Legal expert: Parliament does not have the authority to terminate the assignment of acting ministers

He added that "it is not within the authority of Parliament to terminate the mandate, but it should be terminated by the same appointing authority, and this authority has the right to appeal the Council's decision before the Federal Court."

Shafaq News/ Two law experts confirmed today, Tuesday, that the decision to end assigning the Minister of Finance an agency is outside the powers of the Iraqi Parliament and is not binding on the caretaker government headed by Mustafa Al-Kazemi.

The expert, Muhammad Majid Al-Saadi, told Shafaq News Agency, "The termination of the assignment of the Minister of Finance as an agency is not among the constitutional and legal powers of the House of Representatives," noting that this authority is for the Prime Minister and the minister has the right not to implement this order.

He added, "The decision to assign the Minister of Finance as an agency, was issued by the Prime Minister, and the Parliament can issue a recommendation to Al-Kazemi, and not end the assignment of one of his ministers as acting, because this violates the principle of separation of powers, and for this decision was not implemented by the minister and the government."

For his part, the legal expert, Muhammad al-Samarrai, said in a post on social networking sites "Facebook", that the House of Representatives does not have the power to issue legislative decisions, and this was confirmed by the Federal Court in a previous decision.

He added that the legislative decision issued by the House of Representatives to terminate the assignment of the Minister of Oil from the position of the Minister of Finance as an agency is a violation of the principle of separation of powers and is an interference in the work of the government, in addition to that it is not essentially binding on the caretaker government, which did not take confidence in the current parliament.

At the beginning of the session, the Council postponed the discussion of the issue of the agricultural plan for the upcoming winter season and the discussion of the dangerous water situation that is afflicting the country due to the inability of the Minister of Water Resources to attend due to the death of his father this morning and because the topic of discussion is related to the presence of the Ministers of Agriculture and Water Resources to the Council.
The Council voted on a parliamentary decision to terminate the assignment of Mr. Ihsan Abdul-Jabbar, Minister of Oil, from his position as Deputy Minister of Finance, due to the intersection of his work with provisions of the amended Financial Management Law and at the request of 146 deputies, provided that the Prime Minister assigns another person to replace him.
The Council completed the first reading of the draft law to amend the Companies Law No. 21 of 1997 submitted by the Committee on Economy, Industry and Trade, which came to achieve balance in the board of directors of the mixed joint-stock company according to the percentage of contribution to the management of the company in a way that achieves the preservation and development of public money and the strengthening of oversight over it.
The Council completed the first reading of the draft law regulating service wages in centrally funded state departments and their priorities, submitted by the financial, services, construction, strategic planning and federal service committees in order to regulate the power to impose service wages and money, to maximize the revenues of the state’s public treasury, and to encourage ministries and agencies not associated with a ministry and governorates to impose wages and to find sources new to finance the expenses of the aforementioned entities.
The Council completed the first reading of the draft law on the National Day of the Republic of Iraq, submitted by the Committee on Culture, Tourism, Antiquities and Media, for the purpose of determining the National Day of the Republic of Iraq and to educate future generations about the importance of this date.
The House of Representatives completed the first reading of the Second Amendment Bill to the Public Roads Law No. 35 of 2003 submitted by the Services and Construction Committee, which aims to preserve the integrity of the road network, prevent abuse or damage to it, ensure its regular maintenance, and determine the amounts of wages and fines.
During the session, which was chaired in part by Mr. Mohsen Al-Mandalawi, First Vice-President of the Council, the Council concluded the first reading of the draft law of the third amendment to the Law of the Great Imam College No. 19 of 1997, which was submitted by the Committees of Endowments and Clans, Higher Education and Scientific Research to create and open new scientific departments in the College of the Greatest Imam University to keep pace with the development of The educational and pedagogical process is in accordance with the curriculum followed in reputable universities and colleges.
The council also completed the first reading of the draft law of the National Authority for Nuclear, Radiological, Chemical and Biological Control, submitted by the committees of health and environment, higher education and scientific research to benefit from the peaceful uses of atomic energy in the medical, agricultural, industrial and educational fields and to conduct multiple applied research and to avoid the inherent risks of ionizing radiation to workers, society and the environment.
The Council concluded the first reading of the draft law of the third amendment to the Irrigation Projects Implementation Law No. 138 of 1971 submitted by the Committee on Agriculture, Water and Marshes, which aims to organize the compensation process for the value of fixed installations and planted plants in the lands covered by the implementation of irrigation projects and to address cases of delays in the implementation of irrigation projects in the lands announced Freezing it according to the freezing announcements and in a way that leads to not depriving the stakeholders from continuing to exploit their lands until the actual implementation of the project reaches it and in order to oblige the concerned departments to file expropriation cases within a specified period and to limit the actions aimed at preventing the implementation of irrigation projects by paying an amount for each day delay in the implementation The project.
At the end of the session, President Muhammad Al-Halbousi announced that next Thursday will be a one-paragraph session dedicated to electing the President of the Republic in accordance with the constitutional provisions, directing the distribution of the CVs of the candidates to the ladies and gentlemen of Representatives.
Then it was decided to adjourn the session to next Thursday
