Hours after the issuance of a judicial decision in Baghdad in favor of Pavel Talabani, head of the National Union, in his dispute with his cousin, Lahore Sheikh Janki, a statement issued by the Presidency of the Government in the region stated that Masrour Barzani made a phone call to the family of Colonel Jaf, who was assassinated in an explosion on the seventh of last October.  

  

During the phone call, the President of the Kurdistan Government expressed his condolences to them, and reaffirmed that "the case of the assassination of the martyr Hokar Jaf must go through its legal paths," stressing that "the perpetrators of his assassination shall receive the legal penalty."  

  

The Erbil authorities pointed the finger at the director of the Counter-Terrorism Service in Sulaymaniyah Governorate.  

  

The leadership of the National Union rejected these accusations, considering that they are not devoid of political backgrounds, including work to deepen the differences within the Union and dismantle it from within.  

  

The union faces a crack between two parts, the first led by Talabani and the second led by Sheikh Genki, and the two parties are engaged in a frantic judicial battle that does not seem to have a horizon for its end, with conflicting judicial decisions regarding it between Baghdad and Erbil, according to the report of the newspaper issued in London.  

  

And the judiciary in Baghdad announced its rejection of an appeal submitted by Sheikh Janki, the former co-chair of the National Union, regarding the changes related to his party position, and the case was resolved in favor of Talabani.  

  

Talabani's lawyers team said in a statement that the Iraqi Supreme Judicial Council issued its final ruling on the "Lahore Janki" case, that Talabani is the head of the National Union and that all measures taken are legal.  

  

He stressed that the case was settled in favor of the National Union and the decision is not subject to appeal, while press sources said that Sheikh Genki's defense team is in the process of appealing the decision again.  

  

The decision of the Iraqi judiciary through the Elections Commission came a few hours after the Erbil Court of Appeal sent a letter to the Supreme Political Council of the National Union regarding the co-chair of the party.  

  

The book stated that “the bylaws of the Patriotic Union of Kurdistan include the presence of two co-chairs, Pavel Jalal Husam al-Din and Lahore Gengi Burhan, and this was approved at the party’s fourth conference on December 21, 2019.”  

  

Talabani accuses the court in Erbil of submitting to the political agenda of the Democratic Party, and that its successive decisions in favor of Sheikh Genki fall within this framework.  

  

Earlier, the National Union Leadership Council warned against interference in the internal affairs of the party, hinting at taking political and legal steps against any interference, and considered that the internal affairs of the Union are a red line.  

  

In its statement, the council stressed that all the procedures of the National Union regarding the internal system, the issue of the presidency, complaints and appeals against its decisions were settled legally in favor of Talabani, and the decisions that were taken were approved by the Presidency Council of the Union.

The budget will never be approved easily.
Al-Saray added, "All the wells discovered after 2003 belong to all Iraqis, and the regional government must admit its mistakes," noting that "the political process and its construction in Iraq cannot continue in this way without controlling the border crossings."

Noah agrees with the view that the American pressure on the decisions of the Kurdish leaders regarding the region's crisis is still weak, and he said that "the advice and recommendations of international actors in the Iraqi file no longer have an effective impact on the region for various reasons, as a result of the prevalence of the idea of imposing a fait accompli among the new leaders of the two parties." Which puts international players in a position of accepting this reality, even if it is not compatible with their orientations regarding the damage that will befall the democratic process, political pluralism, and institutional structures in the region.

Earlier, the Judicial Authority for Elections in Baghdad decided to ratify a decision issued by the commission regarding approving the changes of the Patriotic Union of Kurdistan headed by Pavel Talabani, and Lahore Sheikh Janki responded to those changes that led to his removal from the union’s co-chairmanship and from party membership, accompanied by a number of party cadres belonging for his plan.

With regard to the first paragraph of the complainant’s list, which is his dismissal from the party, it was noted that the aforementioned court decided to dismiss the case according to the aforementioned decision, which is of absolute degree.

Shafaq News agency reporter said that the meeting revolves around four main points, one of which is the distribution of electoral districts, the other is the semi-open electoral list, the third is the distribution of electoral seats for the components in the Kurdistan Region, and the fourth is the distribution of votes based on the voter lists approved by the Federal Election Commission.

 

 

 

He added that the meeting took place at the headquarters of the political office of the Patriotic Union of Kurdistan in the city of Erbil.

The electoral institution of the Patriotic Union of Kurdistan and the Kurdistan Democratic Party were scheduled to meet last week, but the meeting was postponed twice due to the illness of a member of the PUK delegation.

The two parties had held a meeting at the end of last February, confirming in a joint communiqué at the end that they had reached an understanding to hold the elections this year, and that they agreed to hold other meetings to complete the final formula for the form of the elections after overcoming some remaining contentious points in the way of agreement.

