SULAIMANI — The Iraqi Minister of Justice, Khalid Shwani, said on Monday (November 28) those who suffered damages from the resettlement scheme under Article 140 of the Iraqi constitution will receive compensation beginning in one month.

Shwani said in a statement the high committee for compensation over Article 140 will be reactivated within ten days.

He said the committee will give the estimated budget for the compensation to the Council of Ministers to be included in the 2023 budget bill.

Shwani stated the compensation is according to an agreement between Erbil and Baghdad and includes all individuals with a claim.

Dizhwar Fayeq, head of the article 140 board in the Kurdistan Regional Government (KRG), told the official Kurdistan Democratic Party (KDP) website that a number of people had already been compensated but many remain and will receive compensation in several stages.

Article 140 of the Iraqi Constitution of 2005 outlines how to settle the issue of the so-called disputed areas, a belt of territory stretching across several governorates from Nineveh through Salahadin and Kirkuk into Diyala and northern Wasit claimed by both the KRG and the federal government.

Part of Article 140 mandates a normalization process in which Arabs who were settled in Kirkuk as part of Saddam Hussein’s Arabization program in the 1970s and 80s would receive compensation and return to their hometowns.

SULAIMANI (ESTA) — The high committee that used to be responsible to implement contentious Article 140 of the Iraqi constitutions, dealing with the disputed territories between the Kurdistan Regional Government (KRG) and The Federal Government has been reestablished, commencing its works shortly, said a Minister on Monday.

Khalid Shwani, the Iraqi Minister of Justice announced that the high committee of implementation of Article 140 has been reestablished following a demand that was recently made by the Patriotic Union of Kurdistan (PUK).

The Committee will begin its works in the next ten days in the frame of the new Iraqi government and in accordance with a political agreement between the parties and the negotiation team of the PUK led by President of the Party Bafel Talabani, according to Shwani’s words.

The committee has been “paralyzed” since 2014. “The implementation of article 140 will takes its own previous path,” Shwani said.

Article 140 was specially written to address the issue of the disputed territories between the KRG and the Iraqi government after the fall of the Baath regime.

The former Baath regime implemented Arabization campaigns in Kirkuk province and other disputed areas in Nineveh, Saladin, and Diyala, forcing Kurdish and Turkmen inhabitants to flee.

After the fall of the Baath regime in 2003 and within the framework of Article 140 of the Iraqi constitution, the lands were given back to their Kurdish and Turkmen owners when the Arabs left the areas voluntarily.

Article 140 of the Iraqi constitution was supposed to have resolved the issue of the disputed areas by 2007, but successive governments have failed to implement the steps outlined in the provision.

Since the federal government retook control of Kirkuk and other disputed areas from Kurdish forces in October 2017 have again been subjected to Arabization, Arabs have been brought to settle in Kurdish areas in Kirkuk.

The areas became disputed between the two sides since it has been claimed by both of them, the KRG and the Iraqi government.

According to Article 140, normalization in disputed territories, including Kirkuk, must go through three phases: Members of the diaspora must be allowed to return and people not native to the area relocated and compensated if necessary to accommodate the returnees.

In the meantime, after conducting a census, a referendum is to be held on whether to integrate Kirkuk into the Kurdistan Region or maintain its current territorial status as an Iraqi province.

The Article also states that normalization in disputed territories should be accomplished by the end of 2007.

However, this step was not implemented but according to the Minister’s words, the high committee to implement it has been set to get back on its work and begin within days.

Iraqi Minister of Justice Khalid Shwani said on his Facebook page that he thanked PUK President Bafel Jalal Talabani for reviving the High Committee for Implementing article 140, suspended in 2014 following an escalated dispute between Baghdad and Erbil.

"I would like to thank the President of PUK Bafel Jalal Talabani for always prioritizing the issue of the disputed territories in his meetings with the parties, and for constantly following up on the matter, and supporting us," the justice minister said.

Speaking to KurdSat English, a former member of the Iraqi House of Representatives Jamal Shukur said," President Jalal Talabani has always placed particular importance on the deprived territories [ a reference to the disputed territories] especially Kirkuk, and President Bafel Jalal Talabani now follows his footsteps."

Per the 2005 Iraqi constitution, the implementing committee is tasked with settling the disputes territories between Baghdad and the Kurdistan region. The constitution states that a committee shall carry out a plebiscite in the disputes lands to decide who would govern them, Erbil or Baghdad.

