Antrim County... small and rural....that big city programmer probably figured they'd never notice....too busy making moonshine and hunting to eat... Then take Maricopa County, AZ.....yep...same software.....the algorithm could be set to change 1/3, (or any percentage), of the Trump votes to Biden using a randomized rotator.... Only fix will be.....everywhere this system, and program, was used will have to be recounted by hand..... Sounds like alot of work..... coorslite21 Posted November 11, 2020 Report Share Posted November 11, 2020 BETH LEBLANC | THE DETROIT NEWS | 1 hour ago President Donald Trump's campaign said it filed a second lawsuit in Michigan on Tuesday seeking to stop the state's canvassing and certification of ballots. The Trump campaign said it filed the case in federal court, where the campaign is alleging "irregularities" in the Detroit absentee ballot counting process and concerns over a software glitch in Antrim County in northern Michigan. Unlike the campaign's filing in the state Court of Claims last week, Tuesday's filing includes more than 230 pages of affidavits, some handwritten, attesting to the irregularities, said Mark "Thor" Hearne, a St. Louis, Missouri, lawyer for the campaign. The campaign announced the suit Tuesday evening, saying it filed the case in U.S. District Court Western District of Michigan. The campaign was denied emergency relief in Court of Claims Judge Cynthia Stephen's courtroom on Thursday in a separate case and was told Monday that its appeal in the state Court of Appeals was missing several attachments. Hearne said he was working to obtain some of those filings, such as transcripts, from the Court of Claims and plans to continue to pursue the state case. Tuesday's federal lawsuit, to be filed on behalf of seven Republican poll challengers in Michigan, alleges equal protection violations of the challengers as well as violations of federal and state laws guaranteeing the "purity of the election." Many of the claims in Tuesday's suit were similar to those alleged in other suits in the last week, including ballot entry irregularities, barriers preventing Republican poll challengers from observing at the TCF Center in Detroit and issues with the Dominion Voting Systems in Antrim County. When asked whether the Trump campaign believed its lawsuit would overcome the 146,000-vote margin in Michigan between Trump and Democratic candidate Joe Biden, Trump campaign communication director Tim Murtaugh said that the campaign does not file a lawsuit if it doesn't believe it has merit. "Every filing and every action that we are taking are getting us closer to the goal of seeing the president reelected," Murtaugh said. "We do not think we are going to eat the apple in one bite, but a large part of these lawsuits is to gather further information.” For example, he said, with Tuesday's lawsuit the campaign hopes to research the software issue in Antrim County at greater length to determine if it affected other counties using the same software. Antrim County pulled its unofficial results off its website last week after officials found a discrepancy that showed Biden leading in the GOP-leaning county. Benson's office has said it was an error by the Antrim County clerk, who failed to update the software used to collect data from voting machines. The issue was corrected and likely would have been discovered in the canvassing process if media and other GOP officials hadn't drawn the county's attention to it first, officials said. Republicans raised concerns about the glitch, noting that 47 other counties have the same software. Republican Kent County Clerk Lisa Posthumus Lyons noted last week the Michigan Republican Party also has used the software in the past for its nomination process. The lawsuit also alleges poll challengers were forced to stay 6 feet away from poll workers, making it difficult to observe in a meaningful way, and kept away from the ballot duplication process at the TCF Center. One of the affidavits came from Mary Shinkle, the wife of Norm Shinkle, a Republican member of the Michigan Board of State Canvassers responsible for the final certification of results in Michigan. Elections officials have argued that at least 134 Republican poll challengers observed the absentee ballot counting process at the TCF Center before a surge of other challengers demanded entrance that was barred because of COVID-19 capacity restrictions. Among the affidavits included in Tuesday's lawsuit were several alleging ineligible ballots, "backdated" ballots, ballots that were run through tabulators multiple times, ballots for whom the individual was recorded with a birthdate of Jan. 1, 1900 if they weren't found in the poll book and ballots recorded without any signature or postmark. The lawsuit also alleges workers "corrected" overvotes and undervotes on some ballots. Another affidavit came from a woman who claimed her deceased son was recorded as voting in the Nov. 3 election, but did not say where the ballot was cast. Responding to some claims of ballot backdating last week, city officials have explained that the receipt