The legal expert, Ali Al-Tamimi, confirmed on Saturday that the legal punishment must be imposed on the employee who discloses job secrets and publishes official books.

Al-Tamimi said, in a statement to Al-Masalla, that the employee is entrusted with what he knows of secrets related to the public office, and these secrets are protected by laws, including the Disciplinary Law for State Employees, the Civil and Military Penal Code, and other laws such as income tax.

He added that the philosophy in this prohibition is that the employee represents the state in preserving these secrets, and therefore delving into them and publishing them in any way, whether electronic or regular, is a loss of confidence and disturbs public order and contradicts the goal of the public office that is intended to confirm this trust.

And the leaking of official documents can be to reveal corruption in state agencies, but that must be coupled with evidence, just as official documents are leaked to reveal sensitive information that may be related to national security, diplomacy, or public security.

He continued that the employee who publishes these official books without official approval shall be punished according to the Disciplinary Law of State Employees in accordance with Articles 8 and 10 of this Law 14 of 1991 and the formation of an investigative committee that has the right to refer the file to the investigation court with the approval of the minister .. Also, the affected person can file this complaint directly This employee is charged according to Articles 437 and 438 thereof, which are punishable by imprisonment for a period of up to 2 years, and it may be tightened if the publications harm the security of the state, which is the same in the Military Penal Code.

And between: It is permissible for the harmed person who is affected by the published books to claim the authority from which the books were issued for material compensation in accordance with Article 219 of the Civil Code.

Leaking of official documents may violate the privacy and civil rights of individuals.

And he went on: Iraq urgently needs to legislate the cybercrime law, as the UAE, Jordan, Palestine and others did.

He concluded: It must be noted that the publication of such information may affect even the family of the person whose information is published in the long run.

Previous governments sought to prevent the leakage of any official document to unofficial parties or its publication through the media, but they did not succeed in deterring this phenomenon.

The leaking of official documents leads to corruption of trust between the government and the public and affects the inter-relationships between parties, people and state institutions, and makes state secrets open even to foreign countries.

Al-Sudani promises Al-Halbousi to implement the "Sunni card" and create new alliances in preparation for the local elections

The two parties are now busy, according to observers, in tracking the movement of the parties and recording what could be considered "violations in the early election campaign."

Some local sources in Nineveh, where al-Sudani visited the province two days ago, explained that he is trying to "manage projects in the city for electoral calculations."

And the presence of al-Sudani in Mosul, according to what the sources say, is crowding out Sunni parties such as “Takadam” led by al-Halbousi, and “Hasm” affiliated with Defense Minister Thabet al-Abbasi.

Al-Sudani's team, who accompanied him to Mosul, quoting local sources, believes that the city "is living in a state of chaos and poor planning," despite all the money it got from budgets and the Reconstruction Fund.

This opinion is recorded as being against the effective political forces in Mosul, where the obsession with electoral promotion strongly dominates the movement of parties these days, according to what the sources say.

Among the issues that are likely to be behind the recent de-escalation between the prime minister and parties within the coordination framework is the decline in talk of a "ministerial reshuffle".

A leader in one of the parties affiliated with the "framework" could not confirm or deny to (Al-Mada) whether Al-Sudani had decided to cancel the idea of replacing ministers, but he said: "There is a reduction in the level of talk about the ministerial change."

And the leader, who asked not to be named, adds: “Most wings of the coordination framework believe that the prime minister’s talk about a government amendment was part of the electoral promotion to show the independence of his decision within the framework.”

Al-Sudani's decline in enthusiasm for the cabinet change appeared after his recent meeting with Nuri al-Maliki, leader of the State of Law and most of those who rejected the government reshuffle.

And Al-Sudani indicated in an economic conference that took place in Baghdad last week that it is difficult to evaluate the ministers now, "and they are without a budget," while he was interpreted as retracting the cabinet reshuffle or postponing it for another time.

However, according to the leader in the "framework", "the calm now may dissipate with the approach of local elections, (which are supposed to take place at the end of this year), due to a change in the map of alliances in the provinces."

Hawk front

Indeed, some Sunni forces began to reveal the mechanism for running in the elections, after announcing a new alliance between Khamis al-Khanjar, the leader of the Sovereignty Alliance, and former MP Mishaan al-Jabouri and his Watan party.

