ERBIL (Kurdistan 24) – Kurdistan Region Prime Minister Masrour Barzani told Kurdistan 24 on Thursday that it is not wise to be suspicious of Iraq’s newly formed government’s intention with regards to implementing the agreement the political parties had signed.

Barzani’s remarks came in response to a question by the Kurdistan 24 correspondent Wladimir van Wilgenburg on whether there is any guarantee to implement the deal struck by the political parties to form the new Iraqi government.

“I do not think it would be wise to be suspicious of the intention of [newly formed Iraqi] government. Let’s give it time. Let’s not be doubtful.

“We have to be confident that this relationship [between federal and Kurdistan Regional Government] will improve. And the federal government will comply and honor the agreement that they have with us,” he added.

Barzani on Thursday took part in a special conversation moderated by Karen Young of the Columbia University at the Middle East Peace and Security Conference 2022 held at the American University of Kurdistan (AUK) in Duhok province.

During the special panel, Barzani highlighted numerous other topics, including the KRG reform, foreign relations, Erbil and Baghdad issues.

Regarding the relations between KRG and its neighbors, PM Barzani confirmed the good policy of KRG with its neighbors.

"Our policy in KRG is good relations with our neighbors and to have those relations based on mutual respect and not interferences," he said.

Another topic of discussion in the conversation was climate change. Barzani showed his concern about the issue and complained about the mismanaging of water resources in Iraq, "In Iraq we need to better manage our water resources" Barzani said.

As the government of Kurdistan Region is going to be digitalized, Barzani hoped that in the near future the government would be completely paperless, "By 2025 we hoping to have a government which is paperless" he said in the conversation.

On the other hand, Barzani showed KRG's willingness to help skilled people in the Kurdistan Region, "People with good ideas will get govt’ help, to basically create more jobs for the people". 

The Prime Minister calls on Syrian Kurds to be united, saying, "There are divisions, they have to come together (Syrian Kurds) and they have to cut off negative influences coming from outside and see how they closely cooperate, we can only help."

PM Barzani concluded the conversation by expressing KRG's willingness to help refugees, "we embraced people in need, and we will continue as long as it takes so they can go back to their homes."

Peace and Security" held by the American University in Duhok Governorate. He was received by the President of the Kurdistan Regional Government, Masrour Barzani."  

  

The statement added, "Speaker of the House of Representatives Mohammed al-Halbousi, President of the Kurdistan Regional Government Masrour Barzani, Second Deputy Speaker of the House of Representatives Shakhwan Abdullah and a large number of officials, researchers and academics will participate in the forum."  

  

He continued, "The president delivered a speech on the occasion, which began by talking about his visit to the Sharya camp for displaced people in Dohuk governorate, where he met with a number of displaced families, stressing the need to unite efforts to provide their requirements and accelerate their return to their cities, strengthening Amen and turning the page on displacement."  

  

According to the statement, the President of the Republic praised "the governorate of Dohuk and the beauty of its nature and the urban development it has become, praising the method of peaceful coexistence among its components and mutual respect for social and religious diversity."  

  

Rashid also spoke about "giving confidence to the Iraqi government and the need to support its approach in order to achieve the aspirations of Iraqis to live in dignity. He also talked about the outstanding issues between the center and the region and the importance of exerting efforts to find solutions to them in accordance with the constitution and the law," according to the statement.  

  

The statement added, "The President of the Republic reviewed the results of his participation in the Arab and climate summits, pointing to the broad support that Iraq received from brotherly and friendly countries participating in the two summits."  

  

He continued, "The president touched in his speech on the problem of drought and water shortage that Iraq suffers from, stressing that he will work to find quick solutions to reach an agreement on the fair sharing of water shares."

Al-Zaman newspaper dealt with the water file with Turkey and Iran and quoted the Minister of Water Resources, Aoun Diab, as saying that an upcoming meeting will be held with the Turkish side, to agree on sharing the drought damage and pumping good amounts of water.

