According to the documents that "NAS" reviewed (July 3, 2023), the Prime Minister submitted an appeal to the Federal Supreme Court against a number of paragraphs of the General Budget Law.  

  

A government source said, "Al-Sudani submitted an appeal to the Federal Supreme Court with a number of paragraphs of the budget law, with a request from the court to issue a (state order) to stop the implementation of these articles after the law entered into force until the court decides to challenge the constitutionality of these articles."

A member of the Parliamentary Finance Committee, Representative Mustafa Sanad, announced today, Monday, that Prime Minister Muhammad Shia’a al-Sudani had challenged an article in the budget that addresses the problems of the procedure and contracts.

Shafaq News/ The Parliamentary Finance Committee commented, today, Monday, on the submission of Prime Minister, Muhammad Shia'a Al-Sudani, to the Federal Supreme Court, an appeal against a number of paragraphs of the General Budget Law.

 

Committee member, Representative Jamal Cougar told Shafaq News agency, "It was expected that the Prime Minister, Muhammad Shia'a al-Sudani, would file an appeal with the Federal Supreme Court with a number of paragraphs of the budget law, especially since the Minister of Finance and al-Sudani told parliament before voting on the law that the government would appeal to any paragraph It affects the government program and has a financial side.”

 

And Cougar indicated that "the House of Representatives, by amending some paragraphs of the budget law, added some paragraphs that have a financial side, despite informing the Minister of Finance and the Sudanese, and this appeal was very expected."

 Erbil (Kurdistan 24) - The Federal Supreme Court informed the House of Representatives of the Prime Minister's lawsuit over articles from the general budget.

Where the Prime Minister challenged the constitutionality of 12 articles of the general budget law for the years 2023, 2024 and 2025 and calls on the Federal Supreme Court to issue a state order to stop the implementation of the contested articles until a ruling is made that they are unconstitutional.

Prime Minister Muhammad Shi'a al-Sudani submitted an appeal to the Federal Supreme Court against a number of articles of the General Budget Law, calling for the issuance of a "state order" to stop the implementation of these articles, while the court gave the Presidency of Parliament a period of 15 days in order to respond to the appeal petition. A government source said: "Prime Minister Muhammad Shia' al-Sudani submitted an appeal to the Federal Supreme Court with a number of articles of the budget law." constitutionality.”
According to an official document, the Federal Court notified the Presidency of Parliament of the appeal petition submitted by the Prime Minister regarding the budget, and the court demanded Parliament to respond to the lawsuit within a period not exceeding 15 days from the date of receiving the notification in accordance with the provisions of Article 21 / second of the Court’s internal system No. 1 of 2022.
Earlier, the House of Representatives approved the draft federal budget law for the fiscal years 2023-2024-2025, and the value of the current year’s budget is 197 trillion and 828 billion dinars (about 152.2 billion dollars), with a total deficit of 63 trillion dinars (48.3 billion dollars).
And Al-Sudani had stated earlier that "the government will work to review the items that have been amended in the budget and study the extent of their conformity with the government's vision and objectives approved in the ministerial curriculum approved by Parliament."
Commenting on the Prime Minister's submission of an appeal to the Federal Supreme Court with a number of articles of the General Budget Law, a member of the Parliamentary Finance Committee, Representative Jamal Cougar, said: "It was expected that the Prime Minister would submit an appeal to the Federal Supreme Court with a number of paragraphs of the Budget Law, especially since the Minister of Finance Al-Sudani told parliament, before voting on the law, that the government will challenge any paragraph affecting the government program that has a financial side.
And Cougar indicated that "the House of Representatives, by amending some paragraphs of the budget law, added some paragraphs that have a financial side, despite informing the Minister of Finance and the Sudanese, and for this reason the appeal was very expected."
And the Minister of Finance, Taif Sami, stated, in a statement in early June, that “what the government included in terms of texts and allocations (in the budget) was according to the study and needs of the ministries and governorates, and it meets all requirements according to the government’s vision in its government program,” stressing that “any change will hinder The spending operations drawn up by the government to meet all needs,” and warned that the ministry “will challenge the budget if it is approved and contains a change to the paragraphs that the government included in the budget.” In addition, a delegation from the Ministry of Finance of the Kurdistan Region will visit Baghdad in the coming days, to complete the discussions on sending The Kurdistan region's share of the budget.

A Kurdish deputy warns of a "dangerous bomb" in the budget law

Shafaq News/ Today, Monday, a Kurdish deputy in the Iraqi Parliament called on the Kurdistan Regional Government to challenge what he called a "dangerous bomb" in the tripartite general budget law, as it makes the fate of the region's share in the hands of the Shiite majority in the Iraqi Parliament.

