Shafaq News/ The State of Law coalition, led by Nuri al-Maliki, commented today, Tuesday, on the Federal Court's decision to dismiss the case for canceling the first parliament session and electing the Presidency of the Council.

The leader in the coalition, Adel Al-Manea, told Shafaq News Agency, "The Federal Court, if its specialization is constitutional legal, but it mixed between the political position and the legal position, and therefore it took into account the political aspect more than the legal one, indicating that its decision "has a clear political aspect."

Al-Manea added that "great pressures were placed on the Federal Supreme Court, and for this reason its decision was more political than legal and constitutional, and this same thing happened in the case of appealing the results of the early parliamentary elections."

 

Earlier in the day, the Federal Supreme Court of Iraq settled the controversy and issued a ruling on the legality of the first session of the Iraqi parliament.

 

And the Federal Court decided to reject the appeal in the first session of Parliament submitted by Representative Bassem Khashan, considering the session as legitimate and choosing the presidency of Parliament as legitimate. It also decided to charge the costs of the case to Representative Bassem Khashan.

Today, Tuesday, Parliament Speaker Muhammad Al-Halbousi thanked the Iraqi judiciary after the decisions of the Federal Supreme Court.

"Thank you to the independent Iraqi judiciary and its professional role in preserving state institutions and constitutional contexts," Al-Halbousi said in a tweet posted on his official account on the "Twitter" website.

 

Earlier in the day, the Federal Federal Court rejected the challenge to the legitimacy of the first session of Parliament, during which Al-Halbousi was elected president by an absolute majority of 200 votes, as well as the election of Hakim Al-Zamili as his first deputy and Shakhwan Abdullah as second deputy.

ULAIMANI — The Iraqi Federal Supreme Court on Tuesday (January 25) rejected the appeal of the first session of parliament and canceled the state order to stop the work of the presidency.

MPs Basem Khashan and Mahmoud Daoud filed the appeal on January 13, claiming there were legal and constitutional violations during the first session of the Iraqi Parliament.

The appeal resulted in the suspension of Iraqi Parliament Speaker Mohammed al-Halbousi and his two deputies, Hakim al-Zamili and Shakhawan Abdullah, who were elected during the first session of parliament that was held on January 9, which came following elections on October 10, 2021.

The first parliament session was ruled legitimate on Tuesday, as well as Halbousi’s nomination as speaker, an NRT correspondent stated following the ruling.

"The Federal Court ruled MP Khaled al-Daraji presiding over the first parliament session, does not contradict the provisions of the constitution,” the NRT reporter explained, adding the court decided to cancel the state order for the temporary suspension of the work of the parliament presidium.

Daraji took the role of interim speaker over the first session of the Iraqi Parliament after Mahmoud al-Mashhadani collapsed during a disruption of parliament on January 9 when a scuffle broke out between MPs from the Sadrist Movement and the Coordination Framework.

Following the first session, the Iraqi Parliament has 30 days to elect a new president.

ERBIL — Iraq’s Shia cleric and the leader of the Sadrist Movement, Muqtada al-Sadr, has reiterated commitment to formation of a “national majority government” despite growing political tensions with Shia rivals. 

The influential cleric, whose party emerged victorious in the last October’s parliamentary elections, invited other factions to join him and help the formation of the new Iraqi government. 

Sadr’s statement was issued to welcome the decision by the Federal Supreme Court which approved the first parliamentary session on January 9 as “legal and constitutional”. 

He said the decision proved the court’s impartiality despite immense pressures imposed by political factions to influence the decision and interfere into the legal procedures. 

Earlier the day, the Federal Supreme Court reviewed a lawsuit filed to annul the outcome of the first session of the newly-elected parliament, saying the process was constitutional with no violations recorded. 

MP Mahmoud Mashhadani and MP Basim Khashan had filed a lawsuit claiming that legal and constitutional violations were committed during the first session on January 9 when Muhammed al-Halbousi was re-elected as the parliament speaker.

The lawsuit forced the Federal Supreme Court to temporarily suspend the parliament presidency and begin processing the complaint.

