If the legislator does not consider the resignation as a personal right of the Prime Minister, and it was commented on the approval of other parties - Parliament or the President of the Republic - and we asked you, gentlemen, for advice and drafting this provision in a constitutional text, then what would you give up, and what would you write in the drafting?
Do you think that this ruling must be mentioned explicitly, which is that the Prime Minister must submit his resignation to the concerned party - Parliament or the President of the Republic - within a specified period, then mention the implications of accepting or rejecting the resignation?

2 - The bulk of the opinion that went to say - that it is necessary - to submit the resignation of the Prime Minister to Parliament or the President of the Republic lies in two arguments; the first of which is to protest the absence of the constitutional text and its silence, and the other is the analogy with other branches of law, namely the civil service law And the administrative law, and it was evident by the extensive presentation of the fall of these two arguments, their inability to withstand constitutional jurisprudence and experiences in parliamentary systems.
 
3 - Based on the multiple evidence that we gathered, the resignation of the Prime Minister under the provisions of the Iraqi constitution and general rules in parliamentary systems is a purely personal right of the Prime Minister, and a political behavior that can be invoked in order to achieve some political and popular goals; and no one can deny this right, or cover it This behavior.
 
4 - This resignation is considered effective as soon as it is announced, without being commented on by a condition, that it depends on a specific procedure, or that it is accompanied by the approval of any body, whether legislative or executive.
 
5 - The fact that resignation is a personal right of the Prime Minister does not mean that he is not notified of other parties with it, whether it is the House of Representatives or the President of the Republic, it is an option, if he wants to, and if he does not, then that we have seen in this regard based on that resignation is a right And it is in the circle of permissibility, and it is not obligatory or obligatory for any party to agree to it, but this right does not prevent the Prime Minister from notifying other parties about it, especially the House of Representatives and the President of the Republic, but rather it is the most appropriate in my modest estimate.
