(Reuters) - Acting on a request from the central government inIraq, a U.S. judge has signed an order telling the U.S. Marshals Service to seize a cargo of oil from Iraqi Kurdistan aboard a tanker off the Texas coast, court filings showed on Tuesday.

The United Kalavrvta tanker, carrying some 1 million barrels of crude worth about $100 million, arrived near Galveston Bay on Saturday but has yet to unload its disputed cargo. The ship, which is too large to enter ports near Houston and dock, was given clearance by the U.S. Coast Guard on Sunday to transfer its cargo offshore to smaller boats that would deliver it to the U.S. mainland.

But Iraq's central government, in a court filing on Monday, laid claim to the cargo that it says was sold by the regional government of Kurdistan without permission from Baghdad, which has said such deals amount to smuggling.

To carry out the order from Magistrate Judge Nancy K. Johnson of the U.S. District Court for the Southern District of Texas, the Marshals Service may need to rely on companies that provide crude offloading services.

The judge's order said the vessel would be allowed free movement after the cargo is unloaded.

The U.S. State Department has expressed fears that independent oil sales from Kurdistan could contribute to the breakup of Iraq, has said the oil belongs to all Iraqis, and warned potential buyers of legal risks. But it has also made clear it will not intervene in a commercial transaction.

The filings on Monday did not name the end-buyer of the cargo in the United States. AET Offshore Services, a company in Texas that had been hired to unload the tanker for the buyer, asked in a separate court filing whether Iraq's claims were valid.

Piecemeal oil exports have gone from Iraqi Kurdistan to Turkey and Iran by truck in the past, which Baghdad also opposed. But the opening of a new pipeline to Turkey earlier this year, which could supply the Kurds with far greater revenues, has met much fiercer opposition from Baghdad. One cargo of Kurdish crude was delivered in Houston in May to an unidentified buyer, and four other cargoes of Kurdish crude have been delivered this year in Israel.

MOSCOW, July 29 (RIA Novosti) - A US court has ordered marshals to seize a cargo of oil from Iraqi Kurdistan aboard a tanker off the Texas coast, Reuters reported Tuesday, referring to court filings.

The United Kalavrvta tanker was carrying about 1 million barrels of crude worth some $100 million, and arrived near Galveston Bay on Saturday. As it was too large to enter the port, the ship had to wait till Sunday for the US Coast Guard to give it clearance to transfer its cargo offshore to smaller boats for delivery to the mainland.

However, on Monday, Iraqi government said Kurdistan’s sale of oil amounted to smuggling as it was sold without Baghdad’s permission.

US State Department spokeswoman Jen Psaki said Monday that “the cargo remains on board the ship at this time.”

“We believe that Iraq’s energy resources belong to the Iraqi people and certainly have long stated that it needs to go through the central government. And as you know, there’s an ongoing legal dispute in this case, which is – which obviously is something that we’re aware of and we’re closely following,” Psaki said, adding that US policy has not changed.

Authorities of Iraqi Kurdistan are in conflict with Baghdad over oil exports. In May, a cargo of Kurdish crude was delivered in Houston to an unidentified buyer, and four other cargoes have been delivered so far this year to Israel.

This all just seems to be a convenient Smoke screen of the last final ramifications of the Maliki regime...I've got a hunch this's all one big game plan. To the outside world it looks like Iraq can't get along, their biggest asset is at a stall and the value of their currency just took a nose dive. It's basically because Maliki froze the Kurds cut in the budget because they got tire of his underhanded deals. It was mentioned why or what are they stalling for...actually they just bought some more time. The Kurds are not going anywhere the President is business as usual today building a new government.  The Supreme Court has time now to get this right the first time. The government can get rid of Maliki in about two weeks, one way or the other.  The new PM gives everyone amnesty for a new start and the Supreme Court lay down a structured framework of just how the cow will eat the cabbage from now on. The CBI puts a rate on the dinar that gets me in my bathroom with a putty knife scrappin' and whistling Dixie then we can never look back and none of us will ever wonder what happen to ...Iraq....

I really don't see in the big picture another alternative in which diversion would accompany efficiency. They filed a court order to confiscate their own oil that the ebullient of making the port security watch their oil while they get rid of Maliki's regime. They pumped three 3 tanker ships full of oil to ports that will be customers when this's all said and done. There unloading the tanker and the tanker should be returning about the time it looks like there will be some type of decision handed down. The big kicker would for everyone to sell back their dinar over this, which there have been suggestive articals stating it's best to at least get the current rate now as to Iraq vanishing in another week and I don't have to use RVWITHME's putty knife...

That Is A Pretty WEAK Warning From Our Guberment If They Truly Have "Fears" About "The Disintegration Of Iraq". IMHO

Don't worry if the central govt of Iraq keeps harassing the Kurds the Kurds will file a law suit on the 15 the of July to put an end to it because the Kurds told everyone the Supreme Court all ready resolved this

That must be why turkey won't release any money to the Kurds

And why the courts will tie up the oil in Texas

Those Kurds screw everything up for themselves freaking idiots

So the current – because of the current location, the government – the preliminary measure is – the measure that was done to seize the cargo was done in case the cargo enters into U.S. jurisdiction. It has not yet entered into U.S. jurisdiction, and once – our understanding is that if the oil enters into U.S. jurisdiction, the court order against the cargo could be enforced. But at this point in time, it remains – the cargo remains on the ship, which is outside of jurisdiction.

QUESTION: Have you been in communication with the people running this ship about their intentions and what you would like to see them do?

MS. PSAKI: Well, I think our policy remains the same. There’s obviously a legal case here, and given that, we certainly recommend that the parties make their own decisions with advice from their counsels. There’s a legal case. Our policy position remains the same, which is that we believe that oil should be transferred through the central government of Iraq. But again, this is a case where because it’s not in our jurisdiction, there’s little we can do at this point in time.

QUESTION: But apart from the legal case, if that was not there, would you have a problem with this oil being offloaded, being sold?

MS. PSAKI: Well, I think --

QUESTION: I mean, is there some kind of a legal restriction apart from this current case? Is there – does the U.S. policy include some – a ban on Kurdish oil coming into the U.S. unless it comes through --

MS. PSAKI: I’m – I’d have to check, Matt, but our policy position you’re very familiar with.

QUESTION: Right. But I mean, but it’s not prohibited by the U.S., is it?

MS. PSAKI: Well, but it’s U.S. policy that we’d oppose the selling of outside of the central government of Iraq.

QUESTION: Well, but you can oppose a lot of things that are not illegal, right?

MS. PSAKI: I’m sure we can, but it doesn’t mean that we’d participate in it or support it.

QUESTION: No, I’m just wondering if the – if policy includes a ban on the transfer or sale of Kurdish oil outside --

Hawrami said that "the central government can not earn the issue of the disputed Kurdish oil," pointing out that "the region's oil is produced and shipped and exported and sold in accordance with the rights guaranteed by the Kurdistan region of Iraq's constitution."

He said that Hawrami "territory demanding compensation for the dues that were not paid by Baghdad, according to the Constitution and the laws of Iraq," stressing at the same time, "the Government of the region's readiness to appear before any foreign court where the federal government is trying to fight us."

 

The Iraqi Oil Ministry filed suit in Texas court to demand the acquisition of a shipment of crude oil from the Kurdistan region, says it was sold without her consent.
