وينص المشروع المعدل على أن تبقى تقديرات إيرادات الموازنة العامة الاتحادية للسنة المالية 2011 بمبلغها السابق والبالغ (78705237500000) دينار(ثمانية وسبعون ألف وسبعمائة وخمسة مليار ومائتان وسبعة وثلاثون مليون وخمسمائة ألف دينار) وفق الحسابات الرئيسية، ألا أن زيادة طرأت على ميزانية العجز والنفقات بحيث تم تخصيص مبلغ مقداره (94295059613000) (اربعة وتسعون الف ومئتان وخمسة وتسعون مليار وتسعة وخمسون مليون وستمائة وثلاثة عشر الف دينار لنفقات السنة المالية 2011 يوزع وفق (الحقل 3 إجمالي النفقات) من (الجدول ب النفقات حسب الوزارات )الملحق بهذا القانون. وكان مشروع الموازنة قبل تعديله ينص على أن يتم تخصيص مبلغ مقداره (9298058297000) اثنان وتسعون الف وتسع مائة وثمانين مليار وثمانية وخمسون مليون ومئتان وسبعة وتسعون الف دينار لنفقات السنة المالية 2011 يوزع وفق (الحقل 3 إجمالي النفقات) من (الجدول ب النفقات حسب الوزارات )الملحق بهذا القانون. كما ينص المشروع على احتساب الإيرادات الناجمة عن تصدير النفط الخام على أساس معدل سعر قدره (73) دولارا للبرميل الواحد، ومعدل تصدير قدره (2250000) برميل يوميا منها (150000) برميل يوميا عن الإيرادات الناجمة عن تصدير النفط الخام عن طريق إقليم كردستان. وبناء على ما تم الاتفاق عليه خلال اجتماع مجلس الوزراء، وما عرضته وزارة المالية بموجب كتابها ذي العدد (95) والمؤرخ في 12 من كانون الثاني الجاري. الفصل الأول Chapter I

الإيرادات Income

المادة -1- أولا :أ- تقدر إيرادات الموازنة العامة الاتحادية للسنة المالية 2011 بمبلغ (00078705237500) دينار (ثمانية وسبعون ألفا وسبعمائة وخمسة مليار ومائتان وسبعة وثلاثون مليون وخمسمائة ألف دينار) حسبما مبين في (الجدول أ- الإيرادات وفق الحسابات الرئيسية) الملحق بهذا القانون. Article 1 - First: A - estimated revenues of the federal budget for fiscal 2011 of $ (00078705237500) JD (Seventy-eight thousand seven hundred and five billion two hundred and thirty-seven million five hundred thousand dinars), as shown in (Table A - income according to the main accounts) attached to this law.

ب- احتساب الإيرادات الناجمة عن تصدير النفط الخام على أساس معدل سعر قدره (73) دولارا للبرميل الواحد، ومعدل تصدير قدره (2250000) برميل يوميا (مليونان ومائتان وخمسون ألف برميل يوميا ) منها (150000) برميل يوميا (مائة وخمسون ألف برميل يوميا) عن الإيرادات الناجمة عن تصدير النفط الخام، عن طريق إقليم كردستان وإلزام الإقليم بتحويل الإيرادات المتأتية عن ذلك إلى صندوق إعمار العراق DFI بعد خصم نسبة الـ(5%) عن تعويضات حرب الكويت، أو أي نسبة أخرى يقررها مجلس الأمن وتسديدها إلى الأمم المتحدة وعند عدم التسديد يتم خصم المبالغ من حصة الإقليم البالغة 17%. ثانيا: تلتزم الوزارات والجهات غير المرتبطة بوزارة بقيد جميع مبالغ المنح النقدية التي تحصل عليه بموجب اتفاقيات مع حكومات أو مؤسسات أجنبية إيرادا نهائيا للخزينة العامة الاتحادية، وعلى وزارة المالية الاتحادية إعادة تخصيصها للإغراض التي منحت لأجلها وذلك بالتنسيق مع وزارة التخطيط الاتحادية. يخصص مبلغ مقداره (94295059613000) دينار لنفقات السنة المالية 2011، يوزع وفق (الحقل 3 إجمالي النفقات) من (الجدول ب النفقات حسب الوزارات )الملحق بهذا القانون أ- مبلغ مقداره (29163999804000) دينار لنفقات المشاريع الاستثمارية يوزع وفق الحقل (2 نفقات المشاريع الاستثمارية ) من(الجدول ب النفقات حسب الوزارات) الملحق بهذا القانون- مبلغ مقداره (00065131059809) دينار للنفقات الجارية وعلى النحو التالي: The sum of $ (94295059613000) dinars for the expenses of the fiscal year 2011, distributed according to (field 3 Total expenditure) (Table B expenditures by ministries) attached to this law a - the amount of $ (29,163,999,804,000) dinars for the expenses of the investment projects distributed according to the field (2 expenses of the investment projects ) from (b Expenditure Schedule by ministries) attached to this law - the amount of $ (00065131059809) dinars and current expenditures as follows:

