Parliament votes on a number of laws during today's session

The House of Representatives holds, Thursday, its regular session of the first legislative term of the fourth legislative year to vote on a number of laws and other reading.

The Information Department of the Council in a statement received / Mawazine News / a copy, "The Parliament holds its 18th meeting to complete the vote on the draft amendment to the Third Law of Governorates not organized in the region No. (21) for the year 2008 (Legal Committee, the Committee of Regions and governorates not organized in (Remaining 11 articles), and vote on the proposed law to commemorate the sacrifices of the martyrs of the war against gangs and called for terrorist and accelerate the completion of their transactions and the care of their wounds (Committee of Martyrs, Victims and Political Prisoners) (11 articles).
 


The statement added that "the session includes the completion of voting on the draft irrigation law (Committee on Agriculture, Water and Marshlands) (remaining 15 articles), and vote on candidates for membership of the Committee on tribal conflicts in the province of Basra, and vote on the candidates of the investigative committee for the abducted.
 


He added that "will also vote on the recommendations that have been submitted by the Committee of Civil Society Organizations and the Finance Committee and the Committee of Regions and governorates not organized in the province and the Committee for Services and Reconstruction after hosting the governor of Baghdad and members of the provincial council, and vote on the proposed law of the Information and Communication Commission (Committee on Culture and Information, (Legal Committee, Committee on Endowments and Religious Affairs) (10 articles).

The statement pointed out that "the meeting will also see the completion of the first reading of the draft law on the election of the Council of Representatives (the Legal Committee) (45 articles), and presented a report and discussion of the draft law of the Second Amendment Law of the Central Bank of Iraq issued by Order No. (56) for 2004 on the authority (The Finance Committee, the Committee on Economy and Investment) (10 articles) and the quarterly activity report of the Legal Committee ").

A parliamentary source told Mawazine News that "the council held today its 18th session of the first legislative term for the fourth legislative year under the chairmanship of its president Salim al-Jubouri."

Abadi delivers parliament to remove the governor of Kirkuk
[BAGHDAD: The Euphrates News] Prime Minister Haider Abadi, submitted a request to parliament to vote on the removal of the governor of Kirkuk, leader of the Patriotic Union of Kurdistan Necmettin Karim.
"The Office of the Speaker of the House of Representatives Salim al-Jubouri received on Thursday a request from the Prime Minister's Office asking for a vote on the removal of the governor of Kirkuk, Najm al-Din Karim, according to Article (7 / VIII / 2} of the Law of Governorates that are not organized in Region No. 21 of 2008 amended. 
The governor of Kirkuk, Najmuddin Karim, had submitted a request to the Kurdish-controlled provincial council to approve the inclusion of Kirkuk in the referendum on the independence of Kurdistan and approved by the Council to boycott Arabs and Turkmen. 
Karim's request came after the provincial council approved his request in March to raise the flag of the province over the institutions of the province and refused to remove it despite the issuance of a federal decision to violate the Constitution.
It is noteworthy that the House of Representatives voted in its first meeting on Tuesday to reject the referendum in the Kurdistan region and authorized Abadi to take what is necessary to preserve the unity and sovereignty of Iraq.

Parliament receives a request from Abadi to dismiss the governor of Kirkuk

The Office of the Speaker of the House of Representatives Salim al-Jubouri that he received, on Thursday, a request from the Office of Prime Minister Haider Abadi, asking for a vote to dismiss the governor of Kirkuk, Najmuddin Karim.

The House voted on Thursday to include the removal of the governor of Kirkuk on its agenda.

A parliamentary source told Mawazine News that "the council voted to include a clause to dismiss the governor of Kirkuk on his agenda."

"Article 7 - VIII.2, which states: The Council of Representatives to dismiss the governor by an absolute majority on the proposal of the Prime Minister for reasons of lack of integrity or exploitation of the job and cause the waste of public money and the loss of one of the conditions of membership and negligence or Deliberate negligence in the performance of duty and responsibility ".

ERBIL — The Iraqi Parliament voted in a session on Thursday to remove the Kirkuk Governor Najmadin Karim from the office.

The Iraqi Prime Minister Haider al-Abadi’s Office sent a request to the Parliament Speaker Salim al-Jabouri on Thursday, asking the parliament for a vote to dismiss the governor of Kirkuk.

