Indian Civil Rights Act of 1968 (25 U.S.C. §§ 1301-03)

§ 1301. Definitions

For purposes of this subchapter, the term -

  1. ''Indian tribe'' means any tribe, band, or other group of Indians subject to the jurisdiction of the United States and recognized as possessing powers of self-government;
  2. ''powers of self-government'' means and includes all governmental powers possessed by an Indian tribe, executive, legislative, and judicial, and all offices, bodies, and tribunals by and through which they are executed, including courts of Indian offenses; and means the inherent power of Indian tribes, hereby recognized and affirmed, to exercise criminal jurisdiction over all Indians;
  3. ''Indian court'' means any Indian tribal court or court of Indian offense.

§ 1302. Constitutional rights

No Indian tribe in exercising powers of self-government shall -

  1. make or enforce any law prohibiting the free exercise of religion, or abridging the freedom of speech, or of the press, or the right of the people peaceably to assemble and to petition for a redress of grievances;
  2. violate the right of the people to be secure in their persons, houses, papers, and effects against unreasonable search and seizures, nor issue warrants, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched and the person or thing to be seized;
  3. subject any person for the same offense to be twice put in jeopardy;
  4. compel any person in any criminal case to be a witness against himself;
  5. take any private property for a public use without just compensation;
  6. deny to any person in a criminal proceeding the right to a speedy and public trial, to be informed of the nature and cause of the accusation, to be confronted with the witnesses against him, to have compulsory process for obtaining witnesses in his favor, and at his own expense to have the assistance of counsel for his defense;
  7. require excessive bail, impose excessive fines, inflict cruel and unusual punishments, and in no event impose for conviction of any one offense any penalty or punishment greater than imprisonment for a term of one year and [1] a fine of $5,000, or both;
  8. deny to any person within its jurisdiction the equal protection of its laws or deprive any person of liberty or property without due process of law;
  9. pass any bill of attainder or ex post facto law; or
  10. deny to any person accused of an offense punishable by imprisonment the right, upon request, to a trial by jury of not less than six persons.

§ 1303. Habeas corpus

The privilege of the writ of habeas corpus shall be available to any person, in a court of the United States, to test the legality of his detention by order of an Indian tribe.

Each of these reservations are a nation within a nation. Very few federal laws are excepted as law. We as a native people have never even after all these years never been given citizenship in the USA if living on the reservation.

Tribal sovereignty in the United States refers to the inherent authority of indigenous tribes to govern themselves within the borders of the United States of America. TITLE: Tribal Governments and Tribal Police Departments Equal With Any

Department or Agency of United States

WHEREAS, we, the members of the National Congress of American Indians

of the United States, invoking the divine blessing of the Creator upon our efforts and

purposes, in order to preserve for ourselves and our descendants the inherent sovereign

rights of our Indian nations, rights secured under Indian treaties and agreements with

the United States, and all other rights and benefits to which we are entitled under the

laws and Constitution of the United States, to enlighten the public toward a better

understanding of the Indian people, to preserve Indian cultural values, and otherwise

promote the health, safety and welfare of the Indian people, do hereby establish and

submit the following resolution; and

WHEREAS, the National Congress of American Indians (NCAI) was

established in 1944 and is the oldest and largest national organization of American

Indian and Alaska Native tribal governments; and

WHEREAS, tribal law enforcement officers are faithful citizens of this

Nation, sworn to the Constitution of this nation and tribal government they represent;

and

WHEREAS, tribal law enforcement officers work for the more than 500 tribal

police agencies in our nation; and

WHEREAS, tribal law enforcement officers defend all citizens from crime

and are partners in homeland defense; and

WHEREAS, in a national homeland security strategy tribal law enforcement

officers need to be prepared and equipped to respond to terrorism events and potential

terrorist activities without the risk of limited firepower, which is standard in non-tribal

law enforcement departments; and

WHEREAS, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF)

is responsible for enforcing the provisions of the Gun Control Act of 1968 (GCA); and

WHEREAS, language needs to be added/included in 18 U.S.C. Sec.

922(w)(3)(A) to add/include Tribal Governments/Tribal Police Departments as being

exempted and authorized to possess large capacity ammunition feeding devices (a

firearms magazine) that holds more than ten (10) rounds of ammunition; and

WHEREAS, tribal governments, as sovereign nations, are afforded the respect

of a consultation process in matters affecting the health, safety and welfare of their

tribal nations; and

WHEREAS, the United States Department of Justice, Office of Tribal Justice and all

other branches of our Nation's government engage in a consultation process with Tribal

Governments in matters of treaty trust responsibility; and

WHEREAS, a September 30, 2004 sunset clause on this statute creates the need for

immediate attention as an emergency resolution status for consideration by this assembly; and

WHEREAS, a consultation is proper and in order for adding/including the language of

Tribal Governments/Tribal Police Departments into 18 U.S.C. Sec. 922 (w)(3)(A); and

WHEREAS, equal treatment and application of the Gun Control Act for our Tribal

Governments/Tribal Police Departments is in order.