ج-يخصص مبلغ قدره(250) مليار دينار احتياطي الطوارئ ضمن اعتمادات المصروفات الأخرى لموازنة وزارة المالية الاتحادية، من أصل التخصيصات الواردة بالفقرة (أولا -ب ) النفقات المشار إليها أعلاه- تخصيص مبلغ قدره(2657256000) دينار لأعمار وتنمية مشاريع الأقاليم والمحافظات بضمتها إقليم كردستان من أصل التخصيصات المشار إليها بالفقرة(أولا - أ ) أعلاه يتم توزيعه كالآتي. هـ - يخصص مبلغ (1633788000) الفا وستمائة وثلاثة وثلاثون مليار وسبعمائة وثمانية وثمانون مليون دينار إلى المحافظات، ما يعادل دولارا واحدا عن كل برميل نفط خام منتج في المحافظة ودولار واحد عن كل برميل نفط خام مكرر في مصافي المحافظة ودولار واحد عن كل 150 متر مكعب منتج من الغاز الطبيعي في المحافظة يتم توزيعه حسب إنتاج كل محافظة وعلى أن يتم إجراء التسويات الحسابية بعد تدقيقها من قبل ديوان الرقابة المالية E - The sum of (1633788000) thousand, six hundred and thirty-three billion seven hundred and eighty-eight million to the provinces, the equivalent of one dollar for every barrel of crude oil producer in the province and one dollar for every barrel of crude oil refined in the refineries of the province and one dollar for every 150 cubic meters producer of natural gas in the province is distributed according to the production of each province, and that the accounting adjustments are made after being examined by the Office of Financial Supervision

ثانيا العجز Second, the deficit

أ- بلغ إجمالي العجز المخطط للموازنة العامة الاتحادية للسنة المالية 2011 (15589862113000) دينارا، ويغطي هذا العجز من المبالغ النقدية المدورة من الموازنة العامة الاتحادية لسنة 2010 ومن الاقتراض الداخلي والخارجي. A - The total planned deficit for the federal public budget for fiscal year 2011 (15,589,862,113,000) dinars, and covers the shortfall of cash retained from the Federal budget for the year 2010 and the internal and external borrowing.

ب- يخول وزير المالية الاتحادي صلاحية الاستمرار بالاقتراض من صندوق النقد الدولي بما يكمل مبلغ (5.4 ) مليار دولار ومن البنك الدولي، بما يكمل المبلغ الـ(2) مليار دولار خلال سنة 2011 وباستخدام حقوق السحب الخاص بـ SDR بحدود (1.8) مليار دولار لتغطية العجز المتوقع بالموازنة العامة الاتحادية إضافة إلى الاقتراض الداخلي بموجب حوالات الخزينة. B - authorizes the Federal Minister of Finance the power to continue to borrow from the International Monetary Fund which complements the amount (5.4 billion) and the World Bank, which complements the amount of (2) billion dollars in the year 2011, using the special drawing rights of up to SDR (1.8) billion dollars to cover expected budget deficit of the federal public in addition to domestic borrowing by the treasury transfers.

ج- كذلك يمول العجز من مبلغ القرض البالغ (500) مليون دولار الممنوح لوزارة النفط من قبل شركة النفط البريطانية. C - as well as finance the deficit of the loan amount of $ (500) million dollars granted to the Oil Ministry by the British oil company.

