ERBIL, Kurdistan Region – The Kurdistan Regional Government has welcomed a call by Prime Minister Haider al-Abadi for Baghdad to pay the salary of Kurdish public servants, saying that doing so requires the Iraqi government has to pay 1.2 million people and that will cost Iraq 897.5 billion Iraqi dinars ($772 million).
 
The KRG said in a statement that it is willing to provide the Iraqi government the list of those people who are on its payroll if Baghdad agreed to pay in full their salaries.
 
It also criticized the proposal for the 2018 Iraqi budget which for the first time does not refer to Erbil as the Kurdistan Region, instead choosing to use “the provinces of the Kurdistan.” It said doing so violates the Iraqi constitution recognizing the Kurdistan Region as a federal entity with its own government, legislature and laws.
 
The KRG detailed that it has 1,249,481 people on its payroll, including 455,000 public servants (police forces included), 266,465 Peshmerga and local Asayish (Kurdish security).
 
PM Abadi stated on Tuesday that his government is willing to pay the Kurdish salaries.
 
The Kurdistan Region has been struggling to pay its large employees because of the drop in oil prices, the war on ISIS, and budget cuts by Iraq since 2014.
 
The KRG said it is willing to provide the list of its employees it collected through the biometric mechanism aimed at canceling double salaries and ghost employees. 
 
PM Abadi on Monday doubted the Kurdish Region has hundreds of thousands of Peshmerga fighters, saying it is a small fighting force while many stay at home.
 
He said the Peshmerga must either come under the command of the Iraqi government, or be downsized to a small, local force paid by Erbil.
 
The KRG demanded for the Iraqi government not to approve a budget proposal presented by Baghdad’s finances ministry that “for the first time since 2003 the constitutional term of (the Kurdistan Region-Iraq) has been removed and instead used the term 'provinces of the Kurdistan Region,' ” the statement detailed. It added that this violates Article 117 of the Iraqi constitution that recognized the Kurdistan Region as a federal region with its own government, parliament and judiciary.
 
It said that the Iraqi government trying to deal directly with the provinces of the Kurdistan Region is also in violation of the Iraqi constitution since the constitution recognized the four provinces collectively as one entity.
 
The KRG pointed out that the budget proposal for the first time since 2005 has cut the Kurdish share from its entitled 17 percent down to a mere 12 percent. It added that the KRG and Iraq have since 2005 agreed that the Kurdish population constitutes 17 percent of the Iraqi population, and this remains to be the case unless a census conducted.
 
The regional government stated the Iraqi constitution does not allow the federal government to decrease the constitutional powers of the Kurdish government, nor does it allow the constitution to be amended in this regard.
 
It concluded that PM Abadi has long advocated that every side respect the constitution, and now it is his turn to show in practice that his government will be doing so.

Kurdish media revealed the intention of the Kurdistan Regional Government President Nechirvan Barzani to visit soon to the capital Baghdad, led by a delegation of Kurdistan, including his deputy Kebad Talabani and representatives of the parties in the region.

This development comes a few days after the departure of the President of the region Massoud Barzani, and the vote of the Parliament of the Territory to transfer the powers of the President to the Prime Minister, who became the first official in the region. 
The date of the upcoming visit is unclear. While parties say that the visit will take place next week, the Kurdish Democratic bloc talks that Barzani is waiting for an invitation from Abadi to come to Baghdad. 
In the meantime, denied a deputy close to the Prime Minister knowledge of the existence of a scheduled date to visit the President of the Kurdistan Regional Government, again the conditions of the government to start any dialogue with the Kurdish side, which is the announcement of the cancellation of the referendum in public.

" 
The United States, Britain, Germany and France have made extensive efforts to bring Baghdad and Erbil closer to the backdrop of the referendum. And calls for these efforts as a whole to calm and non-escalation between the federal government and the Kurdistan region. 
On Tuesday, the US State Department praised the decision by the president of the Kurdistan region not to extend his presidency and called on Baghdad and Erbil to make efforts to resolve controversial issues according to the constitution.
In turn, London urged the Iraqi government to start a dialogue with Erbil, confirming the Kurdistan government's readiness for it. A statement from the office of Abadi said he had received a phone call from British Foreign Minister Boris Johnson, noting that the parties "discussed the victories against terrorism and the spread of federal forces in the province of Kirkuk and other areas and political and security conditions."

EXCLUSIVE: Draft of Iraq-KRG agreement proposal on borders, forces

Rudaw has obtained the documents detailing the draft of recent agreement proposals between the Kurdistan Region and Iraq following a few days of clashes in some of the border areas. Iraqi and Kurdish authorities have held negotiations to solve their disputes, mainly in the disputed territories and the deployment of forces, though on Wednesday the Iraqi government and the KRG both accused each other of backtracking on the agreement. 