The legal department official in the elections institution of the Kurdistan Democratic Party, Hawar Muhammad, announced last Friday, in a press statement, that the delegations of the two parties will visit other Kurdish parties to discuss the seats of the components and develop a mechanism to amend the election law.

Kurdish parties agree on 5 points regarding the elections

Seven Kurdish parties agreed, on Saturday, to hold elections for the Parliament of the Kurdistan region according to the four-electoral district system, to adopt the biometric record of the Electoral Commission in Iraq and to activate the Electoral Commission in the region.  

  

  


This came during a meeting held by the Elections Institution of the Patriotic Union of Kurdistan and the Kurdistan Democratic Party, (March 11, 2023), with "representatives of 5 Kurdish parties at the headquarters of the Political Bureau of the Patriotic Union, namely: the Change Movement, the Islamic Union, the Justice Group, the Communist Party, and the Workers' Party." And the toilers."  


The following meeting was issued:  

  

Representatives of the Kurdish political parties represented in the Kurdistan Parliament met today, Saturday 11/3/, at the headquarters of the Political Bureau of the Patriotic Union of Kurdistan in Sulaymaniyah, with the aim of preparing and understanding about amending the Kurdistan Parliament election law.  


During the meeting, frank discussions took place on issues related to amending the Kurdistan Parliament elections law and activating the High Electoral Commission, and the necessary decisions were taken regarding the following axes and topics:  


1- Follow the system of four electoral districts according to the governorates of the region.  


2- Approving the biometric record of the Independent High Electoral Commission in Iraq, with all its requirements.  


3- Relying on the data of the Ministry of Planning in the federal government, to determine the percentage of provincial seats.  


4- Activating the High Commission for Elections and Referendum in the region.  


5- The Presidency of Parliament and the blocs will hold a meeting with representatives of the components inside and outside Parliament.

Al-Marsoumi said in a post followed by "Nass" (April 5, 2023), that "Kurdistan's share in the 2023 budget = 12.67%," noting that "Kurdistan's share in the 2023 budget after deducting sovereign and ruling expenditures = 16.609 trillion dinars, which is included in the sovereign expenditures, cost Transportation of crude oil exported through the region amounting to 1.428 trillion dinars, and the cost of production and export of the region's oil is 2.448 trillion dinars.  

  

He added, "The region is committed to exporting at least 400,000 barrels per day, provided that the region's oil revenues are deposited in one bank account without any deductions for any purpose, and the prime minister of the region or whoever authorizes him is authorized to exchange, and the account is subject to central government control."  

  

He continued, "The Ministry of Finance pays the region's dues on a monthly basis, and accounting settlements regarding the rights and obligations of the oil and non-oil parties are made on a quarterly basis."  

  

He explained, "Knowing that the articles related to the region in the budget and the recent agreement between the region and the center are not consistent with the decision of the Federal Court, which considers oil a federal asset, which should be subject to the central government in all aspects of production, management, export and revenues."  

  

Earlier, a spokesman for the Iraqi government, Basem Al-Awadi, revealed 4 basic items included in the agreement between the federal government and the Kurdistan Regional Government regarding oil exports.  

  

Al-Awadi said in a statement carried by the official agency, followed by “NAS”, (April 4, 2023), that “the agreement included 4 basic items, the first is the export of 400,000 barrels of oil per day from the Kurdistan region through the National Oil Company (SOMO) and naming a representative of the region in the company, and this happens for the first time.” Once, it was suggested that he be an assistant to the president of the SOMO company.    


He added, "The second item included the formation of a quartet committee at the rate of two representatives from the Federal Ministry of Oil and two from the Ministry of Natural Resources in the region. This committee supervises the sale of oil extracted from the Kurdistan region in global markets until the issuance of the budget or agreement to speed up the oil and gas law, meaning that this The point is temporary.    


And he continued, "The third item is related to the Kurdistan Region's agreements with 4 international companies, and many of the provisions of these agreements have binding legal points. According to the agreement, the region demanded today the assistance of experts from the Federal Ministry of Oil to facilitate negotiations with these companies in order to implement the new agreement."    


Al-Awadi indicated that “the fourth item included opening a bank account under the supervision of the federal government, and Baghdad demanded that the account be in the central bank, and the formula was modified so that the account be in the bank itself or a bank accredited by the central bank and authorizes the president of the Kurdistan government the authority to exchange under the supervision of the Federal Office of Financial Supervision in what It is only related to the federal budget for the year 2023.    


On the implementation guarantees, Al-Awadi indicated that "the signing of the minutes of the agreement in the presence of the Prime Minister, Muhammed Shi'a Al-Sudani, and the President of the Kurdistan Regional Government, Masrour Barzani, provides the guarantee."    