الفصل الثالث Chapter III

- احكام عامة وختامية - - General and Final Provisions -

المادة -3- Article 3 -

يحصر الصرف من اعتمادات الحسابات الرئيسية (المنح، الإعانات، المصروفات الأخرى، ونفقات المشاريع الرأسمالية) المعتمدة ضمن الموازنة العامة الاتحادية لجمهورية العراق من قبل الوزير المختص أو رئيس الجهة غير المرتبطة بإقليم في ضوء الاعتمادات المرصودة ضمن موازنته السنوية. المادة-4- Article 4 -

لوزير المالية الاتحادي صلاحية إجراء المناقلة بين اعتمادات الموازنة العامة الاتحادية لجمهورية العراق، المصادق عليها في الموازنة العامة الاتحادية السنوية والتكميلية على مستوى الأبواب والأقسام والحسابات الرئيسية والفرعية وله تخويل الوزراء ورؤساء الجهات غير المرتبطة بوزارة والمحافظين ورؤساء مجالس المحافظات غير المرتبطة بإقليم صلاحية إجراء المناقلة بين اعتمادات الموازنة الاتحادية لجمهورية العراق المصادق عليها في الموازنة العامة الاتحادية السنوية أو التكميلية بنسبة لا تتجاوز (10%) من وحدة صرف لوحدة الصرف الأخرى التي يتم تخفيض اعتماداتها باستثناء اعتمادات المشاريع الاستثمارية مع مراعاة أحكام البند (8) من القسم (9) من قانون الإدارة المالية والدين رقم (95) لسنة 2004، على أن لا تتم المناقلة من تخصيصات نفقات المشاريع الرأسمالية إلى النفقات التشغيلية، ولا تتم من تخصيصات الموجودات غير المالية إلى مادة الرواتب والنفقات التشغيلية. المادة-5- Article 5 -

مجلس الوزراء استخدام المبالغ المعتمدة لـ( احتياطي الطوارئ) المنصوص عليها في البند (أولا" - ج) من المادة (2) من هذا القانون، لتسديد النفقات الطارئة وغير المتوقعة بعد نفاد هذا القانون وكانت حاجة ملحة للإنفاق المحلي وعدم وجود تخصيص لتغطية هذه الحاجة. المادة- 6 - Article - 6 -

أولا : لا تستخدم الاعتمادات المصادق عليها في هذا القانون لغاية 30 كانون الأول من السنة المالية 2011 تابعا وتقيد الإيرادات المتحققة لغاية 31/12/2011 والمقبوضة بعد نهاية السنة المالية 2011 إيرادا للموازنة العامة الاتحادية للسنة المالية 2012. المادة-7- Article 7 -

يتم احتساب مبالغ المنح والإعانات غير المستخدمة من المبالغ المخصصة لدوائر الدولة وشركات القطاع العام بانتهاء السنة المالية 2010 وفق المعاير المحاسبية المستخدمة لاحتساب الصرف النهائي وتعتبر المبالغ المدفوعة بصورة زائدة وفق هذه الأسس دفعة مقدمة على حساب المنحة المخصصة للدائرة أو الوحدة في السنة المالية 2011. المادة - 8- Article - 8 -

للوزير الاتحادي المختص ورؤساء الجهات غير المرتبطة بوزارة والمحافظين ورؤساء المحافظات صلاحية الصرف في ضوء التخصيصات المعتمدة ضمن موازنتهم السنوية وتخويل رؤساء الدوائر التابعة لوزارته أو الجهة غير المرتبطة بوزارة صلاحية الصرف كلا أو جزءً ووفقا لما يأتي: To the Federal Minister competent and heads of departments not related to the Ministry and the provincial governors and heads of the power exchange in the light of the approved allocations within the annual Moisnthm and authorize the heads of departments of his ministry or organization is not related to the Ministry the power exchange in whole or in part, according to the following:

أولا: أن يتم الصرف وفقا للاعتمادات المصادق عليها في الموازنة العامة الاتحادية السنوية أو التكميلية وللإغراض المحددة لها. First: that the exchange is in accordance with appropriations approved in the federal budget and the annual or supplementary purposes specified.

ثانيا: أن يتم استخدام الاعتمادات المخصصة في الموازنة العامة الاتحادية بموجب خطة إنفاق يصادق عليها وزير المالية الاتحادي. Second: that is the use of funds allocated in the federal budget under the spending plan approved by the Federal Minister of Finance.

ثالثا: التقيد بالاعتمادات المخصصة في الموازنة العامة الاتحادية بموجب خطة أنفاق يصادق عليها وزير المالية الاتحادي. Third: compliance with the appropriations allocated in the federal budget under the spending plan approved by the Federal Minister of Finance.

