Shafaq News / On Thursday, MP Muhammad Othman al-Khalidi called on the judiciary to accelerate the reinstatement of the provincial councils to resume their duties, considering their dissolution as a "flagrant constitutional error" committed by the Iraqi parliament in 2019.

 

Al-Khalidi told Shafaq News, "The provincial councils are independent constitutional institutions. No party has the right to interfere in its affairs, and its solution is a fatal legal error committed by the Iraqi parliament."

 

He added that "the dissolution of the provincial councils must be done through a constitutional amendment and not a parliamentary decision," stressing that "the return of the provincial councils is necessary and important to address many administrative problems and intersections in the governorates and support the executive and service authorities through their oversight role."

 

Al-Khalidi suggested that "the provincial, district and district councils will return to the exercise of their duties soon after the completion of the formation of the Federal Court in its entirety."

 

In light of the popular demonstrations in Iraq in October 2019, the Iraqi parliament voted in favor of a legal amendment that ends the work of the provincial councils that are not organized in a region and the district and sub-district councils affiliated with them, and assigns parliament members the task of monitoring the work of the governor and his deputies in each governorate separately.

 

The provincial, district and district councils submitted appeals to the Federal Court. However, decisions were postponed several times for various legal reasons, most notably the lack of a quorum of the Federal Court.

If they don't all things might possibly revert back to old ways of business as usual and we may see any TRUE progress put on the back burner while the criminal element AGAIN has a field day.

In a related development, the spokesman for the Independent Electoral Commission in the Kurdistan Region, Shirwan Mirza, announced that the commission at the present time has obstacles and problems and the legal period for them has expired, and for this we asked the Kurdistan Parliament to solve these obstacles, then extend the legal period for them or start another council of commissioners to work.

Mirza added that without resolving these obstacles, they cannot do any work in the Kurdistan Region for the elections scheduled to take place in the future.

, a member of the Kurdistan Regional Parliament for the National Union, Abbas Fattah, stressed the importance of making a change in the heads of the bodies and institutions of the Kurdistan Parliament, indicating that the end of the legal period of these institutions affects the activities and long-term plans.
According to his party's media, Fattah said, "Despite the end of the legal period for the heads of bodies and institutions of the Kurdistan Parliament, the political parties have not yet identified their candidates for those positions, and this means that the reason is the political parties, and at any time they determine their candidates and bring them to the Kurdistan Parliament, it is Voting will be made on changes in those institutions and bodies. "
He added, "What has been worked on so far and a change in a short period of time is the head of the Human Rights Commission, but for other bodies and institutions, especially the Integrity Commission and the Independent Electoral Commission in the Kurdistan region, they have remained as they are, and Parliament is waiting to determine the parties’ candidates.
Fattah pointed out that "the end of the legal term for the heads of bodies and institutions affiliated with the Kurdistan Parliament affects the work and activities of these institutions and they are not able to set a work program and long-term plans for them as required." Ended 29 / h
