Masrour Barzani arrived earlier this morning in Baghdad and met with Mohammed Shia al-Sudani, where he reviewed the most important files at the national level and ways to integrate the work of the federal and regional governments to provide the best services to citizens throughout and governorates of Iraq, according to a statement issued by the media office of the Iraqi Prime Minister.

 

 

A statement issued by the regional government "witnessed a mutual emphasis on the importance of solving problems between the Kurdistan Region and the federal government on the basis of the constitution and the ministerial curriculum," a statement issued by the regional government said.

Al-Kazemi added, "It is necessary for there to be clarity about what the Kurdistan region exports of crude oil, in addition to the total imports of border crossings and airports, and for there to be transparent figures for the number of employees working in the regional government," noting that "next week will lead to positive results." ".

Last week, the head of the regional government, Masrour Barzani, accompanied by a high-ranking delegation from his government, visited Baghdad, during which he discussed with Iraqi officials the differences and outstanding issues between Erbil and Baghdad.

The center's analysis indicated that the government program set six months to enact two important laws, the Oil and Gas Law and the Federal Court Law. But half of the deadline passed without much progress being made on the two laws necessary to restore relations between Erbil and Baghdad. This means that temporary and short-term solutions remain the only option, while these temporary solutions do not lead to political and economic stability and for this reason the approval of the federal budget has been delayed.  

  

The Kurdish Center stated that the survival of the Federal Court in its old structure makes the relations of Erbil and Baghdad in a state of tension due to the accumulation of rulings issued by a court that does not represent the approved constitutional version, the most prominent of which in the past two years was the abolition of the oil and gas law for the Kurdistan region.

Political initiatives to resolve the dispute between the power parties in the Kurdistan region

The differences between the two power partners in the Kurdistan region are still escalating, and there is no immediate horizon for overcoming them, despite the multiplicity of political initiatives to bridge the rift, which fuels fears of the division of the region and its political and social repercussions, according to a report by the London-based Al-Arab.  

  

  

  

The report, which was followed by "NAS", (January 24, 2023), stated that with the two poles of power in the Kurdistan region of Iraq sticking to their rigid positions towards each other with regard to the mechanism for managing the region's affairs, the chances of reaching solutions, albeit temporary, to the political crisis afflicting the region are gradually diminishing. Amid questions about whether the continuation of the disputes will lead to the division of the region into two independent administrations.  

  

Opposition political forces in the Kurdistan region of Iraq said that they had presented political initiatives based on common factors that they gather with the parties in power, to be a comprehensive project that would resolve the escalating differences between the two ruling parties, the Kurdistan Democratic Party and the Patriotic Union of Kurdistan.  

  

The newspaper quoted observers as skeptical about the ability of the proposed initiatives to heal the rift between the two main parties in the region, as previous initiatives failed to move the stalemate and heal the rift between the two parties, which stand on opposite sides of several outstanding issues.  

  

They point out that despite multiple attempts by parties and other political entities to facilitate an easing of tensions between the Patriotic Union and the Democratic Party, today the conflict has become intense and protracted, and the threat of the division of the Kurdistan region is more dangerous than ever.  

  

The Democratic Party, led by Massoud Barzani, controls the provinces of Erbil and Dohuk, while the Patriotic Union, led by Pavel Talabani, son of the late Iraqi President Jalal Talabani, controls the province of Sulaymaniyah.  

  

The most important differences between the two poles of power are the amendment of the election law and the unification of all financial revenues, as well as the real partnership in managing the system of government.  

  

The last of these disputes was represented by the refusal of the Deputy Prime Minister of the Kurdistan Regional Government, Qubad Talabani, to attend cabinet sessions in the region two months ago, in protest against what he described as the “monopoly” of the Democratic Party in power in Kurdistan.  

  

These events came after the assassination of Colonel Hawkar al-Jaf, one of the most prominent officers in the Anti-Terrorism Institution, on the seventh of last October in the city of Erbil, which led to the boycott of the ministerial team of the Patriotic Union of the cabinet sessions in the regional government, after the Democratic Party accused security leaders in the Patriotic Union of standing behind the assassination.  

