Maybe we should just not be looking for # "40" at all and concentrate on the rest of that statement..."a call for immediate revaluation of currency." I for one would love to see a replay of this speech and hear that part of the sentence for myself....what great news if this were to be true!

After reading all the rumors about this and article 40, I checked my mail, for my brother is a dinarholic, and sure enough he sent me the same thing said he listened to the news link and Maliki was pushing for the revalue of Iraq currency......honestly I dont no what to believe, with all that has gone on recently nothing would surprise me......sure hope it true, and I will try and find more on this, :)

I just received an email that contained the following chat conversation between two of our members:

mailboxmoney - could you please provide some more details regarding Article 40 along with how the government has now been directed to RV? What exactly did they say other than calling for Shabibi to take action? Thank goodness you were able to watch the English translation of this. I guess we now have to determine what exactly "immediate" means to the Iraqi government - is that tomorrow, this week, prior to January 1st, or what?

Here is article #40 of the new 2010 Constitution:

Article 40:

The freedom of communication and correspondence, postal, telegraphic, electronic, and

telephonic, shall be guaranteed and may not be monitored, wiretapped, or disclosed

except for legal and security necessity and by a judicial decision.

Nothing to do with RV.......bummer......

Yes, I found the same copy of their constitution and was about to post the same thing. I haven't had a chance to look over all the articles but I haven't found anything yet that addresses RV.

Maybe it's just someone blowing smoke and telling lies.. Sorry for calling this person out but this person is starting rumors which are not true,,just lies.. It would be nice if everybody who post stuff on this site would just tell the truth and quit the lying,,,,, We all want this RV and we get caught up on lies and get excited.. Please stop lying and just tell the truth

This may be the artilce 40 that they are talking about:

Article 38 [Prime Minister, Council of Ministers]

(A) The Presidency Council shall name a Prime Minister unanimously, as well as the members of the Council of Ministers upon the recommendation of the Prime Minister. The Prime Minister and Council of Ministers shall then seek to obtain a vote of confidence by simple majority from the National Assembly prior to commencing their work as a government. The Presidency Council must agree on a candidate for the post of Prime Minister within two weeks. In the event that it fails to do so, the responsibility of naming the Prime Minister reverts to the National Assembly. In that event, the National Assembly must confirm the nomination by a two-thirds majority. If the Prime Minister is unable to nominate his Council of Ministers within one month, the Presidency Council shall name another Prime Minister.

(B) The qualifications for Prime Minister must be the same as for the members of the Presidency Council except that his age must not be less than 35 years upon his taking office.

Article 40 [Responsibility, Vote of No Confidence] (A) The Prime Minister and the ministers shall be responsible before the National Assembly, and this Assembly shall have the right to withdraw its confidence either in the Prime Minister or in the ministers collectively or individually. In the event that confidence in the Prime Minister is withdrawn, the entire Council of Ministers shall be dissolved, and Article 40 (cool.gif, below, shall become operative. (cool.gif In the event of a vote of no confidence with respect to the entire Council of Ministers, the Prime Minister and Council of Ministers shall remain in office to carry out their functions for a period not to exceed thirty days, until the formation of a new Council of Ministers, consistent with Article 38, above. This is from their Interim Constitution back in 2004.

NO it is NOT a lie........what's happening here is that the person that broke it on KTFM (Dame was not the one that heard it) got the facts wrong. I know these people personally and have dealt with them for a long time, as I was on staff at that forum. You can believe what you want but you don't know what you're talking about. I'll say it again...this was NOT about Article 40, it was the 40th point in Maliki's speech

40-media respect for pluralism and freedom of expression واعتبارهما essential pillars to support the political process and democracy.

I dont know why the anticipation is got people going out of their minds; I guess it proves why investing is not for everyone. People just don't have the stomach for it. Do your due diligence and be patient enough to watch and see if your goal sees its way through. This is the only thing I found on Article 40 of the Iraqi Constitution and it says nothing about a revaluation. This thing will happen when it happen, don't drive yourselfs into a comma because of someones rumor without reference (proof).

Chapter IV - Institutions of the Iraqi Republic

[edit] Section I. The Revolutionary Command Council

Article 37 [supreme Institution] The Revolutionary Command Council is the supreme institution in the State, which on 17 July 1968, assumed the responsibility to realize the public will of the people, by removing the authority from the reactionary, individual, and corruptive regime, and returning it to the people.

Article 38 [Competencies] The Revolutionary Command Council exercises the following competencies by a twothird majority of its members: (a) Electing a President from its members, called President of the Revolutionary Council, who is President of the Republic. (B) Electing a Vice-President from its members, called Vice-President of the Revolutionary Command Council, who replaces the President, as qualified in the preceding paragraph, in case of his official absence or in case of the impossibility of exercising his constitutional competencies or any legitimate reason. © Selecting new members for the Council, from members of the Regional Leadership of the Socialist Arab Ba'ath Party, not to exceed twelve members. (d) Taking a decision concerning the resignation of the President, and Vice-President or any of the Council's members. (e) Relieving any member of the Council's membership. (f) Accusing and prosecuting members of the Revolutionary Command Council, Vice- Presidents, and Ministers.

Article 39 [Oath] The President of the Revolutionary Command Council, the Vice-President and the members take the following oath before the Council: "I swear by Allah almighty, by my honor and by my faith to preserve the Republican system, to commit myself to its Constitution and laws, to look after the independence of the Country, its security and territorial integrity and to do my best earnestly and sincerely to realize the objectives of the Arab Nation for Unity, Freedom and Socialism."

Article 40 [immunity] The President of the Revolutionary Command Council, the Vice-President, and the members enjoy full immunity. No measures can be taken against any of them without a priori permission of the Council. :blink:

Article 41 (a) The President, the Vice-President, or one third of the members can call a meeting of the Revolutionary Command Council. Meetings held are presided by the President or the Vice-President and are attended by the majority of the members. (B) Meetings and debates of the Revolutionary Command Council are closed. Disclosing it, invokes constitutional responsibility before the Council. Decisions of the Council are declared, published and communicated by the means specified in this Constitution. © Laws and decisions are ratified in the Council by the majority of its members, except otherwise stipulated by the Cons

AWWWW so what you are saying is that it was the 40th point and not Article 40 ( like it was originaly posted on the 1st post of this thread )

The 40th point has NOTHING to do with an rv......evidently there is a lot of confusion going on in this thread!!

The one below seems to be one that is in relation to the rv.

I wonder if there is any significance to the order??

18-to achieve stability of the Iraqi economy and stabilizing the national currency and the inflation and unemployment phenomenon through the provision of job opportunities in the private and public sectors.
