Abdullah expressed his regret at "attempts being made to amend Articles (13 and 14)", adding: "We will not allow their amendment because they are the result of a dialogue between two governments that lasted for several months and have technical and administrative aspects."

 

And he continued, "I told them frankly during the meeting (the Parliamentary Finance Committee meeting) that some articles can be amended, but there are political dimensions to these two articles before they have a financial side."

 

Abdullah indicated in an interview with the "Rudaw" network, followed by "Al-Iqtisad News", that the deputies who wanted to amend the two articles submitted proposals to amend them, "We rejected them."

 

Regarding the other unfinished articles of the draft law, he pointed to the “Chapter on Transfers and Additional Materials,” explaining that “the project consisted of 68 articles when it reached us, and now there are additional materials proposed by the Finance Committee to be added, and the project is at its end.”

 

He noted that "in the event of agreement on the two articles related to the Kurdistan region, I expect the completion of the draft law within one day."

 

Regarding the possibility of voting on the draft budget law next Saturday, he said, "The matter depends on resolving the differences over Articles 13 and 14," adding that "in the event of disagreement, we will not allow the inclusion of more than one proposal for voting, and it must be resolved before that."

 

In this context, he said, "The parliament session is not a place to resolve these differences, and if they exist, the political forces must resolve them among themselves, and without it, we will not allow the parliament session to be held."

 

He added that he and Foreign Minister Fuad Hussein raised yesterday the issue of the two articles to the State Administration Coalition, noting that "it is not a condition that all Shiite deputies want this government to succeed or that they support the agreement" between the federal government and the Kurdistan Regional Government, "as there may be people They do not support the agreement in the Kurdistan region either, and there is a force that is always trying to break the consensus.

Amendment text 

Today, Friday, economic expert Nabil Al-Marsoumi revealed the most important amendments to the 2023 budget with regard to the Kurdistan region, and he said, in a clarification received by (Baghdad Today), that "the Parliamentary Finance Committee voted on several amendments related to Kurdistan, including:

First: Article 13 second/a has been amended, as Kurdistan is committed, according to the government version of the budget, to export no less than 400,000 barrels per day, while this paragraph, after the amendment, provides for the region’s delivery of crude oil produced in its fields at a rate of not less than 400,000 barrels per day to The Ministry of Oil to export it through SOMO or to use it locally in Iraqi refineries.

Al-Marsoumi believed that "this amendment has added a kind of complication to the relationship between the center and the region due to the technical difficulties related to the delivery of the region's oil to the center on the one hand, and because of the stripping of the center of the authority to export oil on the other hand."

Second: Paragraph (c) of the same article was amended, which stipulated the commitment of the Ministry of Finance to pay the region's dues on a monthly basis and to make accounting settlements on a quarterly basis.

The economist explained that "the region was receiving its dues in the 2023 budget before it delivered the oil, but in the new amendment, the region was obliged to pay its oil and non-oil revenues before receiving its share of the budget."

Third: Article 14 was amended first, which stipulated that the total revenues of the region’s oil be deposited in one bank account, and after the amendment, the region became obligated to deposit oil revenues in a bank account opened in the Central Bank of Iraq in Jin. The region was seeking to open the account in Citibank.

Fourth: Preventing the region from extracting oil from the fields of Kirkuk and Nineveh, which are currently under the control of the Kurdistan government, which currently constitutes more than a third of the region's production of crude oil.

Al-Halbousi said, "This law has become the urgent need for its legislation, because oil belongs to all the Iraqi people, and therefore this law will guarantee the right for all."

 

Al-Halbousi added, "The good relationship between the federal government and the regional government will soon prompt the legislation of this law."

Parliamentary move to amend the general amnesty 'law'

The first deputy of the Legal Committee and head of the Sanad Parliamentary Bloc, Mortada Al-Saadi, explained in a statement to the official newspaper, followed by "NAS" (May 27, 2023), that "the laws in the House of Representatives are of two types, the first has a financial side, while the second requires political consensus."  

