Mardan, a Kurdish Feili representative, told Shafaq News agency, "There has been no increase in the seats of the components in the election law, the increase requires additional seats for the House of Representatives, and the increase in seats needs a general census of the population, but there is no population census, and this is the reason the main".

 

He explained that "according to the general census of the population, there will be 420 seats," pointing out that "the Federal Court said that the quota seat for the Faili Kurds is a national seat throughout Iraq, and this does not benefit the Faili component."

 

He continued, "If we assume that there will be a national seat, then at least the Faili seats should be 5, as is the case for the Christian component," adding, "The national seat does not serve the Faili Kurds unless it has 5 seats, given that the Kurdish representatives are not present in all Iraqi provinces.

 

Mardan added, "We currently have one seat in Wasit Governorate, but at the level of provincial councils we have two seats, the first in Wasit and the other in the capital, Baghdad," stressing that "all components are currently awaiting the general population census to increase the number of their seats in the House of Representatives."

 

And the Iraqi parliament voted, at dawn on Monday, March 20, that the next parliament will consist of (329) seats, which is the same current number.

 

The deputies voted that the seats be distributed: A- (320) three hundred and twenty seats among the governorates. B: The following components shall be granted a share (quota) of the total number of general seats in the House of Representatives, provided that this does not affect their share in the event of their participation in the general lists. as follows:

 

1: The Christian component (5) five seats distributed to the governorates of Baghdad, Nineveh, Kirkuk, Dohuk and Erbil).

 

2: The Yazidi component (1), one seat in Nineveh Governorate.

 

3: The Sabean-Mandaean component (1), one seat in the Baghdad governorate.

 

4: The network component (1) one seat in Nineveh Governorate.

 

5: Faili Kurds component (1), one seat in Wasit Governorate.

 

A: The governorate for which one of the quota seats has been allocated is a single constituency to represent the allocated quota seat within the seats of the House of Representatives according to its administrative boundaries.

 

Parliament also voted that the candidate should have a bachelor’s degree or its equivalent, with the exception of the quota for the components, the preparatory certificate or higher, for the electoral lists to allocate a percentage not exceeding (20%) of the number of candidates for the segments of society who hold a diploma or preparatory certificate or its equivalent.

 

And he voted that the candidate not be convicted of a felony or misdemeanor involving moral turpitude, including administrative and financial corruption cases stipulated in Articles (330, 333, 334, 335, 336, 338, 339, 340) of the amended Penal Code No. 111 of 1969, by virtue of Judicial pat whether it is covered by pardon or not.

 

The House of Representatives had previously voted to hold provincial elections on 6-11-2023, in the same session it held last Monday, to vote on the law of the third amendment to the House of Representatives, provincial and district elections law No. 12 of 2018.

Last Thursday, a number of independent deputies filed a complaint before the Federal Court to challenge the legitimacy of the parliament's voting session, at dawn last Monday, on some provisions of the law, considering that it "violated the sessions' regulations and the parliament's internal system."

More than 75 independent deputies and emerging blocs oppose the bill because of the adoption of the 1.7 electoral representation formula according to the Saint-Lego system.

What is the position of independent representatives now?

 

Independent MP Basem Khashan explains that “part of the election law was voted on in a previous session, and it was objected to in the Federal Court,” noting that “the prevailing opinion on the law is subjective and not discussed, and now most independent representatives do not have a fixed opinion on it.” This subject".

 

Khashan added to Shafaq News agency, "Therefore, all opportunities to correct the problems in the law were wasted due to the lack of clarity of vision of the independent representatives, and the lack of objectivity of the prevailing opinion in the street."

The Iraqi parliament voted in the dawn session of last Monday on seven paragraphs of the controversial election law, out of 15, and decided to complete them in today's session.

 

For two weeks, the Iraqi parliament has failed to hold any session whose agenda includes passing the third amendment to the Provincial Council Elections Law, in its current form and the St. Lego system, which opponents consider a law tailored to the size of the forces in force in the country, as it restores the single-circuit system.

During his speech to Shafaq News agency, Al-Fariji warns that "there is another issue that is bigger than the electoral system, which is the mechanisms of the election law that may allow voter fraud, including trying to rely on the unified card other than the biometric card, and also relying on manual counting and sorting, and thus We lose biometrics and electronic counting and sorting, and this, in addition to outside voting, could lead to massive fraud.”

 

He explains, "The law of multiple constituencies is a law that came out with the will of the masses, and the process of overthrowing it is a process of a coup against the will of the street, so today there are protests to bring the voice to the House of Representatives, and if it does not listen to the voice of the masses, there will be other cases of protest."

 

And "St. Lego" is a mathematical calculation method followed in the distribution of voter votes in countries that operate under the proportional representation system, and it depends on dividing the votes of alliances by the number 1.4 ascending, and in this case, small alliances get a chance to win. However, Iraq previously adopted the electoral divisor of 1.9, which made the fortunes of large political entities escalate at the expense of individual candidates (independent and civilian), as well as emerging and small entities.

