Still looking like a window from Mid-April to Early May on this timeline for a HCL to be signed into effect. The preliminary agreements will come first, signified by oil flowing once again through Turkey with money moving along the proper channels. If this money can be traced and verified as legitimate, they will sign long term laws (HCL). With an HCL to distribute that money to projects to help improve the quality of life for Iraqis we would be on track for positive progress. 
 

Just my two cents, unverified thoughts in my mind.

The correspondent of (Baghdad Today) reported the start of the special meeting between the Kurdish delegation and the delegation of the Federal Ministry of Oil in the capital, Baghdad, on Monday.

Our correspondent said that the meeting between the delegation of the region and the federal oil has just begun to discuss the decision of the Paris court to stop exporting Kurdistan oil, and discuss its appeal.

He added that the terms of the agreement will be announced after the technical delegation reaches an agreement on how to sell oil and deposit the money.

He pointed to the formation of a four-member committee between Erbil and Baghdad, two of whom belong to the Ministry of Natural Resources in the Kurdistan Government, and the other two members from the Iraqi Ministry of Oil.

This committee supervises, according to our correspondent, the export and marketing of the region's oil, under the authority of Kurdistan, and the obligation to open a bank account with the Central Bank of Iraq that is special for the region's oil revenues, provided that one person is specified to withdraw funds.

Kurdistan Reaches Initial Agreement With Baghdad To Restart Oil Exports

Oil from the Kurdistan Regional Government in northern Iraq may start flowing as soon as this week after KRG and federal government officials reached a preliminary agreement to restart exports, which have been cut off since March 25th. 

"Following several meetings between the KRG and federal government, an initial agreement has been reached to resume oil exports jointly through Ceyhan [in Turkey] this week," Lawk Ghafuri, head of foreign media affairs for the KRG, wrote in a Twitter post.

Ghafuri said the agreement would remain in effect until the Iraqi Parliament approves the new oil and gas law governing oil exports and revenue from the Kurdistan Region of Iraq. However, Turkey, which shut off the export pipeline immediately following the court ruling, would also have to approve the resumption deal.

On March 25th, the International Chamber of Commerce ruled in favor of Iraq against Turkey in a dispute over crude flows from Kurdistan, leading to Turkey's shutdown of the pipeline that runs from the Kurdish Fish-Khabur border to the Turkish port of Ceyhan. Iraq had argued that Turkey shouldn't allow Kurdish oil exports via the Iraq-Turkey pipeline and Ceyhan without approval from the federal government of Iraq between 2014 and 2018. 

While Baghdad and Erbil have been battling for years over the KRG's unilateral crude oil exports, which bypass the Iraqi federal government's oil marketer (SOMO), the situation intensified significantly a year ago, when the Iraqi Supreme Court ruling that a 2007 oil and gas law regulating the KRG's industry was unconstitutional. Since the election of a new Iraqi government in the fall, and until last week, there had been indications that Baghdad was easing up on its legal battle with the KRG. 

Tensions heightened in February last year after the Iraqi Supreme Court made a landmark decision by ruling that a 2007 oil and gas law regulating the KRG's oil industry was unconstitutional.

Mohammed Shia al-Sudani, who became Iraq's prime minister in October last year, has been working to quell tensions since taking office.

 

While this week now looks more promising for a resumption of exports, the shutdown of the Ceyhan pipeline last week prompted some oil companies to start shutting down production due to a lack of storage capacity. Norway-based DNO ASA on Wednesday said it had started an orderly shutdown of oilfields while exports remain suspended.  

The international ruling takes some 450,000 barrels per day (0.5% of the global oil supply) off the market. Last week, those barrels drove a crude oil price rally. 

An initial agreement does not mean there is any certainty that KRG exports will resume this week. There have been some indications that Turkey is hoping to reverse this leverage to pursue its own claims in the international court, which would hold up Ankara's approval of resumption.

The head of the Kurdistan Regional Government representation in Baghdad, Faris Issa, told Rudaw Media Network on Monday (April 3, 2023) that "the delegation of the Kurdistan Region and the Ministry of Oil meet with the companies buying the Kurdistan Region's oil."

He added that "the delegation of the Kurdistan Region and SUMO are also scheduled to meet with the companies purchasing the Kurdistan Region's oil after this meeting."

The Iraqi Ministry of Oil announced in a statement, Sunday (April 2, 2023), that the government and the ministry are "keen to accelerate the resumption of oil exports to the region's oil through the Turkish Ceyhan port and work to bring views closer to serve the public interest."

She expressed hope that "an agreement will be reached to resume oil exports soon," "in light of the positive atmosphere and bilateral understandings."

The Iraqi Ministry of Oil confirmed the announcement of the resumption of exports of the Kurdistan Region at the time, "once a final agreement is reached in accordance with the new understandings."

She pointed out that she took into account the flexibility required to move forward towards achieving the goal of resuming exports first, indicating that she discussed other outstanding technical issues between the center and the Kurdistan Region, according to the new data after the decision of the International Court in France.

