

He pointed to "the existence of a real will of the House of Representatives to legislate the law," noting that "the budget of the current year included the addition of two articles to the law, namely the regulation of the export of oil in terms of export and deposit imports in a bank accredited by the Central Bank."

"Iraq's oil is one and indivisible and there is a movement towards achieving justice in the distribution of wealth to the people, whether in the Kurdistan region or the center and south," he said.

He added, "The atmosphere is suitable for the adoption of the law, and it is hoped to complete the draft and reach Parliament in the current legislative term," expecting "the adoption of the law in the next legislative term after about 4 months."

The committees formed for the purpose of resolving the oil and gas law continue their work and meetings, especially between Baghdad and Erbil, with the aim of resolving the law before agreeing on it in full and presenting it to the House of Representatives in order to legislate it and work with it to eliminate the problems between the center and the region.

 

At a time when political parties ruled out the Kurds' acceptance of the oil and gas law in its current form, especially after it was rejected more than once after it was put forward by previous governments before the Council of Ministers for approval and sent to the House of Representatives for the purpose of legislation, but the Kurdish rejection was present, which postponed the decision of the law to this day.

Former MP Jassim Muhammad Jaafar told Al-Maalouma, "The Kurds got their chance in the oil and gas law in 2008 when the law was sent from the Council of Ministers to Parliament for its legislation."

Jaafar added, "Erbil rejected the law despite its resolution within the Council of Ministers in the aforementioned year, demanding a law that meets their aspirations and is in their interest, whether with or without consensus on passing this law, which excludes its resolution." 

 

On the other hand, a member of the Fatah Alliance, Ali al-Zubaidi, told Al-Maalouma that "the oil and gas law has been postponed a lot as a result of the escalation of political disputes around it, which necessitates the proper preparation of the law so that it is fair to all and makes the center the main engine of this law through the distribution of wealth to everyone without the injustice of any province, whether in the region or outside."

Zubaidi added that "parliament may be heading for heated discussions regarding the oil and gas law."

"There are some objections that often occur when trying to introduce the law," he said.

On the other hand, MP for the Kurdistan Democratic Party Jiay Timur told Al-Maalouma that "the Sudanese government is serious about sending the draft oil and gas law to parliament and the relevant committees continue their meetings in the hope that they will finalize the draft and refer it to parliament."

He added, "Dialogues are continuing to remove all differences facing the legislation of the law."

Taymour pointed out that "there is a joint vision between the Baghdad government and the regional government to finalize the oil and gas law file and send it to the House of Representatives within the coming weeks." Finished 25n

Oil expert Hamza Al-Jawahiri said on Sunday (August 27, 2023) that there is a need to involve experts in the field of oil in the preparation of the draft oil and gas law, as well as the participation of parties in the governments of Baghdad and Erbil.

Al-Jawahiri said, to "Baghdad Today", that "the legislation of laws in Iraq is subject to political agreements, which lead to the legislation of any law or not, but the preparation of draft laws, must be from the competent authorities and personalities, so that there are no gaps in any paragraph of the law."

He explained that "the involvement of experts and specialists in the field of oil in the preparation of the draft oil and gas law is in force in many countries and is a health condition, and therefore the competent government agencies in the federal government and the Kurdistan Regional Government can also participate in the preparation of the draft."

The oil sector in the Kurdistan region has entered a "dark tunnel", since the export of oil through the Turkish port of Ceyhan was stopped by an international judicial decision from the Paris Court, as well as the continued dispute between Iraq and Turkey over the mechanism for restoring oil exports through the Turkish port of Ceyhan, in addition to the new Baghdad-Erbil agreement, which made the Kurdish oil sector not isolated from the control of the federal government in Baghdad.

While the political forces stress the need to legislate the oil and gas law, all problems between Baghdad and Erbil are being relied upon and the shape of the relationship and the clear mechanisms to control the oil of the Kurdistan region and the specific powers of the regional government and the government of Baghdad, but the differences and lack of clarity of vision regarding the definition of powers and privileges between Erbil and Baghdad still hinder the legislation of the law and reaching an agreed formula.
