A legal expert clarifies who will transfer the powers of the President of the Republic after his resignation and who will be appointed as Prime Minister?
{Baghdad: Al Furat News} The legal expert, Ali Al-Tamimi, explained who will transfer the powers of the President of the Republic after his resignation and who will be appointed as Prime Minister.
Al-Tamimi said (for Furat News) that "the president of the republic waved the resignation, because the resignation must be written in accordance with Article 75 of the Constitution and submitted to the Speaker of Parliament and is considered effective seven days after its submission."
"This means that the seven days during which the resignation is submitted until the effective date, the full powers of the President of the Republic remain and he is entitled to assign another candidate for the Prime Minister," he said, noting that "in the event of 7 days here, the Vice President replaces the resigned president within 30 days, since Iraq There is no vice president in it. Paragraph 4 of Article 75 of the constitution says the speaker of parliament replaces the president of the republic, and the term is 30.
Al-Tamimi indicated that "the speaker of parliament has no right to assign a person to the prime minister because he is outside his powers and tasks stipulated in the constitution."
On the non-assignment of a candidate to the government and the end of the constitutional period, Al-Tamimi stressed that "the period for conducting business for Abdul Mahdi will be 30 days, and the administration of the country according to Article 81 of the Constitution will be transferred to the President of the Republic for his replacement for 15 days and he can nominate a new taxpayer."
He noted that "in the event that the constitutional period here ends, the constitution does not address this situation and the House of Representatives must dissolve itself, and calls the President of the Republic to early parliamentary elections within 60 days of the date of the solution."
And the legal expert added, "God was in the help of the President of the Republic because between the two street pressures, the demonstrators and the political entities, this must be a compromise between the blocs that satisfies all parties and demonstrators; To the government, which will be lacking in powers and sovereignty. "
Al-Tamimi concluded by saying, "There is no state from which the prime ministers and the Republic resign and did not happen even in the forests, and there is no justification for the parliament remaining after the two parties resigned."

The building responds to Saleh and calls on parliament to take legal measures against him
{Baghdad: Al Furat News} The Construction Alliance responded to the refusal of the President of the Republic, Barham Salih, to assign his candidate, Governor of Basra, Asaad Al-Eidani, to the prime minister.
A statement of the coalition stated, "The Euphrates News Agency" received a copy of it, "We have been keen since the first day to announce the results of the parliamentary elections in 2018 to maintain harmony in order to preserve civil peace and to avoid crises and problems that disturb the great joy of the Iraqis by winning the terrorist organization ISIS and in support of this compatibility The largest number of parliamentary blocs, which we confirmed and recorded in the first session of the Parliament on 16/9/2018. We went to nominate Adel Abdul Mahdi with the other bloc, with the approval of the other blocs to assume the position of Prime Minister. After the resignation of the Prime Minister, we were keen on following the same mechanism in Akhtia T an alternative candidate for prime minister. "
"But the President of the Republic's resort to the policy of killing time and sending messages to this direction and those and not abiding by the constitutional deadlines prompted us to provide the evidence that cannot be doubted as the largest number of parliamentary blocs that we adopted in presenting our candidate to the President of the Republic who had pledged to assign him to form the government but we were surprised The insistence of the President of the Republic to violate the constitution and not assign the candidate of the largest bloc, on the pretext of rejecting the candidate from some political parties. "
"We are in the construction alliance, and while we renew our full commitment to the constitutional contexts emphasized by the supreme religious authority, we categorically reject any justifications or a process to circumvent the constitution, and violating the constitution from the party that is supposed to be its protector means pushing the country into chaos that only serves foreign parties," the statement added. Which lie in wait for evil in Iraq and its people, who strongly reject the dictates from any party and impose a fait accompli policy, the guardian of arms and the transgression of constitutional institutions. "
The statement pointed out that "violating the constitution and refusing to assign the prime minister according to the constitutional contexts will lead to results that contradict the demands of the demonstrators and the general public in achieving security and stability so that the process of implementing the demands of the peaceful demonstrators begins."
The Construction Alliance called on the House of Representatives to take legal measures against the President of the Republic to urge him to the oath and violate the constitution, stressing that “he will always be keen on the interests of our people and no one will bid on us to serve this great people and achieve the interests of
mercy and eternity for all the martyrs of Iraq.” End

BAGHDAD - Iraqi President Barham Saleh has confused Iranian calculations regarding the choice of the next Iraqi prime minister, preferring to resign over assigning Tehran's Asad al-Eidani candidate, to open the door to several possible developments.