 

The representative of the "Kurdistan Justice Group", Soran Omar, wrote on his Facebook page, a post entitled "The dangerous bomb has become a law", seen by Shafaq News Agency, in which he stated that the Kurdistan Regional Government should file an appeal with the Federal Court. Concerning Article 13, the seventh paragraph of the General Budget Law for the years 2023-2024-2025, which talks about that in the event of a dispute over rights and obligations between the regional government and the federal government, a joint committee is formed from both sides that seeks to resolve the differences within a period of 30 days, and if it does not reach a solution, the Council Representatives are the ones who issue the appropriate decision in this regard.

 

Omar added that this is the dangerous bomb for the region's share and has become a law, because many problems and disagreements arise between the visions of the region and Baghdad, and it is better for the Iraqi prime minister to issue the decisive decision in this regard, and not the Iraqi parliament.

 

 Omar confirmed that the coordination framework is the one who changed this paragraph in the text of the government bill from the prime minister to the parliament, explaining that instead of the prime minister solving the problems, they will be transferred to the parliament, and there the Shiite majority will issue decisions regarding the region’s share in the region. In the event of a dispute, the decision will inevitably be to suspend the region's share of the budget.

 

Omar called on the regional government to expedite the appeal of this paragraph in the general budget.

After the approval of the federal general budget law, Iraq will settle debts with the region and the steps related to financial issues included in the budget. The official spokeswoman for the National Union bloc says: "The implementation of the budget will reflect positively on the Iraqi people, and until it is implemented, Baghdad's treatment with the region will be outside the framework of the new law."


Susan Mansour, the official spokeswoman for the Patriotic Union of Kurdistan bloc in the House of Representatives, said in a statement to (PUKMEDIA): "Although the Prime Minister challenged some articles of the general budget, the procedures of the budget law have ended and will enter into force within a short period."

The official spokeswoman for the National Union bloc in Parliament confirms: "The Iraqi people need to implement the general budget, and the budget law will open the door to services for citizens, in addition to creating job opportunities and reducing unemployment, and this is what led the Iraqi people to look at the budget and its implementation with an eye of optimism."

Parliamentary planning constitutes a committee to monitor the implementation of the general budget

The Parliamentary Strategic Planning Committee confirmed, on Saturday, the formation of a committee to monitor the implementation of the provisions of the federal general budget and the government program during the next six months.

The deputy head of the committee, MP Muhammad Karim, said in a press interview, "A directive was issued by the committee's presidency to monitor and evaluate the implementation of the ministerial program directly and continuously by following up on the implementation and disbursement of the federal budget to avoid wasting it."

Karim added, "Monitoring and evaluating the ministerial program and the general budget is the responsibility of the Strategic Planning and Federal Service Committee during the coming period."

He pointed out that "the Parliamentary Integrity Committee and the Bureau of Financial Supervision are working on sectoral follow-up by distributing committees to every ministry or government institution that is not linked to a ministry."

Karim pointed out that "the Planning Committee is directly responsible for monitoring and evaluating the ministerial curriculum," noting that "the reports of the sectoral authorities are submitted to the committee for the purpose of evaluation."

Parliamentarian: We are following the issue of accelerating the implementation of the budget instructions
  
{Politics: Al-Furat News} The deputy of the State of Law Coalition, Jawad Al-Ghazali, confirmed that Parliament will follow up on the issue of accelerating the implementation of the budget instructions.
 

Al-Ghazali told Al-Furat News that: "Everyone is waiting for the implementation of the budget instructions to start providing services to the citizens because they suffer from a severe shortage, especially in the housing and educational fields." 


Al-Ghazali pointed out, "It has now left the House of Representatives and entered the Government. On our part, as deputies and the legislative authority, we are following the matter of speeding up the implementation of its instructions."


And the Parliamentary Finance Committee announced that, with the start of the legislative term, it will form sub-committees to monitor the provisions of the implementation of the budget law, and activate the oversight role on certain ministries without other ministries, according to the committee’s plan.


Today, Sunday, the Presidency of the House of Representatives set a date for the start of the second legislative term for the second legislative year, and the first session of the second legislative term will be held next Saturday, corresponding to 7/15/2023.

The Federal Court considers the appeals submitted by the Prime Minister against the budget law

It is scheduled that the Federal Court will consider the appeals submitted by the Federal Prime Minister, Mohamed Shia Al-Sudani, against some articles of the Federal Budget Law.


