Al-Marsoumi explained, "The case (the export of Kurdish crude) has been going on at the International Arbitration Court of the International Chamber of Commerce in Paris for nearly 9 years and has centered on Iraq's claim that Turkey violated the 1973 Pipeline Crossing Agreement by allowing crude oil exports from the Kurdish region without consent." March 25 (Reuters) - Iraq halted 450,000 barrels per day (bpd) of crude exports from the semi-autonomous Kurdistan region and northern Kirkuk fields on Saturday, an oil official told Reuters, after the country won a longstanding arbitration case against Turkey.

In a case dating from 2014, Baghdad claimed that Turkey violated a joint agreement by allowing the Kurdistan Regional Government (KRG) to export oil through a pipeline to the Turkish port of Ceyhan. Baghdad deems KRG exports as illegal.

 

"Iraq was officially informed by the International Court of Arbitration final ruling on Thursday and it was in favour of Iraq," a senior oil ministry official said.

 

Turkey informed Iraq that it will respect the arbitration ruling, a source said.

Turkish shipping officials told Iraqi employees at Turkey's Ceyhan oil export hub that no ship will be allowed to load Kurdish crude without the approval of the Iraqi government, according to a document seen by Reuters.

 

Turkey subsequently halted the pumping of Iraqi crude from the pipeline that leads to Ceyhan, a separate document seen by Reuters showed.

On Saturday, Iraq stopped pumping oil through its side of the pipeline which runs from its northern Kirkuk oil fields, one of the officials told Reuters.

Iraq had been pumping 370,000 bpd of KRG crude and 75,000 bpd of federal crude through the pipeline before it was halted, according to a source familiar with pipeline operations.

"A delegation from the oil ministry will travel to Turkey soon to meet energy officials to agree on new mechanism to export Iraq's northern crude oil in line with the arbitration ruling," a second oil ministry official said.

ERBIL, Kurdistan Region - Iraq’s Ministry of Oil on Saturday welcomed a decision from an arbitration court in Paris that ruled in Baghdad’s favour against the Kurdistan Region’s independent crude oil exports through Turkey.

“The Ministry of Oil welcomes the final verdict in favour of Iraq which was issued by the International Chamber of Commerce in Paris last Thursday, March 23, 2023,” reads the statement

The arbitration court ruled that Turkey had breached a 1973 pipeline agreement between Iraq and Turkey obliges the Turkish government to abide by instructions issued by Iraq regarding the transport of crude oil exported from Iraq. In 2014, the Kurdistan Regional Government (KRG) began using the pipeline to send its crude to Turkey’s Ceyhan port, to the ire of Baghdad.

Under the court ruling, the Iraqi government, via the State Oil Marketing Organization (SOMO), is the only party in charge of the management of export operations through Turkey’s Ceyhan port related to Iraqi oil, the ministry stated.

“The Ministry of Oil clarifies that it will discuss the mechanism of exporting Iraqi oil through Turkey’s Ceyhan port with the concerned entities in the [Kurdistan] region and the Turkish authorities… in order to guarantee the continuity of oil exports,” the ministry said.

According to a Reuters report, citing an unnamed senior Iraqi oil official, Iraq suspended exports of Kirkuk oil through the pipeline to Turkey. It also reported that Turkish authorities had informed Iraqi employees at the port that Ankara will no longer allow KRG’s crude to be loaded onto ships at Ceyhan port without permission from Baghdad. 

The KRG has not commented on the latest developments. 

The Kurdish government is heavily reliant on its revenues and an inability to sell its crude will severely impact its already struggling economy. The government has failed for years to pay its over a million civil servants on time and in full. 

Talks are ongoing between Erbil and Baghdad to draft an oil and gas law that addresses the concerns of both governments.

The oil ministry said that the court decision will not affect ties with Turkey.

In the case, which has been pending in the Paris-based court for nearly nine years, Iraq claimed that "Turkey violated the 1973 pipeline transit agreement by allowing the export of crude oil from the Kurdish region without Baghdad's consent."  

  

"Since the last tanker was loaded on Friday, there have been no reports of more crude vessels being transported from the Kurdistan region," the person familiar with the verdict said.

The Ministry of Natural Resources in the Kurdistan Regional Government announced on Saturday that the French court's decision in favor of the Iraqi government against Turkey will not hinder our relations with the Baghdad government.

 

 

The ministry said in a statement received by {Euphrates News} a copy of it, that: "In recent months, the Kurdistan Regional Government has held continuous dialogues and negotiations with the federal government, the latest of which is on the budget files, oil and gas, and the two sides have reached a preliminary agreement and good understanding under the umbrella of the constitution and the constitutional rights and entitlements of the Kurdistan region."
"The President of the Kurdistan Regional Government is in constant contact with the federal prime minister, and after his recent visit to the region, the importance of solving problems based on the constitution was stressed."
"The decision of the French court in favor of the Iraqi government against Turkey will not hinder our relations with the Baghdad government, and in this context we will visit Baghdad for dialogue and resolution of related issues," the ministry said.

Shafaq News: The Ministry of Natural Resources in the Kurdistan Regional Government commented, on Saturday, on the decision of the arbitration panel of the International Chamber of Commerce in Paris, which ruled that the Federal Ministry of Oil won a lawsuit against Turkey over the export of Kurdistan Region crude.

The ministry said in a statement received by Shafaq News Agency, "In recent months, the Kurdistan Regional Government has held continuous dialogues and negotiations with the federal government, the latest of which is on the budget files, and oil and gas. The two sides then reached a preliminary agreement and a good understanding under the umbrella of the constitution and the constitutional rights and entitlements of the Kurdistan Region."

 

 

She added that "the President of the Kurdistan Regional Government is in constant contact with the Federal Prime Minister, and after his recent visit to the Kurdistan Region, the importance of solving problems based on the constitution was stressed."

Today, Saturday, the Federal Ministry of Oil announced the winning of the arbitration lawsuit filed by Iraq against Turkey regarding the export of crude oil from the Kurdistan Region through the Turkish port of Ceyhan, while it stated that it will discuss the export mechanism through the port itself with the concerned authorities in the region and the authorities in Ankara according to the new data.

Shafaq News / The President of the Kurdistan Regional Government, Masrour Barzani, announced on Saturday, the visit of a Kurdish delegation to Baghdad.

Barzani wrote in a tweet seen by Shafaq News: "Our recent understanding with Baghdad is a good basis for resolving issues related to the court's decision today."

 

 

"A team from the Kurdistan Regional Government will visit Baghdad tomorrow to continue our talks on the basis of good faith," he said.

The Ministry of Natural Resources in the Kurdistan government confirmed today, Saturday, that the
regional government affirms its firm position not to give up the constitutional rights of the Kurdistan people.

The ministry stated in a statement, a copy of which Mawazine News received, that “the
Kurdistan Regional Government has conducted, in recent months, continuous dialogues and negotiations with the
federal government, the latest of which was on the budget and oil and gas files, stressing that” the two sides