رابعا: التقيد بالاعتمادات المخصصة في الموازنة في الموازنة العامة الاتحادية ولا يجوز الدخول في الالتزام بالصرف بما يزيد عما هو مخصص في الموازنة العامة الاتحادية IV: compliance with the appropriations allocated in the budget in the federal budget may not enter into a commitment to certifying more than what is intended in the federal budget

المادة-9- Article 9 -

اولا: تقدم الوزارات ودوائر الدولة الاتحادية كافة حساباتها الشهرية( موازين المراجعة) في موعد لا تتجاوز مدته(10 أيام) من نهاية كل شهر إلى وزارة المالية الاتحادية دائرة المحاسبة. المادة-10- Article -10 -

لوزير المالية الاتحادي بالتنسيق مع وزير التخطيط الاتحادي مناقلة التخصيصات المعتمدة للمشاريع الاستثمارية الواردة في الموازنة العامة الاتحادية لسنة 2011، التي لم تنفذ ما نسبته (25%) من تخصيصات كل مشروع، خلال ستة أشهر من إقرار الموازنة على أن لا تؤثر على التزامات الجهة المنفذة التعاقدية، وتحويلها إلى مشاريع أخرى وتستثنى من ذلك المشاريع التي لم يبدأ التنفيذ بها لأسباب أمنية قاهرة. المادة-11- Article -11 -

أولا: عند نقل الموظف من دائرة من دوائر الدولة الممولة مركزيا أو ذاتيا إلى القطاع الخاص تتحمل وزارة المالية الاتحادية نصف راتبه الذي يتقاضاه من الدوائر المنقول منها لمدة سنتين اعتبارا من تاريخ نقله على إن تقطع علاقته من دائرته نهائيا. المادة- 12- Article - 12 -

يخول وزير البلديات والإشغال العامة الاتحادي صلاحية إجراء مناقلة بين تخصيصات موازنة المؤسسة البلدية ذات التمويل الذاتي للمحافظة الواحدة لتنفيذ الخدمات المطلوبة. المادة -13- Article -13 -

أولا: تحدد حصص المحافظات غير المنتظمة في إقليم بنسبة عدد سكانها من إجمالي النفقات المبينة في الجدول( الجدول د النفقات الحاكمة) الملحق بهذا القانون بعد استبعاد حصة إقليم كردستان البالغة 17 %. ثانيا: تحدد حصة إقليم كردستان بنسبة (17%) من إجمالي النفقات المبينة في (الجدول د- النفقات الحاكمة) الملحق بهذا القانون على أن لا يتم التصرف بهذه الحصة إلا بعد التشاور والتنسيق بين الوزارة المعنية في الحكومة الاتحادية والوزارة المعنية في إقليم كردستان. Secondly: the share of the Kurdistan Region (17%) of the total expenditures shown in (Table D - expenditure ruling) attached to this law that does not dispose of these share only after consultation and coordination between the concerned ministry in the federal government and the concerned ministry in the Kurdistan region.

ثالثا: تحدد نسبة ( 17%) من مجموع النفقات التشغيلية ونفقات المشاريع الاستثمارية للموازنة العامة الاتحادية لجمهورية العراق المصادق عليها لإقليم كردستان، بعد استبعاد النفقات السيادية المتمثلة بـ(مجلس النواب، ورئاسة الجمهورية، ومجلس الوزراء، ووزارة الخارجية، ووزارة الدفاع، أجور المفاوضات والمطالبات القانونية للديون، أجور تدقيق ومتابعة وملاحقة الأموال في الخارج، أجور تدقيق شركة (ارنست ويونغ) ولجنة الخبراء الماليين، المساهمة في كلفة إنتاج النفط الخام المصدر بما فيها عقود الشركات الأجنبية المنفذة لاقليم كردستان، فوائد القروض الأجنبية، فوائد على على سندات حوالات الخزينة العامة، فوائد السندات على إطفاء الديون الخارجية للقطاع الخاص، مبالغ المساهمات العربية والدولية، مبالغ تعويضات حرب الكويت، النفقات التشغيلية لمديرية السفر والجنسية وقيادة قوات الحدود، تسوية الديون في الخارج، الفوائد المترتبة على إعادة هيكلية الديون الخارجية بموجب اتفاقية دول نادي باريس ودول خارج نادي باريس، أجور نقل النفط الخام المصدر عبر تركيا، أقساط الاتفاقيات الثنائية مع دول نادي باريس ودول خارج نادي باريس والمشاريع الاستثمارية للشركات النفطية الأجنبية. رابعا: عند حصول زيادة أو انخفاض في إجمالي نفقات الموازنة العامة الاتحادية تضاف أو تخفض حصة إقليم كردستان تناسبيا مع هذه الزيادة والنقصان على موازنة إقليم كردستان، مع مراعاة أحكام البند( ثانيا) من هذه المادة بما فيها التعديلات التي تجري على النفقات السيادية من مناقلة النفقات السيادية إلى نفقات عامة بنفس النسبة المذكورة أعلاه Fourth: When you get an increase or decrease in the total budget expenditures of the federal public add or reduce the share of the Kurdistan region in proportion to the increase and decrease the budget of the Kurdistan region, taking into account the provisions of clause (ii) of this Article, including amendments to the sovereign expenditure from the transfer of expenditure sovereign to public expenditure, the same proportion mentioned above

