Najran Barzani requires Baghdad to provide the province's share of the budget in exchange for the delivery of oil revenues
The Prime Minister of the Kurdistan Region, Nezhirvan Barzani, on Monday the readiness of his government to hand over crude oil revenues to the federal government in Baghdad provided that the latter provides the full share of the province of the federal budget for 2018.

Deputy National Alliance MP Amer al-Fayez on Monday received positive indications from the Kurdish parties to announce the cancellation of the referendum and open a dialogue without any preconditions with Baghdad, stressing that no dialogue or reception of any Kurdish delegation without the region's announcement to cancel the referendum and the result.

 
Fayez said in a press statement that "some Kurdish parties have received positive signals about their intention to cancel the referendum and the result of the coming days to open a dialogue with Baghdad directly to overcome the crisis of the economic region."

 
He added that "the Kurdistan Regional Government involved in several crises can not be bypassed without going through Baghdad, most notably the provision of salaries of employees in the region and the Peshmerga as well as external debt and the file of oil exports and the failure of neighboring countries to deal with the region through border crossings without the supervision of the federal government.


Al-Fayez said that "the Baghdad government has officially declared its ability to pay the salaries of the staff of the region and solve its economic problems in the event of announcing the cancellation of the referendum and the delivery of border ports and airports and other conditions declared."

14 Kurdish MPs facing death sentence threats for referendum

ERBIL, Kurdistan Region - Fourteen Kurdish members of the Iraqi parliament are facing the threat of death sentences from Baghdad for voting in Kurdistan Region’s independence referendum on September 25.

 

Dr. Muthana Ameen, an MP from the Kurdistan Islamic Union (KIU), one of the MPs in question, says “They want to try us with Iraq’s penal code156 for voting as Kurds and in a civil and democratic way for the independence of Kurdistan.”

 

Ameen slammed the parliament’s decree saying “We see this decision against us as political not legal.”

 

The Iraqi Parliament’s MPs affairs committee has so far read three recommendations from the parliament against the 14 Kurdish parliamentarians which include stripping them of immunity, trial and banning them from parliamentary duties until their cases have been decided on by the court.

 

Amin wonders why the parliament is only after these 14 MPs when “many others” voted, too.

 

“If death sentence is issued for an MP for voting, then three million Kurds must be punished," said Amin.

 

On suggestions from the Shiite State of Law Coalition nearly 100 MPs submitted a letter to the Iraqi Federal Court, wanting legal measures taken against the Kurdish MPs who voted for the independence of Kurdistan from Iraq.

 

Of the 14 MPs, 10 are from the Kurdistan Democratic Party (KDP), two from the Patriotic Union of Kurdistan (PUK) and the other two from the KIU. 

 

The Federal Court refused to issue any verdicts against them, saying according to the Iraqi constitution, it was not their business to issue verdicts against the respective MPs.

 

On October 10, a temporary committee comprised of the legal and MPs affairs committees decided to expel the 14 MPs and sent their cases to the court.

 

Amin Bakir, a Change Movement (Gorran) parliamentarian in Baghdad echoed the sentiment that stirring the motion against the Kurds in the parliament is more of “political.”

 

“This question is political and lifting immunity on MPs is not an easy job,” Bakir, who is also member of the legislature’s legal committee, told Rudaw.

 

He added they “Do not know the opinion of other Kurdish MPs since they have not returned to Baghdad yet. But this subject is certainly more to do with political stalemates between Erbil and Baghdad.”

 

In the meantime, the Iraqi parliament is trying to persuade the Kurdish MPs to return to Baghdad.

 

According to Renas Jano, one of the 14 charged MPs, Salim al-Jabouri, parliament speaker had asked several MPs to persuade other Kurdish parliamentarians to return and attend the sessions.

 

“But Jabouri has not given any guarantees to the MPs that there will not be any legal measures against them once they return,” he explained.