 

"Can't be silent"

 

For his part, the demonstrator, Dr. Dergham Majid, confirms that "the demonstrations and sit-ins that started since last night are continuing until now, to reject the St. Lego law that serves the ruling political class," noting that "the last law on which the elections took place, although it does not meet the aspirations of the Iraqi people, is In a way, he removed the corrupt and, in return, brought in new, independent faces who were not accused of corruption.

 

Majed added to Shafaq News agency, "The Iraqi people demand a fair election law, to get rid of the corrupt who insist on approving it to serve their interests and desires and to increase the suffering and destruction of the country and the people, and this cannot be tolerated."

 

And in the event that the law is approved, Majed indicated that "there are other steps other than the sit-in, which are under study, and there are mass crowds that will arrive within hours to the place of the sit-in, and then a statement will be issued by the Coordinating Committee regarding the session and the law to be approved in it." 

    

Serious repercussions

 

In turn, the political researcher, Abd al-Qader al-Nayel, believes that "the process of passing the St. Lego law that the coordination framework wants will have serious repercussions on the Iraqi scene, and these repercussions represent a blatant challenge to the Sadrist movement and to Muqtada al-Sadr in particular, because the latter was raising slogans of reform, and therefore he is now (Sadr). At a crossroads, either he will be present in the process of not approving this law, or the coordination framework will succeed in eliminating al-Sadr once again in the upcoming elections.

 

During his speech to Shafaq News agency, Al-Nayel pointed out that "the main reason behind pushing for the election law legislation is because their future existence depends on it, because it is a return to square one, after they failed in the multiple constituency elections, but they put themselves in front of the people, especially And that there is a large audience, and they are (the revolutionaries of October), who sacrificed a lot of blood to change this law that is unjust to the Iraqi voter.

 

And he affirms that "passing the law is tantamount to an actual challenge and confrontation to the Iraqi people, so there will be a variety of reactions, including the launch of new demonstrations that have already begun, especially Al-Sadr's directive not to travel to his political leaders to address this issue, and therefore we are facing a new phase of the conflict in the event that it is passed." Shafaq News/ The independent deputies in the Iraqi parliament affirmed, on Saturday, their insistence on their position rejecting the election law in its current form, noting that the large political blocs do not intend to negotiate with them to amend the law.

 

 

 

Independent MP Amir Al-Mamouri told Shafaq News agency, "The independent forces and blocs insist on their position and refuse to vote on the election law, in addition to that there are many deputies within the political blocs who are not convinced of the current version of the election law."

 

"Today we are trying, through legal means and the internal system of the House of Representatives, to prevent political parties from voting on the election law," he added.

Al-Mamouri indicated that "there are no real intentions of the political blocs to negotiate with the independent forces to amend the election law in accordance with the will of the Iraqi people."

 

Al-Mamouri's statement comes in conjunction with a demonstration rejecting the election law in its current form, which started this evening in front of the walls of the Green Zone, not far from the House of Representatives, where a parliamentary session is supposed to be held this evening dedicated to completing the vote on the election law.

Today, Sunday, the representative of the State of Law coalition, Thaer Makhaif, revealed the reasons for the delay in voting on the general budget law in the House of Representatives, while confirming that the parliament decided to postpone the vote on the budget in order to complete the file of the provincial councils and amend the election law.

"The file of the provincial councils and the amendment of the election law preceded the file of voting on the general budget," Makhaif said in a press interview, noting that "the House of Representatives decided to resolve the file of amending the election law after agreeing on a specific formula from all political forces."

He continued, "There is an importance to the file of approving the law as a result of the presence of directions and opposing opinion from the street calling for its resolution and termination during this period," pointing out that the House of Representatives decided to postpone the vote on the budget law to complete the file of the provincial councils and amend the election law.

Regarding the vote on the general budget law, Makhaif confirms: "The parliamentary committees will work to make the necessary amendments to the budget in order to complete the three readings and pass it as soon as possible."

House of Representatives voted to amend Articles 2, 6 and 7 of the Law on the Elections of the House of Representatives and Provincial Councils.

The media department of the House of Representatives said in a statement received by the Iraqi News Agency (INA), that "the House of Representatives voted to amend Article 2 of the law (displaced voter: the Iraqi who was displaced from his place of permanent residence to another place inside Iraq after 9/12/2013 for any reason whatsoever, provided that he is registered with the Ministry of Migration and Displacement)."
She continued, as the House of Representatives voted to amend Article (6) of the Elections Law, which is as follows: First: A:
The Council of Ministers, in coordination with the Commission, must set the date for the elections for the provincial councils this year, provided that it does not exceed 20/12/2023.
B: After the end of the electoral cycle for the provincial councils stipulated in item (first) of this article, the elections shall be held 45 days in advance, and the date of the elections shall be determined by a decision of the House of Representatives in coordination with the Commission before a period of not less than 90 days.
A: Elections for the new sessions of the House of Representatives, provincial councils and districts shall be held 45 days before the date of the end of the previous sessions.

