For his part, the First Deputy Speaker of the House of Representatives, Hakim Al-Zamili, indicated that starting tomorrow, Tuesday, he will hold a meeting with the heads of political forces; To consult on resolving the formation of parliamentary committees, as they are the most important detail and basis for the legislative and oversight work of the House of Representatives.

Al-Zamili stressed the need for this session to be effective and influential in order to achieve the reform that the people aspire to.

For his part, the Deputy Speaker of the House of Representatives, Shakhwan Abdullah, explained that the House is continuing to exercise its oversight and legislative role, and that the discussions of the political blocs regarding the selection of the President of the Republic will not affect the House of Representatives in exercising its oversight and legislative role entrusted to it.

Shafaq News/ An informed source said, on Tuesday, that it was agreed to postpone the resolution of the parliamentary committees until after the election of the president of the republic and the formation of the new Iraqi government.

The source told Shafak News Agency, "The parliamentary political blocs have chosen and distributed their members to the parliamentary committees, and each deputy will be a member of a certain committee."

He added, "The heads and representatives of the political blocs will discuss the distribution of representatives to the committees in today's meeting, which will be held under the chairmanship of the First Deputy Speaker of Parliament Hakim Al-Zamili."

The source pointed out that "the issue of distributing the heads of the parliamentary committees and their deputies will be postponed until after the election of the president of the republic and the formation of the government."

Iraqi lawmakers have failed to elect a new president as key factions blocked the process by boycotting Monday’s parliament session.

A two-thirds quorum of the legislature’s 329 members is required for an electoral session.

But Monday’s vote could not be held as legislators, many of them allied with powerful Shia Iraqi leader Muqtada al-Sadr, stayed away.

Only 58 showed up.

Who announced the boycott?

The boycott was announced on Sunday by al-Sadr, who heads the largest parliamentary bloc with 73 seats.

He was followed by parliament speaker Mohamed al-Halbousi, who heads a bloc of 51 seats.

The 31-seat Kurdistan Democratic Party (KDP) then followed suit.

The Sadrist Bloc made its announcement after Iraq’s Supreme Court temporarily suspended the nomination of frontrunner Hoshyar Zebari, whose presidential bid is supported by al-Sadr.

Why was Zebari’s nomination suspended?

The high court cited pending corruption charges against the veteran Kurdish politician and former foreign minister, adding that the candidacy of the Western-friendly statesman could not proceed until corruption charges from a separate 2016 stint were dealt with.

The 2016 charges against Zebari, for which he was never convicted, stem from his time as finance minister when he was dismissed from the job over alleged corruption.

On Sunday, Zebari denied the charges and said he respected the court’s decision to temporarily suspend his candidacy until the issue is resolved.

What happened at the session?

With no quorum, parliament speaker al-Halbousi kept the session open without scheduling a new date for another vote on a new president.

“The majority of the political parties boycotted the session due to the lack of a political agreement over the president post,” lawmaker Mishaan Jabouri said.

“Parliament will not convene until an agreement is in place.”

What happens next?

Monday’s session reflects the deep divisions among Iraq’s political factions that have only grown since the October 10 parliamentary elections, the results of which have been rejected by political groups supported by neighbouring Iran.

Iraqi politicians have not been able to agree on a compromise candidate for the country’s top post, and the delay raises concerns of a presidential vacuum that would also prevent the appointment of a prime minister.

According to Iraq’s post-war convention, the largely ceremonial post of the president should be held by a member of the country’s Kurdish minority, the prime minister must be a Shia and the parliament speaker a Sunni.

Iraq normally enters months of political deadlock after each general election as the political elite jockey for spots in the new government.

Iraqis are increasingly disillusioned with the political process, accusing nearly all their politicians of corruption.

Political analyst Ihsan al-Shammari said the failure to elect a president is a prelude to political crises that will continue to rage in Iraq until a consensus can be reached.

“Continuing to violate the constitution is an indication of the depth of the political differences between the political blocs and political forces in Iraq,” he said.