  

The refusal of the Patriotic Union to perform its duties in the government had great repercussions on the administration of the Kurdistan Regional Government, in light of the boycott of its members, such as the Minister of Peshmerga, of their governmental duties, which led to the emergence of major problems and the management and organization of the Peshmerga forces, for example, became more difficult, and this, according to analysts, is a dangerous reality for the region. The continuation of the disputes raises enormous fears among the residents of the Kurdistan region, as they realize that the outbreak of any conflict between the two main parties may bring back to mind the past, which witnessed civil war, the emergence of financial crises, and the fragmentation of the region.  

  

The Patriotic Union's complaints that the Democratic Party is financially penalizing Sulaymaniyah, the province in which the Patriotic Union's headquarters is located, have been going on for more than a year. The controversy centers around sharp budget cuts by the KRG that have left PUK-controlled areas such as Sulaymaniyah unable even to pay the salaries of government employees and security forces.  

  

Despite multiple attempts to ease tensions between the Patriotic Union and the Democratic Party, the conflict today has become intense and protracted, and the threat of the division of the Kurdistan region is more dangerous than ever, according to local and international reports.  

  

The leaders of the Patriotic Union say that the income of the province of Sulaymaniyah between oil and tax revenues and the income of two international border crossings is still not sufficient to cover the basic needs of the province's budget and salaries. The lack of funds caused a salary crisis in the Sulaymaniyah regions such as Halabja, Garmian and Rabarin, which led to a delay in the distribution of salaries.  

  

Many observers fear that the continuation of the differences between the two parties will lead to a rift in the political situation of the Kurdistan region of Iraq, and the tendency of each party towards a separate administration within the region, especially with previous statements issued by some quarters in Sulaymaniyah that hinted at this.

Shafaq News / Today, Tuesday, the Minister of Justice of the Kurdistan Regional Government described the Federal Supreme Court's decision regarding the unconstitutionality of the oil and gas law in the region as "the depth of differences" between Baghdad and Erbil, indicating that the decision "has no constitutional and legal basis."

 

"The Iraqi Federal Court played a role in deepening the disputes between Erbil and Baghdad," Minister Firsat Ahmed Abdullah said in a study he published about the disputes between the Kurdistan Region and the central government over the issue of oil and gas, seen by Shafak News Agency.

 

The Minister of Justice added, "The decision has no constitutional and legal basis, and the court played a decisive role in deepening and complicating the conflict between the Kurdistan Region and the federal government."

 

The minister added, "The decision is far from a convincing explanation that is consistent with the legal and material reality of the complaint."

 

On February 15, 2022, the Federal Supreme Court issued a ruling that the oil and gas law in the Kurdistan Regional Government was unconstitutional, and obligated the Kurdistan Regional Government to hand over oil imports to Baghdad.

 

It is noteworthy that the Federal Minister of Oil, Ihsan Abdul-Jabbar, filed a lawsuit against the Minister of Natural Resources in the Kurdistan Region and asked for clarification from the Prime Minister, the Federal Minister of Finance and the Prime Minister of the Kurdistan Region.

And the Federal Minister of Oil asked for the ruling to implement and implement what came with the provisions of the Constitution and related laws and to hand over the entire oil production produced in the region to the Federal Ministry of Oil.

 

A member of the Basra Provincial Council, Ali Shaddad Fares, also filed a lawsuit against the President of the Kurdistan Regional Government and the Speaker of the Parliament of the region, requesting an appeal against the oil and gas law of the Kurdistan Region, as well as an appeal against the decision of the regional government regarding contracting with foreign companies.

 

This decision sparked controversy between Baghdad and Erbil, and it was rejected by the Kurdistan Judicial Council, and parties in Baghdad called for its implementation, while work is currently underway to pass an oil and gas law in the Iraqi parliament, which is a long-awaited law that regulates the relationship between the region and the center regarding oil exports and imports.
