On Monday, the Integrity Commission announced Iraq's participation in the 13th session of the review team for the implementation of the United Nations Convention against Corruption.   

  

 

The authority stated in a statement that Nass received a copy of it (June 13, 2022), that it "participated in the United Nations Convention against Corruption in the thirteenth session of the review team for the implementation of the convention, and the open-ended intergovernmental group on the prevention of corruption."   

  

She explained that "the government team headed by the head of the Integrity Commission, Judge (Alaa Jawad Al-Saadi), will review, during the conference, which will be held for the period from (13-17 June), the extent of the commitment of the Republic of Iraq to respond to the requirements to join the United Nations Convention against Corruption, to which Iraq joined under Law No. (35) of 2007, whether in the legislative field and completing the legal system combating corruption, or the educational awareness aspect represented by holding workshops and seminars, organizing awareness programs, and creating a center for training the regulatory bodies represented by the Iraqi Anti-Corruption Academy.”  

  

She added, "It will also review Iraq's efforts to implement the decisions and requirements of joining the Convention in the preventive and injunctive investigations, and the great achievements that have been achieved in these areas, as well as in the field of drawing public policies and strategies, and approving a strategy for integrity and anti-corruption."   

  

She pointed out that "the mechanism for reviewing and evaluating the implementation of states parties is done through two states reviewing the implementation of the agreement by another state, and the state submits to the review once during the review cycle, which lasts (5) years, as the reviewing state must identify (15) governmental experts who prepare a draft report of the state under review. ".

The financial advisor to the Prime Minister, Mazhar Muhammad Salih, confirmed that the regulatory agencies are witnessing an advanced state in implementing the law and controlling public money.
Saleh said, in a statement to the official agency, that "the national oversight agencies are witnessing an advanced state in implementing the law and imposing control over public money," referring to "the role of the Federal Financial Supervision Bureau, the National Integrity Commission and the Anti-Money Laundering Authority, as well as the judiciary."
He explained, "The four sides represent the axis of state building in imposing discipline, applying the law and protecting regulations for all public properties," noting that "these bodies enjoy independence and practice good governance accurately, in order to cross an important stage in building the state and imposing its prestige and authority, by respecting the behavior with public money without neglecting the role of public opinion and popular control in diagnosing imbalances, and the role of international cooperation in combating new illegal activities in the abuse of public money.
He stressed, "The rule of law and respect for financial behavior and addressing the phenomena of abuse of public money is a matter that is taking a strong legal path in a growing and accelerating manner, according to the development of the prominent role of the legal institution and the regulatory authorities in the country, including the supervisory role of the legislative authority and the operational role of the national security services." Saleh pointed out, "The importance of the role of the oversight and internal audit bodies in all ministries and government institutions in assuming professional, functional and national responsibility in addressing phenomena that violate public money and administrative penetration, as they are early warning devices in protecting the Iraqi state institutions and consolidating the constants of their performance."

The President of the Federal Integrity Commission, Judge Alaa Jawad Al-Saadi, met, on Tuesday, the President of the ninth session of the Conference of States Parties to the United Nations Convention against Corruption, and the Chairman of the Administrative Control Authority in the Arab Republic of Egypt, Major General Hassan Abdel Shafi, and they discussed a number of files related to the recovery of smuggled funds.

And the thirteenth session of the Open-ended Governmental Working Group on Preventing Corruption, held in Vienna, discussed the joint work mechanisms among the member states of the UN Convention against Corruption and the extent to which the states parties adhere to its decisions, and the importance of taking bold decisions against states that refrain from cooperation and legal assistance with regard to the extradition of convicts and funds contraband, and discuss the development of the mechanism for reviewing the implementation stipulated in Article (65) of the Convention.  

  

The head of the commission referred to the "recommendations made by the Baghdad Conference for the Recovery of Stolen Funds, which were: the establishment of an international judiciary specialized in corruption and money recovery issues, and the formation of an international bloc; Money recovery and combating corruption, such as confiscation not based on a criminal conviction.  

  

The statement pointed out that "the two sides discussed the importance of concluding bilateral agreements between countries to facilitate the implementation of the articles and provisions of the UN Convention against Corruption, and to work hard to strengthen cooperation between all parties in order to activate the articles of the UN and Arab anti-corruption conventions."  

  

The statement indicated that "Judge (Alaa Jawad Al-Saadi) heads the Arab Network for Integrity and Anti-Corruption, and was also chosen as Vice-President of the fourth session of the Conference of the States Parties to the Arab Anti-Corruption Convention, whose current session is chaired by the Kingdom of Saudi Arabia.

Iraq proposes to establish an electronic portal to prepare international recovery files

Al-Saadi confirmed the response of the Republic of Iraq to the requirements of accession to the United Nations Convention since its accession in 2007, pointing out that the race responded to many of the requirements of accession by forming anti-corruption bodies and enacting laws that address this scourge and developing constructive policies for that, as well as deterrent and injunctive means.
 