He said in a statement yesterday that (the issue of sharing the damage is important in order to raise additional quantities from the Turkish side towards Iraq, and this will be noticed on the water situation during the coming days, as there will be a noticeable improvement).

Al-Sabah newspaper focused on the upcoming visit of a delegation from the Kurdistan region to Baghdad and said that observers in the Kurdistan region
expect the Kurdish negotiating delegation to enter Baghdad into a round of talks that is not easy, noting that it will arrive at some stages at a high level on the Kurdish side that will require the presence of the head of the regional government, Masrour Barzani.

Observers point out that the negotiations may touch on preserving Iraq's sovereignty from violations by neighboring countries, as Hedayat Taher, deputy official of the National Union organizations in Kirkuk, says: "The delegation will consist of the Minister of Natural Resources, the Minister of Finance, the Minister of Planning, the spokesman for the regional government, and the head of the Cabinet Office.

ERBIL — Kurdistan Region Prime Minister Masrour Barzani on Tuesday received China’s Ambassador to Iraq Cui Wei, discussing the importance of resolving the pressing issues between Erbil and Baghdad.

During the meeting, the Kurdish PM “highlighted the reforms implemented by the government to diversify the economy, eliminate bureaucracy, and facilitate foreign and domestic investments,” Barzani’s media office said in a statement.

For his part, the Chinese envoy applauded “the efforts and cooperation” of the Kurdistan Region Government’s (KRG) “relevant institutions” towards strengthening bilateral ties in addition to “promoting trade and investment between the Kurdistan Region and China.”

Meanwhile, the Kurdish leader and the Chinese ambassador underscored the importance of “maintaining the security and stability of the Kurdistan Region” and underlining the significance of “resolving the standing issues between Erbil and Baghdad.”

Barzani conducted his first official visit to Baghdad after the inauguration of the new Iraqi government in October to meet with the country’s top officials to discuss the outstanding issues between Erbil and Baghdad.

Both sides stressed national unity and cooperation to overcome the economic challenges as well as issues of livelihoods and services, according to a statement from Barzani’s office.

Al-Sudani reiterated that his government is committed to the implementation of Iraq’s constitution as a basis for resolving the lingering issues between Erbil and Baghdad in a manner that protects every component’s interests.

Both officials also highlighted the country’s border security, stressing the cooperation between Erbil and Baghdad to protect Iraq’s sovereignty and rejecting the repeated violations. They also agreed that Iraq will not be a threat to its neighbors.

The Kurdish president is set to meet with his Iraqi counterpart Latif Rasheed and the head of the judiciary, Fayaq Zedan, in Baghdad as part of his official visit.

 The disputed territories between Erbil and Baghdad as well as energy management are at the forefront of the outstanding issues between the two governments.

A top Kurdistan Regional Government (KRG) official has recently told Kurdistan 24 that a government official will visit Baghdad to begin negotiations on the issues with Iraq’s new government.

Al-Sudani’s government has previously announced that it would work to send an oil and gas bill to the parliament within six months. Erbil has previously called for the enactment of a hydrocarbon law, in the absence of which, the Kurdish authorities have argued the energy disputes between the governments had persisted.

ERBIL, Kurdistan Region - The president of the Kurdistan Region on Tuesday met with the Iraqi prime minister in Baghdad, during which both sides emphasized the importance of cooperation in facing repeated violations on Iraq’s sovereignty.

According to a joint statement from Iraqi PM Mohammed Shia al-Sudani’s and President Nechirvan Barzani, one of the topics of the meeting focused on discussing security on the Iraqi border areas.

“They emphasized cooperation to protect Iraq's sovereignty, reject repeated violations, and work to prevent using Iraqi territory as a platform for attacking any neighboring country,” the statement read.

The meeting comes as the Kurdistan Region’s borders have become an arena of instability with Turkish bombardment in the north and Iranian drone and missile attacks coming from the east.