So far, Saleh has refused to assign three candidates submitted by the Construction Alliance, which includes all the pro-Iranian deputies in the Iraqi parliament, and they are both former Oil Minister Ibrahim Bahr al-Uloum for the Supreme Islamic Council led by Hammam Hammoudi, and the Minister of Education in the current resigned government, Qusay al-Suhail, for a coalition. State of Law led by Nuri al-Maliki, and the current governor of Basra, Asaad al-Eidani, from the Al-Fatah coalition led by Hadi al-Amiri.

These three unacceptable candidates represent forces with close ties with Iran that have enabled them to reach the top in the Iraqi political scene, highlighting the fact that their rejection needs great audacity.

Political sources told “Al-Arab” that the commander of the Quds Force in the Iranian Revolutionary Guards, Qassem Soleimani, had intervened personally to support al-Idani’s candidacy, confirming that Soleimani had vowed to fire Saleh and chase him if he did not pass the mentioned candidate.

The sources said that among the threats used by Tehran against Saleh was to send drones to fly over his home in Baghdad, during his meetings with officials and politicians.

Reuters quoted sources from Saleh's office as saying that the president left Baghdad on Thursday for his hometown in Sulaymaniyah.

And Iraqi political sources attributed the departure of Saleh to Baghdad to the "real danger posed to his life after he rejected the candidate of the Iranian-backed parties."

Most of the powers of the president in the Iraqi constitution are formal, but his right to assign the candidate of the most numerous parliamentary bloc to form a government is the most dangerous task entrusted to him.

Those close to Saleh say that the president prefers to listen to the public’s voice at this stage, despite the great Iranian threats, some of which affect his life and members of his family.

Saleh would not have gone this far, had it not been for the encouragement of the Shiite leader Muqtada al-Sadr, whose close associates were quick to thank the Iraqi president for standing with the street and rejecting the candidate proposed by Iran.

Sadr controls a parliamentary bloc that has 54 seats in the Iraqi parliament, and can play crucial roles in voting for candidates.

Representatives of al-Sadr said in parliament that they would not allow the acceptance of President Saleh's resignation, asking him to choose candidates that match the specifications set by the Iraqi protesters stationed in the protest squares three months ago.

Saleh Muhammad al-Iraqi, who is described as "the minister of al-Sadr" and the closest confidant to him, said that he investigated the candidates whom the street could approve of, and reached three names, adding that the three candidates, one of whom could form the next government, are intelligence chief Mustafa al-Kazemi The head of the Integrity Commission, Rahim al-Aqili, and deputy in parliament, Faeq Sheikh Ali.

None of these candidates is affiliated with the Sadrist movement, past or present, which may enhance one's chances.

The Iraqi entry into the candidate selection line may represent an important way out of the name-burning crisis, especially given the difficulty of convincing the protesters of any candidate.

Observers say that putting the candidates through al-Sadr or his associates may represent an important input to persuade the protesters of one of them, given that the Sadrists are strongly present in the demonstration grounds.

Informed sources have suggested to Al-Arab “Al-Kazemi’s fortunes” over others because of Al-Kazemi’s relationship with the office of the Supreme Shi’ite cleric Ali al-Sistani.

The step taken by the Iraqi president is seen as a major turnaround in events. If Adel Abdul-Mahdi’s resignation from the position of prime minister was considered at that time an important victory for the protest forces, Barham Saleh’s resignation can be seen from the side of what it represents of exceptional support for the protesters ’demands and the weighting of their right to choose The character that suits them to judge.

