A member of the Parliamentary Legal Committee, Hassan Fadam, said in a statement to the Iraqi News Agency, “The House of Representatives obligated the government, during the 2021 budget, to resolve special job grades (degrees managed by proxy),” noting that “former prime ministers exceeded the constitution and violated the laws in force by appointing special grades. for sensitive proxy sites.

And he confirmed that “the House of Representatives put in the 2021 budget an article obligating the government to end the file of managing institutions by proxy and to nominate names that are valid to manage institutions within a maximum period of 6/30, and despite the passage of several months since the budget was approved, no names have reached Parliament so far.”
He continued that "the file remaining suspended is a major defect in the state administration," noting that "sending the names from the government does not need to be included in the budget, but the lack of commitment of previous governments called on the House of Representatives to add it within the budget."
Earlier, the Deputy Chairman of the Law Committee, Muhammad Al-Ghazi, confirmed to the Iraqi News Agency (INA) that "the Council of Ministers seeks to complete the special grades before the date of June 30 of this month, and sends them to the House of Representatives for a vote."

Mubasher: The Parliamentary Economy and Investment Committee in Iraq explained the reasons for the delay in resolving the public-private partnership law.

Committee member Mazen Al-Faili told the Iraqi News Agency, "Informed", today, Friday, that the public-private partnership law is among the many laws that have not been resolved during this parliamentary session, as well as some important laws that have not been resolved from previous sessions.

Al-Faili explained that the reason for this is that the parliament sessions were not properly organized as a result of the security events that occurred, in addition to the Corona pandemic and the preparation for early elections.

He stressed that these reasons do not justify the delay in enacting important laws, including the Public-Private Partnership Law.

He stressed, "The law is important and concerns an important sector, which is the economic sector," noting that "Iraq is in need of these legislations to develop its economy in the right direction according to a future vision that is in harmony with the world's economic growth."

The Parliamentary Economic Committee announced in May that the Public-Private Partnership Law is still under study despite the completion of 80 percent of it, while noting that the obstacle facing the law is how to preserve state assets. 

 

At the time, the committee indicated that only minor points of contention remained in the law in order to finalize it.

Although the date of today's session was set a few days ago, the number of deputies attending the session did not exceed 100, according to parliamentary sources who spoke to Mawazine News.
The sources stated, "Most of the attendees are those who did not run for the upcoming elections, and their number did not allow a regular session of the Council, so the session was postponed to next Sunday and it is also unlikely to be held."
The sources talk about the failure to take legal measures against the absent deputies, because they have political blocs and the Parliamentary Department is unable to take measures against them, as part of their salaries were not cut or even warnings were given to them.
According to the sources, "Parliament has become clinically dead, and the most prominent reason for its death is the MPs' preoccupation with electoral propaganda as well as political agreements to prevent lifting the immunity of some MPs accused of certain issues, and requests to lift their immunity were received from the Supreme Judicial Council."

Committee member Hassan Fadam told the Iraqi News Agency (INA): "The House of Representatives is in its final days, after the decision to dissolve the parliament and hold early elections," noting that "important laws can be proposed in the next legislative session."

He added that "there is not enough time during the current legislative session to amend or legislate laws, including the Victims Compensation Law."

The House of Representatives had voted to dissolve itself on October 7, in preparation for early elections three days later .

Article 64 of the Iraqi constitution states, “The Council of Representatives has the ability to dissolve itself at the request of one-third of its members, or from the Prime Minister with the approval of the President of the Republic.

He added that "there is a failure in the aspect of freedom of opinion, and there are violations of the basic articles of the constitution, and the government must abide by them, and the political forces must re-evaluate themselves again, in addition to the government's performance." 
He pointed out that "the legislative authority represented in the House of Representatives must re-evaluate the laws and the performance of the House, because what we believe has not been accomplished so far in a satisfactory way for the political and democratic process." 
Al-Khalidi pointed out that "one of the reasons that hindered the democratic process is the political differences, because there are some political figures who believe that Iraq should be governed as it was ruled in the previous periods before 2003," noting that "the basics of democratic transformation are freedom of opinion and that there should be no control over money and weapons." How can we believe that there is a democratic transformation with the exploitation of money, weapons and political positions?

A member of the Legal Committee, Rashid Al-Azzawi, told "Al-Sabah", that "the amendment of Article 57 of the Personal Status Law has become a controversial subject inside and outside Parliament," noting that "the amendment should be for the benefit of the child, not the custodian."
And he added, I tend to “give the judge the authority to know where the child’s interest is, because we see the children, some of them wronged by their father and some by the mothers, especially if the mother is not married. Therefore, we tend to amend the article by giving the social researcher and the judge, who are the ones who assess the circumstances of each case, so that the custodian is either The father or the mother or not both if they are not qualified and the state is responsible for the child.
He explained, "The custody of the mother should not be absolute, but rather set at a time that may be 15 years or 7 years. All these matters, except for custody, should be left to the judge, and he is the one who assesses the situation in favor of the mother or father."
Al-Azzawi continued, "The committee postponed the discussion of this amendment, due to the large number of objections by the members of the committee to Article 57," ruling out that "it will be passed during this session."

Committee member Sattar Al-Jabri said, "The oil and gas law is one of the strategic laws and it is difficult to resolve it in the current parliamentary session," stressing that "it will be transferred to the next parliamentary session," according to "conscious."

Al-Jabri called for "making the law among the priorities of the next council, as it achieves social justice by distributing wealth to the people of the same country without discrimination of components or regions."

The Oil and Gas Law establishes a system for managing oil operations in Iraq, taking into consideration the existing international agreements between the Republic of Iraq and other countries regarding the transportation of crude oil.

It also aims to define the basis for cooperation between the concerned ministries in the federal government, as well as to establish a base for coordination and consultation between the federal authorities and the authorities of the oil-producing regions and governorates.
