The Internet 'Kill Switch' Bill: What It Is, and Why It Won't Die by Amar Toor on February 1, 2011 at 03:00 PM FILED UNDER: politics, security, web On the very day that the Egyptian government shut down an overwhelming majority of the country's Internet servers, Republican Senator Susan Collins began floating a piece of legislation which, if passed, would grant the President the power to do essentially the same thing in the U.S. The so-called 'kill switch' bill was approved by the Senate's Homeland Security and Governmental Affairs Committee back in December, but expired once the new Congress assumed power a few weeks later. Collins, who serves as the Republican ranking member of the Committee, says the legislation wouldn't allow the President to actually "kill" the Internet, but would simply give him the ability to shut down "critical infrastructure" in the event of a serious cyberattack on the country. "My legislation would provide a mechanism for the government to work with the private sector in the event of a true cyber emergency," Collins wrote in an e-mail to Wired. "It would give our nation the best tools available to swiftly respond to a significant threat." An aide to the Senate Committee provided Wired with the following example: if the U.S. detected a serious cyberthreat, Collins' legislation would enable the President to instantly shut down any infrastructure connected to "the system that controls the floodgates to the Hoover dam" Committee Chairman Joe Lieberman, who co-sponsored the bill, hailed the kill switch as a necessary defense against "cyber warriors, cyber spies, cyber terrorists and cyber criminals." "For all its allure," Lieberman continued, "the Internet can be a dangerous place with electronic pipelines that run directly into everything from our personal bank accounts to key infrastructure to government and industrial secrets." Not everyone, however, is so enthusiastic about the idea. Last year, the American Civil Liberties Union, the American Library Association, Electronic Frontier Foundation and Center for Democracy & Technology and several other groups wrote an open letter to Congress, expressing their collective concerns about the proposed legislation. If passed, they argue, the measure could easily allow the government to censor the Web. "It is imperative that cyber-security legislation not erode our rights," they wrote in the letter (PDF). A congressional white paper (PDF) countered that the legislation clearly prohibits the government from censoring websites "based solely on activities protected by the First Amendment." But it's not just free speech advocates who are concerned. "This has implications not just for free speech," Business Insider's Pascal-Emmanuel Gobry writes, "but also for free markets, as zillions of businesses (including this one!) depend on the internet directly or indirectly." Steve DelBianco echoed Gobry's market-related concerns, pointing out that the legislation expressly prohibits targeted websites from contesting the shutdown in court. "Judicial review is our main concern," said DelBianco, director of the NetChoice coalition, which includes eBay, Oracle and Yahoo!. "A designation of critical information infrastructure brings with it huge obligations for upgrades and compliance." Speaking to the Daily Mail, DelBianco added that any company should be able to settle a "good-faith disagreement" with the government in court, and that no law should deny businesses that right. "The country we're seeking to protect is a country that respects the right of any individual to have their day in court," he continued. "Yet this bill would deny that day in court to the owner of infrastructure." PC Magazine's John C. Dvorak thinks the entire premise of the bill is misguided, and founded upon what he calls a "weird tautology." "The country can't function without the Net, so we need to secure [it], which includes having the ability to shut it down," he explains. "But with the Net down, how can the country function? You tell me." The timing of the bill's resurgence is also curious, as the Obama administration continues to urge Egypt to open up the Web and online social networks. National Post's Matt Gurney acknowledges that Congress isn't "wrong" to take strong measures against cyberattacks, but argues that "the irony of the U.S. debating how to kill the Internet while we all rely on the very same technology to keep us up to date about how other people are using social media to change the world is inescapable, and groan-inducing." Then, of course, there's always the concern that the 'kill switch' could just make it easier for the U.S. government to do exactly what Egyptian president Hosni Mubarak did. Pragmatic as the measure may be in combating cyber-terrorists, Dvorak argues that Collins' bill speaks to a reactionary mentality from another era. "There's a banana republic mentality at work here with this Internet kill switch nonsense," Dvorak writes. "Nobody is taking it over to deliver a victory message any time soon. But the idea is clear. I wonder how much of the Merrill Lynch settlement they stole from this poor guy? $18,000,000 divided by 400 claimants = $ 45,000 each and they wanted him to "settle" for a measly $10k and still they planned to keep over half of that.

That should be forwarded to EVERY local, state and/or provincial office as well. One of the biggest wastes of taxpayer money is too much bureaucracy!! Do they really NEED to hire every niece, nephew, son or daughter of their family and friends to work in some capacity or other?

