The President of the Federal Court added: "Considering the fifth session of the Parliament of Kurdistan finished and what was issued after the extension is constitutionally invalid."

Kurdish parties compete for political influence and power in the Kurdistan Region of Iraq, including positions in the presidency, local government, and parliament. The Patriotic Union of Kurdistan (PUK) and the Kurdistan Democratic Party (KDP) share participatory governance in the Kurdistan region, but there are tensions between them over the distribution of power and resources.

Kurdish forces accuse the Electoral Commission of being a creation of the Kurdistan Democratic Party and carrying out its orders.

This decision came in response to a lawsuit filed by opposition representatives in the regional parliament.

According to the decision of the Federal Court, the parliamentarians in Kurdistan must return any salary they received after (6/11/2022) to the public treasury during the extended session, as 51 deputies who have reached the legal retirement age are required to return 28 million and 700 thousand dinars, a total of one billion and 463 million dinars .  

  

According to the reform law in force in Kurdistan, 49 deputies have not reached the legal age for retirement, and each deputy must return 43 million and 400 thousand dinars to the public treasury. The 49 deputies must return 2 billion and 126 million dinars to the public treasury.  

  

According to the Observatory's report, all deputies must return four billion dinars to the public treasury that they obtained illegally within seven months.

And Foreign Minister Fouad Hussein said, in response to the Federal Court's decision that it is unconstitutional to extend the work of the region's parliament, that "the Kurdistan Regional Government continues its work even in the absence of the Kurdistan Parliament after the decision of the Federal Court." It is an indication that the two major parties may not reach a settlement of their differences by next November, and that the regional government will continue to act as a “caretaker government” until new elections are held. There is no specific period obligating the caretaker government to complete the elections.  

  

The two partner parties in the government coalition agreed to the decision to extend Parliament in 2022, after failing to reach consensus on a new electoral law. They pledged to hold elections in November of this year, but they did not reach a new agreement, and when the extension issue was raised as a way out for the survival of parliament, the Federal Court intervened at the request of other Kurdish parties, and decided that the extension was unconstitutional.  

  

Former Kurdistan Parliament Speaker Youssef Muhammad, a leader in the Movement for Change, says that the two Kurdish parties have a bad legacy in the region, which is represented in the failure to hold any of the legislative, presidential or local elections at the time specified by law, and they also have armed forces and security and intelligence agencies that make peaceful exchange Power has a complicated choice.

The spokesman for the regional presidency, Dilshad Shihab, said in a press conference attended by Shafaq News Agency, that the presidency delegation in Baghdad visited the Independent High Electoral Commission in Iraq to discuss with it the steps to conduct the elections for the sixth session of the Kurdistan Region Parliament, adding that the delegation asked the commission to supervise the elections in order to be carried out at the scheduled time.

 

Shihab added that the Iraqi commission confirmed that this step and the opening of the region's presidency and the start of its endeavors is a very positive thing, indicating that the commission expressed its readiness to start preparations for holding the elections for the parliament of the Kurdistan Region, in coordination with the concerned parties and the region's presidency.

 

Shehab pointed out that the Commission did not set any date for holding the Kurdistan Parliament elections, because it also confirmed that its priority now is to hold the Iraqi provincial elections, and after that they will set a date for the Kurdistan Parliament elections. 

 

He added that the region was in favor of the Election and Referendum Commission in the region conducting the elections, but the Iraqi commission conducting them is normal and nothing new, pointing out that the Iraqi commission supervised the elections for the second, third and fourth sessions of the Kurdistan Parliament.

 

Shihab stressed that the presidency of the region was keen to hold the elections under the supervision of the region itself, but the priority now is to hold the elections and not be delayed, as well as in order for Kurdistan to emerge from the legal vacuum because the region’s parliament cannot perform its tasks, and the region’s presidency will seek to hold the elections as soon as possible. The institute confirmed in a statement received by "NAS" on Sunday (June 25, 2023): "Our investigations proved that the three presidencies in the Kurdistan region indirectly approved their commitment to the unconstitutional decision to extend the mandate of the Kurdistan Parliament through visits to the Federal Court and the approach of the Federal Elections Commission to organize the elections and suspended the regional government." Its communication with Parliament because it believes that this parliamentary session is no longer legally in place and that the Kurdistan Parliament has stopped its activity 28 days ago.  

  

The institute stated that it "sent a memorandum to the presidencies, parliamentary blocs, the Minister of Finance, the Anti-Corruption Commission, the Attorney General, the Financial Supervision Bureau in the region and the representative of the United Nations in order to prevent corruption and waste of public resources by stopping the payment of salaries and allocations to Parliament after the issuance of a decision unconstitutional to keep it."

The institute confirmed that "the Ministry of Finance and the regional government illegally disbursed the salaries and privileges of the fifth session of parliamentarians, which is another violation of the laws in force in the region, and at a time when the government still did not distribute May salaries, despite our approaching the end of June."  

  

"If Parliament is unwilling to implement the laws it has passed itself, how can it expect the people to implement them?" the institute asked.  

  

The institute issued an appeal to civil society organizations, journalists, activists, lawyers and jurists to press for the implementation of the law.  

  

The Federal Court ruled (May 30, 2023) that the decision issued in 2022 to extend the work of the Kurdistan Parliament for a year was unconstitutional, and indicated that it undermines democracy in the country.  

  

The president of the court said that all decisions issued by the parliament of the region, starting from the date of extending his term in October 2022, are considered null and void.  

  

With regard to the merits of the ruling, the President of the Court said that "the constitution stipulates that the life of parliament be 4 years, and any other legal text that contradicts the constitution is considered null and void."  

  

The judge added, "The constitution is the owner of abstract and permanent power, and it is a legal document that imposes its rules on all authorities. The constitution organized the basic principles on which the political process is based, including the rule of law and that the people are the source of power."  

  

He continued, "The Kurdistan region is federal in accordance with the provisions of the constitution, and the continuation of the fifth session of the Kurdistan Parliament for more than 4 years after the extension contradicts its provisions, and the court decided that the extension of the work of the Parliament of the Kurdistan region is unconstitutional and considers its fifth session ended and what was issued after the extension is constitutionally invalid."