An Iraqi political observer considered that Saleh succeeded in delivering a sudden blow to the parties and the parliament at the same time, a blow that the two parties may not be able to avoid from its repercussions on the level of the disruption of the equation, which the protesters constitute the second party.

And it became clear that the Iraqi president had chosen to stand with the people, and that is what was stated in his letter that Parliament may seek to postpone consideration of his resignation until the parties find a way out of these repercussions, which can be predicted with its difficulty.

The observer said in a statement to “Al-Arab” that the sudden resignation, an unprecedented event in modern political history in Iraq, has left all possible settlements aside and led to confining the parties to a dead corner, after those parties were unable to impose their candidates by force.

He expected that eyes will focus in a focused manner on Iran, to which the Iraqi President dealt a resounding blow in an indirect way, but Iran will surprise everyone by not having a set of solutions after the hypothetical time for the security solution has ended.

Muqtada al-Sadr may succeed in saving the parties from their predicament, but no one can expect whether the Sadr initiative will receive good responses from the people. Sadr is also accused of complicity in order to pass some deals of the previous parties.

Baghdad - news

Today, Thursday, legal expert and political analyst Amir Al-Daami confirmed that Iraq will be subject to the seventh item and international guardianship, in case the breach of constitutional periods continues.

Al-Daami said, in a statement to "Al-Akhbariya", that "calls by deputies and political parties to choose a candidate by consensus quickly supported by all political parties come from the door that there are constitutional periods that should not be violated on the grounds that violating the constitution may affect the political process and threaten its legitimacy before the international community." And put Iraq under the seventh item. "

He added: "Since Iraq is free from the position of head of government and there is a caretaker government only, and there is a case of demonstrations and paralysis that hit a number of regions and governorates, so they do not want to violate the constitutional period towards the appointment of a legitimate head of government, not a caretaker government."

As for the international trusteeship, Al-Daami explained: "It comes if the constitutional periods are prolonged or violated, the international community will view the Iraqi government as unrecognized and meet to return Iraq to the seventh item, and thus the guardianship will return officially to Iraq."

And about the possibility of declaring a state of emergency in Iraq, between the expert, Al-Qawouni, that it "is subject to the approval of Parliament and it is not within the powers of the President of the Republic or the ministers without referring to the House of Representatives, otherwise it cannot happen."

Baghdad - news

On Thursday, the National Coalition led by Iyad Allawi called on the President of the Republic, Barham Salih, to form a mini cabinet for a year in coordination with the United Nations.

A coalition statement received by "Al-Akhbariya" stated that "at the most critical and dangerous stage in the history of modern Iraq, at a time when we were expecting that the main political forces responsible for nominating a prime minister and submitting it to Mr. President of the Republic to find an appropriate way out of the current impasse, we were surprised by those forces - After she struck the constitution with a wall again, when she did not adhere to the concept of the largest bloc (despite our reservations about it, since the 2010 elections), a prime minister was nominated by only two blocs - to return once more to violate the constitution by insisting that it represents the largest bloc at a time when it did not This is recorded in the first session of the National Assembly WAP ".

He added: "Instead of leaving the matter to the President of the Republic to start his consultations and dialogues to mix the opinions of all political forces and come up with a unified opinion to name the next Prime Minister, I exerted pressure on the President of the Republic to accept his candidate, without any regard for the demands of the demonstrators, and the demands of the unions, unions and associations that had another opinion of this. candidate
.
he continued: "today, with the inability of the blocks to provide a candidate that meets the aspirations of the demonstrators and be eligible to manage the next stage, we feel that it is time to form Dr. Barham Salih , a mini ministry in coordination with the United Nations and the appointment of a new Electoral Commission and in accordance with the new law Mans F and Adel, provided that the mission of this government does not exceed a year and pledges not to run in the elections.

