The Oil, Gas and Natural Resources Committee in the House of Representatives revealed on Monday the date for the enactment of the Oil and Gas Law in Parliament.

Committee member Zainab al-Musawi told the official agency that "there is an agreement between Baghdad and Erbil to legalize the federal oil and gas law," noting that "the House of Representatives will work on legalizing it during the coming legislative chapters."

The Kurdistan Regional Government (KRG) announced on Tuesday that a delegation headed by Finance and Economy Minister Awat Sheikh Janab will visit Baghdad to continue negotiations with the federal government.

According to a statement issued by the regional government, the delegation, in addition to being headed by Sheikh Janab, includes Kamal Mohammed, acting minister of natural resources, and Omid Sabah, head of the cabinet of the Kurdistan region.

The statement added that the delegation of the Kurdistan Regional Government will discuss with Iraqi officials the oil issue in Baghdad and will continue negotiations aimed at resolving differences, and "important high-level meetings are scheduled."

In turn, regional government spokesman Jotyar Adel wrote in a tweet on social networking sites "Twitter", that "regarding the discussion on the oil file, the delegation of the region returns to Baghdad today."

A delegation from the Kurdistan Regional Government (KRG) arrived in Baghdad on Tuesday to discuss the resumption of oil exports and other financial issues.  

  

  

  

According to Kurdish sources affiliated with NAS (March 28, 2023), the delegation consists of the Minister of Finance and Economy of the Kurdistan Region, Awat Janab Nouri, as well as the Acting Minister of Natural Resources, Kamal Mohammed, and the Head of the Cabinet Office, Omid Sabah.  

  

The Deputy Prime Minister for Energy Affairs and Federal Oil Minister, Hayyan Abdul Ghani, chaired, last Sunday, a meeting with the delegation of the region, which included Kamal Mohammed, acting Minister of Natural Resources, Omid Sabah, Chief of the Council of Ministers of the Region, Fares Issa, head of the representation of the regional government in Baghdad.  

  

The meeting, according to a statement by the Ministry of Oil, a copy of which was received by NAS (March 26, 2023), discussed "the new mechanisms and data for the region's exports after the decision issued by the Arbitration Tribunal of the International Chamber of Commerce in Paris last Thursday, March 23, 2023, in the arbitration case filed by Iraq against Turkey for violating the provisions of the Iraqi-Turkish pipeline agreement signed in 1973, which stipulates that "the Turkish government must comply with the instructions of the Iraqi side regarding the movement of crude oil exported from Iraq." to all storage and drainage centers and the terminal."   

  

The meeting was attended by "the Undersecretary for Extraction Affairs, the Undersecretary for Distribution Affairs, the Director General of the Oil Marketing Company, the Director General of the Economic and Legal Department, the Director of the Government Media and Communication Office, and a number of officials in the concerned departments."   

  

Earlier, the Kurdistan Regional Government's Ministry of Natural Resources commented on the federal government's winning arbitration case in the case of exporting oil through Turkey.  

  

The ministry's statement, a copy of which was received by NAS (March 25, 2023), stated that "in recent months, the Kurdistan Regional Government has held continuous dialogues and negotiations with the federal government, the latest of which is on the budget files and oil and gas. The two sides then reached a preliminary agreement and a good understanding under the umbrella of the constitution and the constitutional rights and entitlements of the Kurdistan Region."   


The statement added, "The President of the Kurdistan Regional Government is in constant contact with the federal prime minister, and after his recent visit to the Kurdistan region, the importance of solving problems based on the constitution was stressed."   


"The French court's decision in favour of the Iraqi government against Turkey will not hinder our relations with the Baghdad government, and in this context we will visit Baghdad for dialogue and resolution of related issues," he said.   


"While reaffirming its firm position not to compromise on the constitutional rights of the Kurdish people, the Kurdistan Regional Government renews its coordination with Baghdad with the aim of reaching a radical, legal and constitutional solution in this regard," he said.   

  

Earlier, the Ministry of Oil announced that Iraq had won the arbitration case in the case of exporting oil through Turkey.  

  

A ministry statement, a copy of which was received by NAS (March 25, 2023), stated that "the Ministry of Oil welcomed the final award in favor of Iraq, which was issued by the arbitration panel of the International Chamber of Commerce in Paris last Thursday, March 23, 2023."   

  

The statement added that "in the arbitration lawsuit filed by the Republic of Iraq against the Republic of Turkey for violating the provisions of the Iraqi-Turkish Pipeline Agreement signed in 1973, which stipulates that "the Turkish government must comply with the instructions of the Iraqi side regarding the movement of crude oil exported from Iraq to all storage and discharge centers and the final terminal."   

  

According to the statement, the ministry expressed "its appreciation for the efforts of the arbitration panel of the International Chamber of Commerce in Paris for its professional and professional handling of the lawsuit filed by Iraq, by providing the opportunity and time for the parties to defend their positions, especially since the decision obliges all parties to respect international agreements and covenants in this regard, and that the Ministry of Oil, through the Iraqi Oil Marketing Company "SOMO", is the only body authorized to manage export operations through the Turkish port of Ceyhan.   

