On Thursday, the representative of the Patriotic Union of Kurdistan, Susan Mansour, pledged to resolve the problems between Baghdad and Erbil by approving the oil and gas law in the parliament, noting that patchwork solutions led to a delay in enacting the oil and gas law.

Mansour said in an interview with Al-Maalouma agency, “The political differences are one of the most important reasons for not enacting the law in the House of Representatives.” She explained that “solutions regarding the legislation of the oil and gas file are still patchwork solutions.”

She added, “The problems that occur from time to time, we see that the oil and gas file tops the scene of political differences.”

And she continued, “Legislation of the oil law is not impossible, but there must be good and sincere intentions away from patchwork solutions.”

The representative of the Kurdistan Democratic Party, Jay Taymur, revealed the scenes and developments of the recent meetings and negotiations that took place between the federal government and the delegation of the Kurdistan Regional Government regarding the oil and gas law, the share of the region, and ending the outstanding differences, indicating that Baghdad and Erbil are close to the comprehensive agreement.

Today, Saturday, a member of the Patriotic Union of Kurdistan, Salih Faki, revealed the percentage of the Kurdistan region's share in the federal financial budget.

Faki said to (Baghdad Today), "There is constant communication and visits to Baghdad and a political consensus that the 12% rate is unfair and does not correspond to the obligations owed by the Kurdistan region, such as salaries, projects, debts, and others."

"On the other hand, the regional government must fully abide by the agreement concluded with the federal government and not abandon its implementation, as it happens every time, for which the Kurdish citizen pays," he added.

Faki confirmed that "the agreement was made to determine the region's share of the budget at 14%."

On February 26, the head of the Cabinet of the Kurdistan Region Council of Ministers, Omid Sabah, announced that a preliminary agreement had been reached with the federal government on the 2023 budget bill.

He added, "After discussing the outstanding issues between Erbil and Baghdad, an initial agreement was reached on the Maronite draft law 2023," noting that "the atmosphere was positive between the two parties."

For about three months, Kurdish delegations have been making shuttle visits to Baghdad to negotiate outstanding issues between the center and the Kurdistan region, during which they met with parties concerned with budget files, oil and gas law, and border crossings.

The head of the representation of the Kurdistan Regional Government in Baghdad, Fares Issa, announced on Sunday the return of the delegation of the Kurdistan region to Baghdad to continue talks, while noting the completion of procedures for sending 400 billion dinars to the region in the form of a loan.  

  

    

Issa said in a statement to the official website of the Kurdistan Regional Government (KRG), affiliated with "NAS", (March 12, 2023), that "the delegation of the Kurdistan Regional Government returned to Baghdad to continue talks on the budget, oil and gas."  

  

"The KRG delegation will meet with the Iraqi Ministry of Oil in Baghdad today," he said.  

  

"All procedures for sending 400 billion dinars in the form of a loan have been completed, and I expect the money to reach the Kurdistan Region today," Issa said.

Adel said in a statement to the regional government website, seen by Shafaq News Agency, that "the delegation consists of the Minister of Justice, the head of the Coordination and Follow-up Department, an agency in the Ministry of Natural Resources and specialists from the Ministry of Justice, and tomorrow meetings will begin on the draft oil and gas law, which is one of the important topics and a solution must be reached within a specific time."

He added that "this law will solve many problems in general, the problems in the oil sector in Iraq, in addition to the relations between Erbil and Baghdad, and for the Kurdistan Region to be a key partner in decisions related to the oil industry effectively."

Adel continued; "The law will reorganize the work of this sector, whether at the level of Iraq or at the level of relations between the region and the federal government, and the details of this issue will be talked about, and in the end this project must be a reflection of a complete agreement between the two parties and be in their interest, and this will be an important achievement not only for the Kurdistan Region, but for the whole of Iraq."

ERBIL — Talks between Erbil and Baghdad on the contents of a potential hydrocarbons law are expected to resume in the Iraqi capital on Sunday as part of the bilateral agreement that broke the political impasse in the country, and led to the formation of the federal government.

A delegation from the Kurdistan Regional Government (KRG) is set to return to Baghdad today to follow up on recent discussions on details of a hydrocarbons law in the making, which will determine the rights and obligations of both sides and help avoid unnecessary disputes on the management of the country's natural resources.

The KRG is hoping to reach a deal with the federal government, and find enduring solutions to avoid this persistent need for crisis management.

Erbil and Baghdad formed a joint committee in late February to draft a hydrocarbons bill, which will be tabled in parliament for a review and vote. They have also reached a preliminary agreement on the upcoming federal budget bill.

Relations between Erbil and the federal government of Iraq became strained after Baghdad cut Erbil's share of the federal budget in 2014. The relationship has often been tested, and complicated by persistent violations of the country's constitution, which enshrines Kurdistan Region's financial entitlements.