Turkey launched an aerial operation, code-named Claw-Sword, early Sunday, targeting the Kurdistan Workers’ Party (PKK) in the Kurdistan Region’s mountainous areas, mostly Sulaimani province, and the People’s Protection Units (YPG) in northern Syria. One day later, Iran attacked Iranian-Kurdish armed groups, the Kurdistan Democratic Party of Iran (KDPI) and Komala, in the Region’s Erbil and Sulaimani provinces with missiles and drones. Both campaigns have claimed the lives of several people, including civilians.

The Iraqi foreign ministry said in a statement on Monday that it “categorically rejects and strongly condemns the Iranian bombardment of the Kurdistan region of Iraq with drones and missiles.”

“The repeated attacks carried out by the Iranian and Turkish forces with missiles and drones on the Kurdistan region are a violation of the sovereignty of Iraq, and an act that contravenes international covenants and laws that regulate relations between countries,” it added.

Ankara has said that its air forces hit 45 PKK targets in the Kurdistan Region and 44 YPG targets in Rojava on Sunday. The Turkish defense ministry claimed on Monday that it has killed 1,441 YPG and PKK fighters in Syria and Iraq during the "Claw" series of operations, which began in 2019.

Iran’s latest attacks came after IRGC’s Quds Force commander Esmail Qaani last week threatened ground operations by Iran against opposition parties taking shelter inside Iraqi land.

In the meeting between Barzani and Sudani, both sides also discussed ways to mend ties between Erbil and Baghdad.

PM Sudani “affirmed the federal government's commitment to the Iraqi constitution in addressing outstanding issues with the Kurdistan Regional Government of Iraq in a way that guarantees the rights of all Iraqi components,” the statement read.


Tension between Erbil and Baghdad has been high since the Iraqi Federal Supreme Court in February deemed the Kurdistan Region’s oil and gas law “unconstitutional”, hence striking the independence of the Region’s energy sector and jeopardizing its industry. The KRG has repeatedly challenged the constitutionality of the court’s ruling.

The Kurdistan Regional Government (KRG) earlier this month formed a delegation to partake in negotiations with Baghdad over the outstanding issues between the two sides, stressing the need to implement the agenda the new Iraqi federal government “as soon as possible.”

Damn, this is simply complicated.

 

I don’t want to see Iran’s internal struggles spill over into Iraq. Specifically, it would be into the Kurdish region. When that happens, if that happens all of the lines drawn in the last 100 years by westerners on the global scale go out the window. The true desires and alliances won’t follow any internationally recognized lines, rather ethnic lines which have been understood in the local regions for hundreds of years. There will be no shared cohesive reality, perhaps that’s the definition of war; leaving those who win to impose their perspective as dominant reality. 
 

As always, the electricity is in the ether. For thousands of years human nature has been presented and recorded here. 
 

Interesting to watch for sure, although I can acknowledge the depth of rich complexities I cannot understand the many facets. It’s Simply Complicated.

Political differences between the KRG and the central government intensify and subside according to the interests of both parties and their alliances to form a government after each parliamentary election. The differences intensify and become public when the Kurdish side feels that the central government is trying to disavow the agreements concluded between them, which are often secret and the masses do not know anything about them, especially those related to oil, gas and disputed territories under the federal system that exists today.

Sometimes the political reactions are large, such as those that led the regional government to hold a popular referendum for the separation of the region from Iraq on the twenty-fifth of September 2017, those that Baghdad opposed and the Federal Central Court issued a decision to invalidate its results, i.e. the referendum, while the authorities in Erbil did not issue any decision to cancel the results of the referendum, but only froze it, considering it an official document that it can return to at any time.

