In response, the KRG has said that it will start transferring 250,000 barrels of oil per day, as required by the budget law. However, with the drop in the global price of oil, the offer is worth far less than it was just a few weeks ago.

 

It's ILLEGAL, to the one who thinks he's been wronged but I would ask this POS if not sending the oil last month was legal. I really don't know how all these crooks an thieves can keep up with who owes who...there has to be a great movie here.

SULAIMANI — Likely alluding to tensions between Baghdad and Erbil, Iraq’s Prime Minister-designate Mustafa al-Kadhimi said on Monday (April 27) that all factions should put the country’s interest ahead of all else. 

“I will only accept what is in the true interest of Iraq, and reject any pressure aimed at undermining it. We should all prioritize what is best for our country,” al-Kadhimi said in tweets written in Arabic, Kurdish, and English.

On April 16, the federal Council of Ministers froze budget transfers to the Kurdistan Regional Government (KRG) after patience ran out with Erbil’s failure to live up to its obligations under the 2019 federal budget law, in particular its refusal to send oil to Baghdad for export.

In response, the KRG has said that it is committed to transferring 250,000 barrels of oil per day, as required by the budget law, but also drew harsh criticism from senior KRG officials.

Referring to the freeze as “political” and a “punishment,” KRG Prime Minister Masrour Barzani said on Monday that it was “against the constitutional rights of the Kurdistan Region and its people.”

ERBIL, Kurdistan Region – Baghdad is withholding the Kurdistan Regional Government (KRG)’s share of the Iraqi federal budget to “punish” the Kurdish people, Prime Minister Masrour Barzani told the United Nations special representative to Iraq during her visit to Erbil on Monday. 

In a statement following his meeting with UNAMI chief Jeanine Hennis-Plasschaert, the KRG prime minister lashed out at Baghdad for using the Region’s share of the budget as a “political trump card”.

“The federal government should not use the matter of salaries and the financial entitlements of the Kurdistan Region as a political trump card to punish the people of the Region,” Barzani told Hennis-Plasschaert, according to the KRG statement.

On April 16, Iraq’s caretaker Prime Minister Adil Abdul-Mahdi called on the finance ministry to halt budget transfers to the KRG and to take back all transfers made since January 1, 2020. 

Baghdad said the KRG has failed to deliver its quota of 250,000 barrels per day (bpd) of oil to the state marketing firm SOMO in exchange for its share of the budget. 

Erbil has not delivered a single barrel of oil since the agreement was reached in December. However, Barzani called the move “politically motivated”. 

“The decision to cut the Kurdistan Region’s budget, half of which goes to civil servants, is politically motivated and against the people of the Kurdistan Region,” Barzani added.

Hennis-Plasschaert was in Erbil to discuss several burning topics with KRG officials, including the formation of a new government in Baghdad and the Region’s response to the coronavirus outbreak. 

UNAMI is likely providing external mediation in the renewed Erbil-Baghdad confrontation. 

Monday’s meeting was also attended by Dr. Adham Rashad, representative of the World Health Organization (WHO) in Iraq, who has supervised the national response to the coronavirus outbreak. 

According to the KRG statement, Hennis-Plasschaert commended the KRG’s “unprecedented” response to the pandemic. 

She also met with health minister Saman Barzanji and minister of state Khalid Salam Saeed.

A separate statement on the UNAMI Facebook page confirmed Hennis-Plasschaert and Barzani discussed the Erbil-Baghdad tensions but did not elaborate on the substance of the discussion. 

The oil-for-budget agreement between the KRG and the Iraqi federal government had been years in the making.

The KRG started exporting its oil independently of Baghdad via its own pipeline to the port of Ceyhan in 2013.

The independent oil sales infuriated the Iraqi government of Nouri al-Maliki, which cut the Kurdistan Region’s share of the federal budget from 17 percent to zero in 2014. 

The move coincided with the outbreak of war with the Islamic State group (ISIS), a massive displacement crisis, and the collapse of world oil prices, which coalesced to plunge the Kurdistan Region into financial crisis. 

The Region has been steadily recovering since former Iraqi PM Haider al-Abadi reinstated a portion of the KRG’s budget in late 2018 and Abdul-Mahdi secured a bigger lump sum under the 2019 budget. 

In return for its 12.67 percent share of the 2019 federal budget, the KRG was supposed to send SOMO 250,000 bpd, but has consistently failed to do so, claiming contractual arrangements and debts owed to foreign oil companies prevented the handover.

The arithmetic behind the December deal has no doubt been shaken in recent months by the ongoing political crisis in Baghdad, the collapse of world oil prices, and the economic slowdown sparked by the pandemic.

Iraq depends on oil sales for 90 percent of its state revenues. Painful austerity measures are expected if Baghdad is to weather the financial storm.

