{Politics: Al Furat News} The Federal Supreme Court issued a state order today, Wednesday, that included stopping the implementation of some articles of the Financial Budget Law.
 

The state order was prolonged, according to a court statement, of which {Al Furat News} received a copy: “Article ((28/ Fourth: A-B), (57/ First-C), (65/ Second), (70/ Second), and (71) And (75) of Law No. (13) for the year 2023 (the federal general budget of the Republic of Iraq for the fiscal years (2023-2024-2025) until a decision is made on the constitutional case filed before this court to challenge its constitutionality, registered in the number (153/federal/2023).

The highest judicial authority in Iraq issues a state order regarding articles of the budget law

Shafaq News/ Today, Wednesday, the Supreme Federal Court (the highest judicial authority in Iraq) issued a state order regarding some articles of the country's tripartite financial budget law.

 

The state order included suspending the implementation of the following articles (Article 28 / Fourth: A - B), (57 / First - C), (65 / Second), (70 / Second), (71) and (75) of Law No. ( 13) for the year 2023 (the federal general budget of the Republic of Iraq for the fiscal years (2023 – 2024 – 2025) until a decision is made on the constitutional case filed before this court to challenge its constitutionality, registered in the number (153 / federal / 2023).

 

 

Prime Minister Muhammad Shia al-Sudani had requested the issuance of a state order against Parliament Speaker Muhammad al-Halbousi regarding the above articles, according to the statement issued by the Federal Court.

 

Sabhan Al-Mulla Jiyad, Advisor to the Prime Minister for Political Affairs, suggested last June that the government would challenge some of the budget articles.

 

And the Iraqi parliament voted, at dawn today, Monday, June 12, on the federal budget law for the years 2023, 2024, 2025, after discussions that lasted for five days.

 

The value of the current year budget is 197 trillion and 828 billion Iraqi dinars (about 152.2 billion dollars), with a total deficit of 63 trillion dinars (48.3 billion dollars), while the items of the 2023 and 2024 budgets have not been published.

"None of these articles are related to the Kurdistan Region's share. Mohammed Shia Sudani should have appealed against the article that required 17,000 teachers in Kirkuk and the separatist areas to be paid by the federal government because it was on his government's agenda," he said. "But he was removed by a majority in parliament."

 

On November 3, Iraqi Prime Minister Mohammed Shia Sudani filed a complaint against 12 articles of the budget law, saying parliament amended these articles in violation of the constitution.

The Federal Supreme Court issued, yesterday, Wednesday, a state order to stop six articles in the budget law, one of which deducts percentages from the salaries of state employees, while the other grants financial powers, while the Parliamentary Finance Committee suggested that budget funds be released on July 18.


And the court said, in a statement: It “issued a state order number (153 / federal / state order / 2023) on 7/12/2023 that included stopping the implementation of several articles until the constitutional case filed before this court to challenge its constitutionality registered in the number (153 / federal /) is decided. 2023).


 According to the statement, the federation challenged Article (28/ Fourth: A-B), which obliges the Ministry of Finance to collect one percent of the total salary of state employees, except for the Ministry of Interior, to be placed in the Martyrs’ Fund of the Martyrs Foundation.


 And Article (57/First-C) pertaining to the deduction of one percent per thousand of the total salary of military and civilian employees of the Ministry of Interior in favor of a newly established fund in the ministry called the “Internal Security Forces Development and support Fund.”


 And Article (65/Second), which stipulates that “university councils may contract with the private sector and hold participation in the field of building hospitals, investment laboratories, scientific productive factories, and agricultural and animal investments in a way that serves primary and higher studies, scientific research, and society.”


 And Article (70/Second) related to adding additional allocations to the completed workloads for the governorates within the regions development plan and disbursed for the period from January 1, 2023 to June 1, 2023. And Article (71) related to obliging the government to end the management of all
 institutions by proxy no later than November 30, 2023. .


 And Article (75), which stipulates the adoption of the date 12/31/2019 instead of 10/2/2019 by Cabinet Resolution 315 of 2019, which is related to contract employees.


