Iraq’s parliament took a major step towards approving its national budget after overcoming disagreements about how to manage oil revenue from the semi-autonomous Kurdistan region, which had held up passage for three days.

Despite these objections, Article 14 was passed at around midnight with the session paused immediately afterwards. Parliament is expected to reconvene on Sunday afternoon to debate dozens of other parts of the budget needing approval.

Prime Minister Mohammed Shia Al Sudani’s government introduced draft budget legislation in March, but its progress through parliament has been halting.

“The stakes are high,” said Mohanad Adnan, a Baghdad-based political analyst at Roya Development Group.

 

“Historically, competition was between the Shiite, Sunni and Kurdish blocs, but now there is an intra-bloc layer of competition, drastically complicating negotiations,” he said.

The legislation is Iraq’s largest ever proposed budget at $153 billion and will run for three years until 2025. The Kurdistan region’s share of 12.67 per cent was confirmed in a vote on Friday night.

“A lot of this spending is for providing more public sector jobs,” said Zeinab Shuker, a sociology professor at Sam Houston State University.

This was a strategy by Mr Al Sudani and his government to win re-election, she said.

 

While this may appeal to many jobless Iraqis, including the growing youth population, Ms Shuker said it was short-term thinking.

“This is not going to be sustainable,” she said. “The budget works with $70 per barrel for oil, any decline and Iraq will not be able to deal with it very effectively.”

Brent closed at $75.04 per barrel on Friday.

Nevertheless, issues of federalism and control of the oil industry in the Kurdistan region were the most contentious and have been the reason for the repeated delays.

The KDP, which is a crucial member of Mr Al Sudani’s governing coalition, objected to amendments introduced by the parliamentary finance committee late last month. They viewed them as contrary to a temporary agreement reached in April between Mr Al Sudani and KRG Prime Minister Masrour Barzani.

This clause passed in the final version will likely exacerbate tensions between the two parties.

A provision backed by Kurdish opposition parties was removed from the budget bill on Saturday. It would have compelled the KRG to repay 10 per cent of the money that it had withheld from the salaries of public servants as part of austerity measures introduced in 2014.

I don't recall seeing any results of previous census endeavors....that was the hold up for years and intentionally not acted upon to avoid validating the citizen's share of oil proceeds. You may very well be right.

YOTA posted one last week that said census at end of this year but like most things Iraq that was probably a miscalculation and could be happening now.

Who are the authorities entitled to file legal appeals against the budget?

Baghdad / Obelisk Al-Hadath: Legal expert Ali Al-Tamimi identified, on Saturday, the parties that have the right to challenge the budget law, while stressing that the appeal is after its approval by the Presidency of the Republic.

A budget challenge is a legal action taken in some cases to investigate the validity and legality of a government budget.

Various parties intend to use this procedure because they have objection to how to prepare or implement the budget.

In Iraq, those bodies can file a judicial challenge against the government budget. This is done by filing a judicial complaint before the competent court.

Al-Tamimi said in a statement to Al-Masalla, that after the Iraqi Council of Representatives voted on the budget law, it was sent to the Presidency of the Republic for the purpose of ratification by the President of the Republic in accordance with Article 73 III of the Iraqi Constitution. by the Presidency of the Republic.

He added that after the President of the Republic ratifies it, it is sent by the Presidency of the Republic to the Ministry of Justice for the purpose of publishing it in the Official Gazette, i.e. the facts according to Law 78 of 1977, the law of publication in the Iraqi Gazette....and when it is published, it is legally obligatory to be applied, followed, and implemented...

And he continued: As for the appeal against the articles of the budget law, it will be within a period of 30 days from the date of publication, meaning that the period of appeal that is submitted to the court will be within 30 days from the date of its publication in the facts, and no appeal will be accepted after this period .. which is stipulated in Article 22 of the internal system of the court Federal Supreme No. 1 of 2022 This article required the Federal Supreme Court to decide on the appeal within 30 days from the date of its submission, unless otherwise necessary.

And he concluded: As for the parties that have the right to challenge the Federal Budget Law, they are the three authorities, the ministries, the prime minister of the region, the bodies not associated with the ministry and the governors…..as Article 19 of the Federal Supreme Court system above says..and that the request be submitted to the court by a letter signed by the head of the concerned authority ...and that the contested text relates to the tasks of those bodies or has implications and differences in application.

