Iraqi jurists have warned of a "legal dilemma" that Iraq is currently going through after a disruption of the quorum of the Federal Supreme Court, which is the highest Iraqi legal body specialized in separating legal disputes between the Iraqi authorities and ratifying the election results.

After the retirement of a member of the court, Judge Farouk Al-Sami, about a year ago, the Federal Court tried to appoint one of the reserve judges to fill his position, but at that time all the reserve members were retired and could not be used to fill the void in the court.

The main members of the Federal Court shall enjoy their positions for life or until their request for retirement, but this does not apply to the reserve members who are subject to the provisions of age and years of regular service.

The  death of the other member of the court , Judge Abboud Al-Tamimi, on Sunday, increased the defect in the quorum of the Supreme Court and exacerbated the legal problem that Iraq is currently going through.

According to the legal expert, Ali Al-Tamimi, "Article 5 of the court law requires that court sessions be held in the presence of the entire court, and on the contrary, its decisions are invalid."

This means that the court will not be able to certify the final results of the elections, according to Al-Tamimi, who said that "according to this case, it is not possible to approve any early or regular elections."

Al-Tamimi suggested returning to a legal article abolished from the Federal Court Law that would allow the Judicial Council to nominate members of the Federal Court and grant the authority to approve the candidacy for the Presidency Council, which was previously formed by the President and his deputies.

But the court itself canceled this article in the past in order to guarantee its independence and not "the authority of others over it."

In order to solve this "dilemma", as expressed by the jurist, Saeed al-Baka, the Iraqi parliament must legislate an alternative article that "guarantees the court's complete independence."

Crying He said that Iraq has become in front of a "constitutional and legal vacuum", which requires the House of Representatives "to assume its historical responsibility and expedite the legislation of the court law stipulated in the constitution," adding that "the upcoming elections are threatened due to the lack of a quorum for the Federal Court."

The Iraqi government, headed by Mustafa Al-Kazemi, pledged to hold early elections after bloody protests that lasted for months and led to the overthrow of the government of Adel Abdul Mahdi.

The demand for early elections and the amendment of the current election law was among the most prominent demands of the protesters, who are currently threatening to restore the momentum of the protests on 25 October.

In turn, the  legal expert, Tariq Harb  , considered that voting on the new Federal Court law is "impossible", as it requires the approval and vote of 220 deputies, and this is difficult to achieve, and it is the same reason that has led to the suspension of the law since 2006.

Harb explained to (Basnews), that «the only solution available so that the Federal Court can hold its sessions again is to amend its current law in order to allow the sessions to take place with a shortage in the number of its members or to allow the nomination of judges to it through a specific mechanism, and this amendment will need a simple majority as much Only 85 deputies, which can be achieved. ''

Pointing out that «some political blocs that do not want to hold early elections are working to obstruct voting on the court’s law, because they know that elections cannot be held without voting on the Federal Court’s law, which allows it to convene and ratify the election results.

As for the legal, Saeed Al Safi, he said that the conflict between the Supreme Judicial Council and the Federal Court over the legal powers and the powers to nominate members of the court "will continue" as long as parliament does not legislate a law.

Al-Safi suggested that the law be "similar to the laws of countries that have similar legal bodies such as the United States."

In the case of the United States, the president is the one who nominates the members of the Supreme Court, but the nomination is not final without the approval of the Senate in Congress.

The Media Office of the Prime Minister stated in a statement, which "People" received a copy of, (October 13, 2020), that "Today, the Council of Ministers held its regular session headed by Prime Minister Mustafa Al-Kazemi, during which a number of issues and topics included in the schedule were discussed. The statement added, "The Minister of Health and Environment, at the beginning of the session, presented a detailed report on the latest developments in the Corona pandemic in Iraq, and the government's efforts to contain the virus, reduce the rates of injuries and deaths throughout the country, and the efforts of the Ministry of Health to provide the necessary treatments and health supplies to all hospitals," As well as continuing the awareness campaigns on taking the preventive measures to be adhered to.  

