The Ministry of Labor and Social Affairs said that the Social Security Law will come into force next August for all workers in the private and public sectors.

Ministry spokesman Najm Al-Aqabi confirmed to Al-Sabah that there are more than 6 million workers in the private sector, and only 10 percent of them have been registered with social security over the past years.

He added that the ministry recorded a remarkable turnout of workers in order to be included in the law after its recent approval by Parliament, in addition to receiving dozens of complaints against company and factory owners who delay salaries and refuse to register them with social security.

Al-Oqabi stated that the reason for the reluctance of employers and workers to register with the guarantee during the past period lies in the lack of culture and awareness of the law. Therefore, the media was called upon to alert the rights of workers through publication and education, especially for the working class, for the purpose of enhancing the situation of inclusion, improving their economic situation and encouraging

Last Wednesday, the House of Representatives passed the Labor and Social Security Law after years of discussions and waiting by thousands of workers in the private sector, in a step intended to reduce the pressure of rushing to appointments in the public sector and achieve the same privileges for workers and earners outside it.

 

The representative of the Labor Committee, Amir Al-Mamouri, said: “The law guarantees many privileges and cancels Law 39 of 1979, which the private sector suffered from, in addition to health and other guarantees related to work injuries,” noting that “the law guarantees retirement for the worker in the private sector with a pension of approximately 80%.” percent of the nominal salary, as is the case with his counterparts in the public sector.”

 

Al-Mamouri added, in an interview with “Al-Sabah,” that “the law protects the cost of living at an annual rate granted by the Board of Directors, so that the minimum pension is 500 thousand dinars,” indicating that “factory and factory workers pay 5% of the retirement contributions, while the employer pays 12%, while the government will have 8%.” .

 

The law includes, according to Al-Mamouri, that “if the insured worker dies, the retirement pension is the right of his heirs,” referring to the privileges that exist for women in the law, including “the retirement of a woman who has three children, even if she has 15 years of service regardless of age, with the payment of an allowance.” Maternity period and delivery by the department during leave.

 

For its part, the Iraqi Communist Party stated, in a statement commenting on the adoption of the law, that "workers in the mixed, public and private sectors have been waiting for this law for many years, as have workers in the public sector with contracts and wages, to be an alternative to Law No. 39 of 1971 in force," stressing that the law " Necessary, after the increase in the number of workers to about 10 million, 58% of whom work in the private sector, specifically in the informal labor sectors.

 

As for the economist Bassem Antoine, he told Al-Sabah: “The law inspires confidence and contributes to establishing social justice.

 

Antoine added, "The main feature is the presence of social, health and educational security, in stages that can develop and bring about an economic renaissance, because the unemployed will enter the market and add additional income." To make room for work in the private sector and divert pressure from the public office.

 

Hadi added to "Al-Sabah" that "the law contains privileges for the private sector and grants the worker a retirement pension or a guarantee in exchange for subscription, which in general improves wages."

Today, Saturday, the Minister of Labor and Social Affairs, Ahmed Al-Asadi, outlined the most prominent features of the Social Security and Retirement Law for workers, and while stressing the development of instructions and mechanisms to ensure the implementation of the law immediately after its publication in the Official Gazette, he announced the date for completing the automation of all departments of the Ministry of Labor.

 

Al-Asadi said in a speech during the workshop on announcing the legislation of the retirement and social security law for workers, that "the social security and retirement law for workers was waiting for a large segment of Iraqis, which is the segment of workers, as despite the passage of more than 50 years since its legislation, but it was in need of basic and necessary amendments." Pointing out that "legislation over the past five decades was not in force and not implemented in a way that guarantees the rights of workers and the rights of their families even after they are retired."

 

He added, "The Social Security and Retirement Law for Workers is one of the most important laws enacted, not only in this session, but in all sessions of the Iraqi Parliament."

 

He pointed out that "the law has many features that make workers race towards registration according to its advantages, and the most important feature developed in it for the first time since its legislation more than 50 years ago is the government's contribution to pension contributions, as everyone knows that the government usually and the state contribute to retirement contributions." for the national pension, but there is no contribution from the government to the retirement of workers.

 

And he continued: “In the past, the worker paid (5%) and the employer paid (12%).” As for the broader segment of workers, which is the (worker for himself) segment, which contains millions of workers, they did not have a share in this law, and they did not have any privilege. In a retirement that guarantees them a guarantee for their present and security for their future and the future of their families.”

 

And he stressed that "in a fundamental amendment to this law and with the support of Prime Minister Muhammad Shia' al-Sudani, and with the support of the government and the follow-up of the Parliamentary Work Committee, an important and essential article was added, which is that the government supports pension contributions to the organized sector by (8%), to be the total pension contributions (25%) and subsidizes the worker sector for himself or the so-called voluntary guarantee at a rate of (15%), whereby the worker pays (5%) while the government pays three times what the worker pays, and thus the percentage becomes (20%), which is the widest and most comprehensive. for Social Security.

 

He pointed out that, "Also, for the first time, there has been a clear, well-known and known increase in the pension salaries of retired workers by (100 thousand dinars) per month, so that the minimum pension for workers is (500 thousand)."

 

And he continued: "The new law also included giving flexibility to transfer between the private sector and the public sector. When a worker moves from this sector to the public sector or an employee from the public sector to the private sector, the service is counted in both sides of this equation."

 

And he indicated that "the Ministry of Labor is required to work quickly on setting instructions and mechanisms to ensure the implementation of this law, and it is obligated to go immediately after the publication of the law in the Official Gazette, to develop instructions and mechanisms to ensure its implementation."

 

He stressed that "the law obligated the Department of Retirement and Social Security to turn towards electronic automation within a maximum period of one year, and the Ministry, since we assumed its duties, has worked to automate all its departments, the most important of which is the Department of Retirement and Social Security," pledging to say: "The year 2023 will not end unless the departments of the Ministry of Labor have Automation completed.

Shafaq News/ Sana al-Musawi, advisor to the Prime Minister, Muhammad Shia' al-Sudani, saw on Sunday that the approval of the Social Security and Retirement Law for workers will significantly activate the private sector in the country during the coming period.

 

In a statement received by Shafaq News agency, Al-Moussawi said, "Article 25 of the constitution stipulates that the state guarantees the encouragement and development of the private sector in the country on modern bases," noting that "the social security and retirement law for workers will guarantee all workers' rights."

 

 

She added, "This law will support the private sector to find job opportunities for young people, as the approval of this law will guarantee their pension rights, and this is a great achievement for the current government."

 

Mohsen Al-Mandalawi, First Deputy Speaker of the House of Representatives, announced in a statement, on Wednesday, May 17, the completion of the vote on the draft social security and retirement law for workers.

 

The law aims to include workers in the three sectors (private, mixed, and cooperative), and everyone covered by the Labor Law who spend their years working without any real guarantee that guarantees a decent life for them and their families.