 

NOTE: The points in the following documents are what the Iraqi side had presented to the Kurdish delegations and the Kurdish side of the negotiations have provided their response as detailed below. These documents in no way mean any kind of final agreement between Erbil and Baghdad.

 

Document 1.

 

The text of the agreement

Based on Articles 110, 114, 115 of the Iraqi constitution concerning the powers of the Federal Government and the Regional Government (KRG) and to normalize the situation, the following agreement was reached between both sides, based on the constitution.

  1. 1. Article 53 of state administration transformed to Article 140 in the constitution which (recognizes the Regional Government as an official government in areas it administered in the provinces of Duhok, Erbil, Sulaimani, Kirkuk, Diyala and Nineveh).
  2.  
  3. 2. Based on Article 140 designed to solve the disputed territories as set in Article 58 of the Transitional Administrational Law to normalize the situation in those areas and establish justice to their populations and erasing all traces of repressive measures taken by previous governments, these areas will be administered by Federal and Region’s (KRG) authorities in coordination and cooperation since they are considered disputed territories until Article 140 has been implemented and their populations have their safety and security returned.

  5. 3. The administration of the Fish Khabur crossing, based on clause 1 of Article 114 of the constitution, stipulates a joint administration. Protection will be provided by a joint force of Peshmerga, Federal forces and the International Coalition. Taking into account that Fish Khabur is inside KRG territory based on Articles 53 and 140.

  7. 4. Joint committees of Federal Forces and Peshmerga will draw a plan for areas where these forces will be deployed.

 

 

Document 2.

 

In the Name of Allah

Based on the Articles and decrees of the Iraqi constitution as the highest power in the country and to which all sides must be committed in all areas and provinces of the country without exception, representatives of the Federal Government and the Regional Government whose names have been listed below met and agreed on this document at the Nineveh Operations Command Center on October, 29, 2017.

  1. 1. Local administration and local police will administer areas falling within the boundaries of the Kurdistan Region based on Article 53 of State Administration law and of 19/03/2003 and Article 143 of the Iraqi constitution, in a way that does not conflict with the Federal Law.

  3. 2. Deployment of Federal Forces in all areas that fall outside the administrative boundaries of the KRG provinces and Peshmerga presence in these areas must be symbolic and differ in size from one area to another and decided by the Federal authorities.
  4.  
  5. 3. Securing the Fish Khabur area by Border forces and Federal forces for lack of a legal text on the deployment of any forces other than the federal forces and if the Peshmerga forces become part of the Federal Forces then they will all have to abide by the orders of the Central Command of the Armed Forces.

  7. 4. The Federal Forces will command all areas where they will redeploy to.
  8.  
  9. 5. Commanders of the Federal Forces and the Peshmerga will draw a plan for the deployment of Federal Forces in these areas and the handover of areas.

  11. 6. This agreement will be implemented in all areas where KRG forces will withdraw from.

  1. Inclusive ceasefire and end to hostilities on all fronts.
  2. Return to the joint military mechanism between the army and the Peshmerga to fight ISIS terrorism that is still persistent.
  3. Respect to the ceasefire and deployment of joint forces until all issues have been constitutionally resolved.
  4. Start of negotiations between Baghdad and the Kurdistan Region and the participation of the International Coalition based on the Iraqi constitution and establishment of political, administrative, legal and military committees to resolve all the issues.
  5. As a gesture of goodwill the Kurdistan Region is willing to allow a joint force of Peshmerga, Federal forces and the international coalition in Fish Khabur, but it has to be temporary until the order of things is restored.

The language of escalation and accusations between Baghdad and Erbil returned after a week of optimism that prevailed in the atmosphere waiting for the outcome of the talks conducted by technical teams of the federal government and the Kurdistan Regional Government.