The Deputy Speaker of the Iraqi Parliament, Dr. Shakhwan Abdullah Ahmed, chaired an expanded meeting in the Constitutional Hall today, Tuesday, 2/8/2022, with the Ministers of Trade, Alaa Ahmed Al-Jubouri and Agriculture, Muhammad Al-Khafaji, and a number of representatives from various parliamentary blocs, in the presence of the hosting requester, Representative Haider Al-Shamkhi.

Yesterday, Wednesday, Ghazi Faisal, the legal advisor to the Legislation Department in the House of Representatives, presented the legal points that prompted the Iraqi parliament to issue a decision to re-nominate the presidency, a decision that angered several political forces..

 

The presidency of the Iraqi Council of Representatives decided to open the door for candidacy for the position of President of the Republic, starting today, Wednesday, February 9, 2022, for a period of (3) days, after it failed to elect a new president for Iraq after most of the parliamentary blocs boycotted the session due to differences based on this position, and over naming the largest bloc that will result in the formation of the next federal government.

 

Faisal said in a statement, "The Presidency of the House of Representatives issued the aforementioned decision, in which it decided to re-run the nomination process for the position of President of the Republic as another ball, relying on the provisions of the Law No. (8) for the position of President of the Republic, and regarding it we make the following observations:

 

1- Article (3/first) of the law on candidacy for the post of President of the Republic referred to, stipulates that ((who wish to be nominated and who meet the legal conditions stipulated in Article (1) of the law shall submit their written requests accompanied by official documents that prove the fulfillment of these conditions with Their CVs shall be submitted to the Presidency of the House of Representatives within a maximum date of three days from the start of the announcement of the submission), which is evident from the aforementioned text, such as the overnight sun, that the set date is inevitable, as it is not extendable and may not be repeated again..

 

2- There is no connection but rather a schizophrenia between the nomination process and the holding of the parliament session to elect the president of the republic, even if the first paved the way for the second. If the aforementioned session could not be held due to the lack of a quorum, which is expected, and because the period specified by the constitution is organizational and not inevitable, this does not affect the nomination process. And it does not take away from the candidates who really meet the legal requirements.

 

3- Since the decision of the Council of Representatives mentioned above is a legislative decision, it is acceptable to challenge it before the Federal Supreme Court based on the provisions of Article (93/Third) of the Constitution and Article (4/Third) of the amended Court Law for the year 2005 and its internal system, and a request for its annulment due to its collision with provisions the law. Based on the foregoing, the House of Representatives is required to set a new date for the session to elect the President of the Republic so that the electoral process will take place among the candidates who have fulfilled the legal requirements so that the political process in the country is not disrupted and the rest of the constitutional institutions are formed as soon as possible,

and the new parliamentary session will start.

The representative of the Union, Suzan Mansour, told Shafaq News Agency, "Barham Salih is the only candidate for the National Union for the position of President of the Republic, and there is no alternative candidate for Saleh, and what is published otherwise is not true."

 

She added that "there is no political consensus between the Patriotic Union and the Kurdistan Democratic Party regarding the presidential candidate," noting that "the door to dialogue is open between the National Union and the Democratic Party over the position of President of the Republic, despite the change of the agreement between the two parties."

 

Mansour pointed out that "the leadership of the National Union moved against the political forces in order to reach an agreement to choose Barham Salih for the post of President of the Republic."

 

On Tuesday, Parliament Speaker Muhammad al-Halbousi announced the reopening of the nomination for the post of President of the Republic, after the failure to hold the session designated for this purpose.

 

Most of the parliamentary blocs boycotted the session that was scheduled to be held last Monday to elect a new president for Iraq.

 

Twenty-five candidates had applied to fill the position, but the competition was limited to Hoshyar Zebari, the Kurdistan Democratic Party's candidate, and the current president, Barham Salih, the candidate of the Patriotic Union of Kurdistan.

 

And last Sunday, the Federal Court decided to temporarily suspend the procedures for Zebari's nomination; Until a decision is made in a lawsuit brought against him by four deputies, on the grounds that he does not meet the constitutional requirements. The court is scheduled to hear the case next Monday.