The alliance that was announced in Salah al-Din was called "the hawks of the nation, the knights of sovereignty," while al-Khanjar, at the celebration of the emergence of the alliance, renewed his demand for the approval of a general amnesty and compensation for those affected.

Mishaan al-Jubouri had announced earlier that a Sunni alliance would soon be formed without Parliament Speaker Muhammad al-Halbousi to support al-Sudani and replace al-Halbousi.

Al-Jubouri hinted that this new alliance might understand the prime minister's failure to implement the demands of the western regions.

However, Haider Al-Mulla, a leader in the Azm Alliance (a Sunni movement competing with Al-Halbousi), denied forming an alliance between his party and the "hawks".

He said in an interview with (Al-Mada) that “what is happening is alliances to pave the way for entering the next local elections,” noting that a party advanced outside this electoral alliance, but continues with “sovereignty” in Parliament.

Regarding the news of the removal of the Speaker of Parliament, Al-Mulla said: “There are dialogues between Azm and other forces on the issue, and the decision will be after the approval of the budget.”

The budget is supposed to be approved at the end of this week, according to what was announced by the State Administration Coalition, which includes all the dominant forces in Parliament.

Al-Halbousi and Al-Sudani

Regarding attempts to expel al-Halbousi, Yahya al-Muhammadi, spokesman for the Taqaddam Party, describes these news as "media explosives" that we usually hear from parties and personalities who "failed to win the past elections."

He added, "Therefore, some may try to invest in these explosives to pressure towards achieving special interests, which was evident in the statements of one of the accused of forgery (referring to Mishaan al-Jubouri), who indicated that he was ready to give up the rights of the component in exchange for the removal of President Muhammad al-Halbousi."

Al-Muhammadi continued that whoever thinks that “the Speaker of Parliament may be subject to pressure or blackmail, or turn right or left away from the path of promoting development and reconstruction is very important, and he must have the necessary courage and present the reasons and justifications for that, and then follow the paths drawn by the law instead of staying up late.” In the studios of some satellite channels, or tampering with social media applications.

Since the emergence of the first government in 2005 after the US invasion of Iraq, a prime minister "did not dare" to amend his government cabinet without consulting with the political forces, as specialists confirm, as the cabinet formation was and still is based on the principle of "election dues" or what is popularly called " Muhasasa", however, the current Prime Minister, Muhammad Shia'a al-Sudani, declared his intention to deal with this politically unfamiliar matter after 2003, challenging the political forces by saying, "Whoever wants to refuse, let him refuse."

It is assumed that the change of ministers will take place on the basis of a 6-month evaluation, but the Sudanese government has been in existence for 9 months since October 13, 2022, and the ministerial reshuffles have not seen the light until now.

"Baghdad Today" spoke with a researcher in political affairs, Ahmed Al-Sharifi, today, Tuesday (8 August 2023), to find out the reasons for the delay in the amendments. The various parties, with the aim of preventing him from carrying out any cabinet reshuffle, despite his promises to do so.

He added, "There are ministers in the current government, who did not provide anything, and we believe there is a need to change them, but the pressures remain in control of this matter, and for this we find the Prime Minister directed to exempt some officials in the state, including managers and others, without prejudice to the personalities who have political and partisan protection." ".

Prime Minister Muhammad Shia al-Sudani, who formed his government during the month of October 2022, pledged days after its formation that he would work to evaluate the performance of those with special grades in the country (general directors and undersecretaries of ministries) within 4 months and subject ministers to evaluation within 6 months.

In the current government there are 23 ministries, distributed among Sunni, Shiite and Kurdish political parties, in addition to minorities, in the manner of “quotas”, or as traditional parties express it by electoral entitlement, which is “consensual” according to the classifications of Iraqi observers, as it passed through the Iraqi Parliament in October Last year, without differences between the parties. 

In the context, Iyad al-Anbar, a professor of political thought at the University of Kufa, criticized, via "Baghdad Today", the delay in the ministerial changes, attributing the reasons to being "for media consumption, especially since the assessments that al-Sudani spoke about after 6 months were not based on a normative issue and public opinion was not informed." On it, as it is not known what plans and programs were presented by the ministers for evaluation, and whether the evaluation is at the administrative level or at the level of achievement.