Around 173 MPs from those who attended today’s parliamentary session voted to withdraw confidence from the Kirkuk governor. The Kurdish MPs, however, boycotted the session in protest of the decision.

Baghdad’s move against the Kirkuk governor is in response to his support for the Kurdistan Region’s independence referendum and holding the vote in the province.

KIRKUK — Head of the Brotherhood faction at the Kirkuk provincial council has rejected Iraqi parliament’s decision to dismiss governor Najmaddin karim, calling it “illegitimate and against the constitution”.

In a statement to BasNews, Mohammed Kamal, head of the faction, explained that they will not be committed to the decision as it was made by a small group within a particular faction at the parliament. “This is a political move… the Iraqi parliament was supposed to be a tribune for all the components of Iraq not only one,” he said.

He believes that the Iraqi government is about to implement its plans of imposing majority decisions on minorities and further distance from the principles of political partnership.

“Iraq’s illegal moves against Kurds have encouraged them to expedite the referendum on independence,” Kamal pointed out.

Earlier the day, the Iraqi parliament, in absence of Kurdish MPs, held a session on Kirkuk and decided to dismiss Kurdish governor of the province from his position due to his support for Kurdistan Region’s imminent independence referendum.

Kirkuk Provincial Council previously agreed to include Kirkuk in the independence vote which is set for 25th September.

ERBIL, Iraq, Sept 14 (Reuters) - Iraq’s parliament “has no right” to remove Kirkuk’s governor from office, a senior Kurdish official said on Thursday, after parliament voted him out following a request by Prime Minister Haider al-Abadi.

“He is an elected governor of the council of Kirkuk,” said Hoshyar Zebari, a close adviser to Kurdish President Massoud Barzani. “That is the only body that can remove him.”

The decision to remove the governor, Najmaddin Kareem, comes after Kirkuk - an oil-rich province claimed by both the central government in Baghdad and the autonomous Kurdish region in northern Iraq - voted to take part in a referendum set for Sept. 25 on Kurdish independence. The House of Representatives votes on two laws and dismisses the governor of Kirkuk

The House voted in its 18th ordinary session held under the chairmanship of Dr. Salim Jubouri, the Speaker of the Council and in the presence of 173 deputies on Thursday, 14/9/2017, on two laws and a parliamentary decision to dismiss the governor of Kirkuk, while he finished reading two laws. 
At the start of the session, President Jubouri urged the ladies and gentlemen to attend the intensive sessions to expedite legislation of important laws. 
The Presidency of the Council decided to postpone the completion of the vote on the draft amendment to the Third Law of Governorates not organized in the region No. (21) for the year 2008 and submitted by the legal committees and regions and governorates not organized in the province to the meeting on Monday.
The Speaker of the House of Representatives referred to the receipt of the presidency of the Council of the request of the Prime Minister to dismiss Mr. Najm al-Din Karim, governor of Kirkuk, explaining the existence of a legal opinion that the law 21 is not applicable to the status of Kirkuk, noting the existence of a request submitted by a number of ladies and gentlemen In order to preserve the public interest, especially with the desire to resolve all outstanding issues by the arrival of a delegation from the Kurdistan region to hold a real dialogue to discuss all issues. 
The Council voted to dismiss Necmettin Karim, governor of Kirkuk, at the request of 128 deputies after approving his presentation on the agenda of the meeting and the arrival of a book submitted by Mr. Haider al-Abbadi, the Prime Minister, asking the House of Representatives in accordance with its powers to remove the governor.
The Council voted on a bill to commemorate the sacrifices of the martyrs of the war against gangs calling for terrorists and expediting the completion of their transactions and the utmost care for their wounds submitted by the Committee of Martyrs, Victims and Political Prisoners in order to speed up and complete the transactions of the martyrs of the battlefield who sacrificed their lives in the holy war against gangs and called the terrorists and civilians who sacrificed their blood The logistical support and media personnel who were martyred during their coverage of the liberation operations and guaranteeing the rights of their loved ones fully to preserve their dignity and worthy of the sacrifices and heroics of the martyrs and their place of care and treatment of the wounded, Gat own them.
The Council ended the vote on the draft irrigation law submitted by the Committee on Agriculture, Water and Marshlands, which aims to preserve water resources and prevent damage to them and to prevent overflow of water quotas and the non-harmonization of the fine imposed on the violators stipulated in the Irrigation Law No. (6) of 1962 with the value of The Iraqi dinar at the present time and for the purpose of canceling the decision of the Revolution Command Council dissolved No. 587 for the year 1981. The 
Council postponed the vote on each of the candidates for membership of the Committee on Tribal Disputes in the Governor of Basra to the meeting on Saturday and candidates for membership of the investigative committee on the kidnapped.
The Council concluded the first reading of the proposed amendment to the Personal Status Law No. 188 of 1959, submitted by the Legal, Endowment and Religious Affairs Committees, which was in line with Article 2 of the Constitution. It is not permissible to enact a law that contradicts the principles of Islam and Article 41 To ensure the freedom of individuals to abide by their personal conditions according to their religion or sects or beliefs or choices and to maintain the courts as a unified judicial body to apply the provisions of the legitimacy of the legitimate conditions after reference to the competent authority. 
The Council completed the first reading of the proposed law of the election of the House of Representatives and submitted by the Legal Committee in order to establish a solid electoral system that achieves the best representation of all citizens.
President Jubouri pointed to the submission of more than one bill and a bill for the elections of the House of Representatives where the adoption of the reading according to the precedence of time and if not approved the proposal of the law after being submitted to vote in principle at the next session will be the draft law elections of the House of Representatives. 
The Presidency decided to postpone the reading of both the report and the discussion of the draft law of the Second Amendment Law of the Central Bank of Iraq Law No. (56) of 2004 on the Coalition Provisional Authority (dissolved) submitted by the Financial and Economy and Investment Committees and the quarterly activity report of the Legal Committee.
The vote on the recommendations that were submitted by the Committee of Civil Society Organizations, the Finance Committee, the Regions and Non-Provincial Committees in the Region and the Services and Reconstruction Committee was postponed after the Governor of Baghdad and members of the Provincial Council were hosted in addition to a bill proposed by the Media, Communications,

