The new understanding between the federal government in Baghdad and the Kurdistan Regional Government, according to an official in the regional government who spoke to Al-Araby Al-Jadeed, includes an agreement to assign the position of deputy director of the Iraqi National Marketing Holding Company (SOMO) to a Kurdish figure, as well as “the return of foreign oil companies operating in the region.” Kurdistan to extract oil from the various fields in the region, because the Kurdistan government has signed a series of contracts with it, and it cannot be canceled, in order to avoid exposing the region to criminal penalties.

The sources confirmed that the Iraqi government will send the quantities of fuel that the region needs for local consumption, provided that they are sold at a price similar to the prices in other Iraqi governorates, which is 450 dinars per liter of gasoline and other derivatives.

In the context, the expert on economic affairs, Nabil Jabbar Al-Nuaimi, spoke about the content of the oil agreement between the Iraqi government and the Kurdistan Regional Government, stressing, in his interview with Al-Araby Al-Jadeed, that “the agreement between Baghdad and Erbil includes, according to the leaks, the joint management of oil sales between the SOMO company.” (Oil Marketing Company affiliated to the Iraqi Oil Ministry) and the Ministry of Natural Resources in the Kurdistan Regional Government.

American pressure

A member of the Kurdistan Democratic Party, Wafaa Karim, confirms that the international pressure exerted by the United States of America succeeded in reaching an agreement between Baghdad and Erbil through the resumption of oil exports.

Karim pointed out, in contact with Al-Araby Al-Jadeed, that "the US State Department played a mediating role and conducted a series of contacts with Turkey and the Iraqi government, because it felt that the continuation of the cessation of oil exports from Kurdistan means that the problems between Baghdad and Erbil will return to square one."

A member of the Kurdistan Democratic Party also indicated that "all oil companies operating in the Kurdistan region have received assurances, and therefore will continue to work within the region, and even those that withdrew will start working again."

In this regard, the consultant and expert specialized in oil affairs, Kovind Sherwani, explained that reaching an agreement between the Iraqi government and the Kurdistan Regional Government was expected.

 

In his interview with Al-Araby Al-Jadeed, Sherwani indicated that "the understandings between the two parties have reached advanced stages with regard to approving the oil and gas law, which includes the management of oil wealth in Iraq in general."

The expert in oil affairs added, "The understandings have made good strides, and Baghdad and Erbil realize that stopping oil exports harms them, and there are daily losses estimated at about $40 million, and this matter increases the deficit in Iraq's financial budget."

The same spokesman explained, "The new agreement will have the largest role in it for the "SOMO" company, and the financial returns will be placed in a special account that is subject to legal review, and the waste will stop after the resumption of oil exports to supply Iraq with millions of dollars.

Shafaq News/ The Presidency of Kurdistan Parliament welcomed, on Tuesday, the agreement concluded between the regional government and the federal government on the oil file.


"After resolving the oil and gas file between the federal government and the Kurdistan Regional Government, the Kurdistan Parliament welcomes the agreement and congratulates the Kurdish and Iraqi people, and hopes that this agreement will be the beginning of a good and common understanding to resolve the rest of the outstanding issues as well," said the Speaker of the Kurdistan Parliament, Rewaz Faiq, in a statement received by Shafaq News agency. .

"The Kurdish people have gone through difficult years of a tiring crisis due to disputes over the oil file, so the people expect all of us to establish a new phase of security, peace and justice among all segments of society and all cities," the speaker of parliament added.


And she concluded, “After confirming the region’s sources of income, we insist on the entitlements of our region within the budget of the Iraqi state,” stressing the necessity for the regional government to “send the draft budget law to parliament in the present and the future, and to fulfill our legal obligations in this regard.”

Today, Tuesday (4 April 2023), the federal government signed an agreement with the Kurdistan Regional Government to resume exporting the region's oil.


This morning, Masrour Barzani arrived in the federal capital, Baghdad, at the head of a high-ranking delegation from the regional government. Immediately upon his arrival, he held a meeting with Al-Sudani, during which he discussed a solution to the problems between the region and the federal government, especially discussing the final stages of the agreement on the oil file and the resumption of the region's oil exports.

The Speaker of the Kurdistan Regional Parliament, Riwaz Faeq, on Tuesday, the oil agreement between Baghdad and Erbil, as the beginning of a common understanding on all controversial files, pointing out that the people are looking forward to a new stage.

 

Faeq said in a statement received by "Baghdad Today", that "the Kurdistan Regional Parliament welcomes the oil agreement reached between the federal government and the Kurdistan Regional Government, and while we congratulate the people of Kurdistan and Iraq for that, we hope that it will be a good precursor to a common understanding on all outstanding controversial files between Erbil and Baghdad and to start a new page of positive relations and joint cooperation."

He added that "the Kurdish people have gone through difficult years of economic crises as a result of unproductive tensions and conflicts due to the oil file."

