As impasse continues between parties over nominations

SULAIMANI — In a move that may help clarify the calculus for selecting a transitional figure to be prime minister, protesters in Baghdad's Tahrir Square released a statement on Friday (December 27) outlining seven qualifications that candidates must have in order to be acceptable to the street.

According to the statement, any candidate must be neutral and non-partisan and never previously been a cabinet minister, member of parliament, or provincial governor. They must also be trustworthy and have no indication of corrupt activities in the past.

They must also be no more than 55-years-old and must promise not to nominate themselves for office at the next election. Finally, they must be committed to meeting the demands of protesters and to making decisions in the sole interest of the Iraqi people, rather than any party or foreign power.

Protesters rejected several candidates nominated by the political parties over the last several weeks, including two nominated by al-Bina parliamentary bloc.

The protesters’ stance forced President Barham Salih to reject the latest al-Bina candidate this week, saying he would be willing to resign rather than appoint someone that does not have the support of demonstrators.

Iraq has been rocked by anti-government protests for nearly three months. Initially the demonstrators wanted the government to do more to fight corruption, increase job opportunities, and improve public services, but they are now adamant that the current government and parties should be swept aside and new elections held.

NRT Digital Media reporter Omed Mohammed said one protester was killed by the security forces late on Friday when clashes erupted in Baghdad's Wastha Square overnight.

Nearly 500 people have been killed and more than 17,000 others have been wounded since the protests began on October 1, according to the High Commission for Human Rights. Local and international rights watchdogs have condemned the killings.

ERBIL (Kurdistan 24) – Protesters in Iraq have broken into the Nassiriya oilfield, shutting down operations indefinitely, security and oil sources reported on Saturday.

According to oil sources, demonstrators who stormed the facility forced staff to cut off electricity from the main control station while they chanted “no homeland, no oil.”

The Nassiriya oilfield produces 90,000 barrels of oil per day (bpd).

Although protesters have blocked entrances to oilfields and key ports during Iraq’s nationwide protests, Saturday marks the first instance where they have shut down an entire facility.

Oil exports make up 90 percent of Iraq’s economy. The country is the Organization of the Petroleum Exporting Countries (OPEC) second largest producer.

No foreign companies operate at the Nassiriya oilfield.

Iraq has been engulfed in anti-government protests for nearly three months now, where over 500 people have been killed in clashes between security forces and demonstrators, and thousands of others injured.

The protests in Iraq reflect widespread dissatisfaction with the economy, availability of jobs, the dismal state of public services, and widespread government corruption.

Demonstrators demand that the next prime minister be independent and someone who has never held a ministerial position in successive governments.

Iraqi rights group says 490 protesters killed since October

2019-637131544710443428-44 (1) Iraq's semi-official human rights commission said Saturday at least 490 protesters have been killed inBaghdad and southern cities in nearly three months of anti-government rallies.

Iraq has been roiled by protests since Oct. 1 in which demonstrators have taken to the streets to decry corruption, poor services and a lack of jobs. They have also called for an end to the political system imposed after the 2003 U.S.-led invasion.
The mass uprisings prompted the resignation of former Prime Minister Adel Abdul-Mahdi late last month. Theprotesters demand an independent candidate to hold the post.
The leaderless protests - the most serious challenge for the ruling class in over a decade - were met with a violent crackdown by security forces. They dispersed crowds with live fire, tear gas and sonic bombs, leading to fatalities.
Faisal Abdullah, a member of the semi-official Human Rights Commission, said the 490 killed include 33 activists ``assassinated'' in targeted killings. More than 22,000 have been injured.
Abdullah said 56 protesters remain missing after reports they were abducted. Another 12 have been released, he said, quoting data recorded by his group, the Iraqi government and a committee looking into abduction linked to the country's Interior Ministry.
The Human Rights Commission doesn't assign blame for the violence.
The United Nations has said it received credible allegations of deliberate killings, abductions and arbitrary detentions carried out by unknown armed men described as `militia,' `unknown third parties' and `armed entities.' ``
Iraqi politicians have warned of infiltrators seeking to co-opt and sabotage the largely peaceful movement.

Presidents Saleh and Abdul-Mahdi ( Iranian Stooge ) discussed three files, namely, speeding up the formation of the government and achieving the demands of the demonstrators, in addition to the political and security conditions.