date of some absentee ballots was entered into the qualified voter file at the absentee counting board because some Detroit satellite clerks' office stamped the date on the absentee envelope but forgot to enter the information into the electronic voter file. None of the ballots entered into the system were received after Election Day, officials said. In a statement Tuesday, Benson's office said ballots of voters who have died between casting an absentee ballot and Election Day are rejected. The state department sampled some of the lists circulating claiming dead people had voted in Michigan and found they contain too little information to even compare to the state's qualified voter file. Trump's election lawsuits plagued by elementary errors When President Donald Trump sends lawyers to court, it seems he’s not sending his best. Fighting to challenge an election he lost to President-elect Joe Biden, Trump has launched a barrage of lawsuits across the country. Top Republicans have stood behind him and said they will wait for those cases to be resolved before officially recognizing the winner, a standard that has no modern precedent. But his attorneys have repeatedly made elementary errors in those high-profile cases: misspelling “poll watcher” as “pole watcher,” forgetting the name of the presiding judge during a hearing, inadvertently filing a Michigan lawsuit before an obscure court in Washington and having to refile complaints after erasing entire arguments they’re using to challenge results. “The sloppiness just serves to underscore the lack of seriousness with which these claims are being brought,” said Rick Hasen, a law professor at the University of California, Irvine. Trump’s legal team has lost repeatedly in court and failed to uncover the kind of widespread fraud that might challenge Biden’s leads in several key battleground states. His lawyers and allies have still pressed forward with asking judges and certification authorities to block the results. Former New York Mayor Rudy Giuliani and other Trump lawyers held a press conference Thursday in which they berated reporters for questioning their claims and cited a Michigan affidavit already dismissed by a judge. They also argued a debunked conspiracy theory that Venezuela could have hacked election results through machines used by local authorities. “I know crimes. I can smell them,” Giuliani said as streaks of sweat and what appeared to be hair dye ran down the sides of his face. “You don’t have to smell this one. I can prove it to you 18 different ways.” Experts have noted that Trump is not employing the Republican Party’s top election lawyers, including those who represented the GOP in the Florida recount two decades ago. Law firms have faced public pressure from Trump opponents not to fight the election on his behalf. Legal giant Porter Wright Morris & Arthur withdrew from a case in Pennsylvania last week. Attorneys at the larger, more established firms that had been representing Trump have expressed concern privately about pushing a legal strategy without a body of evidence, and worry that it’s wrongly furthering a false narrative that the election was fraudulent, according to two people familiar with the litigation. The people were not authorized to speak about litigation and spoke to The Associated Press on condition of anonymity. The day before a major argument in Pennsylvania, three lawyers for Trump withdrew and were replaced in part by Marc Scaringi, an attorney and talk show host who wrote a blog post after the election referring to “President-elect Joe Biden.” Scaringi himself had told listeners on his radio show days after the election that “there are really no bombshells” about to drop “that will derail a Biden presidency,” and noting that several of the lawsuits “don’t seem to have much evidence to substantiate their claims.” Much of the derision has focused on Giuliani, who appeared in court on Tuesday in the Pennsylvania case. It was the first time he had represented a client in federal court in almost three decades. During the hearing, Giuliani forgot the name of an opposing lawyer, misstated the name of the presiding judge and mistook the meaning of the word “opacity.” Hasen pointed to Giuliani’s apparent lack of knowledge of the meaning of “strict scrutiny,” the highest of three standards used by judges to evaluate how a law or action taken by the government affects someone’s constitutional rights. The Trump campaign has claimed without providing evidence that Pennsylvania violated voters’ rights by allegedly allowing election fraud. Strict scrutiny is a basic concept taught to aspiring lawyers and constitutional law classes. “I’ve never seen an election lawyer handle a case as poorly as Giuliani has,” Hasen said. “The idea that the lawyer arguing the most important case in Pennsylvania would not understand what it means to apply the standard of strict scrutiny in a constitutional case is mind-boggling.” On Wednesday, the Trump campaign asked to file a new complaint in Pennsylvania partly to “restore claims which were inadvertently deleted,” according to their filing.
