The Ministry of Labor and Social Affairs has set next September as the date for the entry into force of the Social Security Law, calling on all workers in the private sector to benefit from its privileges.
The Social Security Law, which was ratified last March, expands the legal coverage of social security to include all workers, and it will also expand the scope of benefits to include maternity and unemployment for the first time.


The media advisor to the Minister of Labor, Kazem Al-Atwani, told Al-Sabah that the Social Security Law is the most important and will serve a wide segment of private sector workers, and it is hoped that it will be signed by the President of the Republic within the next few days.


And he indicated that if the law is signed by the presidency, it will be referred to the Iraqi Gazette, so that it enters into force so that the ministry can take action to implement it. less than its government counterpart.


Al-Atwani stated that the law will contribute to creating an encouraging work environment for all employers and workers, and if it enters into force, it will create a quantum leap in the work of the private sector, noting that the ministry will have work teams and continuous inspection tours in order to implement the law and guarantee all workers in the private sector with its clauses and privileges.

On Thursday, the Ministry of Labor and Social Affairs revealed new features of the Social Security Law, while specifying the date for the law to enter into force.  

 

The Director General of Retirement and Social Security at the Ministry, Kholoud Hiran, said in a statement to the official agency, followed by “NAS” (August 17, 2023), that “the Social Security and Retirement Law for Workers will enter into force upon the approval of the President of the Republic, after which it will be published in the Iraqi Al-Waqa’i newspaper.” And after 30 to 60 days, the implementation of the law will begin.”  

  

She added, "The law includes all categories of workers in the private sector, even the employer has the right to fall under the umbrella of social security, as well as the resigned employee and those who have military service during the Iran war, and they work in the private sector, they also have the right to register and their years are calculated." the service".   

  

Last May, the House of Representatives voted on a bill on social security and retirement for workers.  

  

Mohsen al-Mandalawi, First Deputy Speaker of Parliament, said earlier, during a press conference, that “the law will represent the main element for protecting and guaranteeing workers’ rights, and activating the private sector in which more than 5 million workers work. The law will also ensure the expansion of the coverage umbrella by adding The guarantee branch for voluntary retirement, and the addition of labor service in the government sector for the purposes of bonus, promotion and retirement, as well as the inclusion of a retirement formula that provides psychological and material stability, in a way that guarantees their equality with government retirees.  

  

Deputy Speaker of the House of Representatives, Mohsen al-Mandalawi, described the law as "one of the most prominent laws, which will constitute an important turning point and a giant step towards strengthening the economic wheel, protecting the segment of workers in the private sector, and guaranteeing their rights similar to their peers working in the public sector."  

  

He added, "The law also allowed the possibility of purchasing a service for workers who do not have a period of service that qualifies them for retirement, with the possibility of any Iraqi ensuring himself with voluntary retirement, and it also guarantees that the pension for partial disability will be transferred to the successor (heirs) upon the death of the retiree, in addition to granting cost-of-living allowances." annually, linking it to inflation and increasing the pension salaries of insured workers by a decision of the Council of Ministers.  

  

Al-Mandalawi stressed that "women working in the private sector will have a greater share in the new law, as they have been granted wide privileges, including pregnancy and childbirth leave, and they enjoy a full salary, in addition to a number of advantages included in the provisions of this important law."

The Presidency of the Republic ratified, yesterday, Monday, the Labor and Social Security Law, months after its approval, and accordingly, it must enter into force immediately after its publication in the Official Gazette.


It is noteworthy that the law will serve a large segment of workers in the private sector and guarantee their rights.


Haider Al-Sheikh, a researcher in economic affairs, said, in an interview with "Al-Sabah": The retirement and social security law for workers is one of the important laws approved by the House of Representatives in the current parliamentary session, indicating that its approval was under direct follow-up from Prime Minister Muhammad Shia'a Al-Sudani and under the direct supervision of the Minister of Labor. And Social Affairs Ahmed Al-Asadi.


He added that the law will serve a wide range of workers in the private sector, whose number has reached more than 6 million people, by regulating their work with employers, whether factories, factories, companies, or others, according to a mechanism approved by the Ministry of Labor and Social Affairs, provided that the worker is paid after he exceeds Retirement age with a pension of not less than 500,000 dinars per month.


He explained that according to the law, every Iraqi citizen who owns a private business has the right to register according to this law in the Social Security Department in the Ministry of Labor, whether he is a shop owner, a taxi driver or other private business, by paying a small monthly amount in return for obtaining a retirement salary after 15 years. A year of his service or his private work is not less than 500 thousand
dinars per month.

Deputy Chairman of the Committee, Jassem Al-Moussawi, said in a statement to “Al-Sabah”: “The Retirement and Social Security Law has entered into mandatory application for professionals, especially after its publication in the Official Gazette,” noting that “the law contains important paragraphs with imprisonment and a fine for those who do not apply it.”

 

Al-Moussawi added, “The law guarantees the entitlements of the working class because they are workers’ rights that must be fulfilled by private sector and business owners,” noting that “these rights are important at this stage, and whoever hesitates to implement the law will expose himself to legal accountability.”

 

Al-Moussawi called on the Ministry of Labor to “form inspection teams, which is a very important matter, to hold professionals accountable who refuse to register their workers, because there are clear deterrent principles in the law that hold accountable those who attempt to violate the terms and articles of the law,” considering that “the law will work to stabilize the working class and the Iraqi economy in At the same time, because it will contribute to increasing the general budget through the establishment of the Guarantee Fund, which is parallel to the budget.”

 

The Vice Chairman of the Committee continued, “The number of participating workers was 650,000 people and now the number has reached 800,000, and we expect it to reach more than 4 million farmers and others to guarantee their rights in this law, which gives advantages to private sector workers and equates them with workers in the country.” Government sector".
