Shafaq News / An informed source said, on Friday, that the Federal Court may issue a decision to re-count the manual counting of all electoral stations in four Iraqi governorates, including the capital, Baghdad.

The source told Shafaq News Agency, "The Federal Court may issue a decision to re-count all polling stations and stations for the governorates of Baghdad, Babil, Salah al-Din and Nineveh, as they recorded high rates of electoral violations, according to reports of international observers, as well as observers of political and party entities."

He added that "if that decision is issued, it will change the results of the elections in those provinces, albeit slightly."

The same source confirmed to Shafaq News Agency, "The court may proceed with issuing a decision to re-count the comprehensive manual of all electoral centers for all governorates at a rate of 20%.

The Federal Court, in its meeting held last Thursday, announced the postponement of deciding on the election results until the completion of the examination of all the appeals submitted to the court.

It is noteworthy that the Al-Fateh Alliance led by Hadi Al-Amiri had submitted appeals with some documents challenging the integrity of the elections to the Federal Court for consideration, followed by former Prime Minister Iyad Allawi, who submitted a number of appeals documented with evidence, according to his claim.

Member of the law: The Federal Court will postpone its decision to next year and the majority is no longer on the table

{Politics: Euphrates Yanouz} A member of the State of Law coalition, Adel Al-Manea, suggested postponing the Federal Court's decision regarding the consideration of appeals until next year.

Al-Manea told Al-Furat News that: "The Federal Court has set the 22nd day to consider the appeals submitted, and I do not expect that there will be an announcement of the approval of the whole or part or the non-ratification of the election results before the new year."
He expected, "The Federal Court will take into account the political commotion and the date may be postponed to another on the political dialogues that lead to a glimmer of hope for political consensus."
Al-Manea pointed out, "The talk about recent alliances, and what is happening now, dialogues have not reached the stage of political alliances, so the figures announced by the Commission are still subject to change."
He continued, "The political majority is no longer on the table with most of the blocs, and there is a desire to go towards political consensus, which is the best solution after the Federal Court has finished the official announcement."

The court decided to postpone the date of the pleading regarding the coordination framework lawsuit regarding the elections to December 22nd.
Yesterday, Wednesday, the coordination framework ruled out the Federal Supreme Court's recourse to a decision requiring the manual recount of all electoral stations across the country, in a specific proportion.
Wael Al-Rikabi, a member of the State of Law coalition affiliated with the framework, pointed out to Al Furat News that it is premature for the court to take such a decision, and the decision is taken in the name of the court that considers the appeals, which postponed its session to the 22nd of this month. How do they appoint these stations and so far we have not wanted any news about this.

Legal circles suggested that the appeals filed against the election results to the Federal Court would be rejected, after the latter announced yesterday, Wednesday, the “conclusion of the plea” in the lawsuit to cancel the results submitted by the head of the “Al-Fatah” bloc, Hadi Al-Amiri, and set next Sunday the date of the ruling, while political analysts confirmed that the alliances It regains its strength as the date for announcing the election results approaches to form the largest bloc.

