EXCLUSIVE: FBI RAIDS HOME OF WHISTLEBLOWER ON CLINTON FOUNDATION, LAWYER SAYS

• The FBI raided the home of a whistleblower who was in possession of documents regarding the Clinton Foundation and Uranium One, according to the whistleblower’s lawyer, Michael Socarras.
• The whistleblower, Dennis Nathan Cain, had turned the documents over to the Department of Justice’s inspector general and both the House and Senate Intelligence committees, according to the lawyer.
• The FBI rummaged through Cain’s home for six hours, even after the whistleblower handed over the documents, according to Socarras.

FBI agents raided the home of a recognized Department of Justice whistleblower who privately delivered documents pertaining to the Clinton Foundation and Uranium One to a government watchdog, according to the whistleblower’s attorney.

The Justice Department’s inspector general was informed that the documents show that federal officials failed to investigate potential criminal activity regarding former Secretary of State Hillarious Clinton, the Clinton Foundation and Rosatom, the Russian company that purchased Uranium One, a document reviewed by The Daily Caller News Foundation alleges.

The delivered documents also show that then-FBI Director Robert Mueller failed to investigate allegations of criminal misconduct pertaining to Rosatom and to other Russian government entities attached to Uranium One, the document reviewed by TheDCNF alleges. Mueller is now the special counsel investigating whether the Trump campaign colluded with Russia during the 2016 election.

“The bureau raided my client to seize what he legally gave Congress about the Clinton Foundation and Uranium One,” the whistleblower’s lawyer, Michael Socarras, told TheDCNF, noting that he considered the FBI’s raid to be an “outrageous disregard” of whistleblower protections. (RELATED: FBI Takes Aim At The Clinton Foundation)

Sixteen agents arrived at the home of Dennis Nathan Cain, a former FBI contractor, on the morning of Nov. 19 and raided his Union Bridge, Maryland, home, Socarras told TheDCNF.

The raid was permitted by a court order signed on Nov. 15 by federal magistrate Stephanie A. Gallagher in the U.S. District Court for Baltimore and obtained by TheDCNF.

A special agent from the FBI’s Baltimore division, who led the raid, charged that Cain possessed stolen federal property and demanded entry to his private residence, Socarras told TheDCNF.

“On Nov. 19, the FBI conducted court authorized law enforcement activity in the Union Bridge, Maryland area,” bureau spokesman Dave Fitz told TheDCNF. “At this time, we have no further comment.”

Cain informed the agent while he was still at the door that he was a recognized protected whistleblower under the Intelligence Community Whistleblower Protection Act and that Justice Department Inspector General Michael Horowitz recognized his whistleblower status, according to Socarras.

Cain further told the FBI agent the potentially damaging classified information had been properly transmitted to the Senate and House Intelligence committees as permitted under the act, Socarras said. The agent immediately directed his agents to begin a sweep of the suburban home, anyway.

Frightened and intimidated, Cain promptly handed over the documents, Socarras told TheDCNF. Yet even after surrendering the information to the FBI, the agents continued to rummage through the home for six hours.

“After asking and getting my approval to do so, DOJ IG Michael Horowitz had a member of his staff physically take Mr. Cain’s classified document disclosure to the House and Senate Intelligence committees,” Socarras told TheDCNF.

“For the bureau to show up at Mr. Cain’s home suggesting that those same documents are stolen federal property, and then proceed to seize copies of the same documents after being told at the house door that he is a legally protected whistleblower who gave them to Congress, is an outrageous disregard of the law,” he continued.

Cain came across the potentially explosive information while working for an FBI contractor, Socarras told TheDCNF.

Cain met with a senior member of Horowitz’s office at a church close to the White House to deliver the documents to the IG, according to Socarras.

Cain sat in a pew with a hoodie and sun glasses, Socarras said. Cain held a double-sealed envelope containing a flash drive with the documents. The IG official met him and, without saying a word, took the pouch over Cain’s shoulder and left.

The law protects whistleblowers who are government contractors and requires the IG to share such potentially damaging information with the attorney general — who at the time was Jeff Sessions.

The two law enforcement officials directed the documents be sent to the Senate and House Intelligence committees for their examination, according to Socarras, who said that a high-level IG official hand-delivered the documents to the the two intelligence committees.

“I cannot believe the Bureau informed the federal magistrate who approved the search warrant that they wanted to search the home of an FBI whistleblower to seize the information that he confidentially disclosed to the IG and Congress,” Socarras told TheDCNF.

The whistleblower act is intended to protect whistleblowers within the intelligence community, which includes the FBI.

“The [intelligence community] is committed to providing its personnel the means to report violations of law,” according to a 2016 intelligence community directive.