He continued: "Our people are looking forward to launching a new phase in which guarantee and stability prevail, and justice is enshrined among the groups of society and all provinces and kasbahs, and this is everyone's responsibility."

He pointed out that "in dedication to this principle, and after ensuring the sources of revenues of the region, and as the efforts made to reach an agreement to fix the region's dues in the draft federal budget law, and out of constitutional and legal responsibility and in the same logic of dialogue, negotiation and agreement, the Kurdistan Regional Government is required now and in the future to prepare a draft budget law for the region and send it to the regional parliament in implementation of our legal obligations in this regard."

The Speaker of the Kurdistan Regional Parliament, Rewaz Faeq, commented on Tuesday on the oil agreement between the federal government and the Kurdistan Regional Government.  

    

  

Faeq said in a statement received by NAS (April 4, 2023), "The Kurdistan Regional Parliament welcomes the oil agreement reached between the federal government and the Kurdistan Regional Government, and while we congratulate the people of Kurdistan and Iraq for that, we hope that it will be a good precursor to a common understanding on all outstanding contentious files between Erbil and Baghdad and to start a new page of positive relations and joint cooperation."  

  

She added, "The Kurdish people have gone through difficult years of economic crises as a result of unproductive tensions and conflicts due to the oil file. Our people are looking forward to the inauguration of a new phase in which guarantee and stability prevail, and in which justice is enshrined among the groups of society and all governorates and kasbahs, and this is everyone's responsibility."  

  

She continued, "In dedication to this principle, and after guaranteeing the region's sources of revenue, and as the efforts made to reach an agreement to fix the region's dues in the draft federal budget law, and out of constitutional and legal responsibility and in the same logic of dialogue, negotiation and agreement, the Kurdistan Regional Government is required now and in the future to prepare the draft budget law of the region and send it to the regional parliament in implementation of our legal obligations in this regard."  

  

Earlier, Prime Minister Mohammed Shia al-Sudani announced the agreement to resume the export of oil in the Kurdistan region, stressing that the technical authorities should immediately start implementing the agreement with Erbil.  

  

Al-Sudani said during a joint press conference with the Prime Minister of the Kurdistan Region, Masrour Barzani, followed by "NAS", (April 4, 2023), "The technical authorities must immediately start implementing the agreement with Erbil and find legal ways for this matter."   

  

"The agreement confirms the serious and sincere desire of the federal government and the Kurdistan government to face all the problems and obstacles that have been inherited for years and postponed and in which we have not reached solutions," he said.   

  

He added that "facing these entitlements in a professional spirit stems from the public interest of all the Iraqi people, whether in the Kurdistan region or the rest of the provinces," noting that "this is what has been translated into the draft budget law, expressing his hope that "the House of Representatives will proceed to legislate the budget law as soon as possible to be an umbrella for all the file with manifold details."   

  

He continued: "We are waiting for a merit, which is the legislation of the oil and gas law, which will address everywhere the imbalance that accompanied this file since the adoption of the Iraqi constitution," praising "the efforts of the two parties in the federal government and the Kurdistan Regional Government for the professional and responsible negotiations that have been held, and we hope that they will immediately start implementing the agreement."   

  

Al-Sudani pointed out that "this agreement will pave the way for the passage of the budget law and the texts it contained, which also set the outcome of a dialogue between the federal government and the regional government that dealt with all issues, including the oil and gas file," noting that "there are pending files for years and now there is political will and interest for all Iraqis to proceed and address all these files in the spirit of the constitution and the public interest."   

  

He pointed out that "any delay in export clearly affects the total revenues expected in the 2023 budget, and therefore the deficit rate will rise, and this matter is very harmful to all Iraqis, but starting the implementation of this agreement will reduce the damage."   

  

He noted that "this agreement came as a result of discussions that lasted for several days and in a professional spirit to find a solution to the problem of everyone affected by it, and we must remove all obstacles in order to resume exports, enhance public budget revenues and cover the needs as decreed in the budget law," stressing the need for everyone to abide by this agreement, which is a temporary agreement until reaching the adoption of the budget, which takes legal status and covers all obligations and addresses all problems in this file.   

  

For his part, the President of the Kurdistan Regional Government, Masrour Barzani, that the agreement between Baghdad and the region will be the basis for the budget, noting that Al-Sudani is the prime minister of all Iraqis.   

  

Barzani said during the same conference, "This agreement for all Iraqis will be mainly in the budget, and even the oil and gas law because it will be implemented in a controlled manner," pointing out that "stopping the export of oil in the region is not harmful to the Kurdish people, but to all the Iraqi people."   

  

He pointed out that "the re-export of oil in the Kurdistan region will be beneficial to everyone and that we will seek a comprehensive and good agreement between the federal government and the regional government without leaving any aspect of our constitutional rights, but to enable the relationship between the region and the federal government."   

