On Monday, the Federal Supreme Court decided the Kurdistan Regional Government's appeal to the budget law.   

  

The court said in a statement that “NAS” received a copy of, (7 August 2023), that it “considered the case No. (168 / Federal / 2023) filed before it by the plaintiff (the President of the Kurdistan Regional Government / in addition to his job) against the defendant (the Speaker of Parliament). / In addition to his job) regarding appeal against articles of Law No. (13) for the year 2023 ((the federal general budget of the Republic of Iraq for the fiscal years (2023, 2024, 2025)).  

  

And she added, “And it issued its final and binding decision for all authorities, which includes the ruling on the unconstitutionality of the phrase (and with the approval of the Federal Prime Minister) contained in Article (11/First) and the phrase (and in the event that the parliament cannot be dissolved to take the necessary decision) contained in Article (13/ Seventh) of the law".  

  

And she continued, “And it decided to dismiss the lawsuit regarding the challenge to the constitutionality of articles (2 / first / 5 / b), (11 / second), (12 / second / a, b, c, d, e) and (13 / eighth / b) of the law".

The Federal Court resolves appeals against a number of articles of the general budget

Today, the Federal Supreme Court considered the case No. (153 / federal / 2023) filed before it by the plaintiff (Prime Minister / in addition to his position) against the defendant (Speaker of Parliament / in addition to his position) regarding the appeal against articles of Law No. (13) of 2023 ((The federal budget of the Republic of Iraq for the fiscal years (2023, 2024, 2025))  

  

 

And it issued its final and binding decision for all authorities, which includes the ruling on the unconstitutionality of the phrase (exclusively) contained in Article (2 / first / 8 / c / 6), and the phrase (at his request) contained in the last part of Article (16 / second), and Article (20 / Sixth), Article (28 / Fourth / A), Article (57 / First / C), Article (70 / Second), and Article (72) of Law No. (13) for the year 2023 ((The Federal General Budget of the Republic of Iraq for the fiscal years (2023, 2024, 2025)).  

  

The decision also included a judgment dismissing the plaintiff’s case regarding the challenge to the constitutionality of Articles (28 / fourth / b), (62 / fourth), (63 / third), (65 / second), (71) and (75) of the above law.

11 lawsuits are being considered by the 'federal government' against articles in the budget

The Federal Court is considering 11 lawsuits filed against the articles of the Budget Law, including a lawsuit filed by the Prime Minister of the Regional Government, Masrour Barzani, against the Federal Budget Law.  

 

Barzani's appeal includes an article related to the funding of the provinces of the Kurdistan region by the federal prime minister directly in the event of complaints about the distribution of imports, and the paragraph was passed at the insistence of the Patriotic Union.  

  

The appeals of the head of the regional government include articles and paragraphs of the budget law, including:  

  

- Article 2, paragraph 1 5 / b  

  

- Article 11, paragraphs 1 and  

  

- Article 11, para  

  

- Article Twelve, Paragraph 2e  

  

- Article 12, paragraph 2 (a, b, c, d, e)  

  

- Article 13, para  

  

Complaints filed by the Prime Minister of the Kurdistan Regional Government against the Federal Budget Law relate to:  

  

- Determine the amount of financial dues for the Kurdistan region in the budget.  

  

Handing over oil and financial dues to oil companies.  

  

- Delivery of non-oil revenues and payment of the region's share.

{Politics: Al Furat News} The Federal Supreme Court announced that it has resolved the appeals submitted by the federal government and the Kurdistan Regional Government in the financial budget law.

The decision also included a judgment dismissing the plaintiff’s case regarding the challenge to the constitutionality of Articles (28 / fourth / b), (62 / fourth), (63 / third), (65 / second), (71) and (75) of the above law.

The Federal Supreme Court also considered today the case No. (168 / federal / 2023) filed before it by the plaintiff (President of the Kurdistan Regional Government / in addition to his position) against the defendant (Speaker of Parliament / in addition to his position) regarding the appeal against articles of Law No. (13) For the year 2023 ((The Federal General Budget of the Republic of Iraq for the fiscal years (2023, 2024, 2025))

Today, Monday, the Iraqi Al-Waqa’i newspaper announced the publication of the tripartite budget instructions that have entered into force.

"The instructions of the tripartite budget law for the years 2023, 2024 and 2025 have been published in the Official Gazette," Hanan Munther Nassif, Director General of the Iraqi Gazette, told the official agency.

She added, "The instructions have entered into force."

The Federal Supreme Court rejects new appeals with the tripartite budget

Shafaq News/ The Federal Supreme Court decided, on Monday, to dismiss some appeals in form related to the unconstitutionality of articles in the budget law.

 

In a statement received by Shafaq News agency, the court stated that it had decided to dismiss the plaintiffs’ lawsuit in the number (175/federal/2023), (170/federal/2023), (169/federal/2023), (165/federal/2023), and (165/federal/2023). (154/federal/2023) and (166/federal/2023), related to challenging the constitutionality of some articles of Law No. 13 of 2023, the Federal General Budget Law of the Republic of Iraq for the fiscal years 2023-2024-2025.

 

And it indicated that the ruling’s response came based on the provisions of Article 22 of the Internal Regulation No. 1 of 2022 and in the context of Article 19 thereof, because the plaintiffs are not among the persons mentioned in the aforementioned article who have the right to challenge the constitutionality of the budget law and charge them with expenses, fees and attorney’s fees, and the rulings were issued by agreement in full. And binding on all authorities, I understand publicly on 7/8/2023.

Tripartite budget instructions come into force

Today, Monday, the Iraqi newspaper Al-Waqa'a published the instructions of the tripartite budget that entered into force.

The director general of the Iraqi Gazette, Hanan Munther Nassif, said that "the instructions of the tripartite budget law were published in the Official Gazette."

Yesterday, Monday, the Ministry of Justice announced that the federal general budget for three years had entered into force, and the Director General of the Iraqi Facts Department in the ministry, Hanan Munther Nassif, stated that Instructions No. (1) for the year 2023, related to facilitating the implementation of the Federal General Budget Law of the Republic of Iraq for the fiscal years, had been published. (2023/ 2024/ 2025) No. (13) of 2023 in the Official Gazette.

 

Nassif explained that "Instructions No. (1) for the year 2023 are considered effective retroactively from the date 1/1/2023," indicating that "the instructions have entered into force."

 

In addition, the Federal Supreme Court decided, yesterday, Monday, to reject some appeals in form related to the unconstitutionality of articles in the budget law. 

And the court stated, in a statement, that it had ruled to dismiss the plaintiffs’ case in form in (6) cases related to challenging the constitutionality of some articles of Law No. 13 of 2023, the Federal General Budget Law of the Republic of Iraq for the fiscal years 2023/2024/2025.

 

And it indicated that the ruling’s response came based on the provisions of Article 22 of the Internal Regulation No. 1 of 2022 and the significance of Article 19 thereof, because the plaintiffs are not among the persons mentioned in the aforementioned article who have the right to challenge the constitutionality of the budget law and charge them with expenses, fees and attorney’s fees, and the rulings were issued by agreement in full. The Ministry of Finance publishes the amended tables related to Article (76) of the Budget Law