Al-Sudani submitted an appeal to the Federal Supreme Court against a number of paragraphs of the budget law, with a request to the court to issue a (state order) to stop the implementation of these articles after the law entered into force until the court decided to challenge the constitutionality of those articles.

The appeal includes some articles of the budget.


The representative of the Patriotic Union of Kurdistan bloc, Karwan Yarouis, said during a statement to the official website of the Patriotic Union of Kurdistan, PUKMEDIA: The federal prime minister appealed to some articles of the Federal Budget Law.


He added: The Prime Minister did not appeal the entire budget law, but he requested the issuance of a state order to stop the implementation of 12 articles in the budget law until it is resolved by the Federal Court.

Appeals will not stop the implementation of the budget MP Karwan Yarois says: These appeals will not stop the implementation of the budget law, but will be implemented and the Federal Ministry of Finance will issue the necessary instructions to implement the budget.


He added: The Federal Court will discuss the contested articles only and will resolve them in accordance with the lawsuit submitted by the federal government.

The court will decide whether to accept or reject the appeals.


Legal expert Ali Al-Tamimi says during an exclusive statement to PUKMEDIA: The Federal Court will consider the lawsuit filed by the federal government against some articles of the budget law.
He added, "The court will decide to consider or reject the government's lawsuit as it deems appropriate, because the articles, as stated in the government's lawsuit, are contrary to the constitution."


Legal expert Ali Al-Tamimi says: The Federal Court can issue a state order to stop the implementation of the articles challenged by the federal government.


He added: The court can also delete some expressions and texts that were mentioned in the budget law and violate the constitution, and it will decide what is most appropriate to deal with the articles challenged by the federal government.

The contested articles
According to the lawsuit filed by the Undersecretary of the Prime Minister before the Federal Supreme Court, the contested articles are:


* Article (2/First/8/C6) related to expenses, disability, and loans.


* The phrase (at his request) mentioned in Article (16 second) related to appointment to leadership positions.


* Article (20 / Sixth) related to tax provisions.


* Article (28 / Fourth / A, B) related to obligating the Ministry of Finance to collect a percentage of the salaries for the Martyrs’ Fund.


* Article (57 / first / c) related to the establishment of a fund for development and support of the internal security forces.


* Article (62/fourth) related to the budget of the House of Representatives.


* Article (63/Third) related to the budget of the judiciary.


* Article (65/Second) related to the contracting of university councils with the private sector.


* Article (70/Second) related to adding financial allocations within the regions development plan.


* Article (71) related to ending the management of state institutions by proxy.


* Article (72) related to the collection of debts by the enforcement departments.
* Article (75) related to changing the approval of a date without another date.



Violating the principles and provisions of the constitution.


The federal government asserts in the petition: "The House of Representatives violated the principles and provisions of Article (62) of the constitution by introducing many financial obligations to the government and approving many provisions that contradict the general policy of the state and the principle of separation of powers."


The lawsuit filed by Al-Sudani indicated that “there are radical changes in a number of articles in the draft law that the government submitted to the House of Representatives,” stressing that “these changes constitute a constitutional violation in both formal and substantive terms and affect the functions or independence of the judiciary.”


The Prime Minister, through his representative, the legal advisor, Qassem Suhaib Al-Sharifi, called on the Federal Court to issue a state order to suspend the contested articles until the lawsuit is resolved and the ruling is unconstitutional and invalidated.

Iraqi courts are as big a joke as the CBI and the government, and anything they say can be ignored...just like the CBI ignored them back in 2013? when they lost to Warka bank in the courts and were ordered to "compensate and rehabilitate Warka...and 10 years later they've done nothing and warka is still closed...though the CBI did allow them to participate in the currency auctions though I don't know if warka still is or not.

 

Iraq is corrupt to the core! and can only be trusted to mess things up but that's just my opinion and it don't mean squat! lol

The Federal Court issues a state order to stop some articles of the budget law

On Wednesday, the Federal Supreme Court issued a state order to suspend some articles of the budget law.  

 

The court said in a statement, which “NAS” received a copy of, (July 12, 2023), that it “issued a state order number (153 / federal / state order / 2023) on 7/12/2023 that included stopping the implementation of the following articles: Article ((28/ Fourth: A - B) and (57 / First - C), (65 / Second), (70 / Second), (71) and (75) of Law No. (13) for the year 2023 (the Federal General Budget of the Republic of Iraq for the fiscal years (2023 - 2024 - 2025) until the constitutional lawsuit filed before this court to challenge its constitutionality, registered in the number (153 / Federal / 2023) is decided.