  

He continued: "I thank Prime Minister Mohammed Shia al-Sudani because he really works as prime minister for all Iraqis, and he took into account the interests of the people of the region and under his supervision this agreement was made, and I assure that it will be good for all Iraqis."   

  

The Prime Minister, Mohammed Shia Al-Sudani, signed with the President of the Kurdistan Regional Government, Masrour Barzani, on Tuesday, an agreement to resume the export of oil from the Kurdistan region to the Turkish port of Ceyhan.  

  

According to the agreement, the position of deputy director of the Iraqi Oil Marketing Company (SOMO) will be granted to the Kurdistan Regional Government.   

  

The President of the Kurdistan Regional Government, Masrour Barzani, arrived on Tuesday in the capital Baghdad accompanied by Minister of Natural Resources Kamal Mohammed to resolve the resumption of oil exports through SOMO.   

  

Earlier, official sources told Reuters that the Iraqi federal government and the Kurdistan Regional Government have reached a final agreement to resume oil exports from the north and that it is scheduled to be announced on Tuesday.  

  

A government official in Baghdad said a formal request had been sent to Turkey to resume oil exports via Turkey's Ceyhan pipeline, with pumping to resume in the next few hours.   

  

Oil and oil imports have been the focus of historical disputes between Baghdad, which insists that exports be federalized through SOMO, and Erbil, which has been granted large financial imports by export control that have contributed to relative economic independence from Baghdad.   

  

The volume of oil exported by the region amounts to 0.5 percent of the volume of global oil exports, but the export halt has pushed global oil prices to $80 a barrel, according to the Financial Times.   

  

According to the same newspaper, the KRG was selling its oil at a large discount in order to encourage buyers.   

  

Turkey halted the flow of oil through the TADAWUL:2360 pipeline from Kirkuk's fields in the semi-autonomous Northern Province to the port of Ceyhan on March 25, after losing a lawsuit brought by Baghdad before the ICC arbitral tribunal.   

  

The pipelines transport about 450,<> barrels per day of oil, according to Reuters.   

  

Iraq began its legal procedures to force the Kurdistan region to stop exporting in conjunction with the end of the second term of former Iraqi Prime Minister Nouri al-Maliki in 2014.   

  

At the end of the same year, the lawsuit was suspended by Abadi's government, and activated again in 2017 before being frozen again.   

  

Outgoing Prime Minister Adel Abdul Mahdi completely suspended the lawsuit at the end of 2019, before former Prime Minister Mustafa al-Kadhimi reactivated it.

The parliament indicated in a statement on Tuesday that the new agreement could push relations and joint cooperation between the two parties to a new positive stage.

The parliament expressed its aspiration, as a representative of the people in the Kurdistan Region, to "inaugurate a new phase in which guarantee and stability prevail, and justice is enshrined among the groups of society and all governorates and kasbahs."

The Kurdistan Parliament, after guaranteeing the sources of revenues of the region, and the efforts made to reach an agreement to fix the region's dues in the draft federal budget law, called on the Kurdistan Regional Government to prepare a draft budget law for the Kurdistan Region and send it to the Regional Parliament in implementation of its legal obligations in this regard.

Baghdad and Erbil reached this morning an agreement signed between the two sides on the export of oil from the Kurdistan region.

Crude exports from northern Iraq via Turkey will resume today after a deal was signed between the semiautonomous Kurdistan Regional Government (KRG) and the federal government in Baghdad.

"Oil exports to resume today," the KRG's head of foreign media affairs Lawk Ghafuri said.

But the deal "is temporary," KRG prime minister Masrour Barzani said at the signing ceremony, which was attended also by his Iraqi counterpart Mohammed Shia al-Sudani. It will remain in effect until Baghdad's oil and gas bill is approved by parliament. This could be in the coming weeks.

Around 400,000 b/d of northern Iraqi Kurdish crude has been kept from reaching international markets since 25 March, after Turkey closed the export pipeline that transports it to the Mediterranean port of Ceyhan — the only viable outlet through which the KRG can export its crude. Ankara's move followed a ruling by the Paris-based International Chamber of Commerce's court of arbitration, which said Turkey had breached a 1973 bilateral agreement with Iraq by allowing crude marketed by the KRG to be exported without Baghdad's consent.

With the deal concluded, Turkey now will facilitate the resumption of pipeline flows to Ceyhan.

The deal stipulates that crude from the Kurdistan region will now be jointly exported by the KRG's natural resources ministry and Iraq's federal oil marketing firm Somo, according to sources. An account will be set up at the Iraqi Central Bank for oil revenues under the KRG's management, which Iraq's federal government will have monitoring access.

The resumption of crude exports comes on the heels of a unflagged decision by eight members of the Opec+ coalition, including Iraq, to collectively cut 1.16mn b/d from their oil production from May until the end of the year. That has increased June Ice Brent prices by around $5/bl to around $85/bl.