Al-Anbar added, “This is the habit of all previous governments with procrastination and media consumption of such issues, and even if the ministerial amendments were put forward after the budget instructions were published, it does not go beyond being procrastination and media consumption, as it needs political agreements, finding replacements and passing it through Parliament,” noting that “the issue will remain In a vicious circle, since the prime minister does not have the right to make the amendment.

As for the talk about the American veto that some newspapers spoke of against some ministers of the framework, Al-Anbar stressed, "This talk is unrealistic and is put forward by political opponents, nothing more."

Al-Sudani said in a speech he delivered during the Council of Ministers session last February, "The minister ends his relationship with the political forces after his nomination and obtaining the confidence of Parliament."

And the Prime Minister stated in a clip broadcast on state television that "the minister who feels pressure or threat, I am present." A few hours after Al-Sudani's speech, a number of ministers appeared during a meeting of the State Administration Coalition.

Al-Sudani added in the session, "We did not see any preliminary indications of the performance of ministers in combating corruption, and ministers, officials and general managers must be present in the field to solve problems." 

The Prime Minister affirmed: I will not compliment any leader or party with the cabinet reshuffle, and whoever wants to refuse, let him refuse.

As for the researcher in political affairs, Ziyad Al-Arar, he told "Baghdad Today" that "the cabinet reshuffle is not possible because there is no financial abundance through which the prime minister can evaluate the minister's work and achievements."

Al-Arar believes that "there is an evaluation and change coming during the next three months, and there is no possibility currently for evaluation or change."

In addition, the head of the Center for Political Thinking, Ihsan al-Shammari, says, "The prime minister's words are pressure on ministers who are in conflict with some parties or are unable to uncover corruption files."

Al-Shammari added, in press statements, that "Al-Sudani's failure to manage the corruption file and its spread in state institutions weakens his popularity and his pledges to solve this file."

Al-Shammari continues: "Al-Sudani, in the speech that appeared to him, seemed to want to distance himself if he failed to combat corruption. The blame will lie on the ministers whom he warned of not performing their duty."

Frequent news talks about changing at least 5 ministers and 4 governors, in light of their performance, which Al-Sudani personally evaluates. 

According to the Iraqi constitution, the prime minister can make amendments to his cabinet, provided that it is voted on by a half-plus-one majority of parliament.

Regarding the ministerial reshuffle, Jiyad affirmed, "The Sudanese are against quotas, and most of the political forces have only reached the lowest job levels, and the evaluation and follow-up committees are continuing their work on the performance of ministers and officials," announcing, "The next ministerial reshuffle will be before the end of this year."


Al-Sudani's advisor commented on the visit of the high-level security delegation headed by the Minister of Defense to the United States, saying, "It is a valid military visit, but it has political dimensions and came to follow up the strategic framework agreement between the two countries. It also came to Iraq's need to clarify the American presence, and they announced a clear statement today that their role in Iraq


is Adviser and support to build Iraqi military capabilities, not combat.
US Deputy Assistant Secretary of Defense for Middle East Affairs Dana Stroul said that the US-Iraqi dialogue defined the features of the next stage, stressing that the United States "does not seek a permanent military presence in Iraq."


"We are witnessing a new phase of the defense partnership between the United States and Iraq," Stroll added, in a press statement.


Stroll's remarks came at the end of a visit by a senior Iraqi delegation to Washington headed by Defense Minister Thabet al-Abbasi.


The delegation also included the commander of the Anti-Terrorism Service, Lieutenant General Abdul-Wahhab Al-Saadi, Chief of Staff of the Army, Lieutenant-General Special Forces Abdul-Amir Rashid Yarallah, Deputy Commander of Joint Operations Lieutenant General Qais Al-Muhammadawi, and other senior officials.


In a joint statement issued on Tuesday, the United States and Iraq affirmed their commitment to continuing bilateral military cooperation in all fields, especially combating ISIS, working to prevent the return of its activity, and training Iraqi military forces.


The statement, which was issued after meetings that included Abbasi and US Assistant Secretary of Defense Celeste Wander, indicated that the two sides "affirmed their commitment to developing Iraq's security and defense capabilities and their intention to deepen security cooperation across a full range of issues to advance the two countries' common interest in Iraq's security and sovereignty and in the stability of the region."


Iraq and the United States signed a strategic framework agreement in 2008, which included several axes, including regulating the presence of US forces in the country, in addition to provisions related to strengthening cooperation in the economic, cultural and political fields.