المادة -14- Article -14 -

اولا"-أ- يقوم ديوان الرقابة المالية الاتحادي بالتنسيق والتعاون مع ديوان الرقابة المالية لإقليم كردستان باحتساب وتحديد الإيرادات الاتحادية المستحصلة في الإقليم لهذه السنة وتقوم وزارة المالية في الإقليم بتحويلها إلى وزارة المالية الاتحادية شهرياً. رابعا: تتولى وزارة النفط الاتحادية بتحديد الضرر الذي تسببه اي جهة نتيجة التصرف بالنفط الخام المستخرج لغرض التصدير والاستهلاك المحلي. المادة 15- Article 15 -

يعاد النظر في حصة إقليم كردستان والمحافظات غير المنتظمة بإقليم في الموازنة العامة الاتحادية لسنة 2011 وما بعدها في ضوء نتائج الإحصاء والتعداد السكاني لسنة 2011 وعلى أن يتم في ضوء تحديد المبلغ الحقيقي لحصة الإقليم أو المحافظة غير المنتظمة بإقليم. المادة 16- Article 16 -

المادة - 17- Article - 17 -

المادة-19- Article -19 -

تراعى عدالة توزيع القروض التي تقدم للحكومة الاتحادية على أقاليم ومحافظات العراق وحسب نسب سكانها بعد الاخذ بنظر الاعتبار المشاريع الإستراتيجية الممولة من هذه القروض حصرا. المادة -20- Article -20 -

المادة -21- Article -21 -

المادة-22 Article -22

المادة 23- Article 23 -

المادة-24- Article -24 -

اولا: لوزير المالية الاتحادي اعادة تخصيص المبالغ المعتمدة ضمن الموازنة العامة الاتحادية لسنة 2010 لاغراض المشاريع الاستثمارية للوزارات والجهات غير المرتبطة بوزارة ومشاريع تنمية وتسريع اعمار المحافظات وانعاش الاهوار والمشاريع البترودولار وغير المصروفة الى تخصيصات الجهة المستفيدة حصرا لصرفها خلال سنة 2011 لانجاز المشاريع الاستثمارية استناءا من احكام القسم الرابع أ من قانون الإدارة المالية والدين العام رقم 95 لسنة 2004. المادة 26- منع تأجير الطائرات الخاصة بشكل مطلق على حساب الدولة للجهات كافة باستثناء الرئاسات الثلاث (رئاسة مجلس النواب ورئاسة الجمهورية ورئاسة مجلس الوزراء). المادة 27 Article 27

لا تزيد المكافآت النقدية أو العينية الممنوحة للعاملين على مليون دينار سنويا للشخص الواحد ولغير العاملين لقاء خدمة مؤداه الى الوزارة او الجهة غير المرتبطة بوزارة وضمن التخصيصات المقرة بالموازنة المختصة وبموجب تعليمات تصدرها وزارة المالية الاتحادية. المادة 31 - Article 31 -

تلزم وزارات الكهرباء والاتصالات والبلديات والأشغال العامة الاتحادية وأمانة بغداد والبلديات في المحافظات بتفعيل جباية أجور الكهرباء والهاتف والماء والمجاري من المواطنين وأصحاب الأعمال والمصانع والجهات الحكومية والقطاع العام وغيرهم لغرض زيادة مواردها الذاتية وتقليل الاعتماد على الموازنة العامة الاتحادية. المادة 32- Article 32 -

المادة 33- Article 33 -

المادة 34- Article 34 -

عدم التعيين في أية وظائف قيادية (مدير عام فما فوق) ما لم يوجد لها درجة في قانون الوزارة والهيكل التنظيمي الصادر استنادا إلى قانون الوزارة أو الجهة غير المرتبطة بوزارة. المادة 35- Article 35 -

للوزير المختص أو رئيس الجهة غير المرتبطة بوزارة إحالة الموظفين الفائضين عن الحاجة ممن لديهم خدمة تقاعدية لا تقل عن 15 سنة ولا تقل أعمارهم عن الخمسين سنة إلى التقاعد. المادة 36- Article 36 -

المادة 37- Article 37 -

المادة 40- Article 40 -

المادة 41- Article 41 -
