  11. Barzani’s desire to stay in power turns parliament session into fistfight 2013-06-30 Barzani’s desire to stay in power turns parliament session into fistfight Kurdish lawmakers agree to delay presidential polls for two years as they spar over whether to allow Barzani to stand for another term in power. Middle East Online Conflict of interests ARBIL - Iraqi Kurdish lawmakers agreed on Sunday to delay controversial presidential polls for two years as they sparred over whether to allow regional leader Massud Barzani to stand for another term in power. Parliamentary and provincial elections due September 21 will go ahead as planned, but the delay to the presidential polls are the latest step in a months-long battle between the two regional hegemons and opposition parties over whether Barzani, the dominant figure in the autonomous three-province region, can remain in office. The opposition argues Barzani has served the maximum-allowable two terms in office, but the dominant Kurdistan Democratic Party (KDP) and its smaller partner the Patriotic Union of Kurdistan (PUK) have pushed for a referendum on a new constitution which would, if approved, allow him to serve up to two more. On Sunday, the standoff reached a head, with opposition lawmakers throwing water bottles and fistfights breaking out in the Kurdish regional parliament, before a delay to the presidential elections was eventually approved. "The Kurdish parliament approved delaying presidential elections for two years," said Omar Sadiq, an MP loyal to Barzani's KDP. "The election on September 21 will be for parliament and the provincial councils only." He said the delay was to give time for the Kurdish region's political parties to reach agreement on the Kurdish constitution, which was passed by lawmakers in 2009 but never put before a requisite public referendum. Opposition MPs, however, criticised the delay. "We do not trust them," Bayan Ahmed, an opposition member of the Kurdistan Islamic Union, said, referring to the KDP and PUK. "There is no reason for this delay because the date for the elections is already fixed." The KDP and the PUK, headed by ailing Iraqi President Jalal Talabani, have largely held a duopoly in Kurdish politics and have even run on a joint slate in recent elections. Together, the two parties hold a majority of seats in Kurdistan's 111-seat regional parliament. Barzani, the son of revered Kurdish nationalist leader and KDP founder Mulla Mustafa Barzani, has enjoyed tremendous popularity in the region, winning 69.6 percent of votes in the most recent presidential election in 2009. Kurdistan is held up as a paradigm of economic growth and stability in a country still beset by deadly violence and chronic political crises, but critics say its two main parties blur the lines between state office and their own party bureaucracies, fostering nepotism and corruption. In February, Human Rights Watch accused Kurdish authorities of stifling free speech and detaining journalists, activists and political opponents without charge Source

  16. Groundbreaking new laws take power from PM, give to provinces niqash | Mustafa Habib | Baghdad | 27.06.2013 Shortly after provincial elections that saw Iraq’s PM lose sway in many parts of the country, parliament has struck another blow against their controversial leader. Laws giving provincial authorities more power and more money than ever were passed late last week. Last weekend, a new law passed by the Iraqi Parliament in Baghdad, granted the provincial authorities more power than they have ever had before. This momentous move is seen as another step toward decentralization and a move away from the centralized power that current Prime Minister Nouri al-Maliki has been pushing for. Up until now what provincial governments can do has been regulated by Iraq’s Law 21, passed in 2008 and also known as the Provincial Powers Law. Last week, a series of new amendments were made to this law. “These new powers given to the provinces will entrench the principle of decentralization in Iraq,” Kurdish MP Mohammed Kayani, head of the Regions and Provinces Committee in Parliament, told NIQASH; Kayani is a member of Iraqi Kurdistan’s opposition Change movement. “The law gives huge administrative and financial powers to local governments - including the appointment, supervision and punishment of senior officials. In addition, it gradually transfers the powers of seven service provision ministries [in Baghdad] to local governments over a period of two years.” The new amendments to the law gave provinces that are not semi-autonomous regions like Iraqi Kurdistan a host of new political, economic and security-related powers. Provincial authorities may now make more far reaching decisions in these areas without any interference from the central government in Baghdad. “This is a political agreement between Sunni Muslims, Shiite Muslims and Kurdish politicians,” Ziad Ahmad, a local political analyst, told NIQASH. “They are united in their opposition to al-Maliki’s policies. Anti-government demonstrations in the west of the country have also had an impact on this topic. All of these were reasons behind the passing of this law.” Ahmad says that provincial authorities now have more serious responsibilities. He also believes they will require professional advice from outside their own regions in order to succeed. But in fact a lot of these ideas are not altogether new. The provinces were already given broad powers in the 2005 version of the Iraqi Constitution. Articles 111 through 117 give Iraq’s provincial authorities both economic and security-related power. Up until these amendments were passed though, local authorities felt they were constrained by those ruling in Baghdad. Recently especially al-Maliki has been accused of trying to strengthen