  

Al-Saadi added, "There are service laws that are in place, as is the case in the Workers' Insurance Law, which Parliament recently voted on, indicating that the rest of the laws will be decided upon after the budget, and Parliament will proceed with many important laws, such as the "general amnesty" law, which is expected to be passed although it of contentious issues.  

  

In 2016, the House of Representatives voted on a general amnesty law and the President of the Republic ratified it based on the provisions of Clause (First) of Article (61) and Clause (Third) of Article (72) of the Constitution.  

  

The previous law excluded the perpetrators of the crimes stipulated in the Iraqi Supreme Criminal Court law, the terrorist crime that resulted in death or permanent disability, the crime of sabotaging state institutions, the crime of fighting the Iraqi armed forces, and every terrorist crime that he contributed to committing with assistance, incitement or agreement.

He added, "There is no amendment to the share of the region in the budget, and it remained as it came from the government 12.67%," noting that "the amendment was added to the scenario of distributing oil exports from the region, which is that Iraq has an export share of 3 and a half million barrels per day of oil, So the share of the region became 400 thousand barrels, and the rest of the provinces exported 3 million and 100 thousand barrels.  

  

He continued: "The signing of oil contracts with companies is carried out by the Iraqi Ministry of Oil and not the region's government, and this is what was confirmed by the Federal Court and the Arbitration Committee in Paris," and indicated that "oil revenues from the four companies operating in the region will be deposited in the central bank account in the name of the Ministry." Finance, and the federal prime minister will authorize the prime minister of the region to spend, and the region's share will be transferred to the bank account provided by the region's government.  

  

Al-Kazemi explained, “A paragraph has been added, which is that the region is not entitled to export oil from the wells of Nineveh or Kirkuk and other materials that control accounts with the region, and there are provisions related to non-oil revenues and handing them over to the federal government,” adding that “there is another article related to the amounts that were The regional government deducts it from the salaries of its employees as compulsory savings, so the law included an article obliging the regional government to pay this savings and return it to the employees at a rate of 10% of the salary per month, until the employees of the region complete their entitlements from the compulsory savings that were practiced on them during the previous period.

Al-Maliki considered that the demands of the Kurdish forces for additional allocations come "to ensure what they have reached ... if they agree to the fait accompli, they believe that the percentage will decrease," stressing that "the current percentage for the region is unconstitutional and illegal."

In a statement to “ Earth News ”, the National Union deputy, Susan Mansour, said that “ the National Union deputies will vote on amending the Finance Committee, and there are other Kurdish parties that agree with us except for the Democratic Party، According to their statements, they are strongly opposed ”.


She added that “ we will vote because the amendment guarantees the people's right and the salaries of employees and also the return of 10% of the employees ’salaries saved every month, and we do not want to sacrifice the interests of the people for political stubbornness or political discord ”، Indicating that “ the amendment that took place does not affect any political party, only its purpose is to preserve the rights and interests of citizens and pay the salaries of retirees and employees on time ”.


The amendments of the Finance Committee to the articles pertaining to the region in the budget created a great deal that led to the postponement of the budget passing session to another notice, after the Democratic Party attacked the members of the Finance Committee and rejected these amendments.


The Democratic Party maintained its agreement with the Prime Minister, Muhammad Shiaa Al-Sawani, as well as the provisions of the political document to form a coalition of state administration, and demanded commitment to it and not to make amendments that contradict the two agreements.


The members of the Finance Committee, for their part, affirmed that the amendments are their right and within their powers, and they have nothing to do with any political agreement, and that they are not bound by these agreements، Because they study the budget and amend most of its items within their legislative role.


The members of the financial committee affiliated with the Democratic Party withdrew from the voting session on these amendments last Thursday, while the party also sent a hint to the National Union and described its approval of the amendments as ” treason and conspiracy ”.