The Iraqi Ministry of Oil stressed its awareness of "the importance of revenues derived from the resumption of oil exports to the Kurdistan Region, in supplementing the federal budget according to the agreed quantities."

Iraqi government spokesman Bassem al-Awadi told Rudaw Media Network earlier that "the atmosphere of the meetings between the Kurdistan Regional Government and the Ministry of Oil is positive."

It is noteworthy that the National Oil Company (SOMO) announced reaching an agreement with the Kurdistan Region on many points, as SOMO told Rudaw Media Network, on Sunday (April 2, 2023), that "we will announce the agreement with the Kurdistan Region soon."

According to information obtained by Rudaw Media Network from the Iraqi Ministry of Oil, oil exports from the Kurdistan Region will resume soon.

According to information obtained by Rudaw Network, on Saturday (April 1, 2023), a joint room will be formed between the Ministry of Natural Resources of the Kurdistan Region and the National Oil Marketing Company (SOMO), which will take over the tasks of selling the Kurdistan Region's oil.

Erbil, Baghdad Working to Finalize Details of Deal to Resume Crude Exports

 

ERBIL — The Kurdistan Regional Government's (KRG) delegation is in a meeting with Iraq's ministry of oil and state-owned oil marketing company SOMO to finalize the specifics of a "provisional agreement" to resume KRG's crude exports after a court ruling halted them last week.

Kurdistan Region's delegation and SOMO are set to meet with oil firms operating in the Region later today to review details of existing contracts before a final deal is approved and announced. Reports indicate that the deal is likely to be announced within the next two days, after which Baghdad will officially request from Ankara to resume pipeline flows.

A solution to this latest hurdle in relations between Erbil and Baghdad is expected to enhance cooperation between the two sides, and create a more positive environment to resolve other lingering problems. The ministry of oil in Baghdad in a statement yesterday expressed goodwill to expedite the resumption of Erbil's oil exports for the common good of the country.

KRG crude exports were suspended last week after Iraq won an arbitration court case in France, which ruled that Turkey had breached a joint pipeline agreement (1973) with Baghdad by pumping Erbil's oil at the country's Ceyhan port on the Mediterranean sea. The lawsuit was first filed in 2014, but protracted due to the country's war on the Islamic State (IS) and political infighting. The verdict rules that the KRG cannot export its crude without consent from the federal government in Baghdad.

The scope of the lawsuit was pipeline agreement violations from 2014-2018, and another arbitration case on pipeline violations from 2018 onwards remains pending, according to Reuters.

The KRG exported some 450,000 barrels of oil per day before the French court ruling, which accounted for 0.5 percent of global oil supplies. Hallting these crude exports has therefore caused an uptick in global oil prices recently, according to Reuters. The crude halt has been affecting life for ordinary citizens in the Kurdistan Region, including for electricity supplies, which are now being cut due to many oil companies shutting down production on the fields they were operating before.

Oil firms operating in the Kurdistan Region have either ceased production or decreased output, diverting it to storage tanks. The KRG’s economy is heavily reliant on oil revenues, with some revenues being generated internally at border crossing customs points. Continued inability to sell its crude is expected to severely impact Kurdistan Region's economy and the lives of ordinary citizens.

Erbil and Baghdad are also collaborating on drafting a long overdue hydrocarbons law, which along with a potential deal on resuming Erbil's crude exports will help the two handle their crude exports without persistent need for crisis management.

The Kurdistan Democratic Party (KDP) on Monday outlined its position on the central government's demand for the control of the national company SOMO over oil sales in the Kurdistan region, while confirming the existence of a political agreement between Baghdad and Erbil on the oil and gas file.

The party's leader, Wafa Mohammed, said in an interview with the Al-Maalouma news agency that "there is a political agreement between the region and Baghdad before the issuance of the decision of the International Court of Arbitration, which approved the suspension of oil exports from Kurdistan to Turkey.”

He added that "Baghdad's demand is that SOMO be the only company controlling the sale of oil in the Kurdistan region," noting that "oil imports are at a special expense and monitored by the federal government."

The leader of Barzani's party explained that "the Kurdistan government is demanding the appointment of a vice president of SOMO by the region," pointing out that "talks between Baghdad and Erbil are still continuing so far."

Regarding the Democratic Party's position on the central government's proposal, Mohammed said that his party "agrees with Baghdad's proposal, as it will help send the budget quota to the region, which is set at 12.67."

The International Court of Arbitration had earlier approved the suspension of the export of oil from the Kurdistan region to the State of Turkey through the port of Ceyhan, which reinforced Baghdad's oil decision to resort to legitimate ways to export oil imports.

The Prime Minister, Mohammed Shia Al-Sudanese, had set a percentage of 12.67 percent of the 2023 budget for the Kurdistan Region.