For its part, the Parliamentary Finance Committee considered the delay in launching the budget "normal", and the Ministry of Finance may launch work on the budget after July 18, calling on the government to end the electricity file by investing in natural gas.


A member of the Finance Committee, Jamal Cougar, told Al-Sabah: “Work on the budget will start after the 18th of this month, and the budget may be launched, and then the Finance Committee will start its work by following up on the disbursement process.”


He added, "The government was appealed by 12 paragraphs of the budget, and this is a natural matter and within its powers, and the matter now remains up to the Federal Court to consider appeals and submit a ruling," noting that "the Finance Committee expected that some of the budget paragraphs would be appealed by the government, which was confirmed by the Minister of Finance." Parliamentary Finance: Provincial allocations and development funds will be monitored by the concerned authorities

The Parliamentary Finance Committee confirmed that the governorate allocations and development funds included in the General Budget Law will be monitored by the concerned authorities for their proper implementation.
Committee member Mueen Al-Kadhimi said in a press statement that the details of the budget approved by Parliament are clear to the government, the House of Representatives and the people, so following up on the implementation of its paragraphs and articles is the duty of everyone.
He added that the House of Representatives, the Federal Audit Bureau and the Integrity Commission will follow up the implementation of the allocations of the provinces and development funds.
He explained that the government, headed by the Federal Prime Minister, is primarily responsible for following up the implementation of the budget in the best way, especially the Development Fund and other funds and the poorest provinces or provinces affected by terrorism.
He pointed out that these allocations will be under consideration by the political forces, parliamentary blocs and specialized committees, stressing that there are no concerns at this stage with the presence of this official follow-up and monitoring.

{Local: Al Furat News} The Deputy Chairman of the Parliamentary Foreign Relations Committee, Jabbar Al-Kinani, today, Thursday, sent a letter to the Federal Supreme Court stating that the budget was manipulated.
 

Al-Kinani had sent a letter to the head of the Public Prosecution Service informing him of the existence of manipulation in the budget lists.

The Kurdistan government is appealing before the Federal Court against the budget articles related to the region

The Parliamentary Finance Committee said, on Saturday, that the Kurdistan Regional Government had filed an appeal before the Federal Supreme Court against articles related to the Kurdistan region in the 2023, 2024 and 2025 budgets.  

  

Committee member Khalil Al-Dosky stated to Kurdish media outlets affiliated with "NAS" (July 15, 2023), that "the government and the Ministry of Finance appealed against the addition of some articles."  

  

Al-Dosky added, "Most of the articles related to the Kurdistan region were rewritten in an unconstitutional, illegal, anti-Kurdistan way and have political influences, so the Kurdistan Regional Government appealed against the articles related to the Kurdistan region in the budget law."  

  

He continued, "Articles 11, 12 and 13 have been appealed by the Kurdistan Regional Government to the Federal Court."  

  

The member of the Finance Committee denied that the appeal affected the sending of the share of the Kurdistan region, attributing that "because the appeal did not include the request to issue a state order to stop the materials."

Nuri added, "This was the first batch of appeals, and we expect that there will be other appeals by the government for a set of other materials that have been added," indicating that his committee "is awaiting instructions for implementing the budget, after issuing a state order with a group of materials from the Federal Court to stop the implementation of these articles." ".

Parliamentary Finance: A committee in the Council of Ministers working on the salary scale
  
{Al-Furat News Local} Member of the Parliamentary Finance Committee, Muhammad Nuri, confirmed today, Monday, the formation of a committee in the Council of Ministers to work on the salary scale.

Nuri told {Euphrates News} agency, "The salary scale law is very important and concerns a large and important segment of employees with limited incomes."


He added, "The decision needs actual financial coverage to be worked on and added by the Finance Committee, and a committee was formed in the Council of Ministers to work on the salary scale, to determine appropriate financial allocations."


Nuri stressed that "its approval requires another set of governmental and financial decisions for the purpose of its implementation."

 

The past months witnessed hundreds of state employees demonstrating in the capital, Baghdad, and in a number of the country's governorates, demanding an adjustment to the salary scale due to the high prices of commodities in the markets.


The Iraqi parliament intends to legislate a number of "important" laws, including the new salary scale law and the amendment of the public retirement law.