Today, as usual, there seem to be differences between the government of Erbil and the government of Baghdad on a number of matters, including the file of the disputed areas, the file of oil and gas and other files that come after them in importance.The signs of these differences have resurfaced after the resolution of the crisis of government formation and the accession of the Kurdistan Democratic Party to it, through a warning from Arafat Karam, the official in charge of Iraq affairs at the headquarters of the Kurdistan Democratic Party for the Shiite Coordination Framework, as Karam said in a tweet on Twitter, "If he fails The framework in zeroing the problems between Baghdad and Erbil, as the Confederation is the most effective solution to end the suffering of the Iraqi peoples," while the President of the Republic of Iraq, Abdul Latif Jamal Rashid, called for "the need to resolve the differences and outstanding issues between Erbil and Baghdad and work to legislate the oil and gas law in a way that satisfies both parties."

It seems through the two statements that the Shiite coordination framework made a number of concessions to the Kurdistan Democratic Party in order to join the parties that formed the Iraqi government after a year-long political stalemate, which also seems that the Shiite party, after guaranteeing the formation of the ministry, returned to repudiate its promises, which provoked the anger of the Kurdish party. The interests of these forces and their exclusivity of public funds. As for one party's reneging on the understandings concluded and threatening another party to take countermeasures, it also does not depart from the origins of the game they have been playing since they came to power following the American occupation of the country until today.

The threats of the two sides to each other are nothing but a whirlwind in a cup that our people have clearly and clearly experienced. But what interests us from the statements of the two Kurdish officials are, the confederation demanded by the Kurdistan Democratic Party through one of Massoud Barzani's very close associates as a solution to not zero problems between the center and the region, and the legislation of the oil and gas law demanded by the new Iraqi president. This wealth is for the benefit of the political elites and has nothing to do with changing the living reality of our people, 22.5 percent of whom (equivalent to a quarter of its population, i.e. 9 million Iraqis) live below the poverty line, according to the statements of Zikra Abdul Rahim, Director of Social Welfare of the Ministry of Labor and Social Affairs on the thirty-first of August this year, but unofficial figures indicate much higher percentages than the official figure of the Iraqi government.

We do not know if the President of the Republic can link the role of oil imports and its impact on the economy and the lives of people in countries rich in it, but here I would like to recall that oil and gas have not been the cause of the prosperity of the peoples who sleep on lakes of it, except for the Gulf countries with tribal and regional relations and a small population density, the majority of whose peoples live in a living situation compared to their oil counterparts. The level of poverty in oil-exporting countries such as Venezuela, Indonesia, Iran, Algeria and Nigeria is not much different from Iraq's.

It is not the right of a government that plunders the wealth of its people like the Government of Iraq today to enact a law of such importance as the Oil and Gas Law, because the enactment of this law will undoubtedly be in the interest of the forces that enact it and not in the interest of our people at all.

The central government was officially exporting oil without setting metering meters and what is known as the shield, and Shiite parties and militias controlled the oil export docks in the ports and smuggled it illegally to reap billions of dollars in profits, and the regional authorities were not far from this approach as they sold oil to Turkey at low prices and without the knowledge and consent of the central government, in addition to smuggling large quantities of it to Iran through the border crossings in the Sulaymaniyah region to take its way (i.e. oil) to Pakistan and Afghanistan. And abroad through Iranian ports! Have our people, with their Arabs, Kurds and other components, benefited from oil rents to live in dignity for nearly two decades? We do not think that the situation today is much different from the previous one, so the legislation of the law will perpetuate the theft and looting of oil wealth by the quota parties in a "legal" manner.

As for Arafat Karam's warning against the region's resort to confederation instead of federalism in the event that the problems between the center and the region are not zeroed by the Shiite coordination framework, according to him, we do not want to delve into the meaning of the two terms, their applications and laws from foreign sources, but we return to a study by Dr. Nouri Talabani under the title "On the concept of the federal system" prepared in London at the end of 1974 after the return of fighting between the Baath and the Kurdish movement led by the late Mullah Mustafa Barzani, by adopting federalism as a solution. For the national question in Iraq instead of autonomy, because autonomy "does not respond to the aspirations and aspirations of the people of Kurdistan and it is necessary to seek the help of another constitutional system in which the authority in the center cannot strip its content of its content by simply issuing another legislation contrary to it, and I found this in the system in its broad sense" (1).