It was then decided to adjourn the meeting until Saturday, 16/9/2017.

Irrigation Law

In the name of the people Presidency On the basis of what was approved by the House of Representatives and ratified by the President of the Republic based on the provisions of item (I) of Article (61) and Article (III) of Article (73) of the Constitution The following law was issued: No. (2017) Law Irrigation Article (1) The following terms for the purposes of this Law shall have the following meanings: First Ministry: Ministry of Water Resources. Second Minister: Minister of Water Resources. Third: Competent Department: Formations associated with the Ministry of Water Resources, each according to its competence. Fourth: General water resources: rivers, lakes, marshes and natural waterways taken for irrigation or discharge of surplus water or artificial sewage and sewers established by the State for the storage, distribution or discharge of water and what arises in such sewage, water or in its aspects for water control, Budget or collection of scientific or technical information for irrigation and drainage purposes. Article 2 First: The Ministry shall undertake, restore, maintain, maintain and supervise the works of public water resources and the establishment, maintenance or improvement of rivers, bridges, dams, dams, dams, buildings, reservoirs and banks with their prohibitions. Second, the owner of the land shall undertake the work of the water resources of his land and the competent department shall have the right to supervise them. Thirdly, the Minister may decide to count any work created by the Ministry or the competent department from the work of public water resources. Article 3 The Ministry or the Competent Department shall appoint and supervise water quotas and water distribution. Article 4 First: The competent department shall determine the locations and dimensions of the tables, the drainpipes, the drainage pipes, the roads, the irrigation facilities, the other water resources, the land and the water. (B) The Minister or his authorized person shall issue a statement specifying the area and the works of water resources stipulated in paragraph (a) of this clause and may change the location of these rights if necessary. Second, the competent department may take the procedures provided for in item (1) of this article as a matter of urgency if necessary. Such procedures shall not be suspended except by order of the Minister or by virtue of a court ruling acquitted of the degree of bits. Article 5 I. If the competent department finds that an act of water resources or private water resources must be constructed, maintained, repaired, closed, lifted or purified, it shall warn the beneficiary or the owner of the land to do so within ten (10) Date of notification. B. If the beneficiary or the owner of the land is prevented, absent or unknown residence, the competent department shall carry out the work and return to the beneficiary or owner of the land at the cost resulting from such acts. C. The competent department shall be exempted from warning in urgent matters, the delay of which may result in damage to the self, money or acts of water resources. Secondly, if damage is caused to a public work of water resources or water resources, and the actor is unknown, the competent department shall repair it and return its cost to its beneficiaries in solidarity. Article 6 The competent department may temporarily cut water in one of the following cases: First, implementation or regulation of water resources. Second: Water distribution by rotation. Thirdly, to prevent harm caused or feared to be solved by the self, money or works of water resources. Lack of water quantity. V. Abuse of the user The use of water or the neglect of care in a manner that leads to waste. Violation of order or warning issued by the competent department under the provisions of this law. Article 7 First, the user shall not use the water for any purpose other than for its purposes. Second, the user shall not carry out any of the work of the water resources or organize it, which may cause harm to others. Article 8 First No pump or any crane or water-drawing machine may be installed on water resources except with written permission from the competent department. The license may not be used for anyone who is issued in his name or in a place other than the place where the hoisting machine was installed, The machine is designated for him, and the competent