He concluded: "Finally, we value and highly appreciate the national position of the brother of the President of the Republic and his bias towards the people's choice and preference for him, despite the tremendous pressure he was subjected to, and that when we enlarge this position, we announce our categorical rejection of his resignation and call on him to exercise his required role in accordance with the requirements of the Constitution and the requirements of our noble people in a manner that preserves Iraq has its unity, prestige and stability. Kurdish MP: The President of the Republic has never submitted his resignation
{Baghdad: Al Furat News} Kurdish MP Hoshyar Abdullah confirmed that the President of the Republic, Barham Salih, did not submit his resignation to the parliament, but rather presented a reading in which he expressed his readiness to resign.
Abdullah said in a statement today that the Al-Furat News Agency received a copy of it, that "the one who was presented to him by Barham Salih is a" reading "in which he expressed his readiness to resign, and he never sent his resignation to Parliament as promoted in the media, and there is a big difference between the term" resignation "and {Preparing for resignation}, expressing his surprise at “the prevailing misunderstanding of Saleh’s message and the publication by some of the media that he submitted his resignation.”
"If the President of the Republic did not have the intention to assign a person from the largest bloc or from any representative bloc, why did parliament and the Federal Court open and waste a long time in official correspondence and correspondence? It was better from the beginning that he did not send official books on the largest bloc, but rather proceeded to nominate a person Independently from the existing political blocs, especially the ones that formed the previous government, and are now inevitable from forming an interim independent government to prepare the ground for early elections. "
On Thursday, President of the Republic, Barham Salih, refused to assign the candidate of the parliamentary "Al-Bena" parliamentary bloc to head the government, saying that he was ready to submit his resignation to parliament.
The building bloc, led by Hadi al-Amiri, had submitted the name of Asaad Abdul Amir al-Aidani, the governor of Basra, as its candidate for the position of prime minister.
Saleh pointed out that the country's higher interest requires that the candidate be a "calming factor for conditions", and in choosing him in response to the will of the people, he said, "Out of my desire to inject blood and protect civil peace, and with all respect and appreciation to Al-Aidani, I apologize for assigning him a candidate for (the building block)." .
In an angry statement, the Construction Alliance attacked the President of the Republic for rejecting his candidate Al-Aidani and accused him of "resorting to the policy of killing time and sending messages to this party and that" calling "the House of Representatives to take legal measures against the President of the Republic to perjure the right and violate the constitution."
The protests have invaded Iraq since October 1, and the protesters, most of whom are young, are calling for a change of the entire political system, because - in their opinion - they are corrupt and have left most Iraqis in poverty.
More than 450 people were killed in the protests, and thousands were wounded.
The former Prime Minister, Adel Abdul Mahdi, resigned last month and remains in office to conduct business, despite continued protests.

British newspaper: The demonstrations of Iraq and Lebanon, a second and more angry Arab spring
{International: Al Furat News} A prominent British newspaper predicted the occurrence of the “Second Arab Spring” in the Middle East.
The Guardian's editorial, entitled “Arab Spring 2.0,” reads, “More than 60 percent of the Middle East’s population is younger than 30 years old, and they feel frustrated and angry at the corruption of the ruling class, foreign interference, and the military’s control of daily life.” And its affairs. "
The newspaper says that "about ten years ago, these same factors led to the departure of hundreds of thousands of Arab youth to demonstrate in what became known as the Arab Spring protests, and now the demonstrators have returned to the fields, wiser, but also angrier."
She added that "the protests are now in countries that were on the sidelines of the first wave of the Arab Spring protests. In the first wave, Tunisia, Egypt, Libya, Syria, Morocco and Bahrain were present, and now Iraq, Algeria and Lebanon."
The newspaper believes that Lebanon and Iraq in particular pose a threat and that the Arab Spring in its second edition represents another threat.
The newspaper says there is no reason to believe that the second Arab Spring will differ from the first Arab Spring. But the West should not lose hope in the reform process.
The newspaper adds that the demonstrators in Iraq and Lebanon not only demonstrate against unemployment, high prices and lack of services, but they want to put an end to the sectarian and religious system on which the country's system of government is built.
She says that the first wave of the Arab Spring witnessed a limited number of success stories, such as Tunisia, the country that started the Arab Spring, and in this second wave Sudan witnessed a measure of success.