He pointed out that "several teams of government experts have been formed in order to carry out the review process stipulated in the agreement, the last of which was the group of experts formed under the ministerial order (Q.T. 10/14/934 on February 17, 2022), and the first session was completed. regarding the chapters (third and fourth) of the agreement, and Iraq was provided with the executive summary of the response, indicating that the Republic of Iraq is adhering to its commitments regarding chapters (the second and fifth), as the final answers were sent to the United Nations and the United Niue Islands) and setting a date for the country review”, while follow-ups are still ongoing. The responses of the peer countries to the Convention were also evaluated and sent to the United Nations, where the expert team completed the assessment of the responses of the peer countries (Canada, Solomon Islands, Myanmar and Montenegro).
 
He praised the cooperation of the three authorities in Iraq in the field of combating corruption, pointing out that the most exemplary form of cooperation between these authorities was the enactment of several laws representing the legal system addressing corruption, and the last of these laws was the Law of the Integrity and Illicit Gain Commission, which included articles and clauses containing penalties and penalties. Provisions and preventive measures aimed at facilitating the task of the oversight bodies in prosecuting the corrupt and reducing corruption pathways, and at the same time represent a deterrent to anyone who is tempted to think of transgressing public money. Objectives:(Deterrence and prevention, proactivity, reform and development), while the judicial authority worked to form criminal courts and investigative courts specialized in integrity issues, and the formation of the Central Criminal Court specialized in hearing corruption cases, which was re-established according to the statement numbered (96 / s / a on 21/11/2021). ).

Regarding the most prominent challenges identified during the stages of the country reviews, Judge Al-Saadi warned that they are represented in the failure of some state parties to adopt the Convention as a binding legal basis for the purpose of receiving or responding to requests for legal assistance, contrary to Article (46) of the Convention, while many of the supervisory authorities in the states parties still do not The Convention is adopted as a basis for strengthening international cooperation, contrary to Article 62 of it, which obligates the states parties to take the necessary measures to assist implementation, noting that the review mechanism has not clearly addressed the case if the state under review wanted to update its answers submitted in the framework of the peer assessment after Expiry of the deadlines specified under the model schedule for evaluating responses attached to the implementation review mechanism issued under Resolution No. (1/3).

 

The head of the Integrity Commission referred to Iraq's preventive measures to prevent corruption, explaining that the financial and administrative sector had been reformed using electronic governance, especially in the tax and customs sectors, and ensuring that the citizen did not interact with the employee; This resulted in a significant increase in government revenues and the drying up of bribery crimes. Electronic procedures were also adopted to oblige those charged with submitting a disclosure of financial interests from office holders, the mechanism of investigation and investigation, and boycotting the information provided, all through an electronic program “in which we were keen on the security and confidentiality of information circulation, and we were able to access it.” Cases of inflation of funds and conflict of interest. 

He stressed that Iraq aspires for countries to adopt e-governance and automation as a way to help implement the UN Convention, especially in providing legal assistance, noting that this gives countries speed and freedom to recover their looted assets and recover convicts, suggesting the establishment of an electronic portal to prepare international recovery files and the ability to prepare publications The nature of the money, the convicted persons, and the countries abstaining in accordance with international security and judicial procedures that emanate from the provisions of the agreement, balance between the rights of countries to recover their money and the guarantees related to the convicted persons and the legitimate reasons offered by the countries holding the looted assets for their non-cooperation.

For his part, the Director-General of the Prevention Department of the Commission, Ali Qassem Hammoud, reviewed what the Republic of Iraq, represented by the Integrity Commission, has worked on in promoting a culture of integrity and public service ethics, noting that the Federal Integrity Commission, representing Iraq in the United Nations Convention against Corruption, has launched a number of educational activities. and awareness raising such as holding seminars, dialogue forums and workshops, while issuing several magazines and brochures that are concerned with spreading the culture and values of integrity, transparency and anti-corruption, pointing out that these activities and publications covered all segments of society, including educational and educational institutions, from kindergarten to university level. Preparing a value guide for teachers and including in educational curricula the values and concepts of integrity, as well as programs for preparing and presenting radio and television programmes, issuing a special newspaper for the Integrity Commission, and conducting many competitionsSchool publications, art exhibitions, plays and poems.

In turn, the head of the thirteenth session to review the implementation mechanism praised the speech of Iraq and the interventions made by the head of the Iraqi delegation, Judge (Alaa Jawad Al-Saadi), and the proposals that came in them, especially the proposal to establish an electronic portal to prepare international recovery files, and the call for the formation of a pressure bloc on the abstaining countries For providing assistance in the field of recovering convicts and smuggled assets.

The coalition of the United Nations Convention Against Corruption acknowledged that the judicial authorities issued rulings to recover the amount of $2 billion in funds looted in various ways.
Member of the coalition, head of the Al-Nahrain Network for Supporting Integrity and Transparency, Muhammad Rahim Al-Rubaie, told Al-Sabah that there are unremitting efforts being made to work to recover the looted funds, which politicians and economists estimated at hundreds of billions, in compliance with the recommendations of the Baghdad Conference to recover the looted funds, which was held in September last year.
And he indicated that Iraq is demanding the recovery of its money from many countries, the most important of which are the United Arab Emirates, Lebanon, Jordan, Turkey, and other regional countries, by obligating those countries to the United Nations Convention against Corruption in 2007 or by concluding bilateral agreements with those countries to recover the wanted and the looted funds. Al-Rubaie explained that the procedures for recovering these funds are complicated due to the different laws between Iraq and other countries, pointing to the reluctance of some countries to return them under the pretext of economic damage.