Prime Minister Haider al-Abadi accused the Peshmerga factions of trying to drag the federal government into war by attacking the latter in disputed areas. 
The Joint Operations Command announced that the Kurdish side had withdrawn from the redeployment agreement, pointing out that the Peshmerga forces had set up positions to block the progress of our units and promised to respond to the source of fire in the event of an attack. 
Since last Thursday, federal forces have stopped their advance towards the Feshkhabur crossing after violent clashes with Peshmerga forces. The prime minister announced on Thursday the suspension of progress and giving 24 hours to technical teams to facilitate the deployment of federal forces. The deadline was extended more than once. On Tuesday, he announced the arrival of troops to the crossing with Turkey, but the Kurdish side denied this.
"Some of the Peshmerga wings hit our Iraqi forces and are trying to drag us into war," the prime minister said during a meeting with a group of Iraqi journalists and media reporters. "I ordered the military leaders in those areas to respond with the force of law to any attacks targeting them from those armed groups that do not follow the orders of the Peshmerga." 
"I sent a technical team to the province of Nineveh, a few days ago, to find a formula for redeployment, not to negotiate," he said, pointing out that "the Kurds tried to resort to negotiate with our military technical team, but I was directed not to conduct any negotiations outside Baghdad." He stressed that "the technical team is legally mandated and the authority of the federal government to redeploy in the borders and disputed areas, which was controlled by Erbil after 2003."
"I have agreed with the Kurdish side not to negotiate until after the cancellation of the referendum and the adoption of the constitution," the prime minister said, adding that "requests to respond to the negotiations from Erbil, but I postponed consideration until a court ruling on the referendum." 
Abadi put conditions for the participation of the Peshmerga by holding the border areas, including that "its presence in the barracks and not military headquarters, and be subject to the decisions of the commander-in-chief, and is committed to carrying light weapons only."

The Federal Court said on Thursday that it can not express any opinion on the subject of constitutional or unconstitutionality of the referendum, noting that the resolution of cases against the referendum is dependent on the other party to the case.

A copy of the statement was obtained by "The Trend Press", a spokesman for the court, Ayas al-Samok, said that "the plaintiffs in the proceedings before the Federal Supreme Court (89, 91, 92, 93 / Federal / 2017) 25/9/2017 ".

Samok added that "the Federal Supreme Court felt that the resolution of these cases is dependent on informing the other party in the case, which was addressed to him by the representative of the Kurdistan region in the Council of Ministers," noting that "the last confirmation was on 18/10/2017."

He added that "the court can not give an opinion on the subject of constitutional or unconstitutional referendum only through the above mentioned cases," noting that "giving the opinion in advance and without hearing the other party with the existence of such claims is contrary to the provisions of Article 91/5 of the Law of Pleadings Civil, and with established judicial contexts on the need not to give a prior opinion with the existence of proceedings on the same subject.

Twilight Washington / Washington called on both Baghdad and Arbil to avoid fighting and engage in dialogue between the parties. 

The Presidency of the Kurdistan Regional Government issued a statement to the twilight news that the US ambassador expressed during his meeting with the head of the provincial government, Nzhirvan Barzani, his country's concern about the recent events in the disputed areas between Arbil and Baghdad from fighting between the two sides resulted in the deaths and injuries. 

He expressed the hope that the two sides will make serious efforts to end the tense situation and start negotiations and dialogue to solve the problems and saw the need for a truce to stop the fighting in order to achieve this goal. 

The statement pointed out that Barzani stressed during the meeting that the region did not want from the outset of the military confrontation between Arbil and Baghdad, and for this purpose, his government issued a series of statements calling for the start of dialogue between the parties.

But Barzani said that Baghdad in return sought to impose more pressure on the region and lines of agreement, pointing out that the Peshmerga defended itself and those areas.

The Kurdish military has accused Baghdad of continuing a policy of dishonesty towards Kurdistan, according to a new report by al-Masdar news.

 

The Iraqi military’s attacks on Kurdish targets show “ongoing military aggression and unconstitutional demands”, the Peshmarga says.

 

The Kurdish military says it has been put in the defensive position since Baghdad decided to wage a war against the Kurdish Regional Government (KRG) to recapture parts of Kirkuk’s oilfields.

Following the Kurdistan region’s referendum which Iraq did not recognize, Iraq’s government forces completed in mid-October an operation to seize control of all oil fields that Iraqi state-held North Oil Company operates in the oil-rich Kirkuk region from Kurdish forces. A day later, disruptions in oil flows started, with reports that the flow of crude oil from Kirkuk to Ceyhan had plummeted to some 225,000 bpd, from around 500,000 bpd the previous day.

 

These developments benefit the Organization of Petroleum Exporting Countries (OPEC), which has been implementing a policy of reducing its output by 1.2 million barrels per day.

 

The policy has raised Brent barrel prices to $60, which is a growth of over 30 percent compared to pre-January levels.

 

OPEC’s de facto leader, Saudi Arabia, needed to hit the $60 benchmark in order to feel safe in authorizing its state-run firm, Saudi Aramco’s, initial public offering. Though only five percent of the firm is being offered to international investors, the revenues from the deal will sponsor the recreation of the Wahabbi and conservative Saudi Arabia of today, to the Dubai-ish and futuristic society of tomorrow.

Eight members of the US Senate called on Iraqi Prime Minister Haider al-Abadi to accept the initiative of the Kurdistan Region for dialogue and stop the violence and withdraw the popular crowd which is supported by Iran from the Kurdish areas outside the administration of the Kurdistan Region, or called B (disputed), especially in the Nineveh Plain.