Baghdad’s authority and his own. However now local governments are able to choose their own judiciary and their own heads of security. The new laws also give them the power to deploy the Iraqi army inside and outside major cities; Baghdad is also obligated to consult with the local governor, should they wish to deploy the army in their province. In fact the amendment, Article 14, says “the governor shall have direct authority over all the apparatuses operating in the province which are tasked with security and with maintaining public order”. “Security forces coming from Baghdad have always refused to inform the governor’s office here of their activities,” Ninawa’s last governor, Atheel al-Nujaifi, who looks likely to return to the post after the recent elections, told NIQASH. Al-Nujaifi heads a troubled province where a variety of different military forces hold power. “The Iraqi government has dealt with the provinces in a dictatorial way and it was ignoring the Constitution.” The new amendments also look likely to make some of the provinces far wealthier. Another one of the amendments has this to say: “the provincial council is the legislative and regulatory authority in the province. It has the right to issue domestic legislation so as to enable it to administer the affairs of the province in accordance with the principle of administrative decentralization. Provincial councils shall have a legal personality and financial independence.” For example, the amendments will increase the percentage of money those provinces producing oil get. Article 44 of the Iraqi Constitution stipulates that, besides part of the federal budget, fees or fines and tax revenues, each province gets a percentage from any barrel of oil that is either produced or refined there; a similar stipulation exists regarding the production of natural gas. “In Basra, this law means that province should get more than US$10 million a day due to oil extraction there – as well as US$1 billion from the federal budget,” former MP, judge and legal expert, Wael Abdul-Latif, told NIQASH. Basra will get the biggest budget it has ever had in contemporary history, Abdul-Latif noted. “And with that, it should be able to solve a lot of its own problems. The money it gets will almost be equal to the budget of a small country like Jordan.” Of course, not everybody is happy about the changes to the Provincial Powers Law. The political bloc currently ruling the country, led by al-Maliki, says it intends to challenge the amendments in Iraq’s highest court. They say the amendments deprive the federal government of important powers it should have. State of Law MPs even boycotted the voting session during which the amendments were passed. However all the MPs that remained in Parliament supported the law. The timing of the new law is also interesting, coming as it did shortly after provincial elections that saw al-Maliki and his supporters lose a lot of power in some provinces. But as Kurdish MP, Hassan Jihad, who supports the amendments as an expression of Iraqi federalism, said: “any party that votes against this law will most certainly be accused of being a supporter of a centralist and totalitarian system.” Then again, those charges are nothing new to al-Maliki. http://www.niqash.org/articles/?id=3242

Standing before you today, O Iraqis honored to offer you congratulations and blessings on the occasion of our success in remove the nightmare of the provisions of Chapter VII for Iraqna Aziz. And that this victory returned by Iraq, dear lord has full sovereignty and control over its bounty, its economy and its policy and its relations with the countries of the world. This victory is not unique in the world, but thanks to your patience and Tlahmkm your government and your support for the national effort continued difficult. For years, which is engaged in dialogues multifaceted with the UN and its organizations and institutions, and with the countries that were the target of adventures of the Baath Party and aggression, such as Kuwait brother. There is tremendous effort and hard work in order to reach this decision, which entitled every Iraqi to be proud of as a victory a large check to his country. This international consensus in favor of Iraq and in support of the orientations of the new did not come by chance or arbitrarily, but was the result of hard work and policies are clear and wisdom was able eventually to be transferred to Iraq from the state pose a threat to international peace and security under the rule of adventurers to the state contribution in the manufacture of international peace and security, within a short period of longer compared to similar tests undergone by some of the world before us, but it is still reeling from the effects to this day whether the presence of foreign troops on its soil or remain under the provisions of Chapter VII. Ladies and Gentlemen: Once again prove to the Iraqi people that the Baath era aggressive and exciting adventure of problems and wars were not only a fleeting exceptional period of making a handful adventure not been to this people, values and manners thoroughbreds noble thing. The ability of our people to overcome difficulties and to get rid of the heavy legacy of the dictatorial policies of the dictatorial regime Lehigh evidence that he is determined to provide such a model and build constructive relations with all countries of the world and especially the Arab states and neighboring countries. Iraq the day to recover based on the policy of strong support orientation towards the inside in the process of consolidating democracy and the federal system and bypass the central railway and adopt national identity mainly Calculus deal among the people not to cancel or marginalization or discrimination sectarian or sectarian or nationalist