Whitaker may have violated group's tax-exempt status

WASHINGTON (AP) — Matthew G. Whitaker, the nation's new acting attorney general, repeatedly chided presidential candidate Hillarious Clinton in public statements during 2016 while he was speaking for a group that is barred by its tax-exempt status from supporting or opposing political candidates during a campaign.

Before coming to the Justice Department in 2017, Whitaker was president and executive of the Foundation for Accountability and Civic Trust, a charitable organization that styles itself as nonpartisan government watchdog promoting ethics and transparency. The tax-exempt group — known by its initials, FACT — is supposed to serve the public interest under Section 501c3 of the U.S. tax code, without directly or even indirectly supporting or opposing specific candidates for office.

Yet the group has engaged in one partisan pronouncement after another, mostly directed at Democrats. During the last presidential race, Whitaker argued in July 2016 newspaper opinion pieces that Clinton should be prosecuted for her handling of her private email server — a favorite talking point of Donald Trump. The opinion pieces identified Whitaker as FACT's leader.

In September 2016, Whitaker argued that Clinton had acted shamelessly by appointing her charity's donors to boards of the State Department when she was secretary of state.

"I don't think anybody in the history of our country that served in the administration has been this bold in their private fundraising and their sort of giving favors," he said in a radio interview posted on YouTube by his group.

Daniel Borochoff, president of CharityWatch, a Chicago-based group that monitors the nonprofit world, said that statement appears to violate the IRS ban on engagement for or against a particular political candidate. "It's highly critical of a candidate, and he ought not to be doing that, because it's a political partisan comment," he said.

Whitaker, a former U.S. attorney in Iowa, left FACT in October 2017 to become Attorney General Jeff Sessions' chief of staff. He was named this week by President Trump to take over at least temporarily for Sessions, who resigned at Trump's request.

FACT was founded in 2015, tax filings show. Whitaker drew a sizable portion of its budget as his salary as president and executive director — in 2016 he earned more than twice what leaders of similar groups were paid on average that year, according to data from another watchdog group, Charity Navigator.

In 2015 and 2016, Whitaker earned a total of $654,000 from FACT — 30 percent of its entire spending of $2.2 million over that two-year span. His 2016 salary was $402,000; the average CEO or executive director at 380 advocacy or education charities in that year made a salary of $173,099, according to Matthew J. Viola, a vice president at Charity Navigator.

Borochoff suggested that Whitaker's board of directors at FACT didn't appear to be independent enough to apply the brakes on his campaign partisanship. Whitaker appeared to exert tight control over a three-person board of directors that included just one unsalaried member, according to the group's IRS filings in 2015-16.

Whitaker's foundation was initially formed and then primarily supported with funds from another organization called Donor's Trust. That group is a nonprofit built to give conservative and libertarian philanthropists "any level of privacy they want," according to its marketing materials.

A FACT spokesman declined to provide any details on donors or any on-the-record response to other questions. There was no immediate reply to a request for comment from Whitaker made through the Justice Department.

Though 501c3 groups can legally withhold the identity of their contributors and generally do so, there may be a distinct irony when a group dedicated to transparency keeps its funding sources in the shadows.

In 2014, FACT's only source of funds was Donor's Trust, according to IRS filings. In 2015, funds from Donor's Trust accounted for all but $191 of FACT's $500,191 in revenue. In 2016, Donor's Trust provided $800,000 of FACT's revenues of $1,350,265.

It is clear from IRS filings that FACT has paid outside Republican firms to perform some of its work. One such firm is America Rising LLC, which was given $144,000 for research in 2015.

America Rising LLC formed in Delaware in 2002 and was first registered to do business in Virginia in 2016, but its registration was canceled in May 2018 for failing to pay its annual registration fee, according to Katha Treanor, a spokeswoman for the State Corporation Commission. America Rising LLC did not respond to queries from The Associated Press.

Democrats want every Republican to go down and Republicans want every Democrat to go down, but they don't want the crooks in their party to go down? Isn't that what's wrong with America? President Donald Trump still has acting Attorney General Matthew Whitaker on his mind, even though he is on a trip to France for events marking the 100th anniversary of the armistice that ended World War I. Trump tweeted late Friday that Whitaker is "a highly respected former U.S. Attorney from Iowa. He was chosen by Jeff Sessions to be his Chief of Staff. I did not know Mr. Whitaker." But he added that Whitaker was well regarded by several Iowa leaders and said: "I feel certain he will make an outstanding Acting Attorney General!"

8:15 p.m.

The Wall Street Journal has published an email disclosing an FBI investigation into an invention promotion company tied to acting Attorney General Matthew Whitaker.

The email was sent last year by an FBI victims' specialist to someone who the newspaper says was an alleged victim of the company, World Patent Marketing Inc., on which Whitaker served as an advisory board member.

The email shows that the criminal investigation involved the FBI's Miami field office.

The Journal says the company was accused of scamming millions from customers. A Justice Department spokeswoman told the newspaper that Whitaker was not aware of any fraudulent conduct.

Whitaker was appointed acting attorney general on Wednesday after President Donald Trump pushed out Jeff Sessions as the country's chief law enforcement officer. Whitaker had been Sessions' chief of staff.

Republican Sen. Susan Collins is calling on the Senate to pass legislation protecting special counsel Robert Mueller's Russia probe.

Collins said in a statement Friday that she's concerned about comments made by Acting Attorney General Matt Whitaker, whom President Donald Trump appointed after he fired Jeff Sessions this week. Whitaker, expected to temporarily oversee Mueller's investigation, has criticized the probe.

Republican Sen. Jeff Flake said Thursday that he will try to force a vote next week on legislation that passed the Senate Judiciary Committee earlier this year that would attempt to protect Mueller. The bill would give special counsels a 10-day window to seek review of a firing.

Flake can ask to bring up the bill, but any senator can object.

Collins says the bill "would send a powerful message."

Senate Majority Leader Mitch McConnell says he expects President Donald Trump to nominate a new attorney general "pretty quickly" after Trump fired Jeff Sessions earlier this week.

Speaking in Kentucky on Friday, McConnell said he expects acting Attorney General Matt Whitaker to be "a very interim" attorney general.

Democrats have criticized Whitaker for comments he has made in the past that were critical of special counsel Robert Mueller's investigation and have called for legislation to protect Mueller. McConnell said that's not needed because the probe will be allowed to finish.

Senate Democratic Leader Chuck Schumer on Friday sent a letter to Trump questioning the legality of Whitaker's appointment, since he was not confirmed by the Senate.

President Donald Trump is moving to distance himself from Matthew Whitaker as he faces criticism over his choice for acting attorney general.

Trump told reporters Friday "I don't know Matt Whitaker" and said he didn't speak with Whitaker about special counsel Robert Mueller's Russia investigation.

Whitaker has made public comments critical of Mueller's investigation, and critics have called on Whitaker to recuse himself from oversight of the inquiry. Under former Attorney General Jeff Sessions, the investigation was overseen by Deputy Attorney General Rod Rosenstein.

Of the scrutiny Whitaker is facing, Trump said: "It's a shame that no matter who I put in they go after."

He also called Whitaker "a very highly respected man." Whitaker was Sessions' chief of staff before Trump made him Sessions' interim replacement.

Friday’s in-depth Wall Street Journal report suggests the U.S. Attorney’s Office of the Southern District of New York and the FBI appear to possess evidence of Donald Trump’s involvement in a criminal scheme that helped get him elected president. This raises serious questions about what comes next, particularly in light of Trump’s appointment of Matthew Whitaker, a political loyalist, as acting attorney general.

Trump played a central role in hush-money payments made to Karen McDougal and Stephanie Clifford during the 2016 presidential campaign, the Journal reports, adding more detail to the case of Michael Cohen, Trump’s former fixer-lawyer who pled guilty to federal campaign finance violations in the Southern District in August.

Recall that when Cohen pleaded guilty in federal court, he stated under oath that he had made the payments “in coordination and at the direction of a candidate for federal office”—many assumed that that candidate was Trump, of course. We now know from the Journal that the person who directed Cohen in this criminal scheme was, indeed, Donald Trump. The charging document to which Cohen pled guilty states that he “coordinated with one or more members of the campaign, including through meetings and phone calls, about the fact, nature, and timing of the payments.” The Journal reports that “[t]he unnamed campaign member or members referred to Mr. Trump, according to people familiar with the document.”

In addition, we now know that the evidence of Trump’s involvement in this criminal scheme is not limited to Cohen. Even accounting for the likelihood that the piece relies in some part on information provided by Cohen himself, there are plenty of other sources weighing in; the reporters note they obtained information from “interviews with three dozen people who have direct knowledge of the events or who have been briefed on them, as well as court papers, corporate records and other documents.”

Of course there is an important caveat here that what can be reported in the Wall Street Journal doesn’t always translate into usable evidence in the grand jury—in other words, people who are willing to talk to the press may not be as willing or as thorough when it comes to giving testimony to federal prosecutors or a grand jury. But, the Journal article contains an important nugget along these lines: “In August, [prosecutors] outlined Mr. Trump’s role—without specifically naming him—in a roughly 80-page draft federal indictment they had been preparing to file against Mr. Cohen.” As former federal prosecutors, that tells us that the SDNY had evidence of Trump’s involvement even before Cohen pled guilty and began cooperating.

All of this, taken together, indicates that evidence of Trump’s involvement in the hush-money scheme would be a combination of witnesses and other evidence not limited to Cohen, which makes it much more difficult for Trump to brush this off as lies concocted by Cohen to save himself, which Trump’s team have already begun arguing.

And, we know more about Trump’s role in this scheme from the article. For example, the story opens with a detailed recounting of a crucial and previously unreported August 2015 meeting between Trump and National Enquirer publisher David Pecker (who reportedly has been granted immunity to testify by the SDNY) during which Trump asked Pecker how he could help the campaign. Pecker reportedly offered to use his tabloid newspaper to purchase and squash the stories of women alleging affairs with Trump (which he did months later with McDougal).

For them, the party could run Hitler and they would back him, and for the republicans on this site it is exactly the same way.... When you think about it, people aren't really all that different. They back crooks for the sake of the party...

 

I get bashed because I say I'm independent. But it is true. I vote person not party. This election I voted for a Republican governor, Democrat for senator, Republican for congress and an Independent for state representative. I bet you voted one party across your ballot and then cry when nothing ever changes.

I look look at fence sitters like this: You stand for something or fall for everything.

And I don't mean a party affiliate I mean you stand by the Constitution or you stand for chaos.

You can take all of the MSM info and throw it in the Garbage!  Who really believes that the Office of the President of the United States doesn't have the best legal representation working for the Office, and the President.  Just look at the resignation letter by Sessions.......carefully worded........

 

Not a chance that this temp assignment has anything illegal about it........read the statutes.....he is legal......and Trump and company haven't broken any laws.......!!!

 

There are some on here......they are either really uninformed.......or just here to stir the pot............(ie....Stupid/Agitate).....it has become tiresome.....JMO...........CL
