Kenneth Posted January 31, 2011 Report Share Posted January 31, 2011 A U.S. district judge ruled Monday that the health care law unconstitutional because it violates the Commerce Clause Judge Roger Vinson said as a result of the unconstitutionality of the "individual mandate" that requires people to buy insurance, the entire law must be thrown out. "I must reluctantly conclude that Congress exceeded the bounds of its authority in passing the Act with the individual mandate. That is not to say, of course, that Congress is without power to address the problems and inequities in our health care system. The health care market is more than one sixth of the national economy, and without doubt Congress has the power to reform and regulate this market. That has not been disputed in this case. The principal dispute has been about how Congress chose to exercise that power here," Vinson wrote. That means that, in his opinion, the law cannot be piecemealed together, or that only the commerce clause has to be set aside. If that holds up in the Supreme Court, the entire law has to be thrown out and they have to start over again - with a much less cooperative Congress this time. It is clear that this Health Care Bill will end up on the desk of this court. Why should the American people trust that any decision from the Supreme Court is not simply payback for a very powerful lifetime appointment to the highest court of the land? We should still win 5 to 4, he hasn't made any changes to the court that will change the out come; he replaced a liberal pile with another pile.