  

Yesterday, Tuesday, the Prime Minister, Muhammad Shia'a Al-Suadni, announced the agreement to resume exporting the Kurdistan region's oil, stressing the technical authorities immediately direct the implementation of the agreement with Erbil.  

  

Al-Sudani said during a joint press conference with the Prime Minister of the Kurdistan Region, Masrour Barzani, followed by "NAS" (4 April 2023), "The technical authorities must immediately implement the agreement with Erbil and find legal ways for this matter."    

  

He explained that "the agreement confirms the serious and sincere desire of the federal government and the Kurdistan government to confront all the problems and obstacles that were inherited years ago and were postponed and we did not reach solutions."    

  

He added that "facing these entitlements in a professional spirit stems from the general interest of all the Iraqi people, whether in the Kurdistan region or the rest of the provinces," noting that "this is what has been translated into the draft budget law," expressing his hope that "the House of Representatives will proceed to legislate the budget law in Fastest time to be an umbrella for each file with http details.    

  

And he continued: "We are waiting for an entitlement, which is the legislation of the oil and gas law, which will address all the imbalances that have accompanied this file since the adoption of the Iraqi constitution," appreciating "the efforts of the two teams in the federal government and the Kurdistan Regional Government for the professional and responsible negotiations that have taken place. the agreement".    

  

Al-Sudani pointed out that "this agreement will pave the way for the passage of the budget law and the provisions it contains. It also developed the outcome of a dialogue that took place between the federal government and the regional government, which dealt with all issues, including the oil and gas file," noting that "there are files that have been pending for years, and now there is political will and interest." For all Iraqis to proceed and deal with all these files in the spirit of the constitution and the public interest.    

  

And he indicated that "any delay in export clearly affects the total expected revenues in the 2023 budget, and therefore the deficit rate will increase, and this matter has great harm to all Iraqis. As for the direct implementation of this agreement, it will reduce the damage."    

  

He noted that "this agreement came as a result of discussions that lasted for several days and in a professional spirit to find a solution to the problem of everyone affected by it, and we must remove all obstacles in order to resume export, enhance public budget revenues and cover needs as decreed in the budget law," stressing the need to adhere to Everyone is in this agreement, and it is a temporary agreement until reaching the approval of the budget, which takes on a legal status, covers all obligations, and addresses all problems in this file.    

  

For his part, the President of the Kurdistan Regional Government, Masrour Barzani, confirmed that the agreement between Baghdad and the region will be the basis for the budget, noting that Al-Suadni is the prime minister of all Iraqis.    

  

Barzani said during the same conference, "This agreement is for all Iraqis and will be the basis for the budget, and even the oil and gas law because it will be implemented in an exact manner," pointing out that "stopping the export of the region's oil is not harmful to the people of Kurdistan, but to all the Iraqi people."    

  

He pointed out that "re-exporting oil in the Kurdistan region will be beneficial to all, and that we will seek a comprehensive and good agreement between the federal government and the regional government without leaving any aspect of our constitutional rights, but rather to enable the relationship between the region and the federal government."    

  

He continued, "I thank Prime Minister Muhammad Shia'a al-Suwadani because he really works as prime minister for all Iraqis, and he took into account the interests of the people of the region and under his supervision this agreement was made, and I assure that it will be good for all Iraqis."    

  

Yesterday, Tuesday, the Prime Minister, Muhammad Shia Al-Sudani, signed with the President of the Kurdistan Regional Government, Masrour Barzani, an agreement to resume the export of oil from the Kurdistan Region to the Turkish port of Ceyhan.  

  

According to the agreement, the position of deputy director of the Iraqi Oil Marketing Company (SOMO) will be granted to the Kurdistan Regional Government.

The current Iraqi government also does not want the framework to appear as an obstacle to the export of half a million barrels of oil per day during the Ukrainian war, which exhausted the coffers of Western countries.   

  

The analysis pointed out that with regard to the internal level, the Shiites require facing a major challenge with regard to the provincial elections at the end of 2023, and monitoring the plans and activities of Muqtada al-Sadr of concern. Confronting these files requires the support of the Kurdistan Regional Government and Erbil, at least to fill the void left by al-Sadr. On the other hand, if al-Sadr appears again on the political scene, the Shiite forces will not be alone in confronting him in the presence of Kurdish support for the Baghdad authorities.  

  

The analysis showed that the Shiite forces are seeking during the fifth session to find a radical solution to oil and budget issues, and to strengthen relations with the Kurdistan Regional Government. The foundations of the Iraqi state are weakening.

According to the leaks of Kurdish sources that "NAS" followed up on (January 30, 2023), the judges of the Federal Court expressed their fear in the side deliberations that approving the extension of the Kurdistan Parliament would be a basis and argument in the future for similar efforts to extend the mandate of the Federal Parliament and parliamentary sessions, which endangers life. Iraqi democratic politics is in grave danger.     