Al-Gharabi told Earth News Agency, "The budget enters into force after the approval of the President of the Republic, which is 15 days from the date of voting on it, publishing it in Iraqi facts, and issuing instructions for implementing the budget by the Ministry of Finance and Planning."

 

He added, "It is not excluded that these procedures will be completed in early July, as appointments will be launched, all forms of acceptance of applicants for appointment will be organized by the governorates, and the salaries of the beneficiaries will be paid at the beginning of next month."

Today, Tuesday, the Parliamentary Finance Committee confirmed that most of the budget amendments took place in coordination with the ministers, while it identified paragraphs in the budget that the government may object to.

 

Committee member Mueen Al-Kazemi said in an interview with the Iraqi News Agency, followed by "Al-Iqtisad News", that "most of the articles in the budget law have been agreed upon with the government, and the government can object if the amendments made by the committee and approved by the House of Representatives are not among the powers of the parliament," indicating That "the amendments included transfers and reduction of some chapters, which are the prerogatives of the House of Representatives."
Al-Kadhimi continued, "The government has the right to object to financial burdens if it finds doors or clauses that include an increase in financial burdens," explaining that "the government may object to the issue of employees who have been increased to 300,000 new degrees, but all other articles have been agreed upon with the government." ".

Dr. Nermin Maarouf, a member of the Finance Committee in the Iraqi Council of Representatives, confirmed that the region's percentage of 12.67% of the federal general budget is not calculated from the total budget, but rather after deducting the ruling and sovereign expenditures from it.


Dr. Nermin Maarouf said, during a press conference held today, Thursday 6/22/2023, in the Sulaymaniyah office of the Parliament: “The region’s percentage of 12.67% is not calculated from the total budget of 199 trillion dinars, but is calculated from the budget after deducting the ruling and sovereign expenditures until it reaches About 130 trillion dinars, stressing that "this means that the region's share amounts to 14 trillion and 700 billion dinars," in addition to that "the region's share of the ruling budget amounts to approximately one trillion and 300 billion dinars, which reaches the region in kind, not materially."


A member of the Parliamentary Finance Committee explained the reasons for reducing the Kurdistan region’s share of the region’s development allocations in the federal budget, saying: “Although the region’s share in the federal budget amounts to 12.67%, the share of the provinces of the region in the region’s development is 11%,” pointing out that “ The reason for this is the criteria that were set to determine the proportion of each province in the development of the regions represented by the number of residents and the rate of poverty.


A member of the Patriotic Union of Kurdistan bloc stated, "According to the statistics of the Federal Ministry of Planning, the provinces of the region are the least poor in Iraq, especially Sulaymaniyah Governorate, so the proportion of the region has been reduced."
Dr. Nermin went on to say:


She explained, "The budget law does not solve all the problems of the citizens of Kurdistan, but it will contribute to ending many crises, including the problem of delaying the distribution of salaries of employees and retirees."

The draft federal budget law for the years 2023-2024-2025, sent by the federal government to the House of Representatives on March 13, 2023, and after extensive discussions by the Finance Committee and during Parliament sessions as well, the draft law was ratified during the House of Representatives session on the morning of June 12, 2023 In the presence of 258 deputies out of 329.


Then, the House of Representatives sent the voted budget law to the Presidency of the Republic on June 16, where it was signed by His Excellency the President of the Republic, Dr. Abdul Latif Jamal Rashid, yesterday, 6/21/2023.


Today, Thursday, 6/22, the Federal Budget Law was sent to the Federal Ministry of Justice, where it is scheduled to be published next Monday, 6/26/2023, in the Iraqi Al-Waqa’iyyah newspaper, so that the law will enter into force after issuing the necessary instructions by the Ministry of Finance.

Representative Thaer Makhaif said that the political blocs agreed on all paragraphs of the budget law and were approved, and the President of the Republic ratified them and they will become effective after being published in the Iraqi Gazette, pointing out that if the political blocs had found a loophole in the draft federal budget law over the past period, it would have been appealed. by the Federal Court, and this has not happened so far.


He added that the government is the one that sends laws to parliament, including the budget law, and therefore the government will not object to the budget paragraphs because it approved cooperation with it and was on the same line with Parliament until its approval.