Fourth: Elections for provincial councils that are not organized in a region shall be held in one day throughout the Republic of Iraq.

Fifth: The Council of Ministers, based on the proposal of the Commission, suspends the official working hours for election days.
The House of Representatives also voted to amend Article 7 of the original law to read as follows: First:

A fully qualified Iraqi who completed (30) thirty years of age on the day of voting.

Committee proposal: Item VIII is hereby amended to read as follows: -

Eighth: Submitting a list of the names of no less than 500 (five) hundred non-duplicate voters supporting his candidacy from among the voters registered in the electoral district in which he applies for candidacy on a single list in accordance with instructions issued by the Board of Commissioners.

Second, a- To have a bachelor's degree or its equivalent, except for the quota of components, the certificate is preparatory or higher.

Clause III shall be amended to read as follows: Third
: He must not be convicted of a felony or misdemeanor involving moral turpitude or cases of administrative and financial corruption stipulated in Articles (330, 333, 334, 335, 338, 336, 340, 339) of the Penal Code No. 111 of 1969, as amended, by a final court ruling, whether or not
he is covered by pardon
Eighth: Submitting a list of the names of at least 500 (five) hundred non-duplicate voters supporting his candidacy from among the voters registered in the electoral district in which he is applying for candidacy with a list Individually in accordance with instructions issued by the Board of Commissioners.
The House of Representatives also voted to amend the articles of the original law to read as follows: Item I of Article (12)
First:

The valid votes for each list shall be divided on the sequential numbers (1,7, 3, 5, 7, 9..... etc) and the number of seats in the electoral district and the highest outputs are chosen until all seats in the electoral district are exhausted.

Article 14: First: If a member of the House of Representatives or a member of the provincial council loses his seat for any reason, he shall be replaced by the next candidate in the number of votes obtained in his list.

Second: If a member of the House of Representatives or a member of the provincial council loses his seat for any reason and is part of a single list, the seat shall be allocated to another candidate who obtained the highest number of votes, the party or a political organization that obtained the maximum number of votes and did not obtain a seat.

Baghdad today publishes the text of a new election law voted by parliament.

 

Earlier, the House of Representatives voted on the second and sixth articles of the Third Amendment Law to the House of Representatives, Governorate and District Councils Elections Law No. 12 of 2018.

The Council voted to amend Article 2 of the law to be (displaced voter: Iraqi who was displaced from his place of permanent residence to another place inside Iraq after 9/12/2013 for any reason, provided that he is registered with the Ministry of Migration and Displacement).

Parliament also voted to amend article 6 of the law, to read as follows:

First: A: The Council of Ministers, in coordination with the Commission, shall set the date for the elections for the provincial councils this year, provided that it does not exceed the date of 20/12/2023.

B: After the end of the electoral cycle for the provincial councils stipulated in item (first) of this article, the elections shall be held 45 days in advance, and the date of the elections shall be determined by a decision of the Council of Representatives in coordination with the Commission no less than 90 days in advance.

Parliament passes paragraphs related to Kirkuk election law

Shafaq News / The head of the Turkmen bloc, MP Arshad Al-Salhi, announced the resolution of the Kirkuk file and the passage of paragraphs related to its privacy and obliges the relevant ministries to check the voter register.

 

Al-Salhi said that the vote on the article on the province of Kirkuk in the provincial elections law was by consensus between the Turkmen, Arab and Kurdish leaders, we understood for Kirkuk, and we assumed national responsibility, we made the amendment to the article on the province, with full understanding and cooperation.

 

The correspondent of the Shafaq News Agency in Parliament said that the vote was that the vote of the displaced is 48 hours before the general vote, and with regard to the vote of Iraqis abroad, the biometric card can be used inside Iraq in their constituencies

The House of Representatives voted in its 16th session, which was held under the chairmanship of Muhammad al-Halbousi, Speaker of Parliament, at dawn today, Monday, in the presence of 218 deputies, on the Law of the Third Amendment to the House of Representatives, Provincial and District Councils Elections Law No. (12) of 2018. 

 

The amendment of the law aims to implement the decisions of the Federal Court No. (155 / Federal / 2019 and its units 157, 160, 161, 162, 167, 168, 171/2019, 5 / Federal 2021, 159 / Federal / 2021, 43 / Federal 2021, 117 / Federal 2019, 87 and its units 111/202 , 103 / Federal 2021, 144 / Federal 2021) and for the purpose of holding free, fair and fair elections for the House of Representatives and provincial councils that are not organized in a region and upgrading them and the participation of all segments of society and ensuring a fair distribution of seats among the competing lists.