  

On the other hand, the Kurdish "Pay" Institute Observatory, which monitors the activities of the Kurdistan Parliament, quoted its sources as saying that the Presidency of the Kurdistan Parliament decided to boycott the sessions of the Federal Supreme Court on Tuesday as a protest against the court's recent decision against sending money to the Kurdistan Region.    

  

Earlier, the Federal Supreme Court decided to postpone resolving the fate of the Kurdistan Parliament after it extended itself for a year and held a hearing to decide the case until January 31, 2023.   

  

And the Federal Supreme Court published its decision (248/2022) regarding a lawsuit filed against the legitimacy of the Kurdistan Parliament after the extension for itself, which included a request to stop the parliament’s work according to a state order until the case is decided.

Shafaq News/ Today, Wednesday, the Federal Supreme Court (the highest judicial authority in Iraq) postponed pronouncing the verdict on the lawsuit regarding the unconstitutionality of extending the work of the Kurdistan Parliament to the 24th of this month (May).

A judicial source told Shafaq News agency that the Federal Court was scheduled to issue its ruling in this regard, but decided to postpone it to deliberate further on this matter.

 

 

This is the third time that the Federal Court has postponed pronouncing the verdict on the lawsuit filed regarding the unconstitutionality of extending the work of the Kurdistan Parliament.

At the beginning of last February, the court held a session in which it heard the plaintiffs and clients of the defendant, the Speaker of Kurdistan Parliament, Rewaz Faiq, in addition to her guest.

The court decided to postpone the pronouncement of the verdict to the 15th of March, and then postponed it to the 3rd of May, to be postponed to the 24th of this month.

It is noteworthy that the Kurdistan Parliament voted in October 2022 to extend its legislative term and postpone the elections for one year, provided that they are held during the year 2023 with the provincial elections.

He added, "For this purpose, it called on the parties participating in the political process to take serious steps to prepare for the elections on the legal dates."  

  

He stressed, "We will not go back to talking about the steps and our interest in the process, and we call on all parties and citizens in Kurdistan to cooperate and facilitate fair elections."  

  

He continued, "The KDP calls on the government and relevant institutions to take the necessary steps to make the electoral process a success."  

  

He said: "What is important for our party is to hold parliamentary elections in Kurdistan."  

  

One of the evaluators of the lawsuit regarding the extension of the work of the Kurdistan Region Parliament in the Federal Court in Baghdad, the former Speaker of Parliament, Youssef Muhammad Sadiq, revealed the repercussions of the court's decision that the extension of the parliament's work is unconstitutional.  

  

Sadiq said in a statement to "NAS" (May 30, 2023), that "the decision calls for the repeal of all laws issued after 6/11/2022, as well as the annulment of the resignations of deputies and the swearing-in of new replacement deputies."    

  

He added, "The meeting to reactivate the Electoral Commission will be cancelled."

The President of the Federal Supreme Court, Judge Jassim Muhammad Abboud, said during the special court session to consider extending the work of the region’s parliament, followed by “NAS”, (May 30, 2023), that “the constitution has abstract and permanent power, and it is a legal document that imposes its rules on all authorities, and the constitution regulates basic principles.” on which the political process is based, including the rule of law, and that the people are the source of authority.      


He added, "The constitution stipulates that the parliament be four years old, and any other legal text that contradicts the constitution is considered null and void."

On Wednesday, Professor of Economics at the University of Basra, Nabil Al-Marsoumi, spoke about the repercussions of the Federal Court’s decision on the unconstitutionality of extending the work of the Kurdistan Regional Parliament on the oil agreements between Baghdad and Erbil, and the impact of that on the federal budget for the year 2023.  

  

  

  

Al-Marsoumi said in a post entitled “Will the budget be affected by the Federal Court’s decision on the illegality of extending the work of the Kurdistan Parliament?”, seen by “NAS” (May 31, 2023), “The Federal Court ruled that extending the mandate of the Kurdistan Parliament is unconstitutional and any law and decision issued after 6.11 2022 is null and void, and this means canceling the laws, decisions and agreements that were issued after the extension of the House of Representatives, including the oil agreement between the governments of the region and the center on oil, which were included in Articles 13 and 14 of the draft budget law 2023, because the Erbil government turned into a caretaker government after the date. Therefore, it does not have full powers to sign contracts and agreements, especially those related to energy and the budget.  

  

And he added, "This gives greater legitimacy to the Finance Committee's amendments to Articles 13 and 14 in the federal budget for the year 2023, and in return this will complicate passing the budget due to the current regional government's rejection of the amendments and its lack of full powers to conclude a new agreement on this issue with the federal government because it has become a government."