 

According to Iraq’s penal code 156, a person is sentenced to death who “intentionally” threatens the sovereignty and unity of the state. 

 

But this code has not been implemented in the Kurdistan Region since 2003, according to Article 21 of the Region.

ERBIL, Kurdistan Region—The Kurdish government and political parties are ready to fully engage in negotiations with Baghdad in order to resolve all disputes through understanding and based on the constitution, said Prime Minister Nechirvan Barzani at a press conference in Erbil on Monday, adding that the military is not the right approach to solving any issue.

 

“The KRG is ready for talks that would achieve the best interests of Iraq and Kurdistan Region,” PM Barzani told reporters. “We don't think issues could be resolved militarily. They need serious political talk.”

 

The Kurdish Prime Minister said: “The last fourteen years have been a good lesson that we can't resolve differences by the mindset of who is strong and who is not.”

 

He added that Erbil may have a different view of the Iraqi constitution “but we can still solve all issues through dialogue.”

Barzani described recent military confrontations between the Peshmerga and Iraqi forces as unfortunate, adding that “there was no need for the deployment of the army and Hashd al-Shaabi.”

 

“We ask for a complete and inclusive ceasefire and urge Baghdad for talks.”

 

He maintained that there were talks between Kurdish and Iraqi military officials, “but to this point there is no agreement between them and nothing has been signed,” he said, stressing that “the solution does not lie in the military but in serious political negotiations.”

 

“We are even ready to talk to Iraqi political parties who genuinely want to understand the situation and find a solution for it,” the Prime Minister said, “The talks do not necessarily have to be only with the government.”

 

Responding to a question from a reporter about Kurdistan Region’s oil revenues since the October events and loss of Kirkuk, Barzani said, “More than half of Kurdistan Region’s oil has been reduced and that certainly affects our revenues. What’s important to us, and all our efforts now are to reach a deal with Baghdad.”

 

“We say this now and we have said it before, if Baghdad is willing to fully pay the 17 percent share of our budget we are ready to hand over to them oil dossier.”

 

“There has not been a census in Iraq and until that happens things should remain as they are agreed on in the constitution. The Iraqi constitution gives the Kurdistan Region 17 percent of the budget.”

PM Barzani said that Kurdish political parties are united in their belief in negotiations with Baghdad and they pursue that through the KRG.

 

“Can Iraq’s issues be resolved with force?” Barzani said all Iraqi and Kurdish leaders should ask themselves. “No, Iraq’s history shows us that that is not the case.”

 

“Baghdad and Erbil issues can be solved through straightforward negotiations and with an open mind and not a mentality of who is victorious and who is not,”

 

“If we really want peace and stability and for all groups to live in geography called Iraq, serious talks must then be held far from who has lost and who has won,” PM Barzani said. “With this mindset we can expect a bright future for all Iraqis.”

 

Barzani urged Baghdad to be genuine in its statements and not resort to political games of “saying they will pay KRG employees’ salaries but not doing so”, reminding all sides that a policy of starvation will not serve anyone including Iraqi Prime Minister Haider al-Abadi.

 

On the home front, PM Barzani said that ministers of the Change Movement (Gorran) are welcome to return to their posts and rejoin the cabinet of the Kurdistan Regional Government.

 

The Prime Minister said that his government will do its best to continue paying its civil servants and guarantee their pay. Meanwhile he called on Baghdad to avoid actions aimed at ending the Kurdistan Region as a constitutionally recognized entity.

“The Kurdistan Region is a recognized political entity by the Iraqi constitution and the international community,” he said. “Unfortunately the attitude now is to dismantle this entity completely which is a real risk for all of the Kurdistan Region.

 

“He [Abadi] is the Prime Minister of all Iraq and must act that way, he must care for the payment of Mosul, Basra and the Kurdistan Region equally,”

 

Barzani said that Erbil still maintains ties with Iran and Turkey and that the Kurdistan Region wants to live in peace and harmony with its neighbors.