  

According to the statement, "a discussion of the reform white paper took place during the session, where the Minister of Finance presented the final report of the emergency cell for financial reform in Iraq, which includes immediate plans to get out of the current financial crisis, and an explanation of the contents of the White Paper and its ability to achieve the advancement of the country's economy, which suffers from various problems." And it faces serious challenges, and the white paper is enough to address many of the defects that have accumulated over many years. "  

  

The statement stated that, after discussing what was included in the agenda, and what the discussions concluded about it, the Council issued the following decisions:  

First / Approval of the White Paper for Economic and Financial Reform, taking into account the opinion of the Legal Department in the General Secretariat of the Council of Ministers, and the comments of the members of the Council of Ministers.  

  

Second / Extending the exception granted to the Ministry of Health, according to the decision of the Supreme Committee for National Health and Safety (9 of 2020), and the decision of the Council of Ministers (42 of 2020), regarding the Ministry of Health exemption from the instructions for implementing government contracts (2 of 2014) and its attached controls, and instructions for implementation The federal general budget upon its issuance, and in order to eliminate the Corona pandemic, to ensure the provision of medicines, supplies, and medical and laboratory devices without delay.  

  

Third / Approval of the recommendation of the committee formed according to the Diwani order (34 of 2020) and the Diwani order (247 of 2020), which include:  

- Authorizing the Ministry of Transport to negotiate the Baghdad train project with a consortium (Alastom-Hyundai), at the cost and period that will be determined based on the outputs of the report that will be submitted by the consultant, who will evaluate the proposal submitted by the two companies' consortium, and what will be reached through negotiations between the two sides, The issue was later presented to the Council of Ministers.  

  

 Fourth / Approval of the following:  

1- All creditor ministries and government agencies provide the two ministries of trade and agriculture with lists with a CD containing the debts owed to them by farmers, in order to set off between farmers' dues and those debts and transfer them from the ministries of commerce and agriculture to the creditors.  

  

2- All ministries and government agencies fail to fulfill the principal debts owed by farmers, and cancel the late benefits due on them, for those who have debts owed by government agencies equal to or greater than amounts, and are required to pay them in light of the payment of their dues from government institutions.  

  

3- The farmers who marketed strategic crops (wheat, barley, rice, corn) opened accounts for them at the Agricultural Bank.  

  

4- The Ministry of Commerce and Agriculture released the amounts owed to farmers to their accounts at the Agricultural Bank.  

  

5- The Ministry of Agriculture supplies farmers and farmers with seeds and fertilizers, provided that the Ministry of Trade pays its sums to the aforementioned ministry.

Al-Ghazzi added; "The list in the upcoming elections will not be influential, and the individual will be the one who has influence. Therefore, the time for the leaders’ influence and their role will end under the new election law.

Parliament had voted earlier this week to approve a proposal that determines the number of electoral districts in each governorate.

The proposal stated that "the number of electoral districts in each governorate shall be distributed equal to the number of seats allocated to the women's quota in the governorate."

Women hold 25 percent of parliament seats under the quota.

Based on the women's seats in each governorate, the distribution of electoral districts will be as follows: 17 in Baghdad, 8 in Nineveh, 6 in Basra, 5 in Dhi Qar and Sulaymaniyah, 4 in Babel, Anbar, Erbil and Diyala, and 3 in each of Kirkuk, Najaf and Salah al-Din. Dohuk, Diwaniyah, Karbala, Wasit, Maysan, and two seats in Muthanna.

Parliament began legislating the new election law late last year under unprecedented popular protests that demanded reforms in the country and the removal of the political elite accused of corruption and dependency abroad.

It is expected that the new law will provide more opportunity for independents and small blocs to ascend to Parliament.

Legal experts affirm that the election law has no value without a full quorum for the Federal Court, stressing the importance of amending Article 3 of the court law that allows the nomination of members by the Federal Court and the Judicial Council in consultation.

The legal expert, Ali Al-Tamimi, said that the Federal Court does not have the required quorum, while Article 5 of its law requires the court to hold its sessions in the presence of all its members, and on the contrary, its decisions are incorrect.

Al-Tamimi added that the amendment of Article 3 of the Federal Law, which used to allow for the nomination of court members by the Judicial Council to the Presidency of the Republic, has become a necessary matter and represents a way out for the missing quorum within the Federal Court Authority responsible for approving the final results of the upcoming elections, and without which no elections can be approved.