"The existence of federalism requires a specific territorial, on which human groups live. This system aims to ensure sufficient freedom for these groups or nations living within a single State, while working to avoid the disintegration of the latter" (2).

As a result of the failure of the various Iraqi governments since the establishment of the Iraqi state to solve the national problems in the country, including the Baath government, which recognized for the first time in the political history of Iraq the autonomy of the Kurdistan region except for Kirkuk (it is still a problem that needs great efforts and concessions from various parties to solve it), which ended with the collapse of the experiment and the resort to weapons, which cost the Iraqi state and the Kurdish liberation movement a lot of losses. Federalism was an acceptable option for various parties after the collapse of the Baath and the major changes in society and the state, as well as the role of international powers in their quest to build a new Middle East.

But what we notice from the statements of some Kurdish leaders and as a reaction to the actions of their allies from the Shiite leadership, is the lack of commitment to the constitution that they participated together in enacting and approving regarding the true meaning of federalism, which legally and constitutionally stipulates respect for the national territory, work on territorial integrity within the state of Iraq, and avoid the dismantling of the state according to Dr. Nouri Talabani's concept of federalism.

"Jurists have tried to determine the legal foundations of federalism, and in this way many theories have emerged, commonly called classical traditional theories. In order to define the concept of the federal state and distinguish it from other states, the legal systems of states are generally divided into three types: the confederal state, the federal state and the united state, and the confederal state is formed – according to these theories – by a treaty or charter concluded between two or more states, each of which cedes some of its competences in favor of a common supreme body" (3).

Iraqi Kurdistan is not an independent state for Arafat Karam to address the issue of confederation in his threat to the Shiite alliance to zero or end the differences and problems between the two parties, and his proposal that the confederation is the most effective solution to end the suffering of the Iraqi peoples, according to his statement, means that the population of the Nineveh Plains of the ChaldoAssyrians, Turkmens in their areas and other Iraqi components have the right to request an alliance with Iraq in a confederation manner! Note that the pro-Iranian Shiite alliance, through its policies hostile to the interests of our people, Arabs, Kurds and the rest of its components, dreams of a confederation with Iran, to mortgage Iraq and its people, including the Kurds, to the state of Wali al-Faqih.

The confederation legally consists of the union of two or more independent states, Iraqi Kurdistan and other regions that may appear according to the Iraqi constitution in the future, it is not entitled to adopt the confederation in its relations with Baghdad, but it has the right to constitutionally enjoy its right to federalism, and its right to federalism means that "one of the countries may not withdraw from the federal state to establish an independent state" (4).

Federalism, which we see in many countries, is one state consisting of two or more entities that have their own legal system and other institutions, but it is subject to a federal constitution, which is the decisive factor in solving the problems of the two parties or conflicting parties, and it also has constitutionally and legally one head of state, one army, one flag, one currency and one diplomatic representation, and this is what we do not see in the relationship between Baghdad and Erbil.

The struggle for privileges between the two parties does not give them the right to manipulate the fate of the country, and the KRG and the central government have done nothing for the poor Kurdish citizen who, like Arabs, Turkmen, Yazidis and Chaldo-Assyrians, suffer from unemployment, poverty and destitution. Iraq's ruling elites bear historical responsibility for this decadence in our country, and they are completely unqualified for such responsibility.

Shafaq News / The Kurdistan Region seeks to resolve the outstanding contentious issues with Baghdad, and while politicians confirm the existence of seriousness in the government of Mohammed Shia Sudanese to settle them, especially with regard to the laws of the budget and oil and gas, observers believe that resolving the problems accumulated for 15 years is not by sending negotiating delegations for a few days, amid the likelihood of postponing them to a later stage.