Baghdad - Mawazine News
, an official in the Republican Palace revealed that "severe differences" occurred between the President of the Republic, Barham Salih, and a number of leaders of the "Building Alliance" Thursday morning, because of the refusal to assign Asaad al-Idani to form the next government.
The official said, according to an Arab newspaper, that "President Saleh informed several political parties, in addition to the Najaf authority, since Wednesday night, of his refusal to assign Al-Eidani and his refusal to exert pressure on him by several parties in the building coalition, and other external ones to pass the nomination."
He explained that "the construction leaders considered the continuation of Barham Salih to reject their candidates, starting with Muhammad Shi'a al-Sudani, then Qusay al-Suhail and finally Asaad al-Eidani, unconstitutional, as the task of the president of the republic is to present the candidate of the major bloc only to parliament to assign him, and he has no right to reject it, suggesting to The continued refusal of their candidates is due to an American directive, “given that the three personalities have Iranian support, or that they are not reconciled with Washington.”
The official described Saleh’s threats to resign as “serious and not frightening anyone, or trying to win a popular position, because the pressure turned into dictates.” Noting that he was "to be cast President Saleh to the word registered, but was canceled simply to publish his letter to the parliament , ".anthy 29 / h

Clarification of the constitution’s ruling in Saleh’s declaration of readiness to resign
{Baghdad: Al Furat News} The former head of the Integrity Commission, Hassan al-Yasiri, explained the constitution’s rule in announcing the President of the Republic Barham Saleh’s readiness to resign.
Al-Yasiri said in a statement that the Al-Furat News Agency received a copy of it, "The President's speech addressed to Parliament in which he expresses his willingness to submit his resignation does not mean submitting the resignation at all, and does not arrange any constitutional impact, which makes it a political behavior that has nothing to do with the constitution."
"If the President of the Republic wanted to submit the resignation, he would have announced it directly and openly, so resignation is one thing, and declaring his willingness to present it is another thing," he added.
"If we assume for the sake of argument that he (the President of the Republic) submitted the resignation later, then it does not depend on the acceptance of the House of Representatives and does not need to vote, and it is effective after seven days have passed since the date of its deposit with the House, that is an explicit text that cannot be interpreted unless those who do not know it speak ".
The President of the Republic, Barham Salih, yesterday refused to assign the candidate of the parliamentary "Al-Bana" bloc, Governor of Basra, Asaad Al-Eidani, to head the government, saying that he was ready to submit his resignation to Parliament.
In an angry statement, the Construction Alliance attacked the President of the Republic for rejecting his candidate Al-Aidani and accused him of "resorting to the policy of killing time and sending messages to this party and that" calling "the House of Representatives to take legal measures against the President of the Republic to swear to the right and violate the constitution" in reference to his dismissal.

Parliament presidency responds to Barham: If you do not withdraw your message, Al-Halbousi will be President of the Republic after a week

Baghdad / Obelisk: First Deputy Speaker of Parliament, Bashir Haddad, said on Friday, December 27, 2019, that if the President of the Republic, Barham Salih, does not withdraw his message to the parliament within a week, it will be considered a "resignation."

Haddad said in a statement to Kurdish media, followed by the "obelisk", that "if the President of the Republic does not withdraw his message within a week, it will be considered a resignation, and in this case, according to the constitution, his deputy should succeed him."

He continued, "Given that there is no vice president, the Iraqi constitution requires that the speaker of parliament assume the position and that a president be appointed within 30 days."

He stressed the need for the Federal Court to issue a clarification that President Barham Saleh's message is ready for resignation and not clear resignation, as he put it.

And legal expert, Ali Al-Tamimi, said in a statement to Al-Masala, today, that "Saleh will be during the period of 7 days, with all his powers, and he may withdraw from the resignation, and it is not necessary to vote in Parliament."

