She indicated that the government is “serious, and has a draft in effect with the Ministries of Finance and Planning, which is prepared for the year 2021, and some amendments may occur to it, such as the price of oil or the total budget and the opening of the door to exchange because there will be an appointment for certificate holders, ” and it is likely that the budget will be submitted to Parliament. at the required time.”

Regarding the visit of the President of the Kurdistan Region, Nechirvan Barzani, to Baghdad, Ikhlas Al-Dulaimi stated that “its echo was positive and calmed, with the re-exchange of trust between the two parties and other political parties, which created a positive atmosphere for approving the budget, and sending a delegation by the President of the Kurdistan Regional Government, pleased Barzani, and to clarify the plans, projects and budget of the Kurdistan region, in a calm atmosphere through coordination between the ministries of the region and their counterparts in the federal government, through working committees.

Regarding the role of the Kurds in Baghdad, she revealed that “there are signs of understanding between all parties with the Kurdistan Democratic Party,” pointing out that “the Patriotic Union of Kurdistan and the Kurdistan Democratic Party have great understandings, especially in strategic matters, including the budget and oil laws.” 

A member of the Iraqi Parliament, she stated that “laws and constitutions are not taken into account, but rather the political side plays a major role in the understandings,” stressing that “this is the last opportunity for Muhammad Shia’ al-Sudani to clear up the problems in Iraq in general.”

And she warned that “if al-Sudani fails in this mission, there will be no other opportunity for any government to be established in the future, and if it does not succeed, it will be the end of the regime in Iraq.”

Ikhlas al-Dulaimi, she noted that the prime minister “will not go in the direction of approving any law that would create a rift between the components, because he is certain of the sensitivity of the stage,” noting that the KDP “always resorts to the constitution.”

Regarding the share of the Kurdistan region in the budget, Al-Dulaimi explained that it “depends on population density, as in Iraq in general, and this step is implemented by the Ministry of Planning (in the Kurdistan region), which will send its data to its counterpart in the center, and adopt it in approving the budget.”

And she added that the share of the Kurdistan Region “reached 13.9% in the year 2021, but due to the increase in the population due to the increase in births and migration to the Kurdistan Region, the numbers may be on the rise and thus will affect the share of the budget.”

And she added that the share, based on the recent survey, should be 16% or 15.9%, but that “depends on negotiations between the delegation of the Kurdistan region and the federal government.” 

The representative of the Democratic Party, I suggested that the total amount of the budget ranges from “130-140 trillion dinars.”

With regard to Article 140, Al-Dulaimi commented on it by saying, “The problem of Article 140 is great, the previous governments did not deal with it seriously, all its allocations are very simple, and do not rise to the formation of committees, conducting a census, normalization, etc.,” pointing out that what was allocated to it ranged between 20 And 70 billion dinars.

In her capacity as a representative of the regions included in Article 140, such as al-Hamdaniya and Makhmur, she confirmed that these regions “suffer from problems, and the federal government allocates a small budget for these regions.”

In this context, he pointed out that “in the previous session, we enacted the food security law, and we allocated one trillion and 55 billion to the Nineveh governorate, considering that it includes 4 districts from the areas of Article 140. The federal government, noting that the amount sent in addition to the frozen sums and those from stabilization support and the reconstruction fund amount to more than 2 trillion dinars. 

It considered that the maximum amount that can be allocated to the committees of the regions covered by Article 140 is 100 billion dinars, within the next budget.

Turan said during his reading of the statement, "What has been circulated by some officials about the revival of Article 140 of the Iraqi constitution, which was referred to in the government program with the complicity of everyone and the absence of Turkmen, the clear position of the Turkmens is that this article failed to find sustainable and peaceful solutions to the issue of Kirkuk and the positive paragraphs in it related to resolving property disputes and returning the lands seized by the former regime have not been implemented so far."

He added that "the report of the United Nations mission on this article has clearly indicated that the paragraphs contained in this article, such as the referendum, may be a reason for igniting the civil war between the components of Kirkuk," according to the statement.

The meeting also denounced - as in the statement - what they called "the deliberate absence of the forces of the State Administration Coalition to the representatives of the Turkmen component in the meetings held by the coalition, as if there are secret items that have been agreed upon and some fear that the Iraqi people will see them at a time when we fully believe that any solution to the issue of the so-called disputed areas is through constructive dialogue and with the participation of the components of Kirkuk province, and we will not accept the conclusion of deals or agreements between Baghdad and Erbil, which proved to be a failure. in previous years."

The meeting expressed their rejection of "the inclusion of the province of Kirkuk and other Turkmen regions by the recent decision of the Council of Ministers to own houses built on agricultural land unless the file of property disputes is resolved and the land is returned to its legitimate owners due to the crack it causes in the societal peace in the province and the loss of the rights of the legitimate owners of the land, considering that "it will be a cause for demographic change prohibited by Article 23 of the Iraqi Constitution."