  

The ministry stressed "the depth of the good historical relations that bind Iraq with Turkey, and that the decision of the arbitral tribunal does not constitute an obstacle to the development and expansion of bilateral relations in order to achieve common interests while retaining Iraq's constitutional powers and sovereignty over all its wealth."   

  

The statement added that "the ministry will discuss the mechanisms of exporting Iraqi oil through the Turkish port of Ceyhan with the concerned authorities in the region and with the Turkish authorities, according to the new data after the issuance of the final judgment decision by the arbitration committee in Paris, in a way that ensures the sustainability of oil exports, and fulfills the obligations of "SOMO" with international companies through the port of Ceyhan, in the interest of the ministry to export the entire quantities allocated from all oil fields, including the region, with the aim of maximizing financial revenues, to supplement the federal budget.   

  

According to the statement, the ministry praised "the distinguished efforts of the International Legal Advisory Office and the Ministry's Legal Committee in defending Iraq's rights to manage its oil wealth and the possession of the Ministry of Oil its constitutional powers and powers, for their serious efforts over the past years to achieve justice and restore Iraq's legitimate rights in order to preserve its security and sovereignty."

ERBIL, Kurdistan Region - Iraq looks favorably upon the Kurdistan Region exporting its oil abroad and is concerned about the export halt negatively impacting its economy amid ongoing discussions addressing next steps after an arbitration court ruling, the oil ministry said Tuesday. 

“We fully support the export of the Kurdistan Region’s oil abroad and we should hurry to reach an agreement for the oil to be exported,” Assim Jihad, spokesperson for the Iraqi oil ministry, told Rudaw’s Sangar Abdulrahman, stressing that the court ruling ought to be implemented. 

The Paris-based International Chamber of Commerce (ICC) ruled on Tuesday in favor of the Iraqi government against Turkey with regards to the Kurdistan Regional Government’s (KRG) oil exports through Turkey’s Ceyhan port, placing Iraq’s State Oil Marketing Organization (SOMO) as the only party in charge of the management of export operations through the port.

Following the decision, Turkey informed Iraq that Ankara would no longer allow KRG crude to be loaded onto ships at Ceyhan port without permission from Baghdad. 

“The best way for oil to get exported through SOMO and for the Kurdistan Region to get its share,” Jihad added, explaining that SOMO seeks to sell the oil at the global market rate and that such a decision is favorable towards the Region. 

The production of around 450,000 barrels of oil per day in the Kurdistan Region has been jeopardized as a halt in exports has forced international oil companies (IOCs) operating in the region to store produce rather than allow it to flow to the pipeline – an inadequate measure as storage capacity is limited.

“I call on our friends in the Kurdistan Region to follow this situation realistically … this situation is tied to an international court and this must be considered,” the spokesperson stressed. 

The arbitration court ruled that Ankara had breached a 1973 pipeline agreement between Iraq and Turkey that obliges the Turkish government to abide by instructions issued by Iraq regarding the transport of crude oil exported from Iraq. In 2014, the KRG began using the pipeline to send its crude to Turkey’s Ceyhan port, to the ire of Baghdad.

An assistant to Kurdistan Region Prime Minister Masrour Barzani on Sunday said that the halt of independent oil exports by the KRG is temporary and that it is expected to resume once an agreement is struck with Baghdad.

On Monday, the US said it had urged Ankara and Baghdad to allow the resumption of the Region’s export of oil as “disruptions to global energy supply would not serve anyone’s interest.”

The KRG is heavily reliant on oil revenues and an inability to sell its crude will severely impact its economy. The government has found hardships for years to pay its over a million civil servants on time and in full.

A delegation visited Baghdad following the ruling but the outcome of the discussions remains unclear.

ERBIL — The Kurdistan Regional Government (KRG) is sending a high-level delegation to the Iraqi capital on Tuesday to negotiate a way forward for KRG crude exports after a French court ruling halted them this week.

Ministers of finance and natural resources are heading the delegation to resolve the latest legal challenges caused by a French arbitration court verdict in which Iraq won, subjecting KRG oil exports to consent from the federal government in Baghdad.

Kurdistan Region's oil exports through Turkey's Ceyhan port were halted this week following a request to Ankara to do so in the immediate aftermath of the court decision.

Kurdistan exports nearly 500,000 barrels of oil daily, and halting these crude exports has incurred nearly $35 million in economic losses every day, according to the deputy head of the hydrocarbons committee in the Iraqi parliament, Nahro Rawanduzi.

A KRG delegation was in Baghdad on Sunday, who met with Iraq's Prime Minister Mohammed Shia' al-Sudani and the federal minister of oil to negotiate a settlement to these legal challenges caused by the French court's recent ruling.

A court in France last week decided a pending case on KRG oil sales, ruling that the KRG couldn't export its crude through the Ceyhan port in Turkey without the consent of the federal government in Baghdad. Relations between Erbil and Baghdad have recently improved, with KRG authorities hoping recent positive developments in relations between the two can help in resolving this latest legal challenge to KRG oil exports.

A hydrocarbons law, which is currently being crafted by a joint committee from Erbil and Baghdad, is expected to stipulate the rights and obligations of both parties and help them handle their crude more efficiently.