They should pass a whole bunch of laws ... all using the same premise - IF You are part of the problem ... You're NOT allowed back - and give the people back the monetary value of all those perks and benefits you received while You weren't working on behalf of your constituents!!!

On June 24th, Geithner made an illegal play to divert part of the Global Settlement funds to Josef Ackerman, Chairman of Deutsche Bank, with the plan of working the funds through the middle of July. Fortunately, the evening of June 24th a plane left the US travelling directly to visit Ackerman, with special enforcement personal from the group responsible for getting the Global Settlements completed. Ackerman's Plan was stopped. Upon their return from Germany, Geithner was visited by the same enforcement personal and, will again, if he continues to be a problem. By June 29th, it became public that Geithner is planning on resigning. On July 1st, Geithner was also contacted about the 700 Million Dollars he moved from his personal account in The Vatican Bank to other accounts, at many banks around the globe. Did Geithner actually think we wouldn’t know his movements with the cash? Does he really think we will allow him to keep that money and the other funds he has participated in stealing? This is not a reality. It has been determined that Congress does not have the guts to investigate all of the claims that have been put forth to them. We know in several instances that certain of the names on the list of Vatican Bank account holders and presumed pay-off recipients are the reason. Every one of the Congressional Leaders including Issa has the knowledge in front of them. Hemming and hawwing ... claiming to not want to rock the very delicate boat the United States is in at this time. Mr. Secretary, you have been well paid to strategically perform these criminal actions and to ruthlessly take all the heat, in the beginning, fronting for Alan Greenspan at the Federal Reserve Bank of New York, and then the US Treasury. You have been a good soldier but even you are not important enough to protect as a valuable asset, i.e. any of the Bush family members. Mr. Secretary, the pressure is mounting and you can watch for yourself. In the last week, some old files are re-emerging on the international stage, i.e. the Vince Foster and Ron Brown cases. Both were in high level positions, but at some point they apparently needed to be dealt with. Why? At that point in time the issue was simple ... a man, his oral fixation, a cigar, an intern and a dress. In a significant move, court documents have been unsealed by a Special Division of the United States Court of Appeals, which will prove the FBI and OIC covered-up in the Independent Counsel's probe into the Death of Deputy White House Counsel Vincent W. Foster, and it further exposes the criminal activities of past and present White House Administrations. If it can happen to them, it can easily happen to you. This time there is far more at stake, and do you really think they will allow you to just walk away when you know all the secrets? You know that you have stolen for your Masters, from multiple nations to vast amounts of Investor funds, which have all been recorded. Are you really thinking you can escape justice and America will let you spend one dollar of the funds you were paid to perform these illegal activities? On June 22nd, a Writ was delivered to Phillip Rivett, Senior Statutory Auditor of Price Waterhouse Coopers LLP, London, who was officially put on notice as Auditors for Barclays Bank of illegal trade activity utilizing Mr. Falcone's investment funds on buy/sell programs that created billions of dollars for certain government officials, including key officials of Deutsche Bank and for special accounts held by the CIA at Barclays Bank. This litigation will materially impact Price Waterhouse Coopers LLP, Barclays Bank and Deutsch Bank. The lead attorney firm on record for Mr. Falcone is Fuerst Ittleman of Miami, Florida. In addition, the litigation has already created panic with KPMG, the lead international accounting firm. We know that between the two firms each has expended significant amounts of time, energy and resources in the attempt to get their hands around the problem and the culprits. The culprits answer to the accounting firms is “We’ll take care of it”. Maybe in the past that would be a solid assurance but not currently. The world is falling apart and we are just waiting for either of these firms to believe that this is going away. You, Mr. Secretary, are the titular head of all of this ... you have the keys to the NWO’s Pandora’s Box. This criminal audit trail, from Josef Ackermann to the Bushes, Biden, Herzog, Clinton, Romney and Geithner, is in the hands of a number of Law Firms, proceeding through Global Regulatory Legal actions including criminal investigations. Records have been filed with trustworthy Global Enforcement Agencies such as the FSA (Financial Service Association). China and the EU countries are all working together and have the full sordid unsavoury details of these betrayals. Bank Accounts from the Caribbean to the EU are all traced and records are on file for the courts. More Bank Officers are ready to attest when subpoenaed. Mr. Secretary, do you think they care about the NWO? Not the smart ones. If you are worried about whether you are going to make it through all of this, you need to stop, talk to your attorneys, cut a deal and remove yourself from your post. The Department of Treasury will survive without you, the Country will survive without you and the international community will survive without you. Obama and the others will be concerned but they will appoint someone else to be their puppet.