“The [whistleblower act] authorizes employees of contractors to take government property and give it to the two intelligence committees confidentially,” Socarras told TheDCNF.

The FBI has yet to talk to Cain’s attorney despite the raid, according to Socarras.

“After the raid, and having received my name and phone number from Mr. Cain as his lawyer, an FBI agent actually called my client directly to discuss his seized electronics,” Socarras told TheDCNF. “Knowingly bypassing the lawyer of a represented client is serious misconduct.”

The Justice Department and the IG both declined to comment.

Senate Judiciary Committee Chairman Chuck Grassley wants answers from FBI Director Christopher Wray about a Nov. 19 bureau raid on the home of a recognized whistleblower.

The whistleblower, Dennis Cain, who was once employed by an FBI contractor, reportedly turned over documents to the Department of Justice Inspector General Michael Horowitz regarding the bureau’s failure to investigate potential criminal activity regarding former Secretary of State Hillarious Clinton, the Clinton Foundation and the Russian company that purchased Uranium One.

Horowitz subsequently deemed Cain a whistleblower protected under the Intelligence Community Whistleblower Protection Act, Cain’s lawyer, Michael Socarras, told TheDCNF.

The Iowa Republican sent a separate letter to Horowitz on Nov. 30 seeking Cain’s documents and citing TheDCNF’s reporting.

Cain told the special agent leading the raid that he was protected as a whistleblower, but the agent still ordered 15 additional agents to raid Cain’s home, according to Socarras. The agents searched for six hours while Cain, terrified, sat in the living room.

Cain meticulously followed government procedures for whistleblowers under the act by handing the classified documents over to the IG, according to Socarras. Horowitz sent a top-level official to personally hand-deliver them to the Senate and House intelligence committee.

Grassley in his letter, which also cites TheDCNF’s reporting, asked Wray if “the FBI consider Mr. Cain’s disclosures to be protected.”

The whistleblower act protects federal employees who disclose classified documents to the proper authorities, which includes the IG.

Grassley further asked Wray if the FBI was “aware at the time of the raid that Mr. Cain had made what appeared to be lawful disclosures to the Inspector General? If so, was the FBI aware that these disclosures were passed to the House and Senate Intelligence Committees, per the [act]?”

Grassley also asked Wray of “the basis” for there raid and to provide a copy of the original warrant and all supporting documents.

The raid on Cain’s house was permitted by a court order issued by federal magistrate Stephanie A. Gallagher in the U.S. District Court of Maryland for Baltimore.

The court order and all the documents justifying the raid are sealed and not available for public viewing.

On Nov. 30, TheDCNF requested that Gallagher unseal the affidavit and any other documents that served to justify the raid. The court has not yet responded to TheDCNF.

The FBI did not respond to a request for comment.

The FBI probably just wanted to make sure he turned over ALL of the information....not just part of the story.  And for the conspiracy wonks out there....if this was truly a raid from the fictional "deep state", we'd not be reading about it nor would we see Mr. Cain ever again.  I expect articles like this are going to start ramping up with Republican control of congress dwindling quickly.  As always, just my opinion.

"I Know Where All The Bodies Are Buried": Clinton Foundation CFO Spills Beans To Investigators

The CFO of the Clinton Foundation, thinking he was "meeting an old professional acquaintance," admitted to investigators that the charity had widespread problems with governance, accounting and conflicts of interest, and that Bill Clinton has been commingling business and personal expenses for a long time, reports The Hill's John Solomon. 

Clinton Foundation CFO Andrew Kessel made the admissions to investigators from MDA Analytics LLC - a firm run by "accomplished ex-federal criminal investigators," who have been probing the Clinton Foundation for some time. 

 

Kessel told MDA "There is no controlling Bill Clinton. He does whatever he wants and runs up incredible expenses with foundation funds, according to MDA's account of the interview. "Bill Clinton mixes and matches his personal business with that of the foundation. Many people within the foundation have tried to caution him about this but he does not listen, and there really is no talking to him." 

MDA compiled Kessel's statements, as well as over 6,000 pages of evidence from a whistleblower they had been working with separately, and which they filed secretly over a year ago with the FBI and IRS. MDA has alleged that the Clinton Foundation engaged in illegal activities, and may owe millions in unpaid taxes and penalties.

In addition to the IRS, the firm’s partners have had contact with prosecutors in the main Justice Department in Washington and FBI agents in Little Rock, Ark. And last week, a federal prosecutor suddenly asked for documents from their private investigation.

The memo also claims Kessel confirmed to the private investigators that private lawyers reviewed the foundation’s practices — once in 2008 and the other in 2011 — and each found widespread problems with governance, accounting and conflicts of interest.

“I have addressed it before and, let me tell you, I know where all the bodies are buried in this place,” the memo alleges Kessel said.