Legal expert Tariq Harb said in an interview with “Al-Sabah”: “The Federal Court announced the conclusion of its pleadings, claiming to cancel the elections because there is nothing left to be said regarding them. Half-time and Friday and Saturday are holidays, so the verdict will be issued next Sunday.”
He added, "There is a weighting of two things regarding this lawsuit, the first is to accept the lawsuit and cancel the results, and the second is to reject the lawsuit and certify the electoral results," adding that "the second possibility is the court's decision, especially since yesterday's session became clear what is going on in this direction, specifically that he mentioned That many did not receive the biometric card and that millions did not go to vote, and this matter concerns all parties and does not pertain to one party, so I think that the result is the rejection of the case and the ratification of the results, so that the President of the Republic announces, by a republican decree, that the first session will be held on the first working day on the first day of the next year.
He continued, "It is possible that the session will be urgent to make up for the delay that occurred during the period of approval of the results."
Yesterday, Wednesday, the Federal Court decided to postpone the hearing of the appeal against the election results to next Sunday, December 26, and the court indicated in a statement that "this came after hearing the last pleas and requests of the two faltering parties."
In addition, political analysts confirmed that alliances are regaining strength with the approaching date of announcing the election results to form the largest bloc.
In an interview with "Al-Sabah", political analyst Jassem Mohsen indicated that "with the approaching decision on the election results, it is certain that the movement of the political blocs will be at its peak, and we have seen Erbil in Al-Hanana and Erbil in (progress and determination), so it is certain that the movement will increase in preparation for the announcement of the election results. ".
He added that "the current political movement headed by Nuri al-Maliki because it addressed the axis (the framework) in the understandings and there is waiting for the results of the Federal Court, so the movement will be great to prepare for the paper (the largest bloc) approved by Article 76 after the first session of the House of Representatives."
In turn, political analyst Muhammad al-Hashemi told "Al-Sabah": "The dialogue that started with (the coordination framework) in his visit to Erbil means that he decided to combine the stage of submitting appeals to the Federal Court and moving to understanding about alliances."
He added that "(the coordinating framework) is moving on the Sunni, Shiite and Kurdish national horizon, because it sees that the movement of Sayyid Muqtada al-Sadr with part of the Shiite component and each of the Sunni and Kurdish component weaken the Shiite political position, so (the framework) wants to replace this theory with another and with another reality and equation And it is the Shiite whole with the Sunni and Kurdish whole or with parts of the other components,” and indicated that “(the coordinating framework) considers itself to mean all, regardless of the electoral numbers and election results.”
A large delegation from the (Coordination Framework), headed by the leader of the State of Law coalition, Nuri al-Maliki, arrived in the city of Erbil yesterday, Wednesday, for a round of meetings with Kurdish leaders.
A member of the Kurdistan Democratic Party, Ali Al-Faili, said in an interview with Al-Sabah: "This visit comes at a time when everyone aims to find an opening to block the political process after the election results were announced, and a group objected to these results and disrupted the formation of the expected government."
He stressed that "the Kurdistan Democratic Party stands at the same distance from everyone, but in the end, after the approval of the Federal Court on the election results, there are constitutional timings that must be respected for the formation of the House of Representatives and then assigning the President of the Republic and also the Prime Minister. The visit of a delegation (coordinating framework) headed by al-Maliki to the Kurdistan region in this context.

The Federal Court decided to postpone the special session to consider the cases submitted regarding the cancellation of the results of the legislative elections until the beginning of next week, and the court set the twenty-sixth of this month as the date for definitively ruling on the appeals submitted by the Al-Fateh Alliance regarding the polling results.

The matter with which you will be asked, this was confirmed by the lawyer of the coordination framework after the conclusion of the pleading session in the case against the election results, and after the conclusion of the framework, waiting for the decision, as the Federal Court set next Sunday the twenty-sixth of next week as the date for issuing its decision in the case.

Al-Sarraj: The political scene through shock and the Federal Court will take the calmest path

{Politics: Al Furat News} The political analyst, Adnan Al-Sarraj, confirmed that the political scene through the shock and the Federal Court will take the calmest path.

Sarraj said; For the “State Dialogue” program, broadcast by Al-Furat satellite channel tonight, that: “The current meetings between the political parties to establish a real environment that provides the basis for forming the next government and the three presidencies, and the coordinating framework went to Erbil to melt the ice between the Kurds and Shiite forces.”
He added, "The coordination framework has not yet taken its natural form, and the political forces affiliated with it can give an impression of the alliance's shape, and the differences between progress and determination still exist despite the dialogues."
Al-Sarraj continued, "Some Shiite forces have a strong relationship with the head of the Kurdistan Democratic Party, Massoud Barzani, and Erbil has today become a focal point for any work after obtaining the most seats, and the Patriotic Union of Kurdistan is in the process of collecting its internal conditions."
He concluded, "The framework is closer to democracy than the union with the issue of the three presidencies, and it took the public and legal path and submitted appeals to the Federal Court to object to the elections. I think the period taken by the court is serious in dealing with the appeals and to satisfy the objecting parties."
And Al-Sarraj indicated, "The Federal Court is not in the business of re-counting and manual counting of all stations, and any decision for it is adapted from the inside legally and put forward, but it considers that the arena needs a space of time to resolve the political tensions and it is patient to provide complete conviction among the objectors."
He went on, "We have crossed the shock and the political parties are aware of the tendency to form the government, and the framework and the Sadrist movement are both looking for the nomination of the prime minister, and personal problems will not prevent the agreement of Nuri al-Maliki and Mr. al-Sadr, but the majority project has been dispelled by the realistic partisan vision."
Al-Sarraj concluded, "The Federal Court took the calm path, not the shock, and we suggest postponing the decision, but for shorter periods, and the next parliament can cancel the elections;
The Supreme Federal Court, ended on Wednesday a hearing regarding the appeals filed in the results of the parliamentary post - election listening to other arguments and requests both parties Almtdaaan, the Court decided the conclusion of the hearing and set on 26.12.2021 to issue a decision in the case. Shafaq News/ An informed political source revealed, on Wednesday, the "real" reason that prompted the Federal Court to postpone its decision regarding the lawsuit filed by the leader of the Al-Fateh Alliance Hadi Al-Amiri, demanding the annulment of the election results.