NOW THEREFORE BE IT RESOLVED, that the NCAI does hereby call upon our

Nation's administration and Congress to engage in a consultation process with Tribal

Governments and Tribal Police Departments to include them in the statutory language of 18

U.S.C. Sec. 922(w)(3)(A) as being exempted from the provisions of said statute and thereby be

on equal footing with any department or agency of the United States, and further, be authorized

to possess large capacity ammunition feeding devices that hold more than ten (10) rounds of

ammunition.

The foregoing resolution was adopted at the 2004 Mid-Year Session of the National Congress of

American Indians,

American Indian law: an overview

In U.S. law the term "Indians" refers generally to the indigenous peoples of the continent at the time of European colonization. "Alaska Natives" and "Native Hawaiians" refer to peoples indigenous to the areas occupied by those named states. The terms "tribe" or "band" designate a group of Indians of the same or similar heritage united in a community under one leadership or government and inhabiting a particular territory. Because Indians have increasingly preferred "nation" or "people," the term "tribe" has become controversial. The terms used may vary from statute to statute and case to case as well.

States may recognize particular Indian groups, even if the federal government does not recognize the group. To determine whether a group will be recognized, courts and legislatures examine such factors as the extent of Indian governmental control over individual lives and activities, the extent to which the group exercises political control over specific territory, and the continuity of the group's history.

Federal law recognizes a special kind of Indian sovereign authority to govern themselves, subject to an overriding federal authority. Indian tribes are considered by federal law to be "domestic, dependent nations." Congress enacted this sovereign authority to protect Indian groups from state authority. This sovereign authority extends to Indian tribal courts, which adjudicate matters relating to Indian affairs. The U.S. Supreme Court heard a case in in 2008 concerning the extent of tribal courts' jurisdiction. In Plains Commerce Bank v. Long Family Cattle Co. (07-411), the U.S. Supreme Court reaffirmed a long-held principle that tribes do not have jurisdiction over non-Indians conducting activity on a non-Indian fee simple, even if on an Indian reservation, unless the activity threatens the welfare of the tribe.

There are numerous federal statutes dealing with Indian rights and governance, such as the Indian Reorganization Act, and the Indian Civil Rights Act (also known as the Indian Bill of Rights). 28 U.S.C. § 1360 deals with state civil jurisdiction in actions in which Native Americans are parties.

If the exact time of the dawn of destruction of The Americas and

the indigineous people thereof is to be exposed,

and as for who is responsible for the disease, disrespect, slaughter, theft, lies,

slavery, abuse, rape, illness....

look no further than the vatican.

And they're still up to no good, even today.

They've even gone so far as to defile their own Church, Lord and

Saviour with their misdeeds in the name of wealth and power

using God and His Son as a smokescreen.

+1 Sgt I also feel that what has happened in the past has no bearing on my future other then knowing just what a govt can and will do to justify there means. But If you read carefully whats above they have in a way helped us in the coming strife. As a nation within a nation bound by certain treaties They are obligated to these treaties by their own and international UN law. If I break a law and run to the reservation the federal courts must extradite me from that reservation and only with the approval of the Indian counsel. So this has kind of bit them in the a$$ so to speak. I personaly know brothers out west who live on the larger reservations that own fully automatic weapons . That the counsel has approved and they are untouchable by federal law

I annoys me to see a country such as the United States of America falter as it has in the past decade ..... a country witch started from nothing and became the biggest economy on the planet in such a short time and now teeters on the brink of destruction .... but then as i write this on my laptop and look around my living room I can see furniture older than your constitution that will probably outlive me and you, maybe this the inevitable end of all great empire's ..... after all the roman's failed, I haven't seen a civilization since that even came close to them.

The same spirit that made this country great is still alive and well over here. We are going through a time of struggle but we will survive this. The liberal socialist movement has not taken our country although it is in a prominent position now. We will take this Union back and emerge stronger in doing so. The world will again see a USA that offers hope and strength to all who desire it.

The liberal socialist movement has not taken our country although it is in a prominent position now. We will take this Union back and emerge stronger in doing so. The world will again see a USA that offers hope and strength to all who desire it.

We were neither. When our people crossed the Bering sea as they suggest. There was no Americans or Europeans they did not exist It`s also theory that we came up from south america. Its also theory that we came from outer space. hahahahahahaha

What I was referring to as Europeans were the early Americans as u said in your post not the first Americans

The first Americans as in the native Americans or American Indians were a mix of tribes from what is now Russia and south America .

Well that's what I'm lead to believe I'm no expert on this subject

I recall the great movie "Blue Soldier" ( with Candice Bergen) which came out in the 70's and created quite a stir as was allegedly the first ever movie talking about Indians and actually featuring some Indian People as actors .

Thanks Dog.... I translated from Italian where title was infact "Soldato Blu" as in italian we put adjective always after noun ( most of the time, at least) so I thought that in english had to be "Blue Soldier" as in english usually adjective goes before noun.

In this case it was exactly like in italian then. Thanks.
