When looking at the Iraqi constitution - specifically in the first section of it on executive power, which speaks of the President of the Republic - we find that the words of the Vice President of the Republic have been mentioned in three places. 
The first place in Article 69 / II, which reads: "The provisions of the selection of one or more deputies of the President of the Republic shall be regulated by law." 

According to this text, we find that the legislation of this law is mandatory for the House of Representatives as the federal legislative authority in Iraq, which actually happened by Law No. (1) of 2011, which came in the name of "the law of the Vice-President of the Republic," published in the Iraqi facts number (4174) In (24/1/2011).



1. The number of Vice-Presidents of the Republic of the Supreme Council shall be referred to the Chamber of Deputies in the law which it legislates as a legislative option, after the Constitution has stated its minimum "deputy" or more. 

2 - The law - which the Constitution is required to enact, determines the mechanisms of appointment according to the vision of the legislator, which is also a legislative option. 

In conclusion, the enactment of the law is mandatory, but the mechanisms included in the appointment and the number of deputies of the President of the Republic subject to the choices of the House of Representatives in the provisions of that law.

The second place in which the position of Vice President is mentioned is Article 75 (II) of the Constitution, which states: "The Vice President shall replace the President in his absence." Khudair al-Khuzaie, who was vice president during the second election session replacing former president Jalal Talabani when the latter was dealt with in Germany, and that this substitution does not coincide with a specific period of time, but ends with the end of the absence and the return of the President of the Republic. 

The third position is mentioned in Article 75 / III of the Constitution, which states: "The Vice President of the Republic shall replace the President of the Republic when his office is vacant for any reason. The Council of Representatives shall elect a new President within a period not exceeding thirty days from the date of vacancy."

Examples of the absence of the post, such as the death of the President of the Republic, the loss of one of the conditions for his continuation in office, or the dismissal of him in accordance with the constitutional contexts. The position of his deputy in this case shall be within a time limit not exceeding thirty days from the date of vacancy, In accordance with the provisions of the Constitution, and the Law on the provisions of candidacy for the post of President of the Republic No. 8 for the year 2012. 

Returning to the law of the Vice-President of the Republic, we find that Article (1) stipulates that "the President of the Republic when he assumes his constitutional duties as two or more that not More than three, and presents this nomination to the House of Representatives for approval Balag Endodontic ".



This means that the House of Representatives in accordance with the law in force has no choice in the options of the President of the Republic to a certain number of deputies - provided that not more than three - in the exercise of his competence to ratify that nomination, and if he so wishes to amend the law of Vice President of the Republic reduces Number, in accordance with the legislative contexts provided for in the Constitution. 

But the House of Representatives refused to approve the nomination of someone for the post of Vice President of the Republic, and the President of the Republic nominate alternative. 

Upon ratification of the nomination, the Vice President of the Republic shall recite the oath stipulated in Article 50 of the Constitution before the Chamber of Deputies.

We are just going to have to watch this because one of the things that they have to do according to the constitution, is that when a person runs for government they have to be cleared through accountability and justice which is the law and office that makes sure that these nominations are not disqualified because they have done something in the past while serving with the former government of saddam hussein. I think what they are trying to say in a couple of these articles is that in the rush to form the government they may not have ran these people through that process. Granted it should have been done when they ran for election from the start, but we know how well the electoral commission worked on that one, so i think they are trying to make things right so that things cant be undone later. I totally agree!  Yet, I do believe that Sadr, who won the popular vote is keeping a very close eye on Mahdi's government and the possibilty of corruption.  When I see Sadr speak out about the government formation I'll be worried.  I honestly think, the government portfolio Mahdi put together is comprised of the best, non corrupt technocrats, he could find.