The letter, which consists of ten points, says that Baghdad’s recent move to stop sending money to Erbil to pay government salaries violates the legal and constitutional rights of public servants in the Region, who have done their jobs same as those in central and southern Iraq.

Moreover, it notes that Baghdad had not been paying the Region’s full share of the federal budget, even before it cut off all payments. Moreover, it accused Baghdad of failing to pay the salaries of the Peshmerga, which is constitutionally part of Iraq’s defense forces.

The letter also noted that federal transfers were cut off between 2014 and 2019, which it said totals $452 billion in lost revenue.

Additionally, the KRG demands $384 billion in compensation for damage caused and abuses perpetrated by former Iraqi governments against the Region between 1963 and 2003.

The letter arrived as a delegation of senior KRG representatives was visiting Baghdad for talks with federal officials and foreign diplomats.

The letter stated that "The Kurdistan Region deserves a monthly ratio of 1/12 of the actual expenditures of current expenditures for the fiscal year 2019 similar to the rest of the Iraqi provinces, but the financial dues for the region were not spent in the first three months of the year 2020, except for the compensation of the region's employees amounting to 452 billion dinars, which The General Secretariat of the Council of Ministers demands that it stop what is considered a violation of the law.

And the Kurdistan Regional Government said in its message that "Article 10 / II-c of the Federal Budget Law 2019 stipulated the commitment of the Federal Government to pay the dues of the Kurdistan Region, including employee compensation, and the amount of damage is deducted from the region's share in the event it does not deliver the prescribed share of oil."

And she stated, "Relying on the special paragraph of Article 27 of the Financial Management Law to stop funding the salaries of the region is not in order, and also affirmed that the region still houses more than a million refugees and displaced persons, which makes it bear their costs and without the slightest contribution from the federal government."

She also said, "The federal government did not send the region's dues from February 2014 to 2019, which forced the region to find sources to finance its expenses and needs through borrowing, austerity measures, and reducing public expenditures and compulsory savings."

She noted that "the region supports the settlement of financial dues between the region and the federal government for those years in accordance with the mechanisms stipulated in the federal budget laws to achieve the rights and obligations of the two parties."

The letter stressed, "The steadfast position of the territorial government in resolving the file in accordance with the constitution and the law and on the basis of partnership, and requested reconsideration of stopping the financing of employee salaries in accordance with the joint recommendation reached as a result of the meeting held in Baghdad on April 20, 2020."

The provincial government attached tables and documents with its message, among them a table for the reparation of damages resulting from the crimes of the previous regime committed in the Kurdistan region from 1963 to 2003, which totaled (384,698,302,600) dollars for human, material and environmental losses and willful neglect of the infrastructure.

In another document, the letter confirmed that the Kurdistan Regional Government spent $ 7,051,909,024 as costs to accommodate the displaced and refugees from 2014 to 2019, and also included expenses on securing fuel for electricity generation in Kirkuk for the period from 2011 to 2020.

Shafaq News / A delegation from the Kurdistan Regional Government, who is visiting Baghdad, held talks with the federal government to resolve the differences and outstanding issues between the two sides.

A source in the delegation told Shafak News that the first meetings were held in the second round with the Minister of Oil, Planning, Secretary General of the Council of Ministers, and Advisor to the Prime Minister of Iraq.

The delegation of the region had held last week a round of discussions with the Iraqi government, as well as consultations with leaders and officials of Iraqi political parties on resolving the outstanding differences between Baghdad and Erbil.

The visit came days after the Iraqi government cut the salaries of employees of the Kurdistan Region after it said that the region had not fulfilled its obligations in the financial budget represented by the delivery of 250 thousand barrels of oil per day to the federal government.

The agreement includes the delivery of the Kurdistan Region, the amount of 250 thousand barrels per day of oil to the Federal Government in return for handing Baghdad a share of about 13 percent of the budget to the region in addition to the salaries of employees and peshmerga.

The cut in the salaries of the employees of the region sparked widespread criticism inside and outside the region, where observers considered that this decision comes in the context of political pressure coinciding with the efforts of Prime Minister-designate Mustafa Al-Kazemi to form the new government.

There are pending issues between the two sides for many years, chief among them the disputed territories, how to manage oil wealth, the budget of the Peshmerga forces, and others.

The delegation, headed by Kurdistan Region Deputy Prime Minister Qubad Talabani, arrived in Baghdad on Tuesday for the second round of talks with the Iraqi federal government in hopes of finding a solution to their disputes.

The delegation, accompanied by Kurdish members of the Iraqi parliament gathered at Iraqi President Barham Salih’s palace a day earlier to discuss the position of Kurds in the ongoing issues, especially with regards to PM-designate Mustafa al-Kadhimi’s future government.

Kadhimi is expected to submit his cabinet lineup to the parliament today where MPs would convene to vote.

On Thursday, the Finance Committee of the House of Representatives requested detailed data on the numbers of employees in the Kurdistan region.
