ERBIL, Kurdistan Region - A major oil firm said on Wednesday that it is cutting production at its oil fields in the Kurdistan Region as the legal dispute between Iraq and Turkey continues. 

Turkey closed a key pipeline pumping oil from the Kurdistan Region to its port of Ceyhan in the Mediterranean last week after a ruling by the International Chamber of Commerce (ICC). 

Norwegian oil and gas operator DNO announced in a statement that it began an “orderly shutdown” of its operated oil fields in the Kurdistan Region four days after receiving instructions to temporarily halt oil deliveries to Turkey’s Ceyhan port. 

“It is unfortunate it has come to this given the likely impact of a continuing supply disruption on oil prices and at a fragile time in global financial markets,” said DNO’s Executive Chairman Bijan Mossavar-Rahmani.

The Ceyhan port pipeline carried close to 400,000 barrels per day of Kurdistan oil and another 70,000 Iraqi oil to be exported to the Mediterranean and other refineries prior to the halt.

DNO produced an average of 107.000 barrels per day in 2022 in Tawke and Peshkabir oilfields, which amounts to nearly a quarter of the Kurdistan Region’s total exports, it said. 

The statement added that production at Peshkabir was halted on Tuesday evening, while production at Tawke has been initiated and will take over a day to be completed. 

DNO previously announced it had diverted oil production to its production storage, but its capacity is limited. 

The arbitration court ruled that Ankara had breached a 1973 pipeline agreement between Iraq and Turkey that obliges the Turkish government to abide by instructions issued by Iraq regarding the transport of crude oil exported from Iraq. Oil exports from the Kurdistan Region were halted on Friday and are yet to resume.

The Kurdistan Regional Government (KRG) is heavily reliant on its revenues and an inability to sell its crude will severely impact its already struggling economy. 

The KRG has sent several delegations to Baghdad for discussions since the ruling. Iraq maintains that it is in favor of oil exports resuming but insists that Baghdad remains in control of the oil flow from the Kurdistan Region. 

“We fully support the export of the Kurdistan Region’s oil abroad and we should hurry to reach an agreement for the oil to be exported,” Assim Jihad, spokesperson for the Iraqi oil ministry, told Rudaw’s Sangar Abdulrahman on Tuesday.

British website: Iraq hastened to announce winning international arbitration with Türkiye

However, Western and Turkish sources familiar with the court case paint a different picture. According to the British website, the court case is seen as a legal challenge that intersects a commercial dispute with national and international politics, as Iraq says that one of its components, the Kurdistan Regional Government, does not have a direct mandate to sell oil through the pipeline.  

  

In 2014, Baghdad filed a lawsuit against Turkey and demanded $33 billion in compensation for lost revenue and damages. Last month, they demanded $58 billion in compensation from Ankara for all oil sales made through 2022, according to the sources. But in the end, the court only awarded them $1.4 billion in compensation for the 2014-2018 period, pending interest rates.  

  

According to the site's information based on its sources, the real picture is as follows:  

  

- The court decided that the Kurdistan Regional Government is an organ of the Iraqi government, and therefore it is a legitimate entity. "Therefore, Turkey was not wrong while storing and transporting the oil with the instructions of the Kurdistan Regional Government," the western source said. Their claim for damages under exclusive use was also denied, and they demanded full compensation for oil sale income and loss.  

  

The court decided that Turkey violated the contract only by loading the tankers with the oil that was transported to the port of Ceyhan under the instructions of the Kurdistan Regional Government, because the 2010 amendment to the ITP makes clear that only the Iraqi Ministry of Oil and its affiliated SOMO Corporation are the legitimate authorities that can issue loading orders.  

  

The court assessed whether Ankara imposed excessive transportation fees on Iraq and whether it obtained an illegal discount on the price of oil and ruled in favor of Baghdad. However, the court ruled that 50 percent of the income loss due to the lower oil price had to be borne by the Iraqi government, because the KRG, as an organ of the Iraqi government, profited from the sales and used them for government spending.  

  

- From low pipeline capacity and unpaid transmission fees that go back decades.” “The court awarded nearly $600 million to Turkey over those lawsuits.”  

  

Turkey's counterclaims will have more weight when US denominated interest rates are factored in and added to the total amount because it goes back to the 1990s when rates were higher. "The Iraqi claims, which only go back to 2014-2018, won't have the same excess interest rates, and in the end they will only get a few hundred million dollars," the source said. It's a hollow victory. Even the Court agrees in its judgment that neither party can be considered successful.  

  

A Turkish source familiar with the 2013 KRG-Turkey oil agreement said that in the end no money will come out of Ankara's pocket because the deal includes a compensation clause. The source said, "Any reward will be paid by the Kurdistan Regional Government and thus the Iraqi party."  

  

But Turkish officials expect an agreement to be reached between all concerned parties in time for oil exports to resume.

A Norwegian company announces the closure of its oil wells in the Kurdistan region

Regarding the Tawke field, the company said that it has started to close the wells, but it will take a day to close all the wells because it covers an area of 10 km.

Turkish Energy Minister Fatih Donmez denied, on Wednesday, that Turkey had fined $1.4 billion in the case of the international arbitration award.

The Turkish Ministry of Energy and Natural Resources commented, earlier, on the decision of the international arbitration panel on the export of oil from the Kurdistan region to Turkey.  

  

The ministry said in its statement, which was seen by "NAS" (March 28, 2023), that "Iraq's victory in the oil case before the Judicial Committee of the International Chambers of Commerce, based in Paris, is a known and necessary matter."    

  

In fact, this issue reflects the conflict between the Iraqi central government and the Iraqi Kurdistan region, which is a constitutional unity that has been going on for years, and our country has always respected the unity and integrity of Iraq, according to the statement.    

  

The ministry said, "Our country has spent billions of dollars since 1973 to keep the Iraqi-Turkish oil pipeline in operation despite regional instability, and it has taken diplomatic measures to resolve differences with the parties and countries concerned."    

  

The Paris Judicial Committee rejected four of the five Iraqi requests, according to the statement.

The Turkish Minister of Energy and Natural Resources, Fatih Donmez, denied the validity of the news circulated about an international arbitration committee fining his country, in the context of an oil export lawsuit filed by Baghdad against Ankara.

He said in press statements, on Wednesday, that the arbitration committee of the International Chamber of Commerce in Paris prepared an extensive report on the matter, which includes imposing sanctions on Turkey, without imposing a financial fine, and added: "It is not true that the international committee fined Turkey $1.4 billion."

He stated that the ICRC rejected 4 out of 5 allegations made by Iraq in the framework of the case, and one claim was accepted.

He pointed out that there are also some Turkish demands and allegations within the framework of the lawsuit, indicating that the ICRC accepted 5 of them and rejected the sixth.

The Turkish minister added that "legal specialists at his ministry are currently studying the issue," noting that "the matter needs some time to pass in order to become clear."

Zainab Juma al-Mousawi, a member of the Oil, Gas and Natural Resources Committee in the Iraqi parliament, said in an interview with Al-Jazeera that the court’s decision stipulated obligating Turkey to pay $1.5 billion to Iraq for exporting Kurdish oil through the port of Ceyhan between the years (2014-2018) without approval.