ERBIL, Kurdistan Region - A significant compromise is needed from both Baghdad and Erbil to reach an oil and gas deal, a former energy official at the US Energy Department told Rudaw earlier this month, expressing optimism that such a deal will attract greater investment into the country. 

“There has to be some realistic expectations on the level of control that Iraq is going to be able to exert on the Kurdistan oil and gas sector, given that it has been established for 15 years with its own contract model, and I think that Erbil is going to have to compromise on some issues with Baghdad,” Matthew Zais, HKN Energy’s Vice President of Government Affairs, told Rudaw’s Mohammed Sheikh Fatih in an interview. 

“There has to be significant compromises on both sides,” he added. 

Zais has also previously served as the Principal Deputy Assistant Secretary of International Affairs for the US Department of Energy. 

“I think we are cautiously optimistic that Baghdad and Erbil can reach an agreement, hopefully first on a budget, which will alleviate the pressures that some of us are experiencing in the IOCs [international oil companies] with a lack of budget, and obviously hopefully that there could be an oil and gas law between Baghdad and Erbil,” Zais said. 

The US company HKN Energy operates in Duhok province’s Sarsang block, where it holds a 62 percent share, and boasts of a 75 percent local workforce. It is the largest US investor in the Kurdistan Region and produces 10 percent of the Region’s total oil.

A potential agreement between the Iraqi federal government and the Kurdistan Regional Government (KRG) “should attract more investment” from American companies because such companies seek certainty “to clear the clouds away from the current environment” in order to invest, according to Zais. 

Erbil and Baghdad have seen tensions rise recently following an Iraqi top court ruling against the payment of the Kurdistan Region’s financial entitlements, claiming it violates the 2021 Iraqi Budget Law. The ruling followed another major blow to the Region in a similar verdict against its ability to administer its oil and gas, with the top court finding the Region’s gas law to be “unconstitutional.” 

Both decisions have been vehemently condemned by Kurdish authorities, with Prime Minister Masrour Barzani labeling the court itself “unconstitutional.”

Zais called the rulings “politically motivated” and assured that they do not impact the operations of HKN energy but only seek to deter investment from Iraq. 

Speaking of the implications that arise when Erbil and Baghdad’s relationship deteriorates, Zais warned against the Region’s oil and gas sector losing balance. 

“The oil and gas sector in the Kurdistan Region is the engine of the economy. If it gets out of balance, it has to get back in balance, otherwise the pain of getting out of balance is too high for everyone,” he stressed. 

Kurdish government delegations have traveled to Baghdad on several occasions to reach a common ground with the Iraqi government, however none of the visit shave had a solid outcome.

On this subject, the spokesman for the Kurdistan Regional Government said: The federal oil and gas law will address a number of issues between the Kurdistan Region and Iraq.
Dr. Jotyar Adel, Head of the Media and Information Department of the Kurdistan Regional Government, added to the official website of the government: The delegation of the Kurdistan Regional Government will visit Baghdad today to discuss the federal oil and gas law, and it consists of the Minister of Justice, the head of the Coordination and Follow-up Department, teams from the Ministry of Natural Resources and teams from the Ministry of Justice in the Kurdistan Regional Government. He continued: This draft law will address a number of problems in the relations between Erbil and Baghdad in the field of energy, and will make the Kurdistan Region a real partner in making decisions related to the oil sector in Iraq, leading to the reorganization of this sector at the level of Iraq and the region and strengthening bilateral relations between the two parties, and in the end this project must reflect the agreement of the two parties and be in their interest together.
On the implementation of the draft law, Dr. Jotyar Adel said: "It was agreed to write the draft together, and to some extent the general principles were agreed, but there are many details. Discussions on this subject will continue, and we hope that faith in partnership, reliance on the constitution and agreement will be on the agenda of the Council of Ministers headed by Mohammed Shia Al-Sudani, where the draft law will be discussed.
The spokesman for the Kurdistan Regional Government pointed out: The draft budget law was developed after lengthy discussions with the federal government, what was necessary as the rights of the Kurdistan Region was discussed, and certainly the draft law will address a number of problems between the two sides, the federal government did not have a budget for a while, which affected relations with the Kurdistan Region, and the census must be relied on to determine the share of the Kurdistan Region. There were some positive results and achievements for the Kurdistan Region, such as calculating the salaries of the Peshmerga, supporting the Peshmerga forces within the framework of sovereign expenditures, determining the region's share of the governor's expenses, and there is no big problem in sending the 400 billion and the money will be sent to the Kurdistan Region soon.

Jotyar Adel said: "24 billion dinars of the region's financial share will be transferred by the federal government to the region's account within the next 400 hours."

Earlier, Adel announced that a delegation from the regional government would visit Baghdad to discuss the draft federal oil and gas law.

Adel said in a statement that "this law will solve many problems in general, especially in the oil sector in Iraq, in addition to the relations between Erbil and Baghdad and for the Kurdistan region to be a key partner in decisions related to the oil industry effectively.