The minister also explained that reviving the committee has been part of the agreements made for participating in the Al-Sudani government. "The prime minister re-established the High Committee for the Implementation of Article 140, which was dissolved in 2014," Shuani added.

The minister also added that the committee would meet within ten days to prepare an estimated budget to compensate those covered by Article 140 and submit it to the Council of Ministers to be included in the general budget. The Secretary of the Iraqi Communist Party, Raed Fahmy, confirmed that there is no political will to implement Article 140 more than normalization, indicating that compensation related to the issue requires large sums of money.

Raed Fahmy said, in a televised interview, that “Article 140 consists of 3 stages, and since 2006 we are still in the stage of normalization, and during this stage the process of compensating the expatriates, who agreed to return to their areas, and the deportees who returned to Kirkuk,” adding that “ The matter was expanded to include other regions of Iraq within the definition of compensation, and the size of the amount reached a very large level, and it must be settled in order to move to the other stages. 

And he indicated that the compensation process “needs political will, because there are matters that can be resolved quickly, such as some decisions of the Revolutionary Command Council that affect the region and their need for cancellation by the House of Representatives, as well as some decisions of the Northern Affairs Committee named at the time, and matters related to agricultural contracts and administrative borders.” .   

Raed Fahmy added that “if there is a will to implement Article 140, parallel lines should be followed, part of which relates to what was agreed upon in the political paper and the government’s approach represented in the budget, including compensation,” noting that “the agreement on other stages is surrounded by ambiguity, and this means that There is no will to activate the matter in all its stages.” 

He pointed out that “there are political forces, some of which are currently in power, that have reservations about Article 140, and consider it in favor of the Kurds at the expense of the Arabs and Turkmen,” commenting on that by saying that “the article is innocent and does not have this discrimination, but seeks to restore stolen rights and redress grievances ". 

And he added, "If there are practices that have question marks, they are not attributed to the article, but rather to the practices between the political parties that must abide by the law."

The secretary of the Iraqi Communist Party confirmed that “the problem of Kirkuk will remain, if the article is canceled or alternative solutions are not presented,” expressing his approval for “an amendment or update of the article.” 

He stated that a great stride was made in the normalization phase, but they collided with the financial side because “the number of deported expatriates was approximately 40,000 and more, but it increased later, and they should be compensated with 10-20 million dinars, and this needs allocations, and we needed two billion dollars at the time.” However, it has now increased, knowing that the budget allocated for compensation at the time was $140 million.” 

He continued, “If we do not address the issue of compensation, we will need 15 years to compensate,” suggesting “the state granting bonds to the beneficiaries, as it cannot directly compensate for the huge amount, which confirms the state’s commitment to pay it.” 

Regarding the amount estimated at two billion dollars, Fahmy explained that “it was like that at the beginning,” suggesting that its size would increase to 3-4 billion now “to include the deportees in general and not those included in the scope of Article 140.” 

And the Secretary of the Communist Party considered that “the article is practically suspended,” adding that “some relied on what was stated in the constitution, that the article should be implemented before the date of December 31, 2007, considering that passing this date ends the article.” 

He commented on this by saying: “The dates were set to speed up implementation and not to drop the right contained in the article, and many of the constitutional deadlines have been exceeded, and based on that opinion, many articles must be canceled.” 

He expressed his general opinion, saying, “I do not think that some of the parties to the State Administration Coalition have the conviction and seriousness in activating Article 140. The implementation of the practical aspects of the article requires political consensus.” 

And he continued, “I did not find in the political consensus paper going to implement the article in all its stages, but was limited to allocating the necessary budget for compensation, and I did not hear from the officials of the parties to the state coalition, except for the Kurdish ones, working to implement Article 140 except for the first stage, which is normalization, and the current compensation is part of it.” That stage, so they have no will to apply the article in all its stages.” 

Fahmy went on to say, “During the time when I was in charge of the article, we identified the concrete steps and the program necessary to implement them, even the party responsible for implementation, and we divided the steps between Parliament and the Presidency of the Republic and others on the government, in addition to that some of them are implementable, and the other requires some time, and despite This has not been achieved, and this means that there is no political will to implement the article more than normalization.

He noted that “until now, the borders in Kirkuk where the referendum will take place are not known. Are they the current ones? If so, then it is not what is meant by Article 140, which includes the areas that were cut off from Kirkuk and annexed to other provinces.