The source told Shafak News Agency, "The failure of the Electoral Commission to answer the technical questions sent by the Federal Court was the main reason behind the postponement of the decision session to next Sunday."

He added that "the Electoral Commission has been procrastinating in not sending the answer to the appeals, due to the presence of real legal violations, including the failure to disclose the content of the examiner's report, along with other technical details that would greatly change the announced results."

And the Federal Supreme Court in Iraq had announced the setting of December 26, 2021 as the date for the issuance of the decision by the Federal Court regarding the lawsuit filed by the leader of the Al-Fateh Alliance Hadi Al-Amiri, demanding the annulment of the results of the early parliamentary elections, after hearing the last pleas and requests of the two fallen parties.

Al-Amiri during his appeal to the Federal Court (Twitter)

The announcement by the Iraqi authorities, today, Sunday, an official holiday on the occasion of Christmas, led to the postponement of a scheduled session of the Federal Court to consider the appeal submitted by the leader of the “Al-Fateh” coalition, Hadi Al-Amiri , against the results of the parliamentary elections held on October 10 .

The lawyer entrusted by the "Al-Fateh" coalition, in the case of the appeal filed, Muhammad Al-Saadi, said in a telephone conversation with "Al-Araby Al-Jadeed", that "the Federal Court postponed its session to issue the final decision regarding the lawsuit against the results of the early parliamentary elections, which were scheduled to be held, Today, until tomorrow, Monday, due to the announcement of an official holiday for all Iraqi state institutions.

Al-Saadi indicated that "the Federal Court will hold its session tomorrow, Monday, and this date cannot be postponed again," expecting that the session will witness the issuance of a final decision on the lawsuit submitted by Al-Amiri.

He stressed that "there will not be any postponement in the case of adjourning the case or the decision regarding it, because the court set the date for the ruling, but the official holiday postponed the pronouncement of the ruling."

Al-Saadi claimed that "a lot of evidence and documents were presented, which confirm and prove the absence of a peaceful and fair electoral process, and for this we expect that there will be a decision from the Federal Supreme Court, regarding the announced results, especially that what will be issued will be binding on everyone and the decision is absolutely not subject to appeal, given that Federal Court decisions are binding and final.

In addition, the leader of the "Sadiquon" parliamentary bloc, affiliated with the "Asa'ib Ahl al-Haq" movement, Fadel Al-Fatlawi, told "Al-Araby Al-Jadeed", that "the Federal Court will issue its own decision regarding the lawsuit to cancel the early parliamentary elections, tomorrow, Monday, after postponing the session Today, due to the official holiday announced by the General Secretariat of the Iraqi Council of Ministers.

Al-Fatlawi added: "We believe that the Federal Court will issue a decision regarding the cancellation of some electoral stations, and the conduct of manual counting and sorting for other stations to detect fraud and manipulation, according to the evidence presented by the Al-Fateh coalition at its invitation."

He expected that the decision of the Federal Court would change "even if by a small percentage of the election results announced by the commission, and that the court's decision would be professional and away from any pressures, and any decision issued by the court would be respectful and binding on us, even if it was to dismiss and invalidate the case," he said.

The "Al-Fateh" coalition's lawsuit submitted to the court is based on about 20 files that include various documents, numbers, statements and testimonies, related to what the coalition considers evidence of "rigging and manipulation" in the Iraqi elections, and demands their cancellation.

The "Al-Fateh" coalition, which politically represents the "Popular Mobilization" in Iraq, is one of the most prominent forces that did not achieve important results in the 2021 Iraqi elections , and came late in terms of the number of parliamentary seats by only 17 seats (out of 329), after it was occupying Nearly 50 seats in the previous parliament.

The Iraqi elections witnessed the decline of other prominent forces such as the "Wisdom" movement led by Ammar al-Hakim, the "Victory" coalition headed by Haider al-Abadi, in addition to "Sadiqun" and "Huqooq" linked to armed factions, namely "Asa'ib Ahl al-Haq" and "Kataeb Hezbollah".

This prompted these parties to reject the results, and to form a " coordinating framework " opposing the results of the Iraqi elections.

On the other hand, the Sadrist bloc led by Muqtada al-Sadr won 73 seats out of 329, followed by the "Progress" coalition with 37 seats, then the "State of Law" coalition led by former Prime Minister Nuri al-Maliki with 33 seats, and the Kurdistan Democratic Party led by Massoud Barzani with 31 a seat.

Sources from within the coordination framework suggested that a directive from the Federal Court would be issued to recount and sort a number of stations in light of the evidence presented by the framework, and indicated that the court would not ratify the election results without resolving the evidence presented by the Al-Fateh Alliance regarding the cancellation of the results.