racist and everyone falls under the tent constitution chosen by our people and close higher for the organization of our political, economic, security and foreign affairs. and moving our country towards the outside to open the prospects for good relations and seek cooperation and common interests and non-interference in the affairs of others to confirm not to accept the intervention of others in our affairs and we regret the day to witness the return of the principle of interference in the affairs of other countries, some countries region and the world, causing confusion and vibration security and relations natural among nations and peoples of the region. and we will go policy open doors accredited Iraq's interest first and stand on common ground with others, even if we disagree on the details and specifics of bilateral issues and that the new Iraq will put its potential and experience in the service of his brothers and the world, particularly in the fight against terrorism and rebuild the country. has seen the Iraq war and active base, militias and gangs established by استباحت Iraqi blood and that was the stage tougher than all the wars experienced by Iraq, but again dock included loyal Iraqis under the roof of national reconciliation to besiege terrorism, militias and sectarian and falls down their arms and pursues فلولهم To begin the process of construction and reconstruction, increasing wealth and designed the Iraqis they support their national government on the need to evacuate Iraqi territory of any foreign military presence was epic after painstaking negotiations long was Iraqi negotiator where distinct solid wise to end Iraq to get rid of the foreign military presence amid skepticism near and far in the possibility of achieving What has been agreed upon also questioned the possibility we are out of the provisions of Chapter VII and in the end came out foreign troops and the lifting of Chapter VII. And honestly say we are heading strongly towards rebuilding Iraq economically, politically and towards services and science and well-being and to lift all the legacy of years of injustice and oppression and erase all traces of humiliation which was signed by the Baath Party and dictator before the tent Safwan and where and beyond. That the most dangerous thing we face the return shipping and sectarian polarization and political tension that surrounds the area and beat storm of murder, fatwas and atonement and build-up of a new, not Iraq, nor the region spared from this storm, which interact with some of the ignorant and the owners of purposes and researchers about the role through the blood, murder and atonement. This certainly calls us to be united in the face of the storm to mitigate their effects on our country, which is recovering and envied by others recover. It also must stand our scientists and our politicians and let us know generally discourse takfirist and fatwas of murder and incitement issued here and there in a clear process for tearing fabric of our communities and sow discord and chaos in and among its people., And silence on the fatwas and incitement and sectarian killings is imminent danger that threatens everyone not fancy one that will benefit good It also invites us to reject the national position trends and policies that weaken our country for the benefit of this regional party or the other. With a keen emphasis on establishing the best and blessed relations with the countries of the region and the world. Tyrants is gone forever and fold them humiliation and page siege and the loss of sovereignty and deny Iraq and its people. Iraq opened to new prospects for the future, which must urge paced invested. It was the culmination of a long process of effort and work continued efforts by the government of backing and support you. Dear brothers and sisters in charge of rebuilding Iraq and provide a decent life for our people and our children and the generations that our future depends on Ptserfatna no choice for us but to live brothers loving country continued good pride and dignity and sovereignty and not turn to groups, sects and nationalities warring rival. Dear gentlemen: For reject sectarianism speech and sectarians to protect our country and our people from the evil and destruction. Reject opinions atonement and owners who claim they are the farthest flag what they are about. They atone promoters who allow murder, encourage it and pay the ignorant to the horrific massacres committed against fellow Muslims. To reject all policy or practice weaken our country, even if we disagree on something Keep in Iraq free space shared which we stand, and we do not accept differences and to challenge and divide by any other number. To serve all of us to calm the political and media to give ourselves a chance the proper mindset is passive. Let's start working and make the effort to stop the bloodshed, especially that motivated by sectarian hatred to avoid a reaction. To sit close to the dialogue table hard and finish to meet with pleasantries and formal or celebrations and dining tables and open the file actually work under the Constitution and national interests, though thorny bitter but inevitable that the two halves actually of its complexities., and emphasize the need to work with meetings bilateral and trilateral Introduction to meet national combines all the ideas and data to put touches the solution and reform and strengthen our political. extend my thanks on my behalf and on behalf of the Iraqi people, Mr. Ban Ki-moon, Secretary-General of the United Nations, which recommended the lifting of the sanctions and remove Iraq from the provisions of Chapter VII. And to the permanent members of the UN Security Council and the rest of all Security Council members unanimously raised their hands in favor of this resolution.