department determines the engine's power and the size of the pump. Second, the conditions for granting leave shall be determined by instructions issued by the Minister. Article 9 The competent department may cancel the leave granted under the provisions of Article (8) of this law and raise the machine in one of the following cases: First, the owner of the license violates the conditions stipulated therein. Second, the shortage of land allocated to the crane or tug. Thirdly, there is a reason why the survival of the crane or tug is detrimental to the work of water resources or water resources. Fourth: Not to use the leave within one year from the date of grant. Article 10 First, if any person is exposed to a danger of general damage to himself or money from flood waters or floods, the Prime Minister may, on the proposal of the Minister, decide to demolish or break any origin if necessary to prevent the danger and notify the Prime Minister. The Special Rapporteur may decide to destroy any origin and the injured party shall have the right to compensation for the damage caused by the law. Second: The Prime Minister or the Minister may delegate his powers specified in item (1) of this Article to the Governorate Council or the Governor or a Ministry employee of not less than a Director General. Article 11 First: Landowners may not, without the permission of the competent department in the limits designated by them in accordance with Article (4) of this Law, undertake any action which would endanger the work of water resources. Second, the competent department may take any action it deems necessary to protect the works of water resources and water resources in the lands provided for in item (1) of this Article and to take the necessary dust from them and compensate the owners thereof for fair compensation. Thirdly, the competent department shall have the right to enter any land for the purpose of knowing what is being done in violation of the provisions of this law. Article (12) If a vessel or vessel falls into a river, a table or a docks or sinks, the owner shall remove it and remove its debris within seven (7) days from the date of the accident and otherwise the competent department shall remove it and remove its debris at the expense of the owner of the boat or ship. Article 13 First: Without prejudice to any more severe penalty, a fine of not less than (1000000) million dinars and not exceeding (5 million) five million dinars shall be imposed on anyone who commits one of the following acts: Damage or alteration of water resources. B- Overstating the planned water quota without the prior written approval of the competent authorities. C) Neglecting the monitoring of the water allocated to water the land or not taking the precaution necessary to prevent waste if it causes damage to a public road or work of water resources. D) The use of water for the purpose other than the purpose assigned to it without the written consent of the competent authority. (E) Intervening with water treatment contrary to what is planned. And polluting the water or affecting it as or something that is not valid for what is planned for it. G Install a crane or puller for water without permission from the competent department. Second, the penalty shall be imprisonment for those who repeated or continued to violate the provisions of item (1) of this article. Article 14 The Minister shall issue instructions to facilitate the implementation of the provisions of this Law. Article 15 The following shall be canceled: First, the decision of the Revolutionary Command Council (dissolved) No. (587) on 5/5/1981, and the instructions for the installation, purchase and possession of pumps No. (3883) for the year 1981 issued in accordance therewith remain in force not contrary to the provisions of this law until the issuance of what replaces or cancels them. Second: Irrigation Law No. (6) for the year 1962. Article 16 This Law shall be implemented from the date of its publication in the Official Gazette. Positive reasons For the purpose of preserving the work of water resources and preventing damage to them and to prevent overflow of water quotas and the non-harmonization of the fine imposed on the perpetrators of the violations provided for in irrigation law No. (6) for the year 1962 with the value of the Iraqi dinar at present and for the purpose of canceling the decision of the Revolution Command Council dissolved No. 587) of 1981 This law was enacted.