 

“We are interested in talking to all our neighbors and show our interest for peace and understanding,” he said. “Turkey is an important neighbor and has helped the people of Kurdistan during the hard times,”

 

“We also remember help of the Islamic Republic of Iran,” he added. “The Kurdistan Region wants to live in peace with its neighbors and be a force for stability, including Turkey with whom we have had good relations in the past,”

 

“We want to continue talks with Turkey and Iran and have them help us solve our disputes with Iraq, too.”

 

PM Barzani revealed that he is personally in contact with both countries by way of negotiations.

 

Barzani concluded the press conference by saying that the disputed territories remained “disputed” as outlined in the Iraqi constitution and must remain so “whether the Iraqis are in control of it or us.”

 

And, he added, “We want the displaced people to be able to return but only if they feel safe and secure.”

The office of Prime Minister Haider al-Abadi on Monday confirmed the government's commitment to preserve the unity of Iraq, calling again to abide by the constitution and the decisions of the Federal Court.

The Federal Court confirmed that the Iraqi constitution does not contain a text that allows for the separation of any of the components of Iraq, noting that the Constitution emphasizes the unity of the country.

A spokesman for the Federal Supreme Court said the court ruled that there is no possibility of separation of any area or province of the country.

The ruling came in response to a request by the government to put an end to any erroneous interpretation of the constitution and to emphasize the unity of Iraq. The court is responsible for resolving disputes between the central government in Baghdad and areas including the Kurdistan region.

In a context, a government statement said it was committed to its constitutional position to preserve Iraq's unity and prevent any separatist attempt, and to proceed with the necessary measures to impose federal authority. Reiterated the call for full adherence to the Constitution and the decisions of the Federal Court, the latest issued today concerning the interpretation of Article (1) of the Constitution, which stressed the unity of Iraq and committed all federal authorities to maintain this unit, and clearly indicated the absence of any text in the Constitution that allows separation.

The government considered that all actions taken by the federal government were within this constitutional article and within its powers.

The government demanded 'Kurdistan' a clear declaration of the commitment not to secession or independence from Iraq on the decision of the Federal Court.

The document, which received a copy of the Arab NRT on October 5, 2017 that it "welcomes the initiative of Prime Minister, Haider Abadi, concerning the granting of salaries of employees of the Kurdistan region," demanding that the insurance of salaries of regional employees according to official statistics based on the registration of biometric in the region .

As called for the document, the federal government to treat the province of Halabja the same as the rest of the provinces of Kurdistan within the federal budget law.

The document called on friendly countries and the international community to provide assistance to overcome the current crisis between the federal government and the provincial government in accordance with the principles of the Constitution.

MP of the National Alliance Amer al-Fayez on receiving positive indicators by the Kurdish parties to declare the cancellation of the referendum and open a dialogue without any preconditions with Baghdad.

 Fayez said in a press statement on Monday: "Some Kurdish parties have received positive signals about their intention to cancel the referendum and the result of the coming days to open a dialogue with Baghdad directly to overcome the crisis of the economic region." 
 He added: "The Kurdistan Regional Government is involved in several crises and can not be bypassed without going through Baghdad, most notably the provision of salaries of employees in the region and the Peshmerga as well as foreign debt and the file of oil exports and the neighboring countries to refrain from dealing with the region through the border crossings without the supervision of the federal government. 
 He continued: "The Baghdad government has officially declared its ability to pay the salaries of regional staff and solve its economic problems in the event of announcing the cancellation of the referendum and the delivery of border ports and airports and other conditions declared."

Yota Thanks,  DV,  Lets git er done boys and girls time is of the essence and the Iraqi citizens can no longer wait on procrastinations from "Corrupt Politicians & Greedy Leaders".   All outstanding issues need to be resolved this week and move on to the Finale called the "Infamous RV / RI Of The IQD".