He continued, "This is what actually happened, as the first session was held after fifteen days from the date of ratification, and therefore the session is legal and constitutional, and there may be outputs for this session, which is that there is a party that forms the government and a real opposition may be monitoring the real form of the political process and the work of the Council of Ministers." after its formation.

In the same context, legal representative Ali Al-Tamimi said that "Aliya Nassif's lawsuit and the other deputy who is with her is different from the lawsuit decided by the court today regarding the membership of Parliament Speaker Al-Halbousi and the first session differs. Because Alia Nassif's lawsuit relates to the most numerous bloc and was postponed to one day, nine. Where does the Supreme Court derive this strength to confront partisan and political currents that control everything in and out of the country, and block the way to the political towers that built it, and it always had the final say in everything? Perhaps from its courage, independence and impartiality in defending the articles of the constitution in a country like Iraq that has suffered decades of politics and politicians’ interference in everything, and the dominance of many regional players on the game of internal balances, and charting the course of Iraq’s future and the destiny of its citizens? Will it suffice for it to take refuge in the legal texts and their interpretation to help the Iraqis recover the dream? Or will it set fire to the internal political and security fronts, without realizing it, especially after its expected third decision within days? This issue may not concern the Supreme Court much, but the most difficult test in the developments of the Iraqi scene concerns Iran before others, as it considers itself the first regional player influencing the internal, partisan, political and religious balances of the Iraqi interior. There is no difference between the commander of the Quds Force in the Iranian Revolutionary Guard, General Qassem Soleimani, and his successor, General Ismail Qaani, because the threads of the game are determined by Tehran within the framework of one goal, Iran's Iraqi interests. And the Iranian leadership’s haste in sending Qaani to meet with the Iraqi Shiite forces, which are now divided in two halves in dealing with the political scene, goes far beyond the process of trying to read a position, feel the pulse, or mediate for good. These meetings are a direct warning not to cross the red lines that contradict or prejudice Tehran's interests in Iraq, because they will be a prelude to targeting Iran's accounts and regional influence, specifically in the Gulf, Lebanese, Syrian and Yemeni circles. The battle of the Iraqi presidential elections will help us to discern the features of the next political stage. Will the main Kurdish forces reach an understanding among themselves on naming the next president to support al-Sadr, or will a confrontation take place between Barham Salih and Hoshyar Zebari, consolidating the existing partisan and political balances and alignments in the country? The positions of the Iraqi parties and forces affiliated with Iran towards Al-Sadr, Al-Halbousi and Masoud Barzani, today’s allies, will go in a greater upward direction, when things become more clear, after approaching the nomination of the Prime Minister-designate, which is the most difficult test for Iraq and Iraqis, perhaps between submitting and respecting the decision of the Constitutional Court or going after the option of escalation. Political and security issues, especially if the Constitutional Court decided the issue in favor of al-Sadr, and he got what he wanted.

Muqtada al-Sadr is pragmatic, and he will not abandon his relations with Iran, especially if it gives him the government share he wants.

The important thing now is to know how Al-Sadr's reactions and positions will be in the next stage. Will he enter into new understandings with Tehran, keeping it at the forefront of the scene in return for controlling those who are affiliated with it, or will Tehran give him a short time opportunity, then adopt the call for new parliamentary elections that will restore things to the way they were years ago? The answer is also with the regional players who have begun to announce their positions in support of change, and open the way for a new political stage in Iraq. Will they enter into a confrontation with Tehran, or will they join a plan of understandings and settlements on the Lebanese way that keeps matters between the commentator and the absolute?

The expansion of understandings between the Sadr leadership and the rising Sunni and Kurdish forces affiliated with Massoud Barzani angered the Shiite wing affiliated with Iran in Iraq. Qaani's dispatch to Baghdad came with the aim of helping to resolve the political crisis between the Shiite forces there, but the Turkish and Gulf moves to stand by Iraq are described as "Sunni" interference in the country's affairs and an option to support one party at the expense of another?

Muqtada al-Sadr is pragmatic, and he will not abandon his relations with Iran, especially if it gives him the government share he wants. The "Shiite Shiite" crisis in Iraq is circumstantial. Iran will not allow it to continue for more than that, as its goal there is a political, economic, and strategic goal of a regional nature, which may be far beyond what is said about the sectarian options.