Ordinarily I would say if Mahdi knew what was good for him he'd cooperate and get it done. This is no ordinary situation; he cooperates he's a dead man . The Iranians simply wouldn't stand for it.

Saying that however, is there something else Iran may be up to that we're not privy to ?

Political consensus
Representative of the Alliance of Victory Nada Shaker Jawdat confirmed, in an interview with "Al-Sabah", that "the nomination of the prime minister is still pending, and it is the responsibility of the President of the Republic, because the nomination was consensual and during a specific period, and the tasks of that character end between six months to a year." With it. ”
Jawdat assured to "Al-Sabah" that "it is necessary for the position to be received by a candidate who has political experience and executive work, and we warn against going into chaos", adding, "The candidate for prime minister will only take the position for a transitional period, until the ground is ready for early elections. "
For his part, among the leader of the Iraqi Communist Party, Talaat Karim, "The position regarding the nomination of a prime minister is still subject to political agreements that were not agreed upon, and conflicts between the blocs and the will of the masses that insist on nominating an acceptable person from the conditions of the mass uprising remain."

In fact, the first session of parliament in its current session did not designate a larger bloc.” He added, “Talking about naming a certain bloc as the largest; it is a clear fallacy and everyone He knows it is incorrect, ”he said.
While legal expert Bashar Al-Hattab indicated in an interview with Al-Sabah that the President of Iraq still bears the hallmarks of the parliamentary system that started with the 2005 constitution, the President of the Republic is a symbol of the nation’s unity and represents the country's sovereignty.
He added, “The constitution has authorized the president to exercise part of the independent authority that enables him to assign the candidate of the largest bloc to form the government in accordance with Article (76) of the constitution.” In connection with the controls of the resignation of the President of the Republic and its aftermath, among the legal expert, that “the constitution addressed explicitly The President of the Republic has the right to resign from his position by presenting it in writing to the Speaker of the House of Representatives, and it is considered effective after seven days have passed from the date of its filing. / C) of the constitution. ”
As for the fate of the position of the President of the Republic for the period between his resignation and the election of a new president, between Al-Hattab, it is possible to say that the President of the Republic continues to exercise his duties until the election of a new president by the House of Representatives within (30) days of the date of the resignation, and the basis for that is What was decided by Article (72 / b / b) that granted the President of the Republic the authority to exercise his duties after the end of the elections for the new Parliament. It is a matter of first, according to the general principles that he continues to exercise his duties until the election of a new president.
In turn, the legal expert, Tariq Harb, described the path set by the Iraqi constitution to exempt President Barham Salih as "very difficult and complicated."
Harb said in a statement received by Al-Sabah: “The path that the constitution set in Article 61 of it to terminate the service of the President of the Republic is very complicated and difficult. By constitutional oath or violation of the constitution to high treason), so that deputies vote on that, then the matter is referred to the Federal Supreme Court in order to assume a ruling on the president that he committed one of the cases i.e. perjury, violation or treachery. ”
He explained, “If a conviction is issued, then a session of Parliament is required in order to decide by a majority of the members and not the majority of those present to exempt the president, knowing that the exemption carries the meaning of commutation, while the Prime Minister used the constitution the term of dismissal and withdrawal of confidence, which is a punitive term, meaning that constitutional difficulties In front of the issue of the President of the Republic, a vote must be taken by a numerical majority of 156 deputies for accountability only, after which the matter is referred to the Federal Supreme Court, and if it decides to convict the President, the Council must take over the voting again with the same previous majority for the second time, and after all of the foregoing the president is exempted and not dismissed Or withdraw confidence NH or
isolation".
And Harb continued by saying: “There is a difference between exemption and between dismissal, withdrawal of confidence and dismissal, and the court does not establish condemnation in all that is attributed to the president in order to be exempted, but the exemption will be if it is proven to the court that the president violated the constitution or broke the oath or committed the greatest treachery, and this Difficult legal issues, not like other acts such as theft and murder, for example.
The legal expert went on to say: "The highest judicial body in Iraq is assumed and not the other, in addition to the issue of collecting this number of votes - that is, the issue is judicial and by a high majority - and not like the prime minister who is satisfied with parliamentary accountability only."
