From the article...

The judge put a government lawyer on the spot as he heard legal arguments over whether a court in New Jersey or New York should help decide the fate of Villavicencio, who failed to obey a 2010 deportation order before marrying a US citizen and making a life in America.

“Why is he being detained? Is he a threat to the community? Is he a risk of flight?” Crotty asked. “What is the danger to the community for a man who has committed no crime?”

This judge needs to read up on the LAW and if he can't understand the LAW then he needs to step down or get fired. If the pizza guy FAILED to obey

a legal order( Law breaking 101) then he needs to be deported. Their would be no family to "tear apart" had he done so in the beginning.

Stop legislating or rewriting the law from the bench.

Of course it does not say why he was deported. Probably broke the law.  I think some people believe laws are not for them and they are entitled to live in the USA. Probably because polititions are too buy stuffing their pockets full of cash and not doing their number one job, the safety of it's citizens.