The 48-page submission, dated Aug. 11, 2017, supports its claims with 95 exhibits, including internal legal reviews that the foundation conducted on itself in 2008 and 2011. -The Hill

"There is probable cause that the Clinton Foundation has run afoul of IRS rules regarding tax-exempt charitable organizations and has acted inconsistently with its stated purpose," MDA alleged in its memo, adding "The Foundation should be investigated for all of the above-mentioned improprieties. The tax rules, codes, statutes and the rule of law should and must be applied in this case."

Foundation officials confirmed that Kessel met with MDA investigators, but said that he "strongly denies that he said or suggested hat the Clinton Foundation or President Clinton engaged in inappropriate or illegal activities." 

"Mr. Kessel believed he was meeting an old professional acquaintance who was looking for business from the Foundation," the foundation added in a statement. 

MDA was specifically created to investigate 501c3 charities, and researched the Clinton Foundation at its own expense in the hope that the whistleblower submission they compiled might result in a government reward if the IRS was able to corroborate wrongdoing and recover tax dollars. 

The IRS sent multiple letters in 2017 and 2018 to MDA Analytics, confirming it had received the submission and it was “still open and under active investigation.” But, shortly before last month’s election, the agency sent a preliminary denial letter indicating it did not pursue the allegations for reasons that ranged from a lack of resources to possible expiration of the statute of limitations on some allegations.

I asked a half-dozen former federal investigators to review the submission and key evidence; all said the firm’s analysis of tax-exempt compliance issues would not be that useful to federal agencies that have their own legal experts for that. But they stressed the evidence of potential criminality was strong and warranted opening an FBI or IRS probe. -The Hill

According to retired FBI supervisory agent Jeffrey Danik, MDA's work is "a very good roadmap for investigation, adding "When you have the organization’s own lawyers using words like ‘quid pro quo,’ ‘conflicts of interest’ and ‘whistleblower protections,’ you have enough to get permission to start interviewing and asking questions." 

While some of the documents MDA submitted were marked as attorney-client privileged, Danik doesn't think that should be an issue for federal investigators - given that since special counsel Robert Mueller "got the OK to investigate Michael Cohen and his attorney-client communications with President Trump, I imagine that hurdle could be overcome under the crime-fraud exception." 

 

Meanwhile, next week a GOP Congressional subcommittee led by Rep. Mark Meadows (NC) will review the work of John Huber - the US attorney designated a year ago by then-Attorney General Jeff Sessions to investigate "all things Clinton." The hearing will establish how much money and resources Huber has dedicated, and whether we can expect to see any recommendations regarding Hillarious Clinton's transfer of classified information from her insecure private server, along with the foundation's activities. 

To that end, a prosecutor working under Huber called MDA analytics last week and requested copies of their Clinton Foundation evidence, according to Solomon.

Some evidence that MDA investigators cited is public source, such as internal foundation reviews hacked in 2016 and given to WikiLeaks. Other materials were provided to the investigators by foreign governments that have done business with the charity, or by foundation insiders.

Kessel's inadvertent admissions, meanwhile, track closely with comments made in 2008 written by a private lawyer named Kumiki Gibson - who the Clinton Foundation hired to study its governance. Gibson flagged concerns over improper commingling of charitable and private business. 

"The work of the Foundation and the President are intertwined in a way that creates confusion at, and undermines the work of, the Foundation at virtually every level," he wrote, warning that such actions pose "reputational and legal challenges, and with confusion, inefficiencies and waste."

Specifically, the memo warned the foundation had not created policies and procedures “required by law” and that some of its leaders “appear to have interests that do not always align with those of the Foundation.”

It also raised the possibility of illegal activities, saying the foundation and its managers held an “anti-compliance attitude” and that there were lower-level employees who “begged” for whistleblower protections after witnessing “less than fully compliant behavior or even worse are asked to participate in or condone it.” -The Hill

Meanwhile, a 2011 review by the law firm Simpson Thatcher noted "material weaknesses" found by auditors in 2009 and 2010, such as a lack of board meetings and unsigned board minutes - and also found that some foundation employees "abuse expense privileges," while others had conflicts of interest.

As often is the case in the swamp....things may not be as they appear.....(Shabs will love this one).....corruption by the 3 letter agencies is being exposed.....so what is the FBI so afraid of that whistle blower Cain might have.....?  On whose authority was this raid ordered?...

 

What if Cain had nothing of value....but it was floated that there was enough info in his possession to bury the FBI/DOJ exposing their wrong doings......a set up of sorts...

 

Guess you would get a pretty clear picture....very fast...of who some of the bad actors are in the FBI......let's see how this works out......all is not always as it seems......CL