Turan also went on to say, "The forces forming the State Administration Alliance are still procrastinating in assigning one of the ministerial and political positions to the Turkmen component with a clear intention to marginalize the Turkmen component."

"This marginalization and silence forces us to take escalatory steps to defend our national and national existence," the head of the Turkmen Front said.

Justice Minister Khaled Shwani recently announced the activation of Article 140 of the Iraqi constitution, which has been suspended since 2014, which affected the discontent of the Arab and Turkmen components in the disputed areas.

Kirkuk is one of the disputed areas between Erbil and Baghdad covered by Article 140 of the constitution, and was under the joint authority of the Kurdistan Region and the federal government before the independence referendum held by the region in September 2017.

Article 140 provides for the removal of demographic policies conducted by Saddam Hussein's regime in the disputed areas in favor of the Arabs at the expense of the Kurds, and then the census of the population before the final step of holding a referendum according to which the population determines whether they wish to join the Kurdistan Region or remain under Baghdad's administration.

The implementation phases of the article were to be completed by the end of 2007, but security and political problems prevented this.

In 2019, the Federal Supreme Court ruled that Article (140) of the Constitution of the Republic of Iraq remains in force, stressing that this will continue until its requirements are implemented and the goal of its legislation is achieved.

No solution without consensus

It quoted Ali Mahdi Sadiq, a member of the Kirkuk Leadership Council in the Turkmen Front, as saying that "the problem of Kirkuk is complex, since 2003 it has not been solved through the presence of one or two parties in the administration."

Sadiq added that "experience has shown that it is not possible to solve the crisis without the consensus of the three parties, Turkmen, Arabs and Kurds, because there are permanent and continuous differences in all joints, and the conclusion of any agreement between Erbil and Baghdad in the absence of one of the parties concerned will not have a result, and this will inevitably be strongly rejected."

The newspaper warned that "Article 140 is concerned with solving the problem of areas that have undergone demographic change during the rule of former President Saddam Hussein, through three stages, namely normalization and conducting a census before holding a referendum to determine their fate, whether by staying within the administration of the federal government or joining the Kurdistan region, but the stages of its application have stalled due to the political and security crises that have ravaged the country over the past two decades."

Keys to solutions

Sadiq proposed "a solution that satisfies the Turkmen component, which is to find a consensus formula for the administration through the UN mission," and wondered why this tension was raised again when the federal forces proved their effectiveness by not having any security breach in the governorate center.

He added that the Turkmens "do not have difficult conditions other than achieving partnership in the administration between the components, while giving the security file to the federal forces exclusively, the Kurds have taken their share in assuming the post of governor for 14 years, and the Arabs about five years, so why do not the Turkmens, who are a major component, have the right to assume the position?"

The newspaper continued: "The view of the Arab population seems to be similar to the Turkmens in rejecting the return of the Kurds to the administration of the province according to the previous formula before their withdrawal in the fall of 2017, after Baghdad took measures against the Kurdistan region as punishment for running in a referendum for secession."

According to the newspaper, politicians and observers believe that "political conflicts have always been an obstacle to successive governments being able to solve the file, as the Shiite and Sunni forces refuse to give the Kurds the majority in these areas, especially Kirkuk, at the expense of the weight of Arabs and Turkmens who adhere to staying under the control of the federal government, and therefore the forces in Baghdad may not go far in bargaining with the Kurds except on less important files, such as allowing the Democratic Party to reopen its headquarters and grant administrative positions to the Kurdish forces, as well as "The deployment of joint military and security forces to fill security vacuums, which means that disagreement over the core points of the actual implementation of the article will continue."

Based on this vision, al-Assi ruled out "the return of the country or Kirkuk to the situation created by the post-2003 conditions, when the US forces came and the Kurdish forces entered with them, and even the Kurdish citizen in the province changed, and now everyone is looking for stability to secure his interests and guarantee his livelihood."

The newspaper continued: "On the other hand, the Kurds deny the allegations that the deadline for the application of the article expired by a decision issued by the Federal Supreme Court in 2019 "as it is still in force until the completion of the application of its main paragraphs," according to a member of the parliamentary committee of regions and provinces for the Kurdistan Democratic Party bloc, Sherwan Al-Dobardani, who stressed "the importance of applying the constitution without selectivity, not as some political forces want."

with the reality at hand. I personally believe that the Turkmen should have their own country as decided after WWI, but that’s not gonna happen. The Kurds even had a referendum in 2017, that’s not gonna happen. Time to just deal with the landscape as it is now. 
 

I hope this implementation of Article 140 continues as it is the path toward regional stability moving into the future. And, I’m hopeful it doesn’t start another war.