He stressed, "After the lapse of seven days, the resignation will take effect and the vice president will replace the resigned president, for a period of 30 days, during which a new president will be elected."

The Kurdish lawmaker, Hoshyar Abdullah, said that "the one who was presented to him by Barham Salih was (reading), in which he expressed his willingness to resign, and he never sent his resignation to Parliament as promoted in the media, and there is a big difference between the term (resignation) and (readiness to resign)" .

The Media and Communications Authority responds to the demonstrators' demands: to cancel the shipping card tax

Baghdad / Obelisk: The Media and Communications Commission submitted an official request to the government and the House of Representatives, requesting the cancellation of the tax on the 20 percent mobilization card, in response to the demands of the demonstrators.

The authority says in its document, that the improvement in global oil marketing prices can be an alternative to collecting these amounts from citizens, noting that it "weighs on their shoulders, as well as it drove many investors to enter the Iraqi market, as well as negatively affected sales due to high prices of cards." .

The protest yards, among their slogans, are demanding the cancellation of the tax that was imposed, years ago, on the shipping cards for communications and Internet services.

Recall that the previous government imposed sales tax in the year 2015 to boost public treasury imports when oil prices fell globally, and the House of Representatives approved it, according to the Federal Budget Law of 2015, and this has continued successively until now.

Al-Sadr changes his stance towards the three candidates and directs the "other" to the opposition

 12/27/2019 00:00:53

Shafaq News / "Saleh Muhammad al-Iraqi", a mouthpiece of the Sadrist movement, Muqtada al-Sadr, has rejected the names of three candidates who had proposed them yesterday that they are receiving the satisfaction of the protest squares.
On Thursday, Shiite cleric Moqtada al-Sadr proposed three candidates for the post of Iraqi prime minister to succeed resigned Adel Abdul-Mahdi, for the first time since the outbreak of the protests calling for the fall of the regime on the first of last October.
Saleh Muhammad al-Iraqi, close to al-Sadr, said on his Facebook page that the three candidates are Mustafa al-Kazimi, the director of the intelligence service, the former head of the Integrity Commission, Rahim al-Aqili, and the current parliament member, Faeq Sheikh Ali.
However, he published a new position Friday morning, "Since I did not receive from the demonstrators the answer to the last post, I will consider it a rejection by their candidates."
"And the brothers in all walks should not adopt any candidate, not at this time or later, but rather to take the popular (opposition) constructive approach from within the parliament dome until God permits ... and thank them."
Al-Iraqi’s comment came shortly after the President of the Republic, Barham Salih, waved to resign and refused to nominate Asaad al-Idani to the post of prime minister.

Al-Iraqi concluded his Facebook post by thanking Barham Salih for his refusal to "the candidates the people reject."

And Iraqi President Barham Salih refused on Thursday to name Al-Aidani, the candidate of the Iranian-backed parliamentary building bloc for prime minister, saying he preferred to resign instead of appointing a person in this position, which was rejected by protesters.

Information / Baghdad

On Thursday, al-Hikmah MP, Ali al-Aboudi, stated that those who violated the constitution were the ones who violated it, adding that the Federal Court did not bring anything new regarding the largest bloc.

Al-Aboudi said in a televised statement to his follower, "Al-Maalouma", that "the president's threat to resign has held the political scene."

He added, "The dispersion of the Shiite house made it a throwing ball between the presidencies," noting that "the compass was lost between powers and distorting the face of the regime."

And that "the Federal Court did not bring anything new regarding the interpretation of the largest bloc," stressing the need to take into account reference warnings.

He affirmed, "Consensus is stealing people's voices, and it is a bad custom, and that those who trust in the constitution are those who violated it." 25 n ended

Yep that’s what happens when there’s no real leaders in a society, total chaos. With the rampant corruption in the GOI I’m surprised that the ayatollah of Iran hasn’t just sent someone over to be the PM no questions asked.

Now we have a new twist to the saga, the president submitting a threat to resign. If it wasn’t a cluster enough trying to find an honest person in Iraq to be PM he throws something else for the thieves to debate on.