Iraqi Prime Minister Mohammed Shia al-Sudani confirmed on Monday that the Kurdistan Region was forced to contract with oil companies during 2014 due to the lack of a budget, pointing out that these contracts contain "injustice and blackmail."

 

 

Al-Sudani told the "interview" program on the Qatari channel Al-Jazeera that his government "has reached an agreement with Erbil and it has been included in the budget law," explaining that "the oil and gas law will regulate the relationship with Erbil, as well as many provinces, and will be enacted within 6 months or more."

He pointed out that "some oil companies blackmailed the Kurdistan Region," considering that "the region was forced to go to contracts in which there is a kind of acquiescence and clear injustice, and reached the point of blackmail, especially in the period of the war on ISIS in 2014 and the suspension of the budget, which forced things to go along."

He added that "the budget will end these problems," stressing that "the tripartite budget will prevent the bargaining and blackmail that occur every year," and that his government "implemented its commitments in the government program by 31%."

The prime minister pointed out that "Iraq came out of the bottleneck and achieved a victory over terrorism, and the political process is witnessing positive constructions, but today there is a problem of unemployment, corruption and services," stressing "the need for economic reforms such as activating sectors and benefiting from natural resources."

"Iraq is not only an oil country, but it can be an agricultural and industrial country," he said, stressing that "the process is based on a new vision and philosophy, not on the vision of the socialist system."

Shafaq News / The Kurdistan Regional Government announced the imminent conclusion of an agreement on the resumption of the export of oil to the Kurdistan Region through the Turkish Ceyhan, while stressing the importance of approving the 2023 budget to activate the agreement.

Advisor to the President of the Kurdistan Regional Government, Piwar Khansi, told Shafaq News Agency that "talks between Baghdad and Erbil are taking place intensively to reach an agreement on exporting the Kurdistan Region's oil through the Turkish port of Ceyhan."

"The talks are in their final stages and there is little left to reach an agreement," he said, stressing "the need to approve the draft budget for 2023 to speed up the approval of the region's oil export, as it represents an important part of the general budget."

The adviser to the head of the regional government said that "the export of oil in the region will resume soon and that the agreement between the two governments will be concluded by the Prime Minister in the federal government and the head of the regional government Masrour Barzani, according to the current indications and data."

The Iraqi Ministry of Oil affirmed, on Sunday, the federal government's keenness to speed up the resumption of oil exports to the Kurdistan Region oil through the Turkish port of Ceyhan, and to bring views closer "to serve the public interest."

On Saturday, March 25, the Federal Ministry of Oil announced the winning of the arbitration lawsuit filed by Iraq against Turkey over the export of crude oil from the Kurdistan Region through the Turkish port of Ceyhan, while stating that it will discuss the export mechanism through the same port with the concerned authorities in the region and the authorities in Ankara, according to the new data.

Iraq halted 450,<> bpd of crude exports from the Kurdistan Region and the northern Kirkuk fields after the country won a long-running arbitration case against Turkey.

In a case dating back to 2014, Baghdad alleged that Turkey had violated a joint agreement to allow the KRG to export oil via pipeline to the Turkish port of Ceyhan.

Oh, so they are using the later time frame of 2018 - present to nullify current contracts. The understanding will be through international courts. This will allow them to align the HCL within Iraq as a priority to the current global corporate contracts as Iraq restructures through SOMO. Fascinating, we will see how this plays out.

 

Meanwhile, they will get oil flowing again through Turkey as they set the main foundation set.

Prime Minister Mohammed Shia al-Sudani announced on Tuesday the agreement to resume the export of oil in the Kurdistan region.

Al-Sudani added in a joint press conference with Kurdistan Region Prime Minister Masrour Barzani, that "the technical authorities must immediately start implementing the agreement with Erbil and find legal ways to this matter."

He considered that "the agreement confirms the serious and sincere desire of the federal government and the Kurdistan government to face all the problems and obstacles that were inherited years ago and postponed and we did not reach solutions."

He pointed out that "any delay in export clearly affects the total revenues expected in the 2023 budget, and therefore the deficit rate will rise, and this matter is very harmful to all Iraqis, but starting the implementation of this agreement will reduce the damage."

He stressed "the need for everyone to abide by this agreement," explaining that it is "a temporary agreement until reaching the approval of the budget, which takes legal status, covers all obligations and addresses all problems in this file."

He added that "this agreement will pave the way for the passage of the budget law and the texts it contained, which also set the outcome of a dialogue between the federal government and the regional government that dealt with all issues, including the oil and gas file," expressing his hope that "the House of Representatives will proceed with the legislation of the budget law as soon as possible to be an umbrella for all the file with complex details."

The prime minister went on to say: "We are waiting for a merit, which is the legislation of the oil and gas law, which will address everywhere the defect that accompanied this file since the adoption of the Iraqi constitution," adding that "there are pending files for years and now there is political will and interest for all Iraqis to proceed and address all these files in the spirit of the constitution and the public interest."