On Sunday (November 27), the President of the Kurdistan Region, Nechirvan Barzani, paid a visit to Baghdad for the purpose of completing the agenda of meetings and meetings last week with Iraqi political leaders - which he cut off due to the explosion incident in the city of Dohuk - on the budget, Peshmerga salaries, Article 140, oil and gas issues, and others.

Last Chance Government

Observers believe that the visit of the delegation of the Kurdistan Region to Baghdad comes to discuss what was agreed upon with the coordination framework during the negotiations to form the ministerial cabinet, in what political blocs confirm that the Sudanese government is serious about resolving the outstanding files between Baghdad and Erbil.

In this regard, a member of the Patriotic Union of Kurdistan, Ghazi Kakai, said that "the government of Mohammed Shia al-Sudani is different from its predecessors, as it is considered the government of (last chance) or (golden opportunity), as it was formed after differences that lasted a whole year, and resulted in entering with the rest of the partners in the political process in the alliance (State Administration) and including the settlement of contentious files between Erbil and Baghdad in its government program."

Kakai added, to Shafaq News, "Therefore, all political parties must be serious about adhering to what has been agreed, especially in the State Administration Coalition, and if the current government can implement its program, then the government will succeed and save the Iraqi political system, otherwise it will be tantamount to firing a bullet of mercy on the Iraqi political system."

"Therefore, this government will be more serious about implementing the demands of the political parties, which are the requirements of the Iraqi street, as well as legislating the oil and gas law," he said.

Sudanese "serious" and talks away from the media

Fadel Jaber, a leader in the Fatah Alliance, agrees with this proposal, who also stressed the seriousness of the Sudanese government to settle the outstanding files between Erbil and Baghdad over the oil and gas laws and the budget, stressing that "the visit of the President of the Kurdistan Region, Nechirvan Barzani, to Baghdad was to solve many outstanding problems between the two parties."

Jaber explained during his interview with Shafaq News Agency, that "the budget law and the proportion of the region of it, is discussed between the two parties continuously and thoroughly, as well as the problem in the export of oil in the region after the decision of the Federal Court of unconstitutionality," noting that "the parties discuss these topics quietly away from political tensions and the media, to reach common points that solve the outstanding problems between the two parties."

The problems of 15 years are not solved by delegations for two days

On the other hand, observers believe that the solution to the outstanding problems between the governments of Erbil and Baghdad is not by sending negotiating delegations for a day or two to the federal capital, as "these problems are the product of 15 years of differences, so if the two parties are serious, especially the Kurds in solving problems, it must strengthen its influence and unite its ranks in Baghdad," according to political analyst, Saman Noah.

Regarding Baghdad's position, Noah told Shafaq News Agency that "the Baghdad government has been procrastinating in resolving these problems for years, as it is trying to buy time, which is in its favor, considering that the region cannot impose its will as it did in previous years, or from 2003 to 2013, where the region was then strong security, political and economic."

He continued, "The decline that occurred in the region is due to the lack of unity of the Kurdish ranks and the low economic and financial situation, which weakened the role and weight of the Kurdistan Region in the Iraqi scene, and Baghdad was looking for such an opportunity in order to continue to disrupt the solid foundations of the partnership demanded by the Kurds, which is the application of Article 140 and the Oil and Gas Law and the formation of the Federal Council, which restores the balance to the Iraqi state."

"There is also disagreement over the Peshmerga's budget and the number of its personnel, as well as Baghdad's demand to deploy federal forces on the Turkish and Iranian borders, which Erbil may reject on the grounds that it will weaken the region's presence in the Iraqi arena," the political analyst continued.

"Most political forces, especially Shiites, are not looking for decisive agreements on these problematic issues at the current stage, but will prefer to postpone them to a later stage, which means keeping Iraq in an unstable situation," Noah concluded